JUSTIFICATION FOR OTHER THAN

FULL AND OPEN COMPETITION

I. CONTRACTING ACTIVITY

US Air Force 2d Contracting Squadron 4 1 Vandenberg Ave.

Barksdale AFB, LA 71110-2079

II. NATURE AND/OR DESCRIPTION OF THE ACTION BEING PROCESSED

This acquisition is to obtain, by the use of other than full and open competition, BAE Systems., as the OEM of the AN/USM-464A, is tasked with supplying a contractor as field engineering support for the AN/USM-464A countermeasures Test Sets. This test set completes an end-to end testing of the Electronic Warfare Systems on the B-52H Aircraft at Minot AFB, ND and Barksdale AFB, LA.

III. DESCRIPTION OF THE SUPPLIES/SERVICES REQUIRED TO MEET THE

AGENCY'S NEEDS

a. Overview of Services: The primary purpose of this effo11 is to provide on-site proficiency training, technical gu idance and information in the evaluation of unusual field problems, render technical guidance related specifically to the equipment cited in the contract. and to minimize the time required to test aircraft and increase testing effectiveness resulting in increased aircraft availabil ity and B-52H mission effectiveness.

b. Detailed: The contractor shall provide field maintenance support to AFG SC in support of the AN/USM-464A program at Barksdale AFB, Louisiana and Minot AFB, North Dakota.

• Provide flight line assistance in the annual, and as required testing, of B-52H Electronic Countermeasures Suites utilizing the AN/USM-464A.

• Provide flight line assistance on troubleshooting and repairing discrepancies discovered as a result of AN/USM-474a testing

• Work with Air Force technicians to identify opportunities to improve testing effectiveness to minimize aircraft down time.

• Provide advice and assistance in the submission of Technical Order Improvements and Software Deficiency Reports related to AN/USM-464A aircraft testing associated Test Program Interface Hardware (TPIH) and Test Program Set (TPS).

• Provide training to Air Force technicians and subcontractors on sub assembly, aircraft testing and system knowledge of the AN/USM-464A and associated TPIH and TPS.

• Provide assistance and training in the intermediate level repair, calibration. and preventative maintenance inspections required for the AN/USM-464A Countermeasures Test Set

• Act as a liaison with the AN/USM-464A depot repair facility to report and track status of

Shop Replaceable Units (SRU) required to maintain the AN/USM-464A ' s at a fully mission capable status.

• Provide assistance in the repair and preventative maintenance inspections of the ALR-69, ALQ-155, ALQ-172(V)2, and ALQ-122 TPIH.

• Provide mission capable AN/USM-464A and ALQ- l 72(V)2 TPIH to support BAE

Systems contractors conducting intermediate level repair of ALQ- l 72(V)2 LRUs.

• Provide advice and resolution on difficult and/or unusual problems encountered while utilizing the AN/USM-464A to repair and determine serviceability of ALQ-J 72(V)2

c. Personnel Experience: The contractor shall assign personnel who are knowledgeable and experienced in the following areas of expertise to support this contract. The qualifications of the assigned personnel shall include:

• 0-Level TPS software requirements

• 0-Level TPS hardware requirements

• 0-Level TPIH, RF coupler, cables and adapters

• Understanding of vertical testability issues and capability to conduct vertical testability analysis studies

• 0-Level test philosophy, methods, and implementation

• AN/USM-464A system theory of operation

• AN/USM-464A system technical orders

• AN/ USM-464A stimulus subsystem theory/operation techniques

• AN/USM-464A measurement subsystem theory/operation techniques

d. The estimated cost for this requirement (including 4 potential option periods) is .-., IV. STATUTORY AUTHORITY PERMITTING OTHER THAN FULL AND OPEN

COMPETITION

I 0 U.S.C.2304(c)(I ). as implemented by FAR 6.302- l(a)(2), entitled "Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements."

V. DEMONSTRATION THAT THE CONTRACTOR'S UNIQUE

QUALIFICATIONS OR NATURE OF THE ACQUISITION REQUIRES THE USE OF

THE AUTHORITY CITED ABOVE (APPLICABILITY OF AUTHORITY)

Although several companies have the capability to perform the fo llow-on B-52 AN/USM-464A Field Support contract, no company has the proprietary and classified information required to perform the actions listed in the contract. The contractor has fully-trained and cleared technicians in place. They possess the proprietary and classified information required to support all terms of the contract. The incumbent contractor also has a highly competent and stable program management staff to ensure uninterrupted support for the US military organ izations in at Barksdale AFB, LA and Minot AFB, ND. The award of a contract for this 5-year period to other than the incumbent contractor is imposs ible to accompl ish within the required start date of the new B-52 AN/USM 464A Field Support contract on l July 2014 due to proprietary and classified information.

VI. DESCRIPTION OF EFFORTS MADE TO ENSURE THAT OFFERS ARE

SOLICITED FROM AS MANY POTENTIAL SOURCES AS DEEMED PRACTICABLE .

The follow-on contract, B-52 AN/USM 464A Field Support will be properly synopsized as required by FAR 5.202. Awarding this contract will ensure HQ AFGSC and associated units maintain end-to-end testing of countermeasures systems, radar homing and warning systems and integrated power management systems using TPIH (Test Program Interface Hardware) and application TPS (Test Program Set). Specifically, awarding this sole source contract will guarantee that the company with proprietary information continues to provide service other companies cannot. Market research has verified that the company's information is proprietary and cannot be performed by any other entity.

VII. DETERMINATION BY THE CONTRACTING OFFICER THAT THE

ANTICIPATED COST TO THE GOVERNMENT WILL BE FAIR AND REASONABLE

The Contracting Officer has determined, by the signature on the cover page that the anticipated cost to the Government will be fair and reasonable based upon the fact that the proposal costs received for material and labor are in line with prices on previous contracts.

Furthermore, certified cost or pricing data will be required from the contractor to make a determination of fair and reasonable pricing. The service is non-commercial, non-competitive, above $700,000.00, and prices are not set by law or regulation.

CONDUCTED

The AN/USM-464A test set is required to test all B-52 EWS, many B-52 aircraft will be unable to perform nuclear, conventional, training and test missions if these tests are not accomplished.

IX. ANY OTHER FACTS SUPPORTING THE USE OF OTHER THAN FULL AND

OPEN COMPETITION

A PWS, for Barksdale AFB and Minot AFB, have been written for the B-52 AN/USM-464A Field Support acquisition. The using activity has estimated to replace the test set with the same capability is approximately - The cost and the time it would take to produce a new tester would make this contract exceedingly more expensive to the government than to continue using sole source for the continuing years. In addition to the proposal preparation cost, a new contractor would require a phase-in period of up to four months in order to obtain the necessary work permits, security clearances and the purchase of specialized equipment required by the contract. These costs and added time could not be recovered through competition. This delay would result in many B-52 aircraft being unable to perform nuclear, conventional, training and test missions.

In addition, the award to a source other than the incumbent contractor would result in substantial duplication of cost to the Government that is not expected to be recovered through competition and would result in unacceptable delays in fulfilling the Government's needs. These duplicated costs, estimated at~See paragraph IX, Other Facts.) for the purchase of special equipment owned by the contractor and utilized to perform work specified in the contract. The incumbent contractor is the only known company that can meet the requirement to be in place and fully operational at the required performance start date of 01 July 14.

X. LIST OF SOURCES, IF ANY, THAT EXPRESSED INTEREST IN THE

ACQUISITION

In the previous acquisition, an accomplished synopsis of the contract indicated that there were no companies other than the incumbent contractor, BAE, capable of fulfilling the contract before the expiration of the current contract due to the proprietary information. Although several companies have the capability to perform the follow-on B-52 AN/USM-464A Field Support contract, no company has the proprietary and classified information required to perform the actions li sted in the contract. On 2 1 Jan 2014, BAE Systems confirmed that the serv ice was still considered proprietary and the process has not been released to any other entity.

XI. A STATEMENT OF THE ACTIONS, IF ANY, THE AGENCY MAY TAKE TO

REMOVE OR OVERCOME ANY BARRIERS TO COMPETITION BEFORE MAKING

SUBSEQUENT ACQUISITIONS FOR THE SUPPLIES OR SERVICES REQUIRED

T~B...$2 AN/USM-464A Field Support acquisition has been conducted using full and open competition. B-52 AN/USM-464A Field Suppol I contract is still required to fulfill B-52 conventional and nuclear missions. It is not anticipated that subsequent acquisitions for the services required will be accomplished using full and open competition.

XII. CONTRACTING OFFICER'S CERTIFICATION

The contracting officer's signature on the Coordination and Approval Document evidences that she has determined this document to be both accurate and complete to the best of her knowledge and belief (FAR 6.303-2(a)(l 2)).

XIII. TECHNICAL/REO\JIREMENTS PERSONNEL'S CERTIFICATION

As ev idenced by the ir signatures on the Coordination and Approval Document, the technical and/or requirements personnel hav~ certified that any supporting data contained here in , which is their responsibility, is both accurate and complete (FAR 6.303-2(b)).
