Justification and Approval (J&A) for Other Than Full and Open Competition
I. Contracting Activity.
Department of the Air Force
509th Contracting Squadron

II. Nature and/or description of the action being processed.
This Justification and Approval (J&A) authorizes the use of other than full and open competition procedures to acquire Jaybird Aquafog Portable Explosion Proof Humidifiers (P/N: XE-HRSM-2000-EXP-CUS). The estimated value of this J&A is $141,615.85. As a result of this J&A, a firm fixed price contract will be awarded to Jaybird Manufacturing, Inc.
III. Description of supplies/services required to meet agency needs.
This requirement is for the purchase of Jaybird Explosion Proof Aquafog Portable Humidifiers (P/N: XE-
HRSM-2000-EXP-CUS) to assist in the coating process of the B-2 Aircraft.
IV. Statutory authority permitting Other than Full and Open Competition.
IAW 10 USC 2304(c)(1) the head of an agency may use procedures other than competitive procedures only when --
The property or services needed by the agency are available from only one responsible source or only from a limited number of responsible sources and no other type of property or services will satisfy the needs of the agency;
IAW FAR 6.303-2(b)(4), the statutory authority permitting other than full is identified below:
6.302-1 -- Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements.
6.302-1(b)(1)(ii) For DoD, NASA, and the Coast Guard, unique supplies or services available from only one or a limited number of sources or from only one or a limited number of suppliers with unique capabilities.
V. Demonstration that the contractor's unique qualifications or nature of the acquisition requires the use of the authority cited above (applicability of authority).
The 509th MXS requires the purchase of 30 Jaybird Aquafog Portable Explosion Proof Humidifiers (P/N:
XE-HRSM-2000-EXP-CUS) to assist in the coating process of the B-2 Aircraft. Various processes with the application of coatings require specific humidity levels to be met. Additionally, T.O.
1B-2A-2-01JG-00-1 requires the units to be explosion proof. The portability of these units allows them to be placed directly next to the aircraft during the coating process. While the Aquafog Portable Humidifiers are available from several sources, this model XE-HRSM-2000-EXP-CUS is customized by the manufacturer, Jaybird, with additional explosion proof features over the basic model. The following are the added parts for the customized Whiteman AFB unit as compared to the XE-HRSM-2000-EXP unit: a-264, a-231 (4 extra), a-
32 (3 extra), a-STO-14/3 (3 extra), a-450, a-451, a-456, a-205, a-331, a-346 and a-107. Additional labor and shipping is also required on the customized unit. These modifications are required to be done by Jaybird as any modification done to the unit not completed by the manufacture will void the warranty.
Justification and Approval (J&A) for Other Than Full and Open Competition
VI. Description of efforts made to ensure that offers are solicited from as many potential sources as practicable.
This requirement was reviewed by the Contracting Officer and the user to ensure that all possibilities for competition were considered early in the acquisition cycle. The contract administrator conducted market research via Internet searches, GSA Advantage searches and review of EZQuery findings. That market research, confirmed that Jaybird Manufacturing, is the only source from which to purchase the Aquafog
Portable Explosion Proof Humidifiers (P/N: XE-HRSM-2000-EXP-CUS).
VII. Determination by the Contracting Officer that the anticipated cost to the Government will be fair and reasonable.
Based on initial market research, the total overall price difference between the base model (XE-
HRSM-2000-EXP) of the humidifier and the customized version (XE-HRSM-200-EXP-CUS) is only 1-3% when compared to other companies published prices. Therefore, the total price of $141,615.85 is considered fair and reasonable.
VIII. Description of the market research conducted and the results, or a statement of the reasons market research was not conducted.
Discussions early in the acquisition process centered on whether or not this requirement could be met by another company other than Jaybird Manufacturing, Inc. An extensive Internet search was conducted and could not produce any other manufacturers or distributors that were able to provide humidifier. Only Jaybird can provide the humidifier modified to P/N: XE-HRSM-2000-EXP-CUS. Jaybird confirmed via e- mail that it does not have any outside distributors that are authorized to alter this humidifier to conform to the explosion proof standards as required by the customer and T.O. 1B-2A-2-01JG-00-1.
IX. Any other facts supporting the use of Other Than Full and Open Competition.
As previously mentioned, market research conducted confirmed that no other companies can provide the requested humidifier. Furthermore, confirmation from the manufacturer validated that they are the only company that can provide the humidifier as specified.
X. List of sources, if any, that expressed interest in the acquisition.
Market research performed indicates no other sources will be able to fulfill this requirement. Jaybird
Manufacturing, Inc., the distributor, confirmed that only they can provide the humidifier as specified.
XI. A statement of the actions, if any, the agency may take to remove or overcome any barriers to competition before making subsequent acquisitions for the supplies or services required.
All requirements are thoroughly reviewed to ensure that competition is not unnecessarily restricted. Jaybird is the only manufacturer of this humidifier that conforms to the technical requirements at this time. Therefore, it will be difficult to remove barriers to competition. However, if they allow distributors in the future, all vendors will be solicited appropriately.
XII. Certification by the Contracting Officer.
As evidenced by my signature above, I have determined this document to be both accurate and complete to the best of my knowledge and belief.
