Section A: General Contract Information

Section B: Description of the Supplies/Services Required

A new firm fixed price purchase/delivery order will be issued for the purchase of an intelePharmacy system to include installation and training. A Level 3 Annual Extended 3 Year Warranty with bag and hanger replacements will be included in the purchase of this system.

Section C: Justification for Soliciting from a Single Source or Brand Name

PickPoint is the single source provider and only company permitted to sell the patented intelePharamacy WCS and RDS products. The software that runs this product is custom patented and proprietary. This system manufactured by PickPoint has Authorization to Operate certification from the Defense Health Agency (DHA). This is the only system that is authorized for use on military Networks that uses the hanging-bag style set-up (the only type of type of set-up that fits our pharmacy layout) that directly links the patient identification information (ie. ID card/DoD ID) to its specified bagged prescription(s) by lighting up when the patient's ID is scanned or DoD ID typed into the system regardless of where the bag is located on the hanging shelves. There are no other known sources. A Sole Source Statement was provided by PickPoint verifying their patented and proprietary for this equipment.

Section D: Efforts to Obtain Competition

Per section C, there is no effort possible to identify a source other than PickPoint to procure the identified items due to proprietary rights owned by PickPoint. However, the Government will continue to search for additional sources who are capable of meeting this requirement.

Section E: Steps to Preclude Future Single Source or Brand Name Awards

If, at some point in the future, 20 MDG requires the system identified and proprietary rights are dissolved, the Government will exercise its right to research and procure the equipment from the most cost effective source. If proprietary rights are not dissolved, the Government will be forced to seek procurement from the sole legal source possible.

Section F: Contracting Officer's Determination

I have determined, in accordance with FAR 13.106-1(b)(1), that the circumstances of this contract action deem only a single source is reasonably available.
