Single Source Justification (Simplified Acquisition)

Section A: General Contract Information

Section B: Description of the Supplies/Services Required

Acquisition of one Cummins diesel generator rated at 60kW, 120/208 VAC, 3 phase, 4 wire, 60 HZ, w/subbase fuel tank and outdoor enclosure and integrally associated Automatic Bypass Transfer Switch with NEMA 3R Cabinet Rating, 120/208 VAC, 4 pole, 225amp rating, 60 HZ, Digital Display w/ battery charger.

Section C: Justification for Soliciting from a Single Source

The statute granting authority to use other than full competition is 10 USC 2304(c), as implemented by FAR 6.302-1 (FAR 6.303-2 and 6.304). CEMIRT technicians are trained extensively on operation and maintenance of Cummins generators and automatic transfer switch line ups. Over $40,000 has been invested in 4 training classes for 12 technicians in just the past two years alone. We have also invested $16,000 in Cummins Power Command trainers to enable additional "in-house" training for new personnel. Additionally, we currently have 75 bench stock items on hand for Cummins generators/transfer switches valued at over $100,000. The Cummins generator and its associated transfer switch would be direct fits for the ones being replaced thus eliminating the need for expensive and timely on-site modifications. CEMIRT cannot duplicate the training, software requirements and spare parts inventory for multiple generator/transfer switch brands due to the obvious budget constraints being experienced.

Section D: Efforts to Obtain Competition

Our market research indicated that there are many small companies who can acquire and sell Cummins generators and transfer switches. Although a GSA contract does exist with Cummins Power Generation, they are considered large business. Their product can be provided by a multitude of small businesses opening up contract opportunities for many. Tyndall Contracting previously purchased a Cummins generator for us through a small business.

Section E: Steps to Preclude Future Single Source Awards

Additional offers were not solicited due to the heavy investment CEMIRT has made to acquire Cummins generators. This investment was based on our 30-plus years of operating and maintaining generators manufactured by several different vendors. Our experience has proven that Cummins provides the best value, reliability and ease of maintenance than the other major generator/transfer switch manufacturers. CEMIRT will always look at the current market for potential new vendors if their cost, reliability and ease of maintenance was up to the standards of Cummins.

Section F: Contracting Officer's Determination

I have determined, in accordance with FAR 13.106-1(b)(1), that the circumstances of this contract action deem only a single source is reasonably available.
