ENVIRONMENTAL PROTECTION

PART 1 GENERAL

1.1 The Contractor shall perform all work in such manner as to minimize the polluting of air, water, or land, and shall, within reasonable limits, control noise and the disposal of solid waste materials, as well as other pollutants.

Recycling of construction and demolition debris is required when economically advantageous.

1.2 IMPLEMENTATION

Within 20 calendar days after Notice to Proceed and prior to commencement of the work at the site, the Contractor shall:

a. Detail their proposal for implementing the requirements for environmental pollution control specified herein. Submit in accordance with the submittal table.

1.3 SUBMITTALS

In accordance with Section 01300: Submittals, the Contractor shall submit the following.

2.2 PRECONSTRUCTION SURVEY

Prior to start of any on-site construction activities, the Contractor shall make a condition survey after which the Contractor shall record on a layout plan the condition of trees, shrubs and grassed areas immediately adjacent to the site of the work and adjacent to his assigned storage area

2.3 PERMITS AND FEES

No separate payment will be made for work covered under this section. The Contractor shall be responsible for payment of fees associated with environmental permits, application, and/or notices obtained by the Contractor. All costs associated with this section shall be included in the contract price. The Contractor shall be responsible for payment of all fines/fees for violation or non-compliance with Federal, State, Regional and local laws and regulations.

2.3.1 Environmental Permits

The Contractor shall be responsible for obtaining and complying with all environmental permits and commitments required by Federal, State, regional, and local environmental laws and regulations.

2.4 PROTECTION OF LAND AREAS

Except for work areas, storage areas, or access routes specifically assigned for the use of the Contractor under this contract, the land areas outside the limits of permanent work performed under this contract shall be preserved in their present condition. The Contractor shall confine his construction activities to areas defined for work on the plans or specifically assigned for his use. Storage and related areas and access routes required temporarily by the Contractor in the performance of the work will be assigned by the Contracting Officer.

2.5 PROTECTION OF TREES AND SHRUBS

Except for trees or shrubs marked on the plans to be removed, the Contractor shall not deface, injure or destroy trees or shrubs, nor remove or cut them without special authority. No ropes, cables, or guys shall be fastened to or attached to any existing nearby trees for anchorage.

2.5.1 Tree Protective Structures

Where, in the opinion of the Contracting Officer, trees may possibly be defaced, bruised, injured, or otherwise damaged by the Contractor's equipment or by his other operations, he may direct the Contractor to provide temporary protection of such trees by placing boards, planks, or poles around them.

2.5.2 Restoration of Damaged Trees

Any tree scarred or damaged by the Contractor's equipment or operations shall be restored as nearly as possible to its original condition at the Contractor's expense. All scars made on trees not designated on the plans to be removed by construction operations shall be coated as soon as

SECTION 01 14 31 Page 4 possible with an approved tree wound dressing. Trees that are to remain, either within or outside established clearing limits, that are damaged by the Contractor so as to be beyond saving in the opinion of the Contracting Officer shall be immediately removed, if so directed, and replaced with a nursery-grown tree of the same species and size.

2.5.3 Herbicide

Herbicide use will be restricted to those areas directed to be sprayed by the Contracting Representative. Herbicide shall not be sprayed when wind speeds are greater than 10 mph or when there is likelihood of runoff due to rain. Herbicide shall contain a visible dye for tracking application area. Any application of herbicide at the Launch Facilities or Missile Alert Facilities must be applied by an applicator holding a ND Commercial Pesticide Applicators license. This license must include the category for Right-of-Way. Information on the Applicators license may be found at the NDSU Extension Service pesticide program website. Contractor shall submit proof of certification, catalog data and MSDS for any herbicide proposed prior to use on the site.

2.6 WATER RESOURCES AND STORM WATER DISCHARGE

The Contractor shall monitor construction activities to prevent pollution of surface and ground waters. Toxic or hazardous chemicals shall not be applied to soil or vegetation unless otherwise indicated. The Contractor shall monitor all water areas affected by construction activities.

2.6.1 NPDES Storm Water Program General Construction Permit

2.6.1.1 Construction Activity Less Than One Acre

For construction activity that disturbs less than 1 acre of land the Contractor shall implement Best Management Practices (BMPs) outlined in Section D, Erosion and Sediment Controls.

2.6.1.2 Wetlands, Erosion And Sediment Controls

2.6.1.2.1 Wetlands

The Contractor shall not enter, disturb, destroy, place fill into, or allow discharge of contaminants into any wetlands except as specifically authorized herein. The Contractor shall be responsible for the protection of wetlands on Minot AFB. Authorization to enter specific wetlands identified shall not relieve the Contractor from any obligation to protect other wetlands within, adjacent to, or in the vicinity of the construction site and associated boundaries. Maps showing locations of wetlands within Minot AFB can be obtained from 5 CES/CEIE.

2.6.1.2.2 Erosion and Sediment Controls

The Contractor shall be responsible for providing erosion and sediment control measures in accordance with Federal, State and local laws. This applies in all cases, even for construction activity that disturbs less than an acre of soil. The erosion and sediment controls selected and maintained by the Contractor shall be such that water quality standards are not violated as a result of the Contractor’s construction activities.

The area of bare soil exposed at any one time by construction operations should be kept to a minimum. The Contractor shall construct or install temporary and permanent erosion and sediment control best management practices (BMPs). BMPs may include, but not be limited to, vegetation cover, stream bank stabilization, slope stabilization, silt fences, construction of terraces, interceptor channels, sediment traps, inlet and outfall protection, diversion channels, and sedimentation basins. The Contractor’s best management practices shall also be in accordance with the Base National Pollutant Discharge Elimination System (NPDES) Storm Water Pollution Prevention Plan (SWPPP) which may be reviewed at the Minot AFB Environmental Management Office. Any temporary measures shall be removed after the area has been stabilized.

2.6.2 Discharging of Ground Water

For discharge of ground water, the Contractor shall obtain a State permit specific for pumping and discharging ground water prior to surface discharging in accordance with the requirements of the State Storm Water Discharges From Construction Sites permit. Refer to the NDDH web site.

2.6.3 Protection Of Water Resources

The Contractor shall control the disposal of fuels, oils, bitumen, calcium chloride, acids or harmful materials, both on and off the Government premises and shall comply with applicable federal, state, county and municipal laws concerning pollution of rivers, streams, and wetlands while performing work under this contract. Special measures shall be taken to prevent chemicals, fuels, oils, greases, bituminous materials, herbicides, and insecticides from entering public waters. Water used in on-site material processing, concrete curing, foundation and concrete cleanup, and other waste waters shall not be allowed to reenter a stream if an increase in the turbidity of the stream could result therefrom.

2.6.3.1 Dewatering Of Groundwater

For temporary dewatering of groundwater encountered during construction, the Contractor shall land apply all water generated at the locations indicated on drawings in accordance with Paragraph: LAND APPLICATION.

2.6.3.1.1 Land Application

Land application shall follow state requirements; however, no permit will be necessary. "Land application" implies that the Contractor shall discharge water at a rate which allows the water to percolate into the soil. No sheeting action, soil erosion, discharge into storm sewers, SECTION 01 14 31 Page 6 defined drainage areas, or discharge into the "waters of the State" shall occur. The Contractor shall contact the State of North Dakota, Division of Water Quality and Permit Program, to discuss the water quality parameters for chemical contaminants (such as chlorine), oil, grease, and total suspended solids and shall ensure that all water intended for land application will meet the state requirements.

2.6.4 Erosion And Sediment Control

The Contractor shall be responsible for providing erosion and sediment control measures in accordance with local, state, and federal regulations.

The erosion and sediment controls selected and maintained by the Contractor shall be such that local, state, and federal water quality standards are not violated as a result of the Contractor's construction activities. The area of bare soil exposed at any one time by construction operations should be held to a minimum. For areas subject to erosion including, but not limited to, steep slopes, soils spreading areas, and stockpile areas, the Contractor shall disturb as little vegetation as possible, minimize the period of time that the soil is exposed, prevent surface water runoff from flowing across disturbed areas, stabilize disturbed soils as soon as possible, and provide adequate drainage for the increased runoff. Sedimentation/erosion control features may include, but not be limited to, vegetation cover, stream bank stabilization, slope stabilization construction of terraces, interceptor channels, sediment traps, inlet and outfall protection, diversion channels, and sedimentation basins. Runoff management practices should be employed in areas where the potential for storm water contamination exists that cannot be addressed by a prevention or source reduction measure. Runoff management procedures may include vegetative swales, reuse of collected storm water, infiltration devices, and detention/sedimentation basins. Any erosion and sediment control measures which are damaged or found to be ineffective shall be remedied by the Contractor at no additional cost to the Government. Any areas damaged by erosion shall be repaired by the Contractor at no additional cost to the Government.

2.6.5 Spill Prevention And Response Plan

The Contractor shall include a Spill Prevention and Response Plan in the Implementation Proposal. The plan shall describe the Contractor's procedures for preventing and responding to spills of hazardous materials.

2.7 AIR QUALITY

Equipment operation, activities, or processes performed by the Contractor shall be in accordance with all Federal and State air emission and performance laws and standards.

2.7.1 Burning of material is not allowed on site by the Contractor.

2.7.2 Particulates

The contractor shall not operate a construction site or demolition project unless reasonable precautions are taken to control emissions of particulate matter. Such emissions of airborne particulate matter shall not exceed 20% opacity as defined in 40 CFR 60 Appendix A.

2.7.3 Sound Intrusions

The Contractor shall keep construction activities under surveillance and control to minimize environment damage by noise. The Contractor shall comply with the provisions of the State of North Dakota rules.

2.7.4 Ozone Depleting Chemicals (ODCs)

The contractor shall ensure activities performed under this contract are in compliance with the Air Force Policy on ODCs. The contractor shall not purchase, use, or specify the use of any Class I ODC in the production, design, or maintenance of the end item. Class II ODCs may be used or specified only with the written approval of the Contracting Officer.

2.7.5 Dust Control

The Contractor shall maintain all excavations, embankments, stockpiles, access roads, plant sites, waste areas, borrow areas, and all other work areas free from excess dust to such reasonable degree as to avoid causing a hazard or nuisance. Temporary methods consisting of sprinkling, chemical treatment, light bituminous treatment or similar methods will be permitted to control dust. Dust control shall be performed as the work proceeds and whenever a dust nuisance or hazard occurs.

2.8 TOXICS

The Contractor is responsible for ensuring that no employee is exposed to toxic materials like airborne asbestos, lead from lead base paint or polychlorinated biphenyls (PCB’s).

2.9 HAZARDOUS MATERIALS (HAZMAT)

Contractors must obtain an authorization prior to bringing any hazardous materials (Federal Standard 313) on Air Force installations. Contractors must submit all required documentation including appropriate Hazardous Materials Authorization Information Form, Material Safety Data Sheet (MSDS) and projected usage information to 5 CES/CEIE through the Contracting Officer at least 15 days before the HAZMAT is brought onto Minot AFB and facilities within the Missile Field. This review is to ensure that no Air Force restricted hazardous materials are being proposed for use. The contractor will comply with Federal Acquisition Regulation (FAR) 52.223-5. Following contract award, the contractor shall provide the name and an initial volume of each hazardous material being used on Minot AFB and its storage location. Contractors shall provide 5 CES/CEIE with specific usage data on a monthly basis and a finalized usage report at project completion, as determined by the Installation Hazardous Materials

Management Process (IHMMP) Team. Reports must include: name of material, manufacturer, NSN/Part #, container size, volume start balance, volume of material used in reporting period, storage location if it’s changed since initial reporting and the name and phone number of the reporting official.

Reports shall be on letterhead paper, dated, and signed by the reporting official. Prime contractors shall be responsible for reporting hazardous material used by subcontractors. FAR 52.223-3 provides guidance on Hazardous Material Identification and Material Safety Data.

2.9.1 Emergency Planning And Community Right-To-Know ACT (EPRCRA)

Contractors shall comply with the reporting provisions of EPCRA Sections 311, 312 and 313 during the life of the contract. Contractors shall provide a list of all hazardous materials procured, used and stored along with a current MSDS for each item, an initial inventory and a monthly or quarterly inventory. Contractors shall provide the information to 5 CES/CEIE through the Contracting Officer. The inventory reporting period shall be determined by the installation Hazardous Materials Management Process Team.

2.9.2 Material Safety Data Sheets (MSDSs)

The contractor shall maintain MSDSs for all hazardous materials used on base and the MSDSs shall be on file on site at the construction site office at all times. The contractor shall send 5 CES/CEIE via the Contracting Officer a MSDS for any new material not initially identified, the volume being brought on base, and its storage location. The MSDS shall be submitted to 5 CES/CEIE in accordance with Section 01300: Submittals.

2.9.3 HAZMAT Quantities

Prior to completion of the contract, the contractor shall provide a finalized report of the actual quantities used during the contract, and remove all excess materials. Contractors may use excess materials on other projects and shall be responsible for proper disposal of any materials removed from Minot AFB.

2.9.4 HAZMAT Storage

All hazardous materials used by the contractor on Minot AFB property shall be stored properly in segregated areas in accordance with all regulatory and MAFB Fire Department requirements. Storage requirements shall include, but not be limited to:

a. Containers must be securely closed when not in use.

b. Containers must be labeled with appropriate warning labels.

c. Storage area must be posted with hazardous signs as required.

d. Storage must have secondary containment.

e. Contractor shall check at least weekly for leaks and spills and maintain a log of the inspections.

f. Materials shall be stored in one central location.

g. Flammable items must be stored in an approved flammable storage locker and grounded as needed.

h. All fuel storage tanks and containers must have secondary containment.

2.9.5 Fuel and Lubricants

Storage, fueling and lubrication of equipment and motor vehicles shall be conducted in a manner that affords the maximum protection against spill and evaporation. Fuel, lubricants and oil shall be managed and stored in accordance with all Federal, State, and local laws and regulations. Used lubricants and used oil to be discarded shall be stored in marked corrosion-resistant containers and recycled or disposed in accordance with 40 CFR 279, State, and local laws and regulations. There shall be no storage of fuel on the project site. Fuel must be brought to the project site each day that work is performed.

2.10 GREEN PROCUREMENT

In compliance with the Affirmative Procurement requirements of Section 6002 of RCRA, Executive Orders 13423 and 13514, and the Federal Acquisition Regulations (FAR), the Government requires the use of recycled and recovered materials, and products identified in the Environmental Protection Agency’s Comprehensive Procurement Guidelines as much as practical.

a. These materials and products must meet the requirements of the specifications, must not delay the progress of the work, and must not be cost prohibitive.

b. EPA guideline items are seen as the minimum that should be considered when evaluating recycled/reuse materials. Other materials and products not listed, but commonly used in industry outside of the government, should also be considered. FAR 52.211-5 provides guidance on recycled material usage versus virgin material usage.

c. Material and product submittals for all recycled-content items required will clearly show the recycled/recovered content for each material used, type of material, and total weight of material used.

d. Any decision not to acquire guideline items as required in the contract must be submitted in writing and approved by the Contracting Officer and 5 CES/CEIE. All purchases of guideline items must be verified by the Contracting Officer before contract closure.

e. Paper products such as government documents, agreements, contracts, etc. shall be printed on paper containing at least 30% post consumer materials per FAR 52.204-4. The use of recycled or bio-based containing products is strongly encouraged.

f. All contractually required documents and reports produced by or for the Air Force longer than two pages shall be double-sided per FAR 52.204-4.

2.11 QUALIFIED RECYCLING PROGRAM (QRP)

In compliance with 10 U.S.C. §2577 and DoD Instruction 4715.4, Pollution Prevention, 6 Jul 1998, it is the intention of the Air Force to recycle at its installations.

2.11.1 Recycling/Reuse of Excess Materials and Construction and Demolition (C&D) Debris

The contractor shall reuse/recycle excess materials and C&D debris to the maximum extent possible. C&D debris are those excess/residue materials resulting from construction or demolition activity that would normally be discarded to a landfill. C&D debris includes, but is not limited to soil, rock, vegetation, and concrete, if determined to be economical. All C&D debris resulting from demolition shall become the property of the contractor unless specified otherwise or as determined by the contracting officer.

2.11.2 Reporting Tonnage of C&D Debris

Contractor shall track by month and report the tonnage of C&D debris in two categories:

a. Tons of C&D debris that is or will be recycled or reused

b. Tons of C&D that is disposed in a landfill.

2.11.3 The C&D Debris Recycled/Disposed Tonnage Report

Report shall consist of a written memo with the tonnage of each category (recycled and disposed tonnage) submitted to 5 CES/CEIE through the contracting officer. Submit C&D debris recycled and disposed tonnage report monthly until the project is completed.

2.11.4 Contractor Generated Rubbish

Materials not to be returned to the Government and all contractor generated rubbish, if not recycled, shall be disposed of by the contractor off-base at his own expense, and in compliance with applicable environmental codes and regulations of governing authorities.

2.12 HAZARDOUS WASTE PROCEDURES

All hazardous waste must be managed, handled, and disposed of in accordance with 40 Code of Federal Regulations (40 CFR) Parts 260-299 and the Minot AFB Hazardous Waste Management Plan.

2.12.1 Waste Characterization, Containerization and Disposal

The contractor is responsible for the proper characterization, containerization, and disposal of all wastes generated from his operations, including RCRA hazardous, state-regulated, and spill cleanup wastes.

2.12.2 Waste Disposal Updates

Contractors shall coordinate with 5 CES/CEIE for the disposal of generated wastes at least 14 days before the project begins, and provide updates at least once per month throughout the entire project. Updates shall include the volume and type of waste generated, and storage location.

2.12.3 Solid Waste

The contractor shall dispose of/recycle solid wastes (i.e. non-hazardous) through local disposal or recycling facilities. No liquid wastes of any kind may be put into installation garbage collection containers, or poured into drains, sinks, toilets, or on the ground. Revenue received by the contractor from recycled solid wastes shall offset contract costs. The contractor shall coordinate disposal of RCRA hazardous, state-regulated and liquid wastes from government materials through 5 CES/CEIE via the Contracting Officer. The contractor shall be responsible for disposal of RCRA hazardous, state-regulated, liquid wastes and spill-cleanup wastes generated by contractor processes and from contractor-purchased materials.

The contractor shall characterize, containerize, handle, manage and dispose of wastes in accordance with 40 CFR 260-299 and the installation Hazardous Waste Management Plan. The contractor is responsible for provided appropriate waste collection containers.

2.12.4 Hazardous Waste Storage

Contractors storing hazardous waste on site for more than 24 hours must follow the Minot AFB Hazardous Waste Management Plan. At a minimum, the contractor must establish a secure accumulation point, and appoint and train Hazardous Waste (HW) Managers. If more than 55 gallons of hazardous waste or more than 1 quart of acutely hazardous waste is generated then the contractor must obtain approval for and establish a 90 day accumulation site. The contractor shall coordinate accumulation storage areas with 5 CES/CEIE via the Contracting Officer at least 2 weeks prior to establishing the storage area.

The contractor is responsible for all fines and penalties, which may stem from an EPA or State of North Dakota Department of Health hazardous waste inspection of his operation.

2.13 SOLID WASTES

The contractor is responsible for handling and disposal of all solid waste generated at the job site including laboratory testing and any documentation submittals required by the landfill owner.

2.13.1 Solid Waste Handling

Solid wastes (excluding clearing debris) shall be placed in containers that are emptied on a regular schedule. Handling, storage, and disposal shall be conducted to prevent contamination. Segregation measures shall be employed so that no hazardous or toxic waste will become co-mingled with solid waste. The Contractor shall transport solid waste off Government property and dispose of it in compliance with Federal, State, and local requirements for solid waste disposal. A Subtitle D RCRA permitted landfill shall be the minimum acceptable off-site solid waste disposal option. The Contractor shall verify that the selected transporters and disposal facilities have the necessary permits and licenses to operate.

2.13.2 Solid Waste Recycling

Contractors are required to recycle solid waste generated from their work, including aluminum and other scrap metals, concrete, cardboard, newspaper and office paper. Documentation of recycled solid waste shall be submitted to 5 CES/CEIE via the Contracting Officer on a regular basis as determined by the installation Waste Program Manager. Recycling information shall include the volume and types of recycled materials, and name, phone number, and address of the recycling center. The information shall be written on the contractor’s letterhead paper and be signed by the project manager or other legal representative of the contractor.

2.13.3 Special Handling Requirements

The Contractor shall make all arrangements for disposal of any wastes including wastes requiring special handling such as asbestos and lead containing materials, rubble, sludge or non-hazardous chemical wastes.

2.13.4 Solid Waste Disposal Facilities

All non-hazardous wastes shall be properly disposed of through a licensed landfill or recycling center. North Dakota Department of Health written approval is required for any non-inert materials such as asphalt containing materials, asphalt roofing materials, steel containing materials, etc that are to be disposed of in a Class III landfill site. No written approval is required if a Class II or Class IV landfill site is used for disposal of these non-inert materials.

2.13.4.1 Landfills

Class IV landfills accept Group VI wastes which include construction and demolition waste such as waste building materials, packaging, and rubble resulting from construction, remodeling, repair, and demolition operations on pavements (including asphalt waste), houses, commercial buildings, and other structures.

2.13.4.2 Landfill Exclusions

Regulated hazardous wastes are excluded from all Class II, III and IV landfill sites. Class II landfill sites can receive any wastes acceptable at Class III and Class IV landfill sites in addition to municipal and household solid wastes such as garbage and putrescible organic materials.

2.13.4.3 Minot AFB Landfill Site

No landfill site is available on site or on Minot AFB. Demolition rubble shall not be buried or placed upon the land anywhere on base or at the work site.

2.13.4.4 Improperly Disposed of Waste

The cost for cleanup of improperly disposed wastes and/or the costs for removals of improperly placed hazardous waste materials shall be the responsibility of the contractor.
