I. Contracting Activity.
This document constitutes brand name justification IAW FAR 6.303-2 as required by FAR 13.501(a)(1)(ii). It is executed on behalf of the Department of the Air Force, 5th Contracting Squadron, 165 Missile Ave, Minot Air Force Base, North Dakota 58705.
II. Nature and/or description of the action being processed.
Allow the purchase of the Peltor headsets and Atlantic Signal warrior push to talk accessories based on the current phase one and phase two communication systems employed by the 91st Missile Wing (91 MW).
III. Description of supplies/services required to meet agency needs.
Peltor ACH with 5C downlead, hi noise mic and gen II headband, P/N: ACH.VCY.92 with gel cups, warrior push-to-talk assembly, P/N PTT.WDD.92 and radio connectors are requested based on the current communication system employed by the 91st MW containing proprietary 3M connectors. This equipment is required to enable multi frequency communication capabilities to the 91st Missile Security Forces Squadron (91 MSFS) during missile field operations.
Currently 200 of the requested headset are in use and a greater number is required based on the 91 MSFS manning.
IV. Statutory authority permitting other than full and open competition.
As stated in FAR 13.501(a)(2)(i)(deviation), "For a proposed contract exceeding the simplified acquisition threshold, but not exceeding $700,000, the Contracting Officers (CO) certification that the justification is accurate and complete to the best of the CO's knowledge and belief will serve as approval, unless a higher approval level is established in accordance with agency procedures. IAW AFFARS 5313.501(a)(2), the table located at AFFARS 5306.304(a) dictates justification approval authority. For purchases less than $700,000, the approval authority is the Chief of Contracting Office. IAW 5306.304(a) and local policy this authority has been delegated to the CO.
V. Demonstration that the contractor's unique qualifications or nature of the acquisition requires the use of the authority cited above (applicability of authority).
Pursuant to FAR 13.501, the CO is restricting consideration to an item peculiar to one manufacturer/brand-name product as any other similar products do not meet, nor can be modified to meet, the agency's needs.
Market research has been conducted to ensure no other brand would be capable of providing interoperability with current phase one and phase two communication systems. No other competing products will allow the interoperability required to maintain the capability for 91 Security Forces Group (SFG) members to communicate between multiple frequencies.
VI. Description of efforts made to ensure that offers are solicited from as many potential sources as practicable.
Brand name Peltor and Atlantic Signal components are being sought to ensure radio interoperability with existing phase one and phase two communication systems. Peltor, a large business, is owned by 3M and has numerous small business distributors nation-wide. Atlantic Signal, a small business, has limited their distributors to 5 total businesses.
Of the 5 total distributors, 3 are small business concerns. All 3 small business distributors were contacted, and expressed interest in fulfilling the requirement for both Peltor and Atlantic Signal products. Based on market search conducted a total small business set-aside is anticipated.

VII. Determination by the Contracting Officer that the anticipated cost to the Government will be fair and reasonable.
This requirement will be solicited on the GPE to ensure maximum competition. In accordance with FAR 12.209, Determination of Price Reasonableness, and FAR 13.106-3, Award and Documentation, before making award, the CO shall determine that the proposed price is fair and reasonable. The proposed price reasonableness will be based on competitive quotes.
VIII. Description of the market research conducted and the results, or a statement of the reasons market research was not conducted.
This requirement will be solicited on the GPE to ensure maximum competition. In accordance with FAR 12.209, Determination of Price Reasonableness, and FAR 13.106-3, Award and Documentation, before making award, the CO shall determine that the proposed price is fair and reasonable. The proposed price reasonableness will be based on competitive quotes.
IX. Any other facts supporting the use of Other Than Full and Open Competition.

XI. A statement of the actions, if any, the agency may take to remove or overcome any barriers to competition before making subsequent acquisitions for the supplies or services required.
The Government anticipates utilizing manufacturers who are capable of providing products that support full interoperability with the existing phase one and phase two communication system that the 91st MW has invested in.
Market research will continue to be conducted in the future to determine if new products have entered the market that meet the interoperability requirement of the 91st MW.
