Estimated Contract Cost (including Options): $98,500.00
Section B: Description of the Supplies/Services Required
The 9 SOS requires a specific electronic noise-cancelling (ENC) headset manufactured by David Clark for aviation purposes (DC ONE-XM with TP-108 plug). This particular model provides auditory protection from proven long-term hearing damage suffered from constant exposure to running engines and various internal systems. It has also been successfully used with this aircraft's (C 130) intercom system (ICS) with no compatibility issues.
Section C: Justification for Soliciting from a Single Source or Brand Name
Based on previous attempts to match the specifications of this headset by soliciting products with similar characteristics, it is clear that we need to use this exact model to avoid purchasing products that we cannot use. The delays in filling requirements caused by trying to return and get reimbursed for those faulty products has led to a near-critical shortage of headsets in the squadron. This cannot continue if we are to maintain our primary mission of responding to real world crises Any Time, Any Place.
Section D: Efforts to Obtain Competition
Refer to prior contracts, in which we attempted to fill this need with similar headsets manufactured by Acousticom. The headsets were not able to be used with our aircraft ICS and we had to return all received products and cancel the contract.
Section E: Steps to Preclude Future Single Source or Brand Name Awards
In the future, before any order is placed with a single source provider, resource advisors will review all published guidance and memorandums to ensure that the order placed must be done so with a Brand Name or Sole Source provider. In this particular instance, attempts were made to award the contract to a smaller business with comparable product specifications, and the product was deficient. Due to a near critical shortfall in headsets, we're not able to take another chance on getting a headset that the manufacture says is "or equal" and later is proven to be unsatisfactory.
Section F: Contracting Officer's Determination
I have determined, in accordance with FAR 13.106-1(b)(1), that the circumstances of this contract action deem only a single source is reasonably available.
