I. Contracting Activity.

The Department of the Air Force, Air Combat Command, 99th Contracting Squadron, Nellis Air Force Base, Nevada.

II. Nature and/or description of the action being processed.

The 799th Security Forces Squadron (SFS) located at Creech AFB, Nevada intends to procure Harris radios, to include parts and accessories. The 799 SFS requires 150 XL-200P portable radios, 3 XG-100 base stations and relevant parts and accessories. This Justification and Approval (J&A) authorizes the use of other than full and open competition procedures for the purchase of Harris radios and accessories in order for the 799 SFS to upgrade their existing radio system at Creech AFB.

III. Description of supplies/services required to meet agency needs.

This requirement is for the purchase of Harris radios and accessories. The 799 SFS requires these items to upgrade their radio network. Only Harris radios will meet this requirement as other radios are not compatible with the currently installed Harris Corporation P25 IP CAI (Internet Protocol, Common Air Interface) LMR system at Creech AFB. At this time there is no set standard for the network connectivity and backbone infrastructure. As a result, the network connectivity and backbone infrastructure at Creech AFB are proprietary to Harris Corporation.

IV. Statutory authority permitting Other than Full and Open Competition.

FAR 13.501(a)(1)(ii) Prepare sole source (including brand name) justifications using the format at 6.303-2, modified to reflect that the procedures in FAR subpart 13.5 were used in accordance with 41 U.S.C. 1901.

V. Demonstration that the contractor's unique qualifications or nature of the acquisition requires the use of the authority cited above (applicability of authority).

Currently, the 799 SFS are using Harris equipment and the required radios must be compatible with their existing inventory.

Only the Harris portable radio will be able to function and operate on the current LMR system infrastructure. No other manufacturer's portable radios will be able to operate on the Harris Corporation P25 IP CAI infrastructure network and backbone due to proprietary protocols. This will cause all other manufacturers to have software conflicts and not have authorized licensing requirements.

VI. Description of efforts made to ensure that offers are solicited from as many potential sources as practicable.

Because of the proprietary nature of the products manufactured by Harris Corporation, no other manufacturers are able to meet this requirement at this time. Other companies, such as Motorola, produce similar products, but these products are not compatible with the existing Harris inventory and LMR system of the 799 SFS.

VII. Determination by the Contracting Officer that the anticipated cost to the Government will be fair and reasonable.

It is the Contracting Officer's determination that a fair and reasonable offer will be obtained by comparison of proposed prices with Harris Corporation's Price List IAW FAR 13.106-3(a)(2)(iii) and by comparison with similar items in a related industry IAW FAR 13.106-3(a)(2)(iv).

VIII. Description of the market research conducted and the results, or a statement of the reasons market research was not conducted.

An Internet search of contractor databases such as GSA, and FBO were researched in an effort to find multiple distributors for the requested equipment. Harris radios and accessories can be found on GSA and although items are sold by other vendors, all of the required items are sold only by Harris Corporation. Also, there have been multiple contracts with single source notices for Harris radios posted on FBO within the 99th Contracting Squadron.

IX. Any other facts supporting the use of Other Than Full and Open Competition.

The 799 SFS has selected a Harris brand system based on their current mission requirements and require this system in order to carry out their specific mission needs. At this time, no other brand equipment can meet these requirements.

X. List of sources, if any, that expressed interest in the acquisition.

No other vendor can meet all the requirements needed to support the current radio system in place.

XI. A statement of the actions, if any, the agency may take to remove or overcome any barriers to competition before making subsequent acquisitions for the supplies or services required.

At this point the only equipment that can meet the 799 SFS requirements is Harris and no other brand equipment can meet the current mission requirements at this time.

XII. Certification by the Contracting Officer.

As evidenced by my signature above, I have determined this document to be both accurate and complete to the best of my knowledge and belief.
