Justification and Approval (J&A) for Other Than Full and Open Competition
13 Sep 2017
I. Contracting Activity.
Department of the Air Force, Air Combat Command, 55th Contracting Squadron, Offutt AFB, NE is the contracting organization responsible for the individual justification for other than full and open competition. The Procuring Contracting Officer is
II. Nature and/or description of the action being processed.
This Justification and Approval (J&A) is required for use of other than full and open competition procedure to procure repair parts from Spirent Federal System for the Joint Navigation Warfare Center (JNWC).
III. Description of supplies/services required to meet agency needs.
Provide needed parts to repair and upgrade the Spirent system. This service enhances our capability and capacity to provide PNT and CPNT support and assessment to the services, combined, and joint forces. This will add a 2nd RF output, with 16 channels, includes integration and calibration to a current Spirent system.
IV. Statutory authority permitting other than full and open competition.
10 U.S.C. 2304(f), as implemented by FAR 13.501(a) Sole source (including brand name) acquisitions used in accordance with 41 U.S.C. 1901.
V. Demonstration that the contractor's unique qualifications or nature of the acquisition requires the use of the authority cited above (applicability of authority).
SPIRENT Federal Systems is the sole manufacturer and therefore the only provider of follow on maintenance for this equipment. A letter of confirmation of this information from SPIRENT has been provided in the contract file. SPIRENT is a key system to the NAVWAR mission and is a critical component in being able to generate and analyze frequencies used to emulate and disrupt Global Position Systems. Any disruption to this service, JNWC will not be able to support deployed forces, conduct analysis focused on current and future threats, or analyze the collateral effects of jamming operations on CONUS and OCONUS based infrastructure systems. It is clear that any other company other than SPIRENT would cause extreme risk to the Government.
VI. Description of efforts made to ensure that offers are solicited from as many potential sources as practicable.
Due to the specialized equipment and SPIRENT being the original manufacturer of the equipment, it is not practicable to solicit to other companies.
VII. Determination by the Contracting Officer that the anticipated cost to the Government will be fair and reasonable.
The contracting officer will determine the price fair and reasonable based on previous contract prices for similar repairs and rely on the technical guidance of the subject matter experts at JNWC.
VIII. Description of the market research conducted and the results, or a statement of the reasons market research was not conducted.
Selection of a contractor other than Spirent Federal System would require additional non-compatible equipment to be purchased from another vendor which in turn would require additional training, tools, Justification and Approval (J&A) for Other Than Full and Open Competition
13 Sep 2017 acclimation period, and would create additional unserviceable equipment. This would jeopardize our ability to conduct PNT and CNPT operations across the global.
IX. Any other facts supporting the use of Other Than Full and Open Competition.
None.
X. List of any sources that expressed, in writing, an interest in the acquisition.
SPIRENT Federal Systems.
XI. A statement of the actions, if any, the agency may take to remove or overcome any barriers to competition before making subsequent acquisitions for the supplies or services required.
The requiring activity will compete any new system replacements or seek solutions that allow various substitutes from other companies.
