AMENDMENT 1 - Q&AS

The following are questions by perspective offerors and Government answers:

1. Would the Government kindly consider delaying the required submission date for the proposal due to the requirement to solicit Past Performance Questionnaires. Given there are only 5 work days between the RFP release and due date, combined with federal employee vacation plans makes successfully fulfilling this requirement infeasible. Request the due date be postponed until 6 January to allow Government POCs to return from the holidays and be able to complete the questionnaires.

Answer: The Past Performance Questionnaires (PPQ) were included with the solicitation for reference only.

Solicitation clause 52.212-1 states the following for PPQs “The Government will use a past performance questionnaire to evaluate contractor references. Please note that the government will only attempt to contact past performance references a maximum of three (3) times. If no contact can be made then the past performance for that reference will be rated as Unknown”. The contractor is not required to provide completed PPQs with their proposal.

The Government is extending the due date to 4 Jan 17 as part of this amendment.

2. If a company has consistently demonstrated the ability to recruit and staff SCA Administrative Support contracts such as this one, must the Administrative Support be strictly limited to providing medical support in order to be deemed relevant? This requirement appears to be overly restrictive with the intent of limiting competition— especially since incumbent employees who have the necessary experience must be offered first employment opportunities.

Answer: There is no intent to limit competition. HIPAA presents unique concerns that the Government must address to help ensure patent privacy and confidentiality. Solicitation clause 52.212-1 provides the following definition for relevant contracts “Relevant contracts include medical administration services similar to the requirements of the PWS”. Additionally, solicitation provision 52.212-2 states; under “Basis for Contract Award”, paragraph B: “Relevant performance includes medical support administration services similar to the requirements of the PWS. Relevant contracts include those contracts that showcase the offeror’s ability to provide the services described in the PWS”. The Government is confident that adequate competition will be received with the requirement stated as is.

3. Is it possible for Administrative Support contracts used for Past Performance that do not reflect medical support be evaluated as “Satisfactory Confidence”? If not, can the Government please explain why not?

Answer: No, it is not possible. The performance assessment rating is the overall rating the contractor receives based on all past performance information evaluated. Each reference, provided as part of the contractor’s proposal, does not receive a separate confidence rating. The items that factor into the overall Confidence rating is as follows: The recency and relevancy of the referenced contracts, PPQs, and data independently obtained from other government or commercial sources. A contract is considered “recent” if it was performed in the last three years. The solicitation provides the following definition for relevancy: “Relevant contracts include medical administration services similar to the requirements of the PWS”. Please see the Past Performance Relevancy chart on page 32 of the solicitation for the different relevancy ratings. If an offeror elects to provide a references for other than “medical administration services similar to the requirements of the PWS” it may impact the relevancy rating for that reference. The impact to the relevancy rating may or may not impact the overall Confidence rating depending on other Past Performance information the Government has at their disposal. Medical administration services have unique requirements that other administrative support services do not have. Privacy act information and HIPAA present unique concerns that the Government must address to help ensure patent privacy and confidentiality.

4. Must a company’s past performance specifically be for medical administrative support in order to receive a “Satisfactory Confidence” rating or higher?

Answer: Yes, see question 3.

5. Would the Government please identify the applicable SCA labor category / categories they intend to be used for this proposal that is subject to SCA provisions?

Answer: The Government provided the appropriate SCA Wage Determination (WD) and Statement of equivalent rates for federal hires. The determination of the applicable labor category is the contractor’s responsibility.

6. If the Government will not identify the applicable SCA labor category / categories, would the Government delineate how the PWS requirements are allocated across the 5 personnel in order for the contractor to make an accurate assignment of SCA titles to the personnel?

Answer: No, it is the contractor’s responsibility to identify the applicable SCA labor category.

7. RFP Page 31, Basis for Contract award, B . Past Performance. …”The government reserves the right to seek information on higher priced offerors if none of the lower priced offerors receive a “Satisfactory Confidence” or “Substantial Confidence” performance assessment rating.”

The three Past performance questionnaires have potential ratings of Exceptional (with a numerical rating of 4) , Good (with a numerical rating of 3) , Satisfactory (numerical- 2) and Marginal (numerical-1). How will the government determine “Satisfactory Confidence” or “Substantial confidence” from those ratings? Will the three Past Performance references have to have a total numerical rating of at least 6 to receive a Satisfactory Confidence rating? If that is not how confidence levels will be determined, what is the method that will be used to determine the confidence ratings?

Answer: No numerical rating is required; Government evaluators will follow procedures identified in the solicitation to evaluate offeror past performance.

RFP Page 30, Instructions to Offeror, Past performance. ….”The evaluation of past performance information will take into account past performance information regarding predecessor companies, key personnel who have relevant experience, or subcontractors that will perform major or critical aspects of the requirement when such information is relevant to the current acquisition. However, subcontractor, and predecessor company information may not be considered as highly as past performance information for the principal offeror.

What will determine if the Past Performance of a subcontractor will (or won’t) be considered as highly relevant as that of the prime offeror? How will the relevancy of a subcontractor differ for the government in ranking past performance? Will the numerical scores be different?

Answer: The subcontractors past performance will be subjectively determined based on the level of effort on the subcontractor’s part compared with the overall contract effort.

9. The attached document (Atch 4 - Past performance Questionnaire) SOLICITATION NO: FA4620-17-R-0003 Med Admin 5 does not provide instructions as to where or who the completed document should be emailed or mailed to.

Answer: The questionnaires do not need to be completed, they were only a sample, and the Government just needs the required contact information so that Government evaluators can contact references.

10. Can you please tell me if this is a new requirement? If not, who is the incumbent, and what is the contract number?

Answer: The incumbent contractor for this requirement is: Sterling Medical Associates, INC. The contract number is: FA4620-11-F-A022.

11. Is it possible to share the incumbent employees seniority information so that we can accurately price in the SCA mandate number of weeks leave?

Answer: The following is the incumbent contractor’s employee seniority information: 3 employees at 6 months, 2 employees at 1.5 years, and 1 employee at 2 years.

12. What is the driver behind the requirement for the contractor to provide automobile liability insurance for all automobiles used in connection with performing this effort? I don't see anything in the PWS where contractor provided automobiles will be required. Am I missing something?

Answer: Contractor provided vehicles are optional and may be provided at the contractor’s discretion. FAR Part

28.306 “Insurance Under Fixed-Price Contracts” outlines the minimum insurance requirements to work on a Government installation. This information was provided in conjunction with solicitation clause 52.228-5 “Insurance- -Work on a Government Installation (Jan 1997)”: “(a) The Contractor shall, at its own expense, provide and maintain during the entire performance of this contract, at least the kinds and minimum amounts of insurance required in the Schedule or elsewhere in the contract”.

13. Are proposal sections 1-4 (Price, Provisions, Past Performance, Amendments) all submitted in just one proposal file/document or do offerors submit 4 separate proposal files/documents?

Answer: The offeror can submit the required information in one document or several documents as long as all information required by the solicitation is clearly identified and submitted before the proposal due date/time.

15. Are there incumbents on contract to which the awardee will comply with FAR 52.222-17, Non-displacement of Qualified Workers?

Answer: Yes

16. Can the Government please provide the SCA Wage Determination Occupation code?

Answer: Determination of the SCA WD occupation code is the responsibility of the contractor. See question 5.

17. For the Base Year, for CLIN 0001 the quantity lists 6,720.00 hours for 5 full time employees for the period 02/01/2017-09/30/2017. There are only 167 working days during this period, leaving a total of only 6,680.00 hours that the 5 employees (1336.00 per employee) can work. If you pro-rate vacation, then the employees will on average take 53.33 hours of vacation during this period. So each employee will be able to work a total of 1,282.67 hours (Total of 6,414.00 hours).

a. Did the government intend to have the employees work additional hours in the base year? If so should the contractor add in a part time employee to cover the extra workload since the extra hours will have to be paid at an overtime rate?

Answer: The Government shows a total of 1,344 billable hours for the timeframe of 1 Feb 17 - 30 Sep 17. This is based on 168 working days. 1,344 x 5 = 6,720 total hours billable. This is taking into consideration holiday hours but not vacation hours. Vacation hours will be treated as a scheduled absence under 1.2.3.3 of the PWS. A replacement employee will be required for this time and will be paid a regular hourly rate.

18. For Option Year 1-4, for CLIN X001 the quantity lists 10,000 hours for 5 full time employees. This would mean that each employee would have to work 2,000 hours per year resulting in the employees not being able to take 80 hours for holiday or 80 hours for vacation as outlined by the wage determination sheet for SCA employees.

b. Did the government intend to have the employees work a 2,000 hour year instead of the normal 1,920 hour year? If so should the contractor add in a part time employee to cover the extra workload since the extra hours will have to be paid at an overtime rate?

Answer: The Government intended to have each position work a total of 2,000 hours per year. This is taking into consideration the 80 hours for holidays but not the 80 hours for vacation. The 80 hours for vacation will be treated as a scheduled absence under 1.2.3.3 of the PWS. A replacement employee will be required for this time and will be paid a regular hourly rate.
