I. Contracting Activity.

27 Special Operations Contracting Squadron/LGCC, Cannon AFB, NM will be completing this form as a Justification and Approval for Other Than Full and Open Competition for the requirement F1L11N7298AW01.

II. Nature and/or description of the action being processed.

A brand name requirement to purchase of P5 Soft Armor to phase out M97 Armor as directed by HQ AFSOC A3TL. This action will be awarded as a firm fixed price contract.

III. Description of supplies/services required to meet agency needs.

Purchase of P5 Soft Armor:

65 EA PN: E-SBSP-P5-S

169 EA PN: E-SBSP-P5-M

159 EA PN: E-SBSP-P5-L

48 EA PN: E-SBSP-P5-XL

IV. Statutory authority permitting Other than Full and Open Competition.

This procurement will be pursued as a brand name acquisition under Simplified Acquisition Procedures in accordance with 41 U.S.C. 1901(e) as required by FAR 13.501(a)(1).

V. Demonstration that the contractor's unique qualifications or nature of the acquisition requires the use of the authority cited above (applicability of authority).

AFSOC's only approved aircrew body armor is the P5 Soft Armor vests manufactured by Eagle Industries Unlimited Inc.

On 17 March 2017, HQ AFSOC/A3TL released message E-2017-004 stating that all unit must phase out M97 armor by 1 January 2018. The part numbers listed above are essential to the Government's requirements, thereby precluding consideration of a product manufactured by another company.

VI. Description of efforts made to ensure that offers are solicited from as many potential sources as practicable.

Market research was conducted for this brand name requirement and it was discovered that purchase of Eagle Industries Unlimited products is possible through the company directly and the following dealers:

VII. Determination by the Contracting Officer that the anticipated cost to the Government will be fair and reasonable.

This requirement will be competed as a brand name requirement. According to market research, four quotes are expected. Prices will be determined fair and reasonable in accordance with FAR 13.106-3(a)(1) based on competitive quotes.

VIII. Description of the market research conducted and the results, or a statement of the reasons market research was not conducted.

Market research showed that there are 4 distributors for these products which includes the manufacturer. All of which are small businesses. As such, it is recommended that this requirement be solicited as a Small Business Set-Aside. Additionally, the mandatory security & protection category council (SPCC) was contacted to verify if their contract could fulfill this requirement, SPCC stated they cannot fulfill this requirement. One of the 4 vendors identified has the items listed on GSA. FAR 8.004 encourages the use of GSA as a non mandatory source when possible. However, after reviewing the last two purchases of these items it was discovered that the non-GSA vendors had prices lower than those listed on GSA. Soliciting on FBO with a brand name justification is the most advantageous avenue for the government to allow for competition.

IX. Any other facts supporting the use of Other Than Full and Open Competition.

FA4855-17-P-0005 previously had a brand name justification approved on 24 Jan 17. The justification for this requirement was based on an AFSOC/A3TL message that required all aircrew members to wear this specific type of vest. FA4855-16-P-0040 also had a brand name justification approved on 28 Mar 16. The justification for this requirement similarly had a USAFCENT/A3T memorandum requiring use of this vest.

X. List of sources, if any, that expressed interest in the acquisition.

See Section VI above

XI. A statement of the actions, if any, the agency may take to remove or overcome any barriers to competition before making subsequent acquisitions for the supplies or services required.

Future acquisitions will be evaluated before any additional purchases are processed. Any new requirements for P5 Soft Armor or similar items will be evaluated for full and open competition, to include the evaluation of brand name requirements.
