1. SCOPE OF WORK

The Contractor shall provide all labor, materials, and equipment to fell all timber within approximately 23.03 forested acres of installation land. Work shall be in accordance with contract specifications, drawings, and technical requirements as set forth below. The

Contractor shall conduct all work without interruption to the military mission and ensure that egress roads remain free and clear of debris associated with the logging activity during the duration of construction.

2. DESCRIPTION OF SERVICES

2.1. General

2.1.1. The Contractor shall commercially fell approximately twenty three and three hundredths (23.03) acres of forest as specified in Appendix A, Site Clearing at

JBLE-E military installation, Newport News, Virginia. The contractor shall fell the timber by way of commercially cutting the trees in the designated areas. Work shall meet all Federal, State and local laws, Codes and Statues.

2.1.2. The Contractor shall fell the timber in accordance with accepted good forestry practices as outlined by the Virginia State Department of Forestry Best Management

Practices. The Contractor shall be certified by the Virginia SHARP logger certification program. A copy of the certification shall be included with the proposal.

2.1.3. Site clearing activities include felling all trees in the designated areas. The

Contractor shall leave stumps of felled trees no higher than twelve inches (12”) above ground, except when rare obstacles; stones, metal, or roots will make the cutting of the stump to the required twelve inch (12”) height impracticable. The

Site Clearing Work shall be performed under a fixed price contract that shall include: pre-mobilization including submittals and training; mobilization;

installation and maintenance of storm water management, erosion and sediment control devices (ECDs); duct control; and other specific work activities in conformance with Contract requirements to perform the work.

2.2. Logging Operations

2.2.1. Logging operations shall be confined entirely to the Site Clearing Areas and approved access roads. Logging equipment will not be allowed outside the cutting area without prior approval from the Contracting Officer Representative (COR) in coordination with 733 Civil Engineer Division (CED). Trees outside of the work area shall not be damaged. Only existing rights of ways, trails, roads, and firebreaks within and leading to the Site Clearing Areas shall be utilized to minimize construction of new skidding trails unless otherwise authorized by the COR. All logging debris shall be kept within the Site Clearing Area boundaries, outside of wetland areas, and out of roads and streams at all times. The Contractor shall maintain slash disposal zones at least fifty feet (50’) from the reline along public roads, and twenty feet (20’) from established military reservation roads.

2.2.2. Any and all landings/decks and skid trails must remain within the Site Clearing

Area boundaries unless approved by the COR. Log landings/decks will be located as designated by the COR within the forested areas and not in open field areas currently used for training. Any log decks constructed with heavy equipment will be repaired by the Contractor and approved by the COR a minimum of seven 7 calendar days prior to contract expiration.

2.2.3. Sawmills will not be permitted in the Site Cutting Areas or at JBLE-E. Whole tree chipping is permitted and all chips must be removed from the site. Marketable timber may be removed from the Site Clearing Area at the Contractor’s discretion.

2.2.4. All grounds adjacent to the work area shall be maintained in a clean and sanitary condition. Trash shall be disposed of in a manner satisfactory to the COR. All operations shall be conducted so as to not pollute any watercourse.

2.2.5. All operations shall be conducted in a manner to minimize damage to streams, marshes, ditches, drainage structures, terraces, and stream sides. Streams and drain ditches shall be kept clear of logs, chunks, and debris resulting from operations under this task order.

2.2.6. The Contractor shall exercise all reasonable precautions to prevent excessive soil damage that may cause serious erosion, compaction or rutting problems.

Excessively wet soil is subject to serious damage from equipment operations.

2.2.7. The Contractor shall comply with all US Government and State of Virginia forest fire fighting laws and shall be held liable for damages resulting from his operations.

In the event of a fire the Contractor shall immediately contact 911 first and then notify the JBLE-E representative at (757) 878-4660. The Contractor shall maintain adequate forest fire fighting extinguishing materials and equipment at all times during operations carried out under this contract. No heating equipment, warming fires, or burning shall be undertaken on the property and encompassing harvest area unless prior approval is received from the COR. Burning of trash or maintenance byproducts (oily rags, etc.) is prohibited.

2.3. Environmental Protection

2.3.1. All trees are to be cut and removed from any wetlands within the Site Clearing

Area. All debris is to be placed outside the streamside management boundary or streamside management area.

2.3.2. The Contractor will adhere to all Federal, State, and local laws, regulations and permits pursuant to this project including, but not limited to, the MDE storm water management and sediment and erosion control.

2.3.3. All skid trails, logging decks/landings and haul roads used by the Contractor shall be repaired to pre-cutting condition prior to contract expiration. Repairs shall include, but are not limited to smoothing ruts, spreading out and piles of soil over the area it was removed from, installing temporary erosion control measures such as water diversion bars. Unless otherwise directed by the COR the Contractor is responsible for seeding, mulching, liming, and fertilizing all haul roads, skid trails and log landings. Any associated bonds may not be released until all site repair work is complete.

2.3.4. Any rutting in excess of six inches (6”) shall be repaired at the Contractor’s expense as soon as the weather and ground conditions permit.

2.3.5. The contractor is responsible for all trees felled within the site clearing boundary, damage to trees or vegetation in adjacent areas or property is prohibited. Residual stand damage to neighboring stands within the Site Clearing Area shall be kept to a minimum.

2.3.6. Felling operations are prohibited within fifty feet (50’) of any house sites or other cultural/historical sites. If found at any time during the felling process, all operations will cease until the appropriate evaluation and documentation of the site are collected. Relic hunting or the use of metal detectors for this purpose is strictly prohibited. Any cultural resources adjacent to the Site Clearing Areas and all vernal pools shall be protected from damage.

2.3.7. The sites in this region may be included at any time as part of a Quarantine limiting the transport of forest products to limit the spread of invasive insects which degrade stands of timber. All forest products harvested from these sites are subject to the applicable Orders of Quarantine as they become effective. Also, Threatened and Endangered species can be discovered at any time and impact various human activity on federal land.

2.3.8. The Contractor or his/her employees, agents, or subcontractors shall at all times keep the contract area free from waste materials and litter such as lunch refuse, oil cans, barrels, or other debris. Storage of hazardous materials shall be done in a manner to prevent accidental release into the environment. The Contractor shall not generate any hazardous waste within the site clearing area including but not limited to draining oil onto the ground from any mechanical equipment associated with the tree clearing. If necessary the Contractor shall drain oil into containers intended for this purpose and remove the waste from the site. If a spill of any petroleum product or other hazardous material occurs, the Contractor shall first notify 911 and then

JBLE-E representative at (757) 878-7362/7364. The Contractor shall maintain a spill kit intended for emergency capture/containment of such spill be responsible for all cost incurred in cleanup of such a spill. Procedures for spill cleanup shall be in accordance with State and Federal laws as well as the JBLE-E Spill Prevention, Control, and Counter Measure Plan in place to prevent and respond to any spills of oils, fuels, or other materials.

2.3.9. All logging equipment/vehicles used by the Contractor must be kept at the Site

Clearing Area unless prior approval is obtained from the COR. Trucks used for hauling forest products shall comply with Federal DOT safety requirements and

Virginia State DOT weight restrictions while on federal roads.

2.3.10. All vehicles and equipment entering federal property or any area associated with the Site Clearing Area shall be clean and free from material that could harbor potential invasive/exotic species in the form of soil, seeds, and plants which could inadvertently be transported from any job site to the Site Clearing Area be it logging or any other site work where exposure to such conditions occur.

2.3.11. There is a possibility of uncovering and/or finding unexploded ordnances (UXOs) on this property. The Contractor and/or his/her employees, agents, or subcontractors must be familiar with the process of recognizing and reporting such UXOs or any other unknown object, and if found, must stop all work immediately, contact the

JBLE-E Representative at (757) 878-1008, and follow the guidance received. Work shall not commence until cleared by the JBLE-E Representative instructing a brief on UXO identification and reporting.

2.4. Deliverables

The Contractor shall submit all deliverables in electronic form and shall produce reports using the Microsoft Office suite of applications. All deliverables must meet professional standards and the requirements set forth in contractual documentation. The Contractor shall be responsible for delivering all end items specified.

3. GENERAL INFORMATION

3.1. Hours of Operation.

3.1.1. The hours of operation are 0700 to 1600 Eastern Standard Time (EST), Monday –

Friday, excluding federal holidays. If the Contractor wishes to perform any services outside of the normal hours of operation, the Contractor shall coordinate with the

COR no later than one week prior to the scheduled event. In the event of emergency circumstances, accommodations may be made on a case by case basis.

3.1.2. Base Closure Days: If the Base Commander determines the base is closed due to snow, hurricane, or Acts or God, the Contractor shall reschedule work planned for this time.

3.1.3. Federal Holidays: The Contractor shall not be required to work any of the following federal holidays:

New Year’s Day - 1 January

Martin Luther King Day -3rd Monday in January

Presidents Day – 3rd Monday in February

Memorial Day – last Monday in May

Independence Day – 4 July

Labor Day – 1st Monday in September

Columbus Day – 2nd Monday in October

Veteran’s day – 11 November

Thanksgiving Day – 4th Thursday in November

Christmas Day – 25 December

3.1.4. If a holiday falls on a Saturday, the preceding Friday shall be observed. If a holiday falls on Sunday, the following Monday shall be observed. If a holiday falls on a scheduled service day, the contractor shall be responsible for rescheduling service for the first day past the holiday observance.

3.2. Non Mission Essential Functions

It has been determined by the Functional Commander of this service that the requirements under this PWS are not essential and therefore shall not be performed during a crisis, exercise, or inclement weather.

3.3. English Language Requirement

All contractor personnel shall read, understand, speak, and write English fluently.

3.4. Contract Manager

The Contractor shall provide a contract manager and an alternate who shall be responsible for the performance of the work; these duties can be an additional duty.

These individuals shall have full authority to act for the contractor on all contract matters relating to the daily operation of this contract and shall be designated, in writing, to the

Contracting Officer (CO). The alternate contract manager shall act for the contract manager when the manager is absent.

3.4.1. The contract manager or alternate shall be available within two (2) hours to meet on the installation or by telecom with the CO and/or with other government personnel designated by the CO during normal duty hours to discuss issues or concerns.

3.5. Communication

Contractor personnel shall maintain open and professional communication with government personnel at all times. Complaints validated by the COR shall be reported in writing to the CO and the Contractor for action. Failure of the Contractor to take corrective action on validated complaints raised by the COR and the CO will be considered a failure to perform.

3.6. Appearance

Contractor personnel shall present a professional, conservative, and neat appearance.

Contractor personnel shall report for duty in a professional manner, in appropriate attire, and having complied with socially acceptable standards of personal hygiene.

3.7. Identification Badge

Contractor personnel shall display a contractor badge at all times and in plain view.

Badge shall include company name, contractor personnel’s name and recent color photograph. An identification badge is not required if personnel are dressed in a uniform identifying them as contract employees; this uniform shall prominently display the contractor’s company name and/or logo.

3.8. Conflict of Interest

The contractor shall not employ any person who is an employee of the United States

Government if the employment of that person would create a conflict of interest. The contractor shall note employ any person who is an employee of the Department of the

Air Force, either military or civilian, unless such a person seeks and receives approval in accordance with the Department of Defense (DOD) Directive 5500.7 and Air Force policy. If prior military, personnel must have been discharged under honorable conditions with no administrative actions taken against them.

3.9. Security Requirements for Unclassified Contracts

The contractor shall ensure the necessary pass and identification items required for contract performance are obtained for all personnel.

3.9.1. Listing of Personnel: The contractor shall maintain a current listing of personnel.

The list shall include the employee’s name, social security number and level of security clearance. The list shall be validated and signed by the company’s Facility

Security Officer (FSO) and provided to the sponsoring agency’s security manager, the COR, and the CO. An updated listing shall be provided when an employee’s status or information changes.

3.9.2. Pass and Identification: Temporary Base Access Passes. The contractor shall ensure that each employee obtains the following pass and identification items: all necessary cards, passes, buttons, decals, or other items required for access to the areas and the installation. Upon contract award and the replacement of any employees, the contractor will be required to complete a base access request form which will be submitted to the COR. The COR will submit the pass request to the

733d Security Forces Squadron (733 SFS) to obtain the necessary identification items. Upon approval of the pass request by 733 SFS, the contractor employee will be required to obtain any individual and vehicle identifications media at the 733

SFS Pass and Identification Section, Building 648 Washington Boulevard on Fort

Eustis, VA.

3.9.3. National Agency Check with Inquiries (NACI): As a minimum, contractor personnel shall successfully complete a NAC before beginning work on this contract. Requests for personnel hired at the beginning of the contract shall be submitted to the government not later than 30 working days from the contract start date. Upon contract award, initial employee NACI requests shall be submitted not later than 15 days prior to the beginning of the base period of performance.

Requests for personnel hired subsequent to the contract start date shall be submitted to the government not later than five workdays from the contractor personnel’s first duty day. Contractor personnel receiving unfavorable NACs shall not be employed.

The government will submit requests for investigations on AF Form 2583, Request for Personnel Security Action, at no additional cost to the contractor. The contractor shall comply with the requirements of DoD 5200.2-R, Personnel Security Program, and AFI 33-119, Electronic Mail (E-Mail) Management and Use.

3.9.4. Physical Security (Security of Government Property): The contractor shall safeguard all government property, including controlled forms provided for contractor use. At the close of each work period, government equipment, facilities, and squadron assets and materials shall be secured.

3.9.5. Entry Procedures to Controlled/Restricted Areas: The Contractor shall implement local base procedures for entry to Air Force (AF) and Army controlled/restricted areas where contractor personnel work.

3.9.6. Reporting Requirements: The Contractor shall comply with the requirements of

Volume1, AFI 71-701, Criminal Investigations, and paragraph 1.1 of Volume 2, Protective Service Matters. Contractor personnel shall report to an appropriate authority any information or circumstances of which they are aware that may pose a threat to the security of DoD personnel, contractor personnel, resources, and classified or unclassified defense information. The contractor personnel’s immediate supervisor shall brief him/her upon initial on base assignment and as required thereafter.

3.9.7. Retrieving Identification Media: The Contractor shall return all identification media to the sponsoring agency’s security office, the COR or the CO upon completion of the contract or upon departure of any personnel during the course of the contract. Failure to do so may delay payment to the contractor. Final payment may be withheld until identification media is returned.

3.10. Traffic Laws

The Contractor and personnel shall comply with the installation traffic code as specified in Virginia State Lay and Air Force Instruction (AFI) 31-218, Motor Vehicle

Traffic Supervision (current edition). The Contractor and/or contractor personnel shall comply with current instruction on cell phone use while on any military installation.

3.11. Weapons, Firearms, and Ammunition

Contractor personnel are prohibited from possessing weapons, firearms, or ammunition, on themselves or within their contractor owned or privately owned vehicle while on any military installation. This prohibition includes any individual who may otherwise possess any legally issued concealed weapons permit.

3.12. Environmental Management

JBLE is dedicated to the conservation, protection, and enhancement of the environment. The contractor shall comply with all federal laws and regulations, state and local laws, ordinances, regulations, and installation policy and procedures. JBLE

Installation specific policies are below:

3.12.1. Joint Base Langley Eustis- Eustis: The Contractor must comply with JBLE-I 32-

101, Environmental Management with related Environmental Management

Procedures (EMPs). EMPs are reviewed and or updated at least annually. JBLE-I

32-101 and EMPs can be reviewed and downloaded at:

4. SERVICES SUMMARY (SS)

The contract service requirements are summarized in performance objectives that relate directly to mission essential items. The performance threshold briefly describes the minimally acceptable levels of service required for each requirement. The SS and the

Contractor’s QCP provide information on contract requirements, the expected level of contractor performance, the expected method of government surveillance and confirmation of services provided. These thresholds are critical to mission success. Procedures as set forth in the Federal Acquisition Regulation (FAR) 52.212-4 (a), Contract Terms and

Conditions – Commercial Items, Inspection/Acceptance, will be used to remedy all deficiencies. The absence of any contract requirements for the SS shall not detract from its enforceability nor limit the rights or remedies of the Government under any other provision of the contract. The Government has the right to inspect all service required in the contract.

4.1. Performance Evaluation

The purpose of the SS is to define performance evaluation and payment procedures. The

Performance Objective (column 2) describes what the government will survey.

Performance of a service will be evaluated to determine whether or not it meets the

Performance Threshold (PT) of the contract. When the PT is exceeded, the COR will document the performance issue in a Corrective Action Report (CAR) or a Performance

Assessment Report (PAR) and provide it the Contracting Officer to finalize an issue the report to the contractor.

4.1.1. The Government will periodically evaluate the contractor’s performance by appointing a representative(s) to monitor performance to ensure services are received. The government representative will evaluate the contractor’s performance through inspections of reports and contractor services documentation. The

Government may inspect each task as completed or increase the number of quality assurance inspections if deemed appropriate because of repeated failures or because of repeated customer complaints. Likewise, the Government may decrease the number of quality assurance inspections if performance dictates.

4.1.2. If any of the services do not conform to contract requirements, the Government may require the contractor to perform the services again in conformity with contract requirements at no increase in contract amount. When the defects in services cannot be corrected by re- performance, the Government may:

4.1.3. Failing to meet the performance threshold as outlined in the SS for any of these performance objectives in any one month period may result in an immediate

Progress Meeting with the Multi-Functional Team (MFT). All remedies shall be in accordance with the FAR 52.212-4 (a), Contract Terms and Conditions -

Commercial Items, Inspection/Acceptance.

4.2. Quality Control

The contractor shall develop and maintain a quality control program to ensure tree felling services are performed in accordance with this contract and PWS. The contractor shall develop and implement procedures to identify and prevent non-performance and continual repeat of defective service. A written Quality Control Plan (QCP) shall be submitted to the CO and COR for review and feedback. Government feedback will be provided within 14 calendar days of verified receipt. The plan shall specifically address the contractor’s strategy to provide quality workmanship, continual process improvement and for correcting deficiencies as required.

4.3. Quality Assurance

The Government shall inspect and evaluate the contractor’s performance to ensure services are received in accordance with requirements set forth in this contract. The

COR shall inspect by watching actual task performance, physically checking an attribute of the completed task, checking management information reports, investigating customer complaints, conferring with facility managers, or otherwise inspecting the task or its results to determine whether or not performance meets the standards contained in this

PWS. The COR will record surveillance results. Results of the surveillance then become the official Air Force record of the contractor’s performance.

4.4. Surveillance Methods

4.4.1. 100% Surveillance: This method requires the COR to inspect the service each time it occurs. Results shall be annotated on the inspection checklist. Any deficiency shall be documented and the contractor shall re-perform service as directed by the COR. Any unsatisfactory inspection identified but re-performed acceptably, shall still be counted as an unsatisfactory inspection for trending purposes.

4.4.2. Periodic Surveillance: This method requires the COR to employ a spot check style of evaluation based on the contractor’s schedule. Periodic surveillances will be conducted on a scheduled basis (daily, weekly, monthly, quarterly, semi-annual or annually) and may be adjusted, based on quality trends. Any unsatisfactory inspection (defect) result shall be recorded, and the contractor shall re-perform the service after notification by the COR.

4.4.3. Customer Complaint: This method requires the customer to fill out a locally generated form provided by the COR or CO. The COR will verify the complaint and notify the contractor of valid complaints. The Contractor shall acknowledge the complaint within 2 hours and inform the COR of his recommendation. Any deficiency shall be documented and the contractor shall re perform service immediately, if appropriate, or within 24 hours at no increase in contract amount.

The Contractor shall respond to the Customer Complaint in accordance with the instructions provided and return it to the contracting office within five (5) calendar days of receipt. Any unsatisfactory inspection identified but re performed acceptably, shall still be counted as an unsatisfactory inspection.

4.5. Periodic Progress Meetings

The Contracting Officer, Functional Commander, COR, or other government personnel as appropriate, and the contractor shall periodically meet to discuss the contractor’s performance. The following issues shall be discussed: observed positive performance and steps taken by the contractor to prevent unsatisfactory performance, any modifications required of the contract, opportunities to improve performance, unsatisfactory inspections and trends against each performance objective.

4.5.1. The minutes of these meetings will be reduced to writing, signed by the

Contracting Officer and any other signatures as deemed appropriate, and distributed to the functional area and the contractor. Should the contractor not concur with the minutes, the contractor will provide a written notification to the Contracting Officer identifying areas of non-concurrence for resolution within 10 days of receipt.
