Section A: General Contract Information

Section B: Description of the Supplies/Services Required

Maintenance, inspection and repair of the Merlin XS2530 Aircraft Birdstrike Radar System. This includes two (2) site visits per year to provide maintenance and calibration for the system. Maintenance includes system checks, installation of software upgrades, defective or failed component replacement or repair, and performance testing.

Section C: Justification for Soliciting from a Single Source or Brand Name

This is a unique system where the only authorized service provider is the original manufacturer. The hardware and software used within the Merlin System are proprietary and Detect, Inc is the only company with the authorization to work on the Merlin System. Service or upgrades by other companies are not authorized and could damage the system. Furthermore, any unauthorized service, upgrades or repairs to the Merlin System will void its manufacturers warranty.

Section D: Efforts to Obtain Competition

The original manufacturer (Detect, Inc) was contacted to obtain a list of authorized service providers. The manufacturer submitted a letter stating they are the only authorized company to perform warrantied service on the Merlin System. Furthermore a dynamic Internet search and a sources sought notice on FBO was completed. The sources sought only furnished one reply, the original manufacturer Detect, Inc.

Section E: Steps to Preclude Future Single Source or Brand Name Awards

As long as the current Merlin System is installed, there is only one authorized service provider to work on the system while maintaining the manufacturer warranty.

Section F: Contracting Officer's Determination

I have determined, in accordance with FAR 13.106-1(b)(1), that the circumstances of this contract action deem only a single source is reasonably available.
