DIVISION 1 - GENERAL REQUIREMENTS

SECTION 01000

USPECIAL PROVISIONS

U1. GENERALU:

U1.1 DESCRIPTION OF WORKU: In general, this project includes the following items.

U1.1.1U Remove abandoned ductwork in MAF attic and abandoned curbs in MAF roof.

U1.1.2U Remove abandoned electrical conduit and cable.

U1.1.3U Install additional insulation in attic and install new diffuser in specific offices.

U1.1.4U Patch all holes created by demolition.

U1.1.5U Install attic access doors and paint ceilings.

U1.2 LOCATION OF WORKU: This work is at Missile Alert Facilities A-01 through O-01 in the Minot Air Force Base (MAFB) Missile Field.

U1.3 APPLICABLE PUBLICATIONSU: Publications shall be of the most current date at the Invitation For bid date.

U1.4 HAZARDOUS MATERIALSU: Contractor shall submit prior to contract award Material Safety Data Sheet (MSDS) expected to be used during contract performance. Hazardous material shall be defined in the latest version of Federal Standard No. 313.

U2. PRODUCTSU: The products to be used in the work under this contract are described in the other sections of these specifications.

U3. EXECUTIONU:

U3.1 EQUIPMENT PARKINGU: Space for the Contractor's equipment will be determined at the preconstruction conference. The Government shall not be liable for the security of any of the Contractor's equipment or material during the duration of the project.

U3.2 DRAWINGS AND SPECIFICATIONSU: At least one set of drawings and specifications shall be kept at the job site at all times by each superintendent.

U3.3 WORK CONDUCT, CORRELATION, EXECUTION, ETC.U:

U3.3.1U Work Performance: Contractor shall conduct all work, including materials distribution in an orderly manner with minimum disturbance and inconvenience to operations. Contractor shall confine and limit his personnel to only those areas required for work performance. All work shall be performed in a neat, orderly fashion, with extreme care exercised to avoid damage to all property in and around project areas. Any damage caused by the Contractor shall be replaced, repaired, or restored at no cost to the Government. Upon completion, all work and storage areas shall be cleaned of all evidence of Contractor's debris accumulations. Contractor's proposed work schedule shall be coordinated with the Contracting Officer or his designated representative 14 days prior to the start of any work. All work areas shall be barricaded properly for day and nighttime vehicular safety warning.

U3.3.2U The Using Agency will occupy the premises during construction. The Contractor will be required to coordinate with the Contracting Officer to minimize conflict and to facilitate Using Agency operations.

U3.3.3U Work of the various sections of specifications shall be coordinated so as to assure efficient and orderly sequence of installation of construction elements, with provisions for accommodating items to be installed concurrently by others.

U3.3.4U Storage: At close of each day's operation, all excess materials and equipment shall be moved to Contractor's staging area. If Contractor should have a storage structure or equipment located on site, it shall be removed, and staging area restored to its original condition within fourteen days after final inspection.

U3.4 QUALITY CONTROLU: Refer to Spec. Section 01400 QUALITY CONTROL.

U3.5 PERMITSU:

U3.5.1U AF Form 592: When any welding, cutting, brazing or use of any open flame device is to be used, an AF Form 592 permit must be obtained from the Base Fire Department (Bldg 896, 896 Flightline Drive) prior to beginning such work. During such work, a fully charged and operable fire extinguisher, appropriate for the task, shall be provided by the Contractor.

U3.6 SAFETYU:

U3.6.1U Safety Requirements: Contractor will comply with all OSHA/NEC requirements and MAFB Instruction 32-2001, Responsibilities of Base Personnel to Eliminate or Control Fire Hazards.

U3.6.2U Hazardous Waste: Any hazardous waste/material used or generated by the Contractor shall become the property of the Contractor. The use, generation, and disposal of all hazardous waste/material will be the responsibility of the Contractor and shall be handled in accordance with all federal and state hazardous waste and toxic substances control regulations.

U3.7 UTILITIESU: Electricity required by the Contractor for the completion of the contract shall be provided by the Government at no cost to the Contractor.

U3.8 SECURITY REQUIREMENTS:

U3.8.1U The Contractor shall be responsible for furnishing to each employee and for requiring each employee engaged on the work to display such identification as may be approved and directed by the Contracting Officer.

All prescribed identification shall immediately be delivered to the Contracting Officer, for cancellation upon release of any employees.

U3.8.2U Entry and Site Regulations:

U3.8.2.1U Entry: In order to gain entry onto a facility, Contractor personnel and mission essential Contractor owned/leased/rented vehicles must be listed on an Entry Authority List (EAL), identified by Government inspector/escort personnel, and physically escorted on site by authorized Government inspector/personnel. No privately owned vehicles (POVs) will be permitted on MAFs or LFs.

U3.8.2.2U Thirty (30) working days prior to the initial commencement of work, the Contractor must submit to the Contracting Officer a summarized list of employees and mission essential Contractor owned/leased/rented vehicles along with a legible photocopy of each employee’s government issued credential photo ID. The lists and photocopies will be used to prepare the Contractor’s EAL referenced above. Foremen, supervisors and superintendents must be identified as such on the Contractor’s list of employee information.

U3.8.2.2.1U The Contractor’s summarized list of employee information must show each employee’s full name exactly as it appears on the credentialed photo ID submitted; date of birth (DOB); full Social Security Account Number (SSAN); citizenship; the government issuing agency name and control number exactly as it appears on the credentialed ID submitted. U.S. government issued credential photo IDs must have a picture of the individual, individual’s DOB and a control number. Acceptable government

01000-3 issued credentialed photo IDs are U.S. Federal passport or passport card, or state, commonwealth, territory, protectorate, District of Columbia, U.S.

sovereign insular area or tribal organization recognized by the U.S.

Department of the Interior cards.

U2.8.2.2.2U The Contractor’s summarized list of vehicle information must include vehicle make; vehicle model; vehicle year;

vehicle primary color; vehicle license plate state of issue and number.

Vehicles include mission essential company owned/leased/rented vehicles driven out to the MAF or LF and brought onsite for use, i.e. pick-up trucks, cars, vans, lineman’s trucks, dump trucks and all trailers being taken onsite. All equipment (i.e. skit-steers, Bobcats, forklifts, loaders/backhoes/ lifts, trenchers, air compressors, welders, etc.), materials, and hand-carried items (i.e. power tools and hand tools) brought out to the site on a trailer are not required to be listed on the EAL. A piece of equipment driven on-site rather than on a listed trailer needs to be listed on the EAL. No privately owned vehicles will be permitted on MAFs or LFs.

U3.8.2.3U Upon arrival at the MAF, Contractor personnel will contact the Flight Security Controller (FSC) using the gate intercom telephone and inform the FSC of their presence at the security gate. Contractor personnel must remain outside of the security fence and in or near their vehicle until the arrival of the Government inspector/escort.

U3.8.2.4U Upon arrival, the Government inspector/escort will identify and search all Contractor personnel and vehicles. All Contractor personnel will provide the Government inspector/escort with two (2) forms of identification as listed above (one being photo) stating the employee’s full name and SSN. These two forms of identification shall be the same two forms of ID used to generate the EAL. The Contractor's vehicles will be checked and possibly searched prior to site entry. Contractor vehicles shall be clearly marked identifying each contracting firm.

U3.8.2.5U If Contractor personnel are not listed on the EAL, or those who are listed cannot provide proper identification, they will not be permitted on the site. Delays caused by lack of proper EAL data or proper identification shall be at no cost to the Government.

U3.8.2.6U Restricted Area. The work to be performed is in a restricted area. Therefore, the Contractor shall conform to all requirements of MAFB IDP 31. Workers will be required to have an escort with them at all times. The Using Agency will provide an escort for the Contractor. The Contractor shall allow 60 minutes each day for personnel to process on and off the work site that will not be considered delay time. The Contractor shall bid a crew hourly rate for any delays beyond the 60 minutes. This hourly rate will also apply to Government-caused work stoppages when the entire work crew will be asked to evacuate the work area. All site access delays must be reported by

01000-4 the Contractor, in writing, to the Contracting Officer within 24 hours of occurrence. All Government-caused work stoppages must be documented by Government personnel at the time of occurrence and reported by the Contractor, in writing, to the Contracting Officer within 48 hours of occurrence.

U3.8.3U Security: The Contractor shall:

U3.8.3.1U Protect all Government property.

U3.8.3.2U Comply with base physical security regulations and procedures.

U3.8.3.3U The Government inspector/escort will be responsible for on-site security.

U3.8.3.3.1U While work is in progress, the Contractor may be required to remove his personnel due to Alert status, real or exercise.

U3.8.3.4U During all on-site work, the Contractor personnel will be accompanied and continuously monitored by one (1) Government inspector/escort. Failure to remain within the area being monitored is a serious breach of security and safety regulations. The Contractor will take all necessary action to ensure compliance. The Contracting Officer reserves the right to deny entry to/or take action with any Contractor personnel who refuse to conform to security and/or safety regulations. Delays resulting from such entry denial shall not result in any cost to the Government or schedule delay.

U3.9 AS-BUILT DRAWINGS:U The Contractor shall maintain a set of red-lined full-size, as-built construction drawings marked-up to fully indicate as-built conditions. These drawings shall be maintained in a current condition at all times until completion of the work and shall be available for review by Government personnel at all times. The location as dimensioned from permanent features, general description, type of material, and approximate depth below finished grade of all new and existing exterior underground utilities encountered shall be indicated. All variations from the contract drawings for the required coordination between trades shall be indicated. These variations shall be shown in the same general detail utilized in the initial contract drawings. As-built construction drawings shall be furnished to the Contracting Officer for use during the final inspection. The as-built drawings shall be submitted to the Contracting Officer in accordance with Section 01300: SUBMITTALS.

SECTION 01300

SUBMITTALS

1. GENERAL:

1.1 PROCEDURES:

1.1.1 The Contractor shall be required to submit items listed in the Submittal Schedule at the end of this section to the Contracting Officer for approval.

1.1.2 Items shall be transmitted under AF 3000, Material Approval Submittal form. Each submittal shall identify contract number, project number, and Contractor. Section and paragraph reference shall be made for each item submitted with the AF 3000. Contractor shall submit three copies unless otherwise required elsewhere in the specification.

1.1.3 Unless specifically stated otherwise elsewhere in this

specification, each submittal shall be approved by the Contracting Officer prior to incorporation of materials into the work.

1.1.4 Approvals of submittals which do not conform to the contract shall not be construed as a change to the contract.

1.1.5 The Contractor shall fill in the "Required Submission Date" on the AF Form 66s with the date he plans on submitting the submittals to the Government. A copy of the AF Form 66s with the required submission date filled in shall be submitted to the Contracting Officer for use by the contract administrator. Form 66s shall be submitted in accordance with this section.

1.2 MANUFACTURER'S DATA AND SAMPLES: Where manufacturer's data and samples are required, Contractor shall submit in accordance with procedures identified in 1.1 above.

1.2.1 Manufacturer's Certification: Contractor shall submit a statement from the product manufacturer that proposed products meet the specified standards and other salient characteristics identified as requirements in the specification.

1.3 TEST DATA: Test results shall be dated and signed by the agency performing the test.

1.4 MISCELLANEOUS SUBMITTALS: Submittals which are none of the above types shall meet the specific requirements identified in the referenced paragraph of the Specification Section identified in the schedule.

1.5 SUBMITTAL SCHEDULE: The following is a list of required submittals for this Contract and deadlines for their submittal.

SECTION 01400

QUALITY CONTROL

1.1 SUMMARY:

1.1.1 The requirements of this Section apply to, and are a component part of, each section of the specifications.

1.2 SUBMITTALS: The following shall be submitted in accordance with Section 01300 SUBMITTALS:

1.2.1 Quality Assurance Plan: The Quality Assurance Plan shall address the following:

1.2.1.1 Description of the authority, responsibilities and

coordinating procedures of on-site/off-site quality assurance personnel, including those QA personnel not under direct control of the Contractor.

1.2.1.2 A list of personnel designated by the Contractor to

accomplish the work required by the contract.

1.2.1.3 Contractor’s operational plan for accomplishing and

reviewing work controls, certifications, and documentation of quality control operations, inspections, and test records, including those for subcontractors.

1.2.1.4 Methods to be used during the procurement cycle

(order to delivery) for those materials or equipment that require source inspections, shop fabrications, or similar operations located separately from the work site.

1.2.1.5 Description of on-site personnel training.

1.2.1.6 Certifications of personnel, procedures, processes, and equipment.

1.2.1.7 Nondestructive testing requirements.

1.2.1.8 Identification of independent certifying and testing

laboratories.

1.2.2 Records

1.2.2.1 Contractor shall include all quality control data;

factory tests or manufacturer’s certifications, quality control coordinating actions; records of quality control training/certifications as well as routine hydrostatic, electrical continuity, grounding, welding, line cleaning, field tests and similar tests. Quality Control records must be available for examination by the Contracting Officer.

1.2.2.2 Contractor shall furnish legible copies of the test

and inspection records to the Contracting Officer.

1.2.2.3 A narrative description of an inspection system which provides for compliance with the quality requirements and technical criteria of the contract shall be submitted for approval within 14 calendar days after notice to proceed.

1.2.2.4 A monthly performance report that summarizes the

quality operations shall be submitted. Contractor shall identify inspections made, tests performed, nonconformances, corrective actions taken, status of plans/procedures being developed, and status of open items/problems in work.

1.2.2.5 Letters of Authority or Delegation, outlining the

authority and responsibilities of quality control personnel, shall be submitted along with a copy of the letter of delegation to the Contracting Officer that defines delegated duties and responsibilities.

1.3 QUALITY ASSURANCE

1.3.1 Qualifications

1.3.1.1 Contractor shall submit Quality Representative

Qualifications to the Contracting Officer for approval. Quality Representative may be assigned to more than one contract provided that the assigned contracts are located at the same site.

1.3.1.2 When approval or certifications of special processes, operating personnel, and special equipment or procedures is required by the specifications, approvals or certifications shall be obtained prior to starting the work.

1.3.2 Quality Control Requirements: Contractor shall provide a quality control program encompassing selection of construction materials and sources; suppliers; subcontractors; on-site and off-site fabrication of Contractor-furnished assemblies; on-site and off-site assembly; erection; work procedures; workmanship; inspection; and testing.

1.3.2.1 Contractor shall designate an individual within the

on-site organizations whose sole responsibility is the day-to-day on-site management and direction of the Quality Program. The Quality Program manager will report to the Contractor’s management and have the necessary authority to discharge contractual responsibilities.

1.3.2.2 Records, drawings, submittals, and equipment must be

identified by referencing the Contract Number; Contract Specification Section;

Drawing Sheet Number; Submittal Document Number; and Contract Change Number.

1.3.2.3 Procurement: Contractor is responsible for

controlling procurement sources and those of his subcontractors to ensure that each purchase meets quality requirements.

1.3.2.4 Receiving Inspection System: Contractor shall

maintain a site receiving inspection system that ensures procured materials and equipment are inspected and tested. Receiving inspection records must accompany each procurement delivery to the construction site. Contractor shall maintain records of site receiving inspections. Defects, discrepancies, dispositions, and waivers shall be shown within the records.

1.3.2.5 Nonconforming Articles and Material Control:

Nonconformance discovered by the Contractor, subcontractors, suppliers or Government quality representatives shall be controlled to prevent their use and to correct deficient operations.

1.3.2.5.1 A “nonconformance” report shall be

prepared for each instance comprising: A unique and traceable number, identification of the nonconforming article or material, a description of the nonconformance and the applicable requirement, cause or reason for the nonconformance, remedial actions taken or recommended, and disposition of the nonconforming article or material.

1.3.2.5.2 Each nonconforming article shall be

identified and marked for removal from the work area.

1.3.2.6 Fabrication, Process, and Work Control: Contractor

shall establish in-process inspections to ensure compliance with quality requirements in contract specifications and drawings.

1.3.2.7 Quality Control Records: Quality control records

shall be maintained at a central on-site location. Maintenance of quality control records does not relieve the Contractor from submitting samples, test data, detail drawings, material certificates, or other information required by each section in the specification. Contractor shall ensure each record is identified and traceable to specific requirements in the specifications and drawings.

1.3.3 Quality Inspections.

1.3.3.1 Government Inspections: Work performed under this

contract will be subject to inspection by the Contracting Officer. Changes to the specifications or drawings will not be allowed without written authorization of the Contracting Officer. When the Contracting Officer determines that inspected work needs to be corrected, the Contracting Officer will be allowed 24 hours to complete re-inspection of the corrected work.

1.3.3.1.1 Contractor’s program is subject to

continuous evaluation, review, and verification by the Contracting Officer.

Contractor will be notified in writing of any noncompliance and will be given 3 working days to correct identified deficiencies.

1.3.3.2 Contractor’s Quality Inspections: Contractor shall

implement an inspection system that documents and indicates quality control through records of inspections, tests, and procedures, including a system of scheduled or random audits to ensure task completion. The following items shall be included in the Contractor’s Quality Assurance System:

1.3.3.2.1 A single Contractor’s representative

responsible for on-site communication and operation of the inspection program.

1.3.3.2.2 A purchasing control system documenting

project procurement to drawings, specifications, and approved submittals.

1.3.3.2.3 A receiving inspection system documenting

inspections for each procurement.

1.3.3.2.4 Documentation for handling and disposing

of nonconforming components and materials.

1.3.3.2.5 Inspection records for each specific

section of the specifications and drawings.

1.3.3.2.6 Identification of test(s) to be performed, test procedures, records and independent organizations use.

1.3.3.2.7 Documentation and maintenance

certification or re-certification of procedures.

1.3.3.2.8 Management of government-furnished

equipment, components, and materials.

1.3.3.2.9 Calibration of gages, tools, measuring

instruments and independent laboratories used.

1.3.4 Field Services

1.3.4.1 Responsibility for Inspection and Testing:

Contractor is responsible for all inspections and tests, and the accompanying documentation for each inspection and test. Contractor may utilize independent inspection and testing laboratories or services as approved by the Contracting Officer. Contractor is also responsible for tests of construction materials utilizing the services of an approved independent testing laboratory.

1.3.4.2 Inspection and test records: Contractor shall

provide on-site records of each inspection and test performed throughout the life of the contract including, but not limited to, factual evidence that the required inspections or tests have been performed, including type and number of inspections or tests involved, identification of operators and inspectors, result of inspections or tests, nature of defects, causes for rejection, proposed remedial action, and corrective actions taken. Inspection records, test procedures, test results, and associated forms shall be verified by and provided to the Contracting Officer.

1.4 HANDLING AND STORAGE

1.4.1 Contractor shall provide controls, procedures and

documentation with each shipment that meet requirements of each section of the specifications. Documentation shall consist of that required by the contract along with specifications required to identify, store, preserve, operate, and maintain the items shipped.

1.5 SEQUENCING AND SCHEDULING:

1.5.1 Contractor shall notify Government at least 24 hours prior to scheduled inspections and tests.

1.5.2 Contractor shall provide notice to the Government not less than 7 calendar days prior to contract work starting at the site. When Contractor suspends work for 7 calendar days or longer prior to completion of work, the Contractor shall notify the Contracting Officer. No work shall resume without notification of the Contracting Officer.

SECTION 01431

ENVIRONMENTAL PROTECTION

1.1 The Contractor shall perform all work in such manner as to minimize the polluting of air, water, or land, and shall, within reasonable limits, control noise and the disposal of solid waste materials, as well as other pollutants. Recycling of construction and demolition debris is required when economically advantageous.

1.2 IMPLEMENTATION: Within 20 calendar days after Notice to Proceed and prior to commencement of the work at the site, the Contractor shall:

1.2.1 Detail their proposal for implementing the requirements for environmental pollution control specified herein. Submit in accordance with the submittal table.

1.3 REFERENCES: The publications listed below form a part of this specification to the extent referenced. All references listed in these specifications are intended to be the current version or edition, unless specifically identified otherwise. The Contractor shall conform to the Occupational Safety & Health Act, Environmental Protection Agency, North Dakota Department of Health, U.S. Air Force and all other Federal, State and Local environmental regulatory requirements.

1.4 SUBMITTALS: In accordance with Section 01300: Submittals, the Contractor shall submit the following.

3. EXECUTION:

3.1 PERMITS AND FEES: No separate payment will be made for work covered under this section. The Contractor shall be responsible for payment of fees associated with environmental permits, application, and/or notices obtained by the Contractor. All costs associated with this section shall be included in the contract price. The Contractor shall be responsible for payment of all fines/fees for violation or non-compliance with Federal, State, Regional and local laws and regulations.

3.1.1 The Contractor shall be responsible for obtaining and complying with all environmental permits and commitments required by Federal, State, regional, and local environmental laws and regulations.

3.2 PROTECTION OF LAND AREAS: Except for work areas, storage areas, or access routes specifically assigned for the use of the Contractor under this contract, the land areas outside the limits of permanent work performed under this contract shall be preserved in their present condition. The Contractor shall confine his construction activities to areas defined for work on the plans or specifically assigned for his use. Storage and related areas and access routes required temporarily by the Contractor in the performance of the work will be assigned by the Contracting Officer.

3.3 WATER RESOURCES AND STORM WATER DISCHARGE: The Contractor shall monitor construction activities to prevent pollution of surface and ground waters. Toxic or hazardous chemicals shall not be applied to soil or vegetation unless otherwise indicated. The Contractor shall monitor all water areas affected by construction activities.

3.3.1 Protection of Water Resources: The Contractor shall control the disposal of fuels, oils, bitumen, calcium chloride, acids or harmful materials, both on and off the Government premises and shall comply with applicable federal, state, county and municipal laws concerning pollution of rivers, streams, and wetlands while performing work under this contract.

Special measures shall be taken to prevent chemicals, fuels, oils, greases, bituminous materials, herbicides, and insecticides from entering public waters. Water used in on-site material processing, concrete curing, foundation and concrete cleanup, and other waste waters shall not be allowed to reenter a stream if an increase in the turbidity of the stream could result therefrom.

3.3.2 Spill Prevention and Response Plan: The Contractor shall include a Spill Prevention and Response Plan in the Implementation Proposal.

The plan shall describe the Contractor's procedures for preventing and responding to spills of hazardous materials.

3.4 AIR QUALITY: Equipment operation, activities, or processes performed by the Contractor shall be in accordance with all Federal and State air emission and performance laws and standards.

3.4.1 Burning of material by the Contractor is not allowed.

3.4.2 Particulates: The contractor shall not operate a

construction site or demolition project unless reasonable precautions are taken to control emissions of particulate matter. Such emissions of airborne particulate matter shall not exceed 20% opacity as defined in 40 CFR 60 Appendix A.

3.4.3 Ozone Depleting Chemicals (ODCs): The contractor shall

ensure activities performed under this contract are in compliance with the Air Force Policy on ODCs. The contractor shall not purchase, use, or specify the use of any Class I ODC in the production, design, or maintenance of the end item. Class II ODCs may be used or specified only with the written approval of the Contracting Officer.

3.4.4 Dust Control: The Contractor shall maintain all

excavations, embankments, stockpiles, access roads, plant sites, waste areas, borrow areas, and all other work areas free from excess dust to such reasonable degree as to avoid causing a hazard or nuisance. Temporary methods consisting of sprinkling, chemical treatment, light bituminous treatment or similar methods will be permitted to control dust. Dust control shall be performed as the work proceeds and whenever a dust nuisance or hazard occurs.

3.5 TOXICS: The Contractor is responsible for ensuring that no employee is exposed to toxic materials like airborne asbestos, lead from lead base paint or polychlorinated biphenyls (PCB’s).

3.6 HAZARDOUS MATERIALS (HAZMAT): Contractors must obtain an

authorization prior to bringing any hazardous materials (Federal Standard 313) on Air Force installations. Contractors must submit all required documentation including appropriate Hazardous Materials Authorization Information Form, Material Safety Data Sheets (MSDS) and projected usage information to 5 CES/CEIE through the Contracting Officer at least 15 days before the HAZMAT is brought onto facilities within the Missile Field. This review is to ensure that no Air Force restricted hazardous materials are being proposed for use.

The contractor will comply with Federal Acquisition Regulation (FAR) 52.223-5.

Following contract award, the contractor shall provide the name and an initial volume of each hazardous material being used and its storage location.

Contractors shall provide 5 CES/CEIE with specific usage data on a monthly basis and a finalized usage report at project completion, as determined by the Installation Hazardous Materials Management Process (IHMMP) Team. Reports must include: name of material, manufacturer, NSN/Part #, container size, volume start balance, volume of material used in reporting period, storage location if it’s changed since initial reporting and the name and phone number of the reporting official. Reports shall be on letterhead paper, dated, and signed by the reporting official. Prime contractors shall be responsible for reporting hazardous material used by subcontractors. FAR 52.223-3 provides guidance on Hazardous Material Identification and Material Safety Data.

3.6.1 Emergency Planning and Community Right-to-Know Act (EPRCRA):

Contractors shall comply with the reporting provisions of EPCRA Sections 311, 312 and 313 during the life of the contract. Contractors shall provide a list of all hazardous materials procured, used and stored along with a current MSDS for each item, an initial inventory and a monthly or quarterly inventory.

Contractors shall provide the information to 5 CES/CEIE through the Contracting Officer. The inventory reporting period shall be determined by the installation Hazardous Materials Management Process Team.

3.6.2 The contractor shall maintain MSDSs for all hazardous materials used and the MSDSs shall be on file on site at the construction site office at all times. The contractor shall send 5 CES/CEIE an MSDS, via the Contracting Officer, for any new material not initially identified, the volume being brought on site, and its storage location. The MSDS shall be submitted to 5 CES/CEIE in accordance with paragraph 3.7.

3.6.3 Prior to completion of the contract, the contractor shall provide a finalized report of the actual quantities used during the contract, and remove any excess materials. Contractors may use excess materials on other projects and shall be responsible for proper disposal of any materials removed from job site.

3.6.4 All hazardous materials used by the contractor on U.S. Air Force property shall be stored properly in segregated areas in accordance with

01431-4 all regulatory and MAFB Fire Department requirements. Storage requirements shall include, but not be limited to:

3.6.4.1 Containers must be securely closed when not in use.

3.6.4.2 Containers must be labeled with appropriate warning

labels.

3.6.4.3 Storage area must be posted with hazardous signs as

required.

3.6.4.4 Storage must have secondary containment.

3.6.4.5 Contractor shall check at least weekly for leaks and

spills and maintain a log of the inspections.

3.6.4.6 Materials shall be stored in one central location.

3.6.4.7 Flammable items must be stored in an approved flammable storage locker and grounded as needed.

3.6.4.8 All fuel storage tanks and containers must have secondary containment.

3.6.5 Fuel and Lubricants. Storage, fueling and lubrication of equipment and motor vehicles shall be conducted in a manner that affords the maximum protection against spill and evaporation. Fuel, lubricants and oil shall be managed and stored in accordance with all Federal, State, and local laws and regulations. Used lubricants and used oil to be discarded shall be stored in marked corrosion-resistant containers and recycled or disposed in accordance with 40 CFR 279, State, and local laws and regulations. There shall be no storage of fuel on the project site. Fuel must be brought to the project site each day that work is performed.

3.7 GREEN PROCUREMENT: In compliance with the Affirmative Procurement requirements of Section 6002 of RCRA, Executive Orders 13423 and 13514, and the Federal Acquisition Regulations (FAR), the Government requires the use of recycled and recovered materials, and products identified in the Environmental Protection Agency’s Comprehensive Procurement Guidelines as much as practical.

3.7.1 These materials and products must meet the requirements of the specifications, must not delay the progress of the work, and must not be cost prohibitive.

3.7.2 EPA guideline items are seen as the minimum that should be considered when evaluating recycled/reused materials. Other materials and products not listed, but commonly used in industry outside of the government, should also be considered. FAR 52.211-5 provides guidance on recycled material usage versus virgin material usage.

3.7.3 Material and product submittals for all recycled-content items required will clearly show the recycled/recovered content for each material used, type of material, and total weight of material used.

3.7.4 Any decision not to acquire guideline items as required in the contract must be submitted in writing and approved by the Contracting Officer and 5 CES/CEIE. All purchases of guideline items must be verified by the Contracting Officer before contract closure.

3.7.5 Paper products such as government documents, agreements, contracts, etc. shall be printed on paper containing at least 30% post consumer materials per FAR 52.204-4. The use of recycled or bio-based containing products is strongly encouraged.

3.7.6 All contractually required documents and reports produced by or for the Air Force longer than two pages shall be double-sided per FAR 52.204- 4.

3.8 QUALIFIED RECYCLING PROGRAM (QRP): In compliance with 10 U.S.C.

§2577 and DoD Instruction 4715.4, Pollution Prevention, 6 Jul 1998, it is the intention of the Air Force to recycle at its installations.

3.8.1 Recycling/Reuse of Excess Materials and Construction and Demolition (C&D) Debris: The contractor shall reuse/recycle excess materials and C&D debris to the maximum extent possible. C&D debris are those excess/residue materials resulting from construction or demolition activity that would normally be discarded to a landfill. C&D debris includes, but is not limited to soil, rock, vegetation, concrete, and asphalt, if determined to be economical. All C&D debris resulting from demolition shall become the property of the contractor unless specified otherwise or as determined by the contracting officer.

3.8.2 Reporting Tonnage of C&D Debris: contractor shall track by month and report the tonnage of C&D debris in two categories:

3.8.2.1 Tons of C&D debris that is or will be recycled or reused.

3.8.2.2 Tons of C&D that is disposed in a landfill.

3.8.3 The C&D debris recycled/disposed tonnage report shall consist of a written memo with the tonnage of each category (recycled and disposed tonnage) submitted to 5 CES/CEIE through the contracting officer. Contractor shall submit C&D debris recycled and disposed tonnage report monthly until the project is completed.

3.8.4 Materials not to be returned to the Government and all

contractor generated rubbish, if not recycled, shall be disposed of by the contractor off-base at his own expense, and in compliance with applicable environmental codes and regulations of governing authorities.

3.9 HAZARDOUS WASTE PROCEDURES: All hazardous waste must be managed, handled, and disposed of in accordance with 40 Code of Federal Regulations (40 CFR) Parts 260-299 and the Minot AFB Hazardous Waste Management Plan.

3.9.1 The contractor is responsible for the proper

characterization, containerization, and disposal of all wastes generated from his operations, including RCRA hazardous, state-regulated, and spill cleanup wastes.

3.9.2 Contractors shall coordinate with 5 CES/CEIE for the

disposal of generated wastes at least 14 days before the project begins, and provide updates at least once per month throughout the entire project. Updates shall include the volume and type of waste generated, and storage location.

3.9.3 The contractor shall dispose of/recycle solid wastes (i.e.

non-hazardous) through local disposal or recycling facilities. No liquid wastes of any kind may be put into installation garbage collection containers, or poured into drains, sinks, toilets, or on the ground. Revenue received by the contractor from recycled solid wastes shall offset contract costs. The contractor shall coordinate disposal of RCRA hazardous, state-regulated and liquid wastes from government materials through 5 CES/CEIE via the Contracting Officer. The contractor shall be responsible for disposal of RCRA hazardous, state-regulated, liquid wastes and spill-cleanup wastes generated by contractor processes and from contractor-purchased materials. The contractor shall characterize, containerize, handle, manage and dispose of wastes in accordance with 40 CFR 260-299 and the installation Hazardous Waste Management Plan. The contractor is responsible for providing appropriate waste collection containers.

3.9.4 Contractors storing hazardous waste on site for more than 24 hours must follow the Minot AFB Hazardous Waste Management Plan. At a minimum, the contractor must establish a secure accumulation point, and appoint and train Hazardous Waste (HW) Managers. If more than 55 gallons of hazardous waste or more than 1 quart of acutely hazardous waste is generated then the contractor must obtain approval for and establish a 90 day accumulation site.

The contractor shall coordinate accumulation storage areas with 5 CES/CEIE via the Contracting Officer at least 2 weeks prior to establishing the storage area.

3.9.5 The contractor is responsible for all fines and penalties which may stem from an EPA or State of North Dakota Department of Health hazardous waste inspection of his operation.

3.9.6 Universal Wastes: All Universal Wastes, including

fluorescent light tubes and rechargeable batteries are considered hazardous waste if not recycled. Fluorescent tubes and rechargeable batteries are to be managed in compliance with 40 CFR Part 273, Universal Waste Rules, and sent to an EPA approved recycling center.

3.9.6.1 All rechargeable batteries shall be managed to prevent spills and leaks. Some types of lithium rechargeable batteries must be discharged before recycling. Batteries shall be segregated by type and the terminals taped over to prevent short circuiting and damage to the battery or its terminals. Alkaline batteries, in a quantity of 5 per day, may be disposed of in the trash.

3.9.6.2 Recycling must be performed at a qualified recycling

center that complies with 40 CFR 273 Subpart E standards for destination facilities. Upon completion of recycling, the Contractor must provide 5 CES/CEIE via the Contracting Officer with verification detailing the volume of each recycled material, date of recycling, and name and location of the recycler. Verification of recycling shall be made by a receipt from the recycling center and a cover letter from the contractor. The cover letter shall be on letterhead paper and signed by the project manager or other legal representative of the contractor.

3.9.6.3 The contractor may obtain guidance from the 5

CES/CEIE, 723-4825, on proper storage and handling of hazardous waste.

However, all responsibility rests with the contractor to comply with all federal and state hazardous waste requirements and any information obtained from 5 CES/CEIE does not remove responsibility from the contractor for proper waste management.

3.10 SOLID WASTES: The contractor is responsible for handling and disposal of all solid waste generated at the job site including laboratory testing and any documentation submittals required by the landfill owner.

3.10.1 Solid wastes (excluding clearing debris) shall be placed in containers that are emptied on a regular schedule. Handling, storage, and disposal shall be conducted to prevent contamination. Segregation measures shall be employed so that no hazardous or toxic waste will become co-mingled with solid waste. The Contractor shall transport solid waste off Government property and dispose of it in compliance with Federal, State, and local requirements for solid waste disposal. A Subtitle D RCRA permitted landfill shall be the minimum acceptable off-site solid waste disposal option. The Contractor shall verify that the selected transporters and disposal facilities have the necessary permits and licenses to operate.

3.10.2 Contractors are required to recycle solid waste generated from their work, including aluminum and other scrap metals, concrete, cardboard, newspaper and office paper. Documentation of recycled solid waste shall be submitted to 5 CES/CEIE via the Contracting Officer on a regular basis as determined by the installation Waste Program Manager. Recycling information shall include the volume and types of recycled materials, and name, phone number, and address of the recycling center. The information shall be written on the contractor’s letterhead paper and be signed by the project manager or other legal representative of the contractor.

3.10.3 The Contractor shall make all arrangements for disposal of any wastes including wastes requiring special handling such as asbestos and lead containing materials, rubble, sludge or non-hazardous chemical wastes.

3.10.4 Solid Waste Disposal Facilities: All non-hazardous wastes shall be properly disposed of through a licensed landfill or recycling center.

North Dakota Department of Health written approval is required for any non-inert materials such as asphalt containing materials, asphalt roofing materials, steel containing materials, etc that are to be disposed of in a Class III landfill site. No written approval is required if a Class II or Class IV landfill site is used for disposal of these non-inert materials.

3.10.4.1 Class IV landfills accept Group VI wastes which

include construction and demolition waste such as waste building materials, packaging, and rubble resulting from construction, remodeling, repair, and demolition operations on pavements (including asphalt waste), houses, commercial buildings, and other structures.

3.10.4.2 Regulated hazardous wastes are excluded from all

Class II, III and IV landfill sites. Class II landfill sites can receive any wastes acceptable at Class III and Class IV landfill sites in addition to municipal and household solid wastes such as garbage and putrescible organic materials.

3.10.4.3 No landfill site is available on Minot AFB.

Demolition rubble shall not be buried or placed upon the land anywhere on base or at the work site.

3.10.4.4 The cost for cleanup of improperly disposed wastes

and/or the costs for removals of improperly placed hazardous waste materials shall be the responsibility of the contractor.

3.10.4.5 Copies of all disposal documents and weight tickets

shall be furnished to the Contracting Officer and forwarded to 5 CES/CEIE.

3.10.5 Non-hazardous Solid Waste Diversion Report: The Contractor shall maintain an inventory of non-hazardous solid waste recycling and/or disposal of construction and demolition debris. The Contractor shall submit a report to 5 CES/CEIE through the Contracting Officer on a monthly or quarterly basis as determined by 5 CES/CEIE.

3.11 SPILLS AND SPILL RESPONSE PROCEDURES: Spills of any type material shall be reported immediately to 5 CES/CEIE, 732-4870 or 723-1964, for evaluation to determine if cleanup is required and evaluate the need for reporting to regulatory officials. At a minimum, the contractor shall report the date, time, volume, and location of the spill, and whether the spill entered the environment.

3.11.1 The contractor shall have on hand a clean-up kit that can handle spills of the single largest volume contained on the work site or 25 gallons, whichever is larger.

3.11.2 The contractor will be charged for any cleanups and

disposal costs accomplished by Minot AFB personnel.

3.11.3 All spill cleanups will be completed in accordance with the Minot AFB Integrated Hazardous Materials Emergency Response Plan and be handled by trained personnel only.

3.11.4 Any hazardous products or materials of environmental

concern cleaned up on Minot AFB facilities must be tested to determine if it is a hazardous waste.
