PERFORMANCE WORK STATEMENT FOR

HOODS AND DUCTS CLEANING SERVICES

1. DESCRIPTION OF SERVICES. The contractor shall provide all management, tools, supplies, equipment, and labor necessary to ensure that hoods and ducts cleaning services are performed at Tyndall Air Force Base in a satisfactory manner.

1.1. BASIC SERVICES. The contractor shall clean hoods and ducts systems to include grease filters and exposed surfaces within the area of the hood as indicated in Table 1. in accordance with NFPA Standard 96, AFOSH 91-203 Protection and Prevention, and other local, state, and federal rules and procedures. The contractor shall submit a planned cleaning schedule to the Contracting Officer Representative (COR) for approval no later than 10 calendar days after notice to proceed.

1.2. Perform all work in strict accordance with the highest safety standards and applicable codes in order to eliminate the possibility of damage to installed machinery, equipment and building structures. The Contractor shall coordinate with the 325th Civil Engineer Squadron for approval before proceeding with any access panel installation.

1.3. Notification. The contractor shall notify the Contracting Officer Representative’s Office at (850-283-2909) a minimum of 15 days prior to the date of arrival for services. The contractor shall submit a cleaning report to the COR and obtain a signature on the inspection report to indicate satisfactory cleaning services, in compliance with NFPA 96. If a cleaning is cancelled (and the cancellation is due to government direction or severe weather), it will be rescheduled as soon as possible. If a scheduled monthly cleaning is cancelled by the contractor for reasons other than severe weather, it will re-scheduled only at the discretion of the COR. If a scheduled monthly service is not provided in the month it is scheduled, the cleaning will not be conducted.

2. SERVICES SUMMARY.

3. GOVERNMENT FURNISHED PROPERTY AND SERVICES.

3.1. GENERAL INFORMATION. The government shall provide the facilities, equipment, and services listed.

3.2. GOVERNMENT-FURNISHED PROPERTY. NONE

3.3. GOVERNMENT-FURNISHED SERVICES.

3.3.1. Utilities Conservation. The government will furnish electricity, water and sewage service as necessary for accomplishment of work in accordance with this contract.

3.3.2. Security Police and Medical Services. The government will provide police and fire protection. In the event of a medical emergency, base ambulance service for transporting an injured employee to a local hospital is available on a cost reimbursement basis.

3.3.3. Emergency Medical Treatment. In the event of an emergency during hours of operation, call 911 for response and transport, if necessary, to one of the local hospitals. The contractor shall reimburse the government or Tyndall AFB Medical Treatment Facility for these services.

Contractor personnel are responsible for preparing necessary paperwork. All injuries will be promptly reported to the Base Ground Safety Office at 850-283-4231.

4. GENERAL INFORMATION.

4.1. CONTRACTOR PERSONNEL.

4.1.1. Contract Manager. The contractor shall provide a contract manager (CM) who shall be responsible for the performance of the work. The name of this person and an alternate or alternates, who shall act for the contractor when the manager is absent, shall be designated in writing to the contracting officer (CO) prior to the contract start date. The CM or alternate shall have full authority to act for the contractor on all contractual matters relating to daily operations of this contract. The CM or alternate shall be available during normal duty hours within 2 hours of confirmation of notification, to meet with the COR to discuss problem areas. The CM and alternate(s) must be able to read, write, speak, and understand the English language.

4.1.2. Contractor Employees. Contractor personnel shall present a neat appearance and be easily recognized as contractor employees. This shall be accomplished through the use of a standardized and distinctive article of clothing or accessory, such as a shirt, badge, or hat with the company name on it. The contractor shall provide proof to the COR before starting work under this contract that employees have been properly trained, qualified and certified, in compliance with NFPA 96 Standard, and all federal, state, and local environmental regulation laws, as applicable, to accomplish the services of the Performance Work Statement (PWS).

4.2. GOVERNMENT REMEDIES. The contracting officer shall follow the requirements of FAR 52.212-4, Contract Terms and Conditions for Commercial Items (May 1997), for contractor’s failure to correct nonconforming services.

4.4. SECURITY REQUIREMENTS.

4.4.1. SUITABILITY INVESTIGATIONS. Personnel working anywhere on Tyndall AFB property are required to have a Local Files Check. The Unit Security Manager will coordinate the Background Affidavit (with Pass & ID) and the DD 1172 Base Access Request form – allow 3-5 day process time.

4.4.2. PASS AND IDENTIFICATION ITEMS. The contractor shall ensure the following pass and identification items required for contract performance are obtained for employees and non-government owned vehicles:

a. DBIDS, Defense Biometrics Identification System - Contractor Identification Card. Process a DD Form 1172 to obtain a DBIDS Contractor ID card (If no network access is required). A DBIDS Contractor ID card is required for performance on the installation in a contractor capacity, regardless of alternate base access forms of identification (ex: retired military ID).

b. AF Form 75, Visitor/Vehicle Pass (AFI 31-204): The Service Provider shall adhere to local security policy when applying for short/long term visitors’ passes.

Any contractor requesting a pass for more than 3 days will complete a Local Files Check with 325 SFS/Pass & ID. Vehicle passes (personal vehicles) are no longer required.

4.4.3. RETRIEVING IDENTIFICATION MEDIA. The contractor shall retrieve all identification media from employees who depart for any reason before the contract expires; e.g., terminated for cause, retirement and submit them to the COR.

4.4.4. LISTING OF EMPLOYEES. The contractor shall maintain a current listing of employees. The list shall include employee's name, social security number and level of security clearance or base access (to include if escort privileges are authorized), on company letterhead. The list shall be validated and signed by the company facility security officer (FSO) and provided to the COR (and Unit Security Manager) prior to the contract start date, and to the Contracting Officer (upon request). Updated listings shall be provided when an employee's status or information changes.

4.4.5. ANTI-TERRORISM/FORCE PROTECTION. Contractor personnel, including subcontractors, must comply with and participate in the installation AT/FP Program, specifically including the conduct of Random Antiterrorism Measures (RAM).

4.5. OPERATING INSTRUCTIONS. Adhere to the Air Force activity Operating Instruction (OI) for internal circulation control, protection of resources and to regulate entry into Air Force controlled areas during normal, simulated and actual emergency operations.

4.6. TRAFFIC LAWS. The contractor and its employees shall comply with base traffic regulations, IAW AFMAN 31-116, TAFB Sup1.

4.6.1. Driver’s License. Personnel operating motor vehicles must possess a valid state driver’s license, with valid insurance. Contractor-owned vehicles must have a sticker stating the company name and be in clean/working condition.

4.7. HOURS OF OPERATION. Monday through Friday; normal operating days, excluding federal holidays.

4.7.1. Cleaning schedule will be established by the contractor and approved by the COR.

4.7.2. There will be mission situations that require the contractor to work other than normal hours. Some of these situations include but are not limited to: military exercises, contingency operations, weather emergencies or special events.

4.7.3. Service will not be performed that would require the establishment to close during normal hours. If the contractor’s access to a work area conflicts with an Air Force mission requirement, the contractor shall schedule the work to minimize any disruption.

4.7.4. Such scheduling may require work to be accomplished at times other than normal duty hours and must be approved by the COR.

4.8. FEDERAL HOLIDAYS.

New Year's Day, January 1 or the Friday preceding or Monday following Martin Luther King's Birthday, 3rd Monday in January President's Day, 3rd Monday in February Memorial Day, last Monday in May Independence Day, July 4 or the Friday preceding or Monday following Labor Day, first Monday in September Columbus Day, 2nd Monday in October Veterans Day, November 11 or the Friday preceding or Monday following Thanksgiving Day, 4th Thursday in November Christmas Day, December 25 or the Friday preceding or Monday following

4.8.1. HOLIDAY OBSERVANCE. If these holidays fall on Saturday, the preceding Friday shall be observed. If these holidays fall on Sunday, the following Monday shall be observed. If a holiday falls on a scheduled service day, the contractor shall be responsible for rescheduling services for the first day post the holiday observance.

4.9. DOWN DAYS. These are days designated by MAJCOM or 325 FW/CC as non-working days. The government reserves the right not to allow all non-essential tasks to be performed on these days. The estimated number of down days is eight per year. The contractor shall not charge any cost for down days unless approved by the COR.

4.10. CONTRACTOR TRAINING. The government may request the contractor to attend conferences, symposiums, and training course/sessions to provide interface and attain knowledge necessary for the performance of PWS requirements. All in-residence training courses must be approved by the contracting officer or COR in writing prior to the contractor making a commitment to attend the course.

a. Anti-Terrorism Training. The AF will provide appropriate Level 1 anti-terrorism training to contractor employees as required for mission requirements. This training shall be requested through the contracting officer or COR. (ADLS if CAC, ATO provided if no CAC access)

b. OPSEC Training. The AF will provide OPSEC specific training or training materials within 90 days of initial assignment to the contract.

c. Ancillary Training (Total Force Awareness Training). The contractor shall take all ancillary training courses that the government requires for all military and Civil Service employees (such as Environmental Safety Training) and any specific course pertaining to a task, as required by AFI 33-200, Information Assurance Management, unit or Wing/IA office. All courses must be taken, and passed by all on-site contractor personnel.

d. New or Updated Technology Training. Training in support of new or updated technology for the mission requirements will be provided once by the AF for the initial cadre of contract employees working at the time of the upgrade or receipt of new equipment/ technology. The method, amount, and need for training will be defined by the AF. The contractor shall be responsible for training any subsequent employees.

e. All employees are required to take EMS Awareness. The training can be taken at www.esohtn.com.

4.11. PUBLICATIONS. Can be accessed on-line at http://www.e-publishing.af.mil/.

Supplements or amendments to listed publication from any organizational level may be issued during the life of the contract. The contractor shall immediately implement those changes in publications, which result in a decrease, or no change in the contract price. Prior to implementing any such revision, supplement, or amendment that will result in an increase in contract price, the contractor shall submit to the CO a price proposal and obtain prior approval.

Price proposals shall be submitted within 15 calendar days from the date the contractor receives notice of the revision, supplement, or amendment giving rise to the increase in cost of performance. Changes in the contract price due to supplements and amendments shall be considered under the FAR 52.212-4, Contract Terms and Conditions - Commercial Items clause.

Failure of the contractor to submit a price proposal within 15 calendar days from the date of receipt of any change, shall entitle the government to performance in accordance with such change, at no increase in contract price.

4.12. RESUMES/QUALIFIED STAFFING. The contractor shall obtain resumes and/or certifications showing that contractor personnel are qualified for the tasks they are performing. Within 15 days of contract award or replacement of personnel during the life of the contract. Qualification must be provided to the contracting officer NLT 30 days prior to contract start date. The contracting officer, upon recommendation by the COR will determine whether personnel meet the task qualifications. If the contracting officer, upon recommendation by the COR determines that the person does not meet the task qualifications, the contractor shall replace the personnel within 30 days of contract effective date.

4.13. STAFFING LEVELS. The contractor shall fill a position within 30 work days of a position becoming vacant or the contractor becoming aware of an impending vacancy (whichever occurs earlier).

4.14. NDAA LABOR DATA REPORTING

4.14.1. The contractor shall report ALL contractor labor hours (including subcontractor labor hours) required for performance of services provided under this contract for the Hoods and Ducts Cleaning Services contract via a secure data collection site.

4.14.2. Location of Site. The contractor is required to completely fill in all required data fields at http://www.ecmra.mil.

4.14.3. Reporting Period. Reporting inputs will be for the labor executed during the period of performance for each Government fiscal year (FY). While inputs may be reported any time during the FY, all data shall be reported no later than 31 October of each calendar year. Contractors may direct questions to the CMRA help desk.

4.14.4. Uses and Safeguarding of Information: Information from the secure web site is considered to be proprietary in nature when the contract number and contractor identity are associated with the direct labor hours and direct labor dollars. At no time will any data be released to the public with the contractor name and contract number associated with the data.

4.14.5. User Manuals: Data for Air Force service requirements must be input at the Air Force CMRA link. However, user manuals for government personnel and contractors are available at the Army CMRA link at http://www.ecmra.mil.

4.15. QUALITY CONTROL. The contractor shall develop and maintain a quality control program to ensure services are performed in accordance with established required services addressed in the SS. The contractor shall develop and implement procedures to identify, prevent, and ensure non-recurrence of defective services. The Contractor shall submit a Quality Control Plan to the CO for acceptance 30 days after contract start date.

4.16. QUALITY ASSURANCE. The government will evaluate the contractor’s performance to ensure services meet contract requirements When a performance threshold has not been met or contractor performance has not been accomplished, Contracting Officer’s Representative (COR) will initiate and provide the Contracting Officer (CO) a corrective action report (CAR) for issuance to the contractor. The contractor shall respond to the CAR IAW instructions provided and return it to the CO within 10 calendar days of receipt.

4.17. MULTI-FUNCTIONAL TEAM MEETINGS. The Program Manager and the Contractor may be required to meet with the CO, contract administrator, COR, and other http://www.ecmra.mil/ http://www.ecmra.mil/ government personnel as deemed necessary. The Contractor may request a meeting with the CO when the Contractor believes such a meeting is necessary. If the CO or contract administrator deems necessary, written minutes of any such meetings shall be recorded in the contract file and signed by the project manager and the CO or contract administrator. If the Contractor does not concur with any portion of the minutes, such nonoccurrence shall be provided in writing to the CO within ten (10) calendar days following receipt of the minutes.

4.17.1. PRE-PERFORMANCE CONFERENCE. Offerors/bidders are hereby advised that if they are awarded a contract as a result of this solicitation, they shall be required to appear at the pre-performance conference at a date and time to be determined by the Contracting Officer prior to any work on Tyndall AFB, Florida. Contractor shall provide key points of contact.

4.18. OPERATING INSTRUCTIONS. Adhere to the Air Force activity Operating Instruction (OI) for internal circulation control, protection of resources and to regulate entry into Air Force controlled areas during normal, simulated and actual emergency operations.

4.19. ENVIRONMENTAL REQUIREMENTS.

4.19.1. Environmental Laws and Regulations Compliance. The contractor shall be knowledgeable of and comply with all applicable federal, state, and local laws and permits, and DOD, Air Force, Air Combat Command (ACC), and Tyndall AFB environmental regulations, policies, and guidance. The contractor shall establish policies and procedures to protect the health and safety of personnel using, living, or working on properties under the jurisdiction of Tyndall AFB and minimize or eliminate risks of environmental pollution. Contractor operations are subject to environmental compliance inspections without notice.

4.19.2. Hazardous Waste/Material Management. Any hazardous wastes generated under this contract shall be transported to and disposed of at an EPA permitted facility for hazardous waste in accordance with 40 CFR Parts 260-265. Copies of all manifests shall be provided by the contractor for approval before removing any hazardous waste from Tyndall AFB, and copies of final disposal certificates shall be provided by the contractor to Tyndall AFB Environmental Flight personnel. Personnel shall have proof of the 40 hour Hazardous Waste Operations and Emergency Response (HAZWOPER) training as required by 29 CFR 1910.120, and comply with all other federal, state, and local laws governing hazardous waste determination, treatment and disposal, as determined applicable to the contract. All chemicals used on the installation must be tracked by the Hazardous Materials Management Office. Contractor must submit a TAFB Form 81 & 82 prior to starting work and a TAFB Form 83 at work completion.

Publications and forms applicable to this PWS are listed below. Changes (including, revisions, supplements and amendments) to listed publications from any organizational level may be issued during the life of the contract. The contractor shall immediately implement those changes in publications that result in a decrease or no change in the contract price. Prior to implementing any such change that will affect contract price, the contractor shall submit to the CO a price proposal and obtain the prior approval of the CO. Said price proposal shall be submitted within 30 calendar days from the date the contractor receives notice of the revision, supplement or amendment giving rise to the increase in cost of performance. Failure of the contractor to submit a price proposal within thirty (30) calendar days from the date of receipt of any change shall entitle the government to performance in accordance with such change at no increase in contract price.
