DIVISION 1 - GENERAL REQUIREMENTS
SECTION 01000
SPECIAL PROVISIONS
1. GENERAL:
1.1 DESCRIPTION OF WORK:
1.1.1 The following is a summary of work for QJVF 13-9002, Repair Pavements - IDIQ, located at Minot AFB ND. This project may include work in a restricted area. The Project shall include, but is not limited to:
1.1.1.1 Repair, replacement, and minor construction of
pavements, including sidewalks, roads, parking lots, and other paved surfaces.
The work includes both flexible (asphaltic) and portland cement based pavements.
1.1.1.2 Repair and replacement of storm sewer pipes, catch
basins and castings associated with pavement repair.
1.1.1.3 Specific description of the work is detailed in:
Specifications, Appendix A - Standard Details, and Drawings.
1.1.2 The above description of work is for the purpose of general information only and is not intended to include and describe every feature or item of work or to define the scope of work.
1.1.3 The estimated quantities listed for this contract are
approximated; the actual construction quantities at the completion of this contract will vary with these estimated quantities.
1.2 APPLICABLE PUBLICATIONS: Publications shall be of the most current date at the Invitation For Bid date.
2. PRODUCTS: The products to be used in the work under this contract are described in the other sections of these specifications.
3. EXECUTION:
3.1 TRAFFIC CONTROL: The Contractor shall provide all traffic control devices within the project limits, on all haul routes and on all detour routes. When necessary, sufficient barricades and signs shall be provided to prevent traffic from entering the construction area. The Contractor will be responsible for maintaining all areas of new construction until accepted by the Government. Temporary signs shall have the back and post painted to match

Federal Standard 595b, color 20040. The Contractor shall be solely responsible for furnishing, erecting, maintaining, and removing all protective barriers, signs, temporary lighting, etc., required for protection of persons and property.
3.1.1 For projects on the airfield, the Contractor will be
responsible for maintaining all fencing and fence openings during construction to deter human or animal intrusion into the airfield operating area. During contractor working hours all gates/opening in the fence will be manned, if open. No manning is required if the gates/openings are to remain closed and locked.
3.2 HAULING MATERIALS: Materials will be hauled in vehicles equipped with pneumatic tires. Hauling of materials shall comply with state and local regulations. Truck traffic will be restricted to haul routes on base. Haul routes will be designated at the preconstruction conference. The Contractor shall be responsible for establishing and maintaining off-base haul routes.
On-base haul routes shall be maintained such that a passenger vehicle may travel safely on it at all times. All construction traffic shall be confined to the designated haul routes. Dust shall be controlled to prevent creation of a nuisance in the surrounding area. Haul routes shall be restored to existing condition upon completion of the project at no additional cost to the Government. Any damage to base roads caused by construction traffic shall be repaired by the Contractor at no additional cost to the Government.
3.2.1 For any spill of hazardous material on base, immediately notify the Base Fire Department at 723-2461. The Contractor is responsible for all costs incurred by the Government in responding to or cleaning up any such spill.
3.3 EQUIPMENT PARKING: Space for the Contractor's equipment shall be determined at the pre-construction conference. The Government shall not be liable for the security of any of the Contractor's equipment while on MAFB.
3.4 DRAWINGS AND SPECIFICATIONS: At least one set of drawings and specifications shall be kept at the job site by each superintendent.
3.5 AS-BUILT DRAWINGS: The Contractor shall maintain a set of red-lined full scale, as-built construction drawings marked-up to fully indicate as-built conditions. These drawings shall be maintained in a current condition at all times until completion of the work and shall be available for review by Government personnel at all times. The location as dimensioned from permanent features, general description, type of material, and approximate depth below finished grade of all new and existing exterior underground utilities encountered shall be indicated. All variations from the contract drawings for the required coordination between trades, shall be indicated. These variations shall be shown in the same general detail utilized in the initial contract drawings. As-built construction drawings shall be furnished to the

Contracting Officer for use during the final inspection. The as-built drawings shall be submitted to the Contracting Officer in accordance with Section 01300: SUBMITTALS.
3.6 WORK CONDUCT, CORRELATION, EXECUTION, ETC.:
3.6.1 Work Performance: Contractor shall conduct all work, including materials distribution in an orderly manner, with minimum disturbance and inconvenience to traffic operations. Contractor shall confine and limit his personnel to only those areas required for work performance.
All work shall be performed in a neat, orderly fashion, with extreme care exercised to avoid damage to all property in and around project areas. Any damage caused by the Contractor shall be replaced, repaired, or restored at no cost to the Government. Upon completion, all work and equipment storage areas shall be cleaned of all evidence of Contractor's debris accumulations.
Contractor's proposed work schedule shall be coordinated with the Contracting Officer or his designated representative 30 days prior to the start of any work. All work areas shall be barricaded properly for day and nighttime vehicular safety warning.
3.6.2 Coordination: Any work that will be done in the Military Family Housing Area will require notification of work on roadways.
3.6.2.1 The housing occupants shall be notified in writing a
minimum of 30 days prior to beginning work on the roadway. This letter shall inform occupants of the anticipated duration of the limited access to units.
The letter shall also specifically state if the scope of the work will include the occupant's driveway or the sidewalk. Prior to notifying occupants, submit copies of the letter to the Contracting Officer for approval. A sample copy of the notification letter is located in Attachment 1.
3.6.3 Pay Request: Submit to the Contracting Officer AF Form 3052 with quantities of work completed per bid item signed by the Air Force’s representative, and by the Contractor’s representative.
3.6.3.1 When the pay item quantity is SY, SY-IN, SF, CY, and
LF the Contracting Manager and Contractor shall measure bid items together.
3.6.3.2 When the pay item quantity is in TONS, the Contractor will give the Contracting Manager Waybills and Delivery Tickets.
3.6.3.3 When the pay item is EA, The Contracting Manager and
the Contractor will count items together.
3.6.3.4 When the pay item is in Crew-Hr., the Contractor
shall submit quantity to the Contracting Officer for approval.

3.6.4 Storage: Material storage will not be allowed on base. On-base equipment storage may be allowed, but will be determined at the pre-construction conference. If on-base equipment storage is deemed necessary at the pre-construction conference, all equipment shall be moved to Contractor’s staging area at the close of each day’s operations. If Contractor should have equipment located on-base, it shall be removed, and staging area restored to its original condition within 14 days after completion of work.
3.7 QUALITY CONTROL: The Contractor shall provide a Quality Control Inspector who is familiar with all phases of operation. This individual shall be named and qualifications stated in the Quality Control Plan. The Quality Control Inspector's responsibility shall be to make constant quality control inspections of all phases of the operation, in order to assure constant compliance with the contract specifications. A Quality Control Plan shall be submitted to the Contracting Officer prior to the start of any work. This plan shall apply to all subsequent delivery orders.
3.8 PERMITS AND WORK CLEARANCES:
3.8.1 AF Form 103: The Contractor shall obtain from the contracting Officer's Technical Representative a copy of the AF Form 103, "Base Civil Engineering Clearance Request,” prior to the start of work.
3.8.2 AF Form 592: When any welding, cutting, brazing or use of any open flame device is to be used, an AF Form 592 permit must be obtained from the Base Fire Department (Building 896, 320 Flightline Drive) prior to beginning such work. During such work, a fully charged and operable fire extinguisher, appropriate for the task, shall be provided by the Contractor.
3.9 FIELD ENGINEERING: The Contractor shall provide field engineering services, by a licensed Land Surveyor to; establish grades, lines, levels, and storm drain data.
3.9.1 Grade Control: Grade site to drain. Protect site from
puddling or running water, or accumulation of standing water in excavations.
The Contractor shall provide all surveying required to establish and maintain line and grade stakes necessary to complete the construction.
3.10 SWEEP PAVEMENTS: Each section of pavement shall be cleaned prior to being opened to traffic; cleaning to include sweeping of the pavements and sidewalks.
3.11 DEWATERING: If water is encountered, the Contractor shall be responsible for dewatering the site. Soils affected by the water shall be dried to a workable moisture prior to work proceeding. If the area cannot be stabilized by drying, the Contractor shall replace unsuitable soils with select fill.

3.12 SAFETY:
3.12.1 Safety Requirements: Contractor will comply with all
OSHA/NEC requirements and MAFB Instruction 32-2001, Responsibilities of Base Personnel to Eliminate or Control Fire Hazards.
3.12.2 Radioactive Sources: Non-Air Force organizations bringing radioactive materials on Air Force installations or conducting operations using radioactive materials on Air Force installations must receive written approval by the Base Radiation Safety Officer (RSO), 5 MDOS/SGOAB, at 723-5151.
3.12.2.1 To get this approval, the non-Air Force organization must send a request to the installation RSO at least 30 calendar days before bringing the materials onto the installation.
3.12.2.2 Requests must be in writing and include:
3.12.2.2.1 A brief description of the proposed
activities.
3.12.2.2.2 A copy of a current Nuclear Regulatory
Commission (NRC) Agreement or State license with current NRC Form 241, REPORT
OF PROPOSED ACTIVITIES IN NON-AGREEMENT STATES, AREAS OF EXCLUSIVE FEDERAL
JURISDICTION, OR OFFSHORE WATERS. EXCEPTION: Contractors using generally licensed materials (e.g., certain NITON Lead Paint Analyzers) and DoE or DoE prime Contractors operating in accordance with 10 CFR Part 835 do not require an NRC license or NRC Form 241 for NARM.
3.12.2.2.3 The name, local address, and telephone
number for the responsible local representative and the name, address, and telephone number of the RSO named on their license.
3.12.2.2.4 A copy of that part of the Air Force
contract describing work to be done at the installation and the inclusive dates of the work.
3.12.2.2.5 An acknowledgement that the installation
RSO can make periodic checks to ensure that Contractor personnel follow radiation safety practices to prevent exposures to Air Force personnel and avoid contamination of Government property. In addition, the installation RSO must have authority to suspend Contractor operations believed to be unsafe.
3.12.3 Agreement State licensees using NRC regulated materials must supply a copy of the NRC Form 241 approved by the installation’s NRC Region according to 10 CFR Part 150.20. The form must specify the correct locations and dates of performance of licensed activities. State licensees may not work
01000-6 on Air Force or other installations where exclusive federal jurisdiction exists for more than 180 days per calendar year without first getting an NRC license.
3.12.4 Non-Air Force organizations that do not have an NRC or Agreement State license with current NRC Form 241 and who are not DoE or DoE prime Contractors exempted from licensing must contact AFMOA/SGOR for guidance and approval to use radioactive materials on an Air Force installation
3.12.5 Environmental Requirements: The Contractor shall meet with the appropriate environmental personnel from the 5th Civil Engineering Squadron prior to commencement of work. The Contractor shall contact the Natural Resources Management Element at 723-4826 or 723-2167 if they encounter contaminated soils.
3.12.5.1 All operations in which asbestos-cement pipe is
encountered shall be performed in strict compliance with the most stringent safety requirements or recommendations set forth by safety agencies having jurisdiction, or by recognized industry associations, so that exposure to asbestos fibers is minimized. Asbestos-cement pipe shall be separated at the joint. No sanding, grinding, or abrading will be permitted. The requirements or recommendations include but are not limited to all Federal and State Environmental and Air Quality laws and regulations as well as all Air Force and OSHA safety laws and regulations that govern the handling, removal, storage or disposal of asbestos containing materials.
3.12.6 Hazardous Materials: The Contractor shall comply with
federal, state and USAF regulations governing the procurement, use, management, and reporting of hazardous materials, including but not limited to the emergency Planning and Community Right-to-Know Act (EPCRA), the Pollution Prevention Act, Executive Order (EO) 13423, and Air Force Instruction (AFI) 32-7086.
The Contractor shall a a current material Safety Data Sheet (MSDS) IAW FAR Clause 52.223-3 for each hazardous material to be used in the performance of this contract. Hazardous materials include, but are not limited to, cleaners, bituminous products, cement/concrete, curing agents, compressed gas, lubricants, and aerosol products. The MSDS shall be submitted to the Natural Resources Management Element (5CES/CEAN) by way of the Contract Administrator at least 15 business days before the hazardous material is brought onto Minot AFB. 5 CES/CEAN shall notify the Contractor through the Contract Administrator if any of the requested hazardous materials contain banned chemicals. The Contractor shall procure and use environmentally preferable and/or biobased products as much as possible to complete this project.
The Contractor shall submit to 5 CES/CEAN through the Contract Administrator the following information for each hazardous material brought onto Minot AFB:

1) Product Name
2) Manufacturer of product
3) Container size/volume
4) Amount of each product
5) Storage location of each product
The Contractor shall submit this information on company letterhead signed by the project manager or another company representative at the beginning of the project. The Contractor shall keep track of the information and provide a quarterly report to 5 CES/CEAN the volume used of each hazardous material brought on Minot AFB. The Contractor shall not leave any of the hazardous materials behind without written permission from 5 CES/CEAN via the Contract Administrator. For any hazardous materials approved to remain on Minot AFB, the Contractor shall submit the above information on company letterhead signed by the project manager or other company representative, and include the name of the Shop representative accepting the hazardous material(s), their office symbol and phone number.
3.12.7 Hazardous Waste Identification and Disposal. The Contractor shall comply with federal, state and USAF regulations governing the generation, handling, management, and minimization of hazardous waste, including but not limited to, the Resource Conservation and Recovery Act (RCRA), the Pollution Prevention Act, North Dakota Administrative Code (NDAC) 33-24, EO 13423, AFI 32-7042, and the installation Hazardous Waste Management Plan.
The Contractor shall be responsible for disposing generated wastes from this project off-installation and IAW federal, state, local and Minot USAF environmental laws and regulations. The Contractor shall submit a copy of their waste manifests and Bills of Lading to 5 CES/CEAN via the Contract Administrator for any wastes disposed of directly from the installation property. The contractor shall also report the following information for wastes that are recycled or reused off installation.
1) Waste Name
2) Waste type
3) Volume Removed
4) Volume recycled/reused
5) Facility name and address where waste is recycled/reused
6) EPA Identification Number for RCRA Hazardous Wastes only The Contractor shall not report on any hazardous materials removed from Minot AFB that are then determined to be hazardous waste and disposed of by the Contractor.
3.12.8 Spills. The Contractor shall be able to clean up liquid spills of at least 1 gallon. In the case of large spills and emergency situations, the Contractor shall contact the Minot AFB Fire Department at 911.

The Contractor shall notify the Contract Administrator of all spills, and the following information relayed to 5 CES/CEAN at 723-4826 or 723-2167:
1) Location of Spill
2) Material spilled
3) Amount spilled
4) Date and time of spill
5) Whether spill flowed into a drain
6) Whether spill was cleaned up
7) Whether Minot AFB Fire Department was called
In the event a large volume is spilled and/or the Minot AFB Fire Department is contacted, the installation shall dispose of the spill clean-up materials.
The Contractor shall contact 5 CES/CEAN (723-2167) via the Contract Administrator to arrange pick-up of the spill clean-up materials.
3.13 WINTER EXCLUSION: The winter exclusion shall be from 1 November through 30 April. The roadway and/or parking lot shall be surfaced with new or existing pavement and open to traffic during the winter exclusion.
3.14 GOVERNMENT-CAUSED DELAYS:
3.14.1 Unscheduled Work Delays: In event of a missile movement or required generation, the Contractor will be required to vacate the area of all personnel, equipment, and materials for an indefinite period. The Contractor shall bid an hourly rate for these delays. The on-site supervisor shall notify the Contractor Administrator within 24 hours of the delay.
3.15 SECURITY REQUIREMENTS:
3.15.1 The Contractor shall be responsible for furnishing to each employee and for requiring each employee engaged on the work to display such identification as may be approved and directed by the Contracting Officer.
All prescribed identification shall immediately be delivered to the Contracting Officer, for cancellation upon release of any employees.
3.16 PERFORMANCE OF WORK:
3.16.1 Not less than 14 days prior to construction, submit a
proposed plan for routing traffic through or around the work site. This plan shall be included as a submittal on the AF Form 66, Schedule of Material Submittals.
3.16.2 While roads are under construction, access to base
facilities will be provided to the customers and workers; all other traffic will not be allowed through. Detour routes will be provided to the base populous in order to ensure traffic flow. The Contracting Officer may require
01000-9 the Contractor to perform the work in separate phases in order to accommodate traffic and allow access to specific buildings.
3.16.3 The performance period for each delivery order will be defined at the time of notification of work.
3.16.4 Provisions shall be made daily to allow refuse removal from base facilities.
3.16.5 Provisions shall be made daily to accommodate moving trucks.
3.16.6 Transitions from existing to new work must be smooth and gradual.
3.16.7 Any and all damage caused by the Contractor, directly or indirectly because of performance of this contract, will be fixed to the like condition prior to construction. The Contractor will inform the Contracting Officer prior to the final inspection of any and all such damages and repairs.
3.17 WORK SCHEDULE: Working hours for the Contractor will normally be between the hours of 7:30 a.m. and 8:00 p.m., excluding Sundays and federal holidays. If the Contractor desires to work during periods other than above, additional Government inspection forces may be required. The Contractor must make his/her request to the Contracting Officer three days in advance of his/her intention to work during other periods to allow assignment of additional inspection forces. If such force is reasonably available, the Contracting Officer may authorize the Contractor to perform work during periods other than normal duty hours/days. However, if inspectors are required to perform in excess of their normal duty hours/days solely for the benefit of the Contractor, the actual cost of inspection at overtime rates will be charged to the Contractor. These adjustments to the contract price may be made periodically as directed by the Contracting Officer.
3.18 GOVERNMENT ACCESS: The Government shall have access to borrow pits, stockpiles, asphalt plants, concrete plants, and testing facilities for inspection and sampling.
3.19 UTILITIES: Water and electricity required by the Contractor for the completion of the contract shall be provided by the Government at no cost to the Contractor.
3.20 UTILITY OUTAGES:
3.20.1 Any utility outages (gas, electricity, and water) requested by Contractor shall be submitted in writing no less than fifteen (15) calendar days prior to the proposed outage.

3.20.2 The Government reserves the right to reschedule the
Contractor’s proposed outage if deemed necessary.
3.20.3 In the event utility outages cannot be performed on any facility due to critical operation impact, the utility outages, and any related work shall be performed on non-duty hours.
3.20.4 The Contractor shall notify the Base Fire Department prior to shutdown of emergency utilities to a facility.
3.21 EXCESS MATERIALS: All materials resulting from demolition shall become the property of the Contractor unless specified otherwise or as determined by the Contracting Officer.
3.21.1 Materials determined to be Government property shall be deposited by the Contractor as directed by the Contracting Officer.
3.21.2 Materials not wanted by the Government and all Contractor-generated rubbish shall be disposed of by the Contractor off-base at his own expense, and in compliance with applicable environmental codes and regulations of governing authorities.
3.22 CLOSEOUT PROCEDURES:
3.22.1 When the Contractor considers the work to have reached final completion, submit written certification that the contract documents have been reviewed, the work has been inspected, and that the work is complete in accordance with the contract documents and ready for final inspection.
3.22.2 Provide the Contracting Officer with a requested date for final inspection, in writing, not less than 2 working days prior to the proposed date of final inspection. The Contracting Officer will coordinate with the members of the inspection party and establish the final inspection date. If construction deficiencies are identified, a request for reinspection must be given upon correction of the deficiencies.
3.23 RECYCLING/REUSE OF EXCESS MATERIALS AND CONSTRUCTION AND DEMOLITION
(C&D) DEBRIS: The Contractor shall reuse/recycle excess materials and Construction and Demolition (C&D) debris to the maximum extent possible. C&D debris are those excess/residue materials resulting from construction or demolition activity that would normally be discarded to a landfill. C&D debris includes but is not limited to soil, rock, vegetation, concrete, asphalt, and building materials such as window, wood, metal, and roofing materials. The Contractor shall recycle C&D debris and excess materials, if determined to be economical. All C&D debris resulting from demolition shall become the property of the Contractor unless specified otherwise or as determined by the Contracting Officer.

3.23.1 Materials not to be returned to the Government and all Contractor-generated rubbish, if not recycled, shall be disposed of by the Contractor off-base at his own expense, and in compliance with all applicable federal, state, and local environmental codes and regulations of governing authorities.
3.23.2 Reporting Tonnage of C&D Debris: Contractor shall track and report by month the tonnage of C&D debris in two categories:
3.23.2.1 Tons of C&D that is or will be recycled or reused.
3.23.2.2 Tons of C&D that is disposed in a landfill.
The C&D recycled/disposed tonnage report shall consist of a written memo with the tonnage of each category (recycled and disposed tonnage) submitted to 5 CES/CEAN through the Contracting Officer. Submit C&D recycled and disposed tonnage reports monthly on company letterhead and signed by the project manager or company representative.
3.24 ACC MILLINGS AS BASE COURSE: Government reserves the right to require ACC millings to be placed and compacted per Specification Section 02602, 3.9 in lieu of other base course material. No material shall be larger in diameter than 2-inches. Measurement and payment of ACC millings as base course work performed under this contract shall be by mass of compacted fill material, as measured in tons. For estimating purposes the unit weight of the ACC millings as base course will be calculated at 1.875 tons per compacted cubic yard.
4. WORK ON MISSILE ALERT FACILITY (MAF):
4.1 CONTRACTOR’S USE OF PREMISES: The MAF is under the control of and within the vicinity of the 91st Space Wing, Minot Air Force Base, North Dakota. The MAF is a continuously manned, secure installation. Specific security and access regulations apply. The general work areas are shown on the drawings. The Contractor shall conform to all requirements of MAFBI 31- 101 and AFSPCI 31-1101.
4.1.1 Owner occupancy: The site is an operational facility.
Contractor must adhere to all applicable United States Air Force (USAF) regulations and procedures regarding security, site access, inspection, and safety. Continued functional use of the sites by the USAF is required. The MAF control and security functions shall remain in operation.
4.1.2 Construction Operations: USAF controls the sites, the 25-foot perimeter area outside the security fence, and the access road easement.
Property outside the above defined areas is not under USAF control and the Contractor shall not trespass, but shall first obtain written permission from the landowner if necessary for equipment storage, stating the U.S. Government shall be held harmless from any damage caused by the Contractor during duty
01000-12 and non-duty hours for use of the private land. The Contractor shall be responsible for any negotiations concerning construction easement and storage of materials on private lands.
4.1.2.1 Contractor vehicles and equipment shall not be
allowed to park inside the security fence. Vehicles and equipment trailers shall be allowed on site during work performance only and shall not remain parked inside the security fence overnight. Vehicles may be parked along the access road but any such parked vehicles must be clear of the boundary fence by a minimum of 25 feet.
4.1.2.2 The Contractor may be permitted to store construction materials on site (with the approval of the Government inspector/escort). The Contractor shall be responsible for arranging for storage of all other construction equipment and materials during the course of the project.
4.1.2.3 Once equipment and supplies are brought inside the
fence, Government inspector/escort personnel are required to accompany and advise Contractor personnel in placement and removal of such items. The Government shall not be responsible for loss or damage of Contractor material, tools, or equipment.
4.1.2.4 The Contractor shall clean up the work area debris
and shall ensure the security of equipment, tools, and work/contract materials is accomplished before the end of each workday.
4.2 ENTRY AND SITE REGULATIONS:
4.2.1 ENTRY: In order to gain entry onto a facility, Contractor personnel must be listed on an Entry Authorization List (EAL), identified by Government inspector/escort personnel, and physically escorted on site by authorized Government inspector/personnel.
4.2.1.1 Twenty (20) working days prior to the initial
commencement of work, the Contractor must submit to the Contracting Officer a list showing the full name (EXACTLY as it appears on the ID), birth date, Social Security Account Number (SSAN), and two (2) forms of credentialed ID for each employee being utilized for on-site work (one of which must be photo). Only the following are acceptable: passport, state issued driver’s license, state issued photo identification, Social Security card, or Base identification (if issued for prior on-base work only). The Contractor must include with the EAL submittal a photocopy of all of the ID’s to be used. One of the forms of identification must have a SSAN on it. This list will be used to prepare the EAL referenced above. Foremen, supervisors, and superintendents must be identified as such on the Contractor's list for identification on the EAL. Deletions to the EAL may be made without preparing a new list but must be requested by the Contractor in writing. However, a new list must be submitted by the Contractor for any addition or change to the EAL. All requested changes in writing to an approved list submitted between
01000-13 the 1st and 15th of the month inclusive shall be in place by the end of that month. All requested changes in writing to an approved list submitted between the 16th and end of the month inclusive shall be in place by the 15th of the following month.
4.2.1.2 Upon arrival at the MAF, Contractor personnel will
contact the Flight Security Controller (FSC) using the gate intercom telephone and inform the FSC of their presence at the security gate. Contractor personnel must remain outside of the security fence and in or near their vehicle until the arrival of the Government inspector/escort.
4.2.1.3 Upon arrival, the Government inspector/escort will
identify and search all Contractor personnel. All Contractor personnel will provide the Government inspector/escort with two (2) forms of identification as listed above stating the employee’s full name and SSAN. These two forms of identification shall be the same two forms of ID used to generate the EAL.
The Contractor's vehicles will be checked and possibly searched prior to site entry. Contractor vehicles shall be clearly marked identifying each contracting firm.
4.2.1.4 If Contractor personnel are not listed on the EAL, or those who are listed cannot provide proper identification, they will not be permitted on the site. Delays caused by lack of proper EAL data or proper identification shall be at no cost to the Government.
4.2.1.5 Restricted Area. The work will be performed in a
restricted area. Therefore, the Contractor shall conform to all requirements of MAFBI 31-101 and AFSPCI 31-1101. Workers will be required to have an escort with them at all times. The Contractor shall allow 45 minutes each day for personnel to process on and off the work site that will not be considered delay time. The Contractor shall bid a crew hourly rate for any delays beyond the 30 minutes. This hourly rate will also apply to Government caused work stoppages when the entire work crew will be asked to evacuate the work area.
All site access delays must be reported by the Contractor, in writing, to the Contracting Officer within 24 hours of occurrence. All Government caused work stoppages must be documented by Government personnel at the time of occurrence and reported by the Contractor, in writing, to the Contracting Officer within 48 hours of occurrence.
4.2.2 SECURITY: The Contractor shall:
4.2.2.1 Protect all Government property.
4.2.2.2 Comply with base physical security regulations and
procedures.
4.2.2.3 The Government inspector/escort will be responsible
for on-site security.

4.2.2.3.1 While work is in progress, the Contractor
may be required to remove his personnel due to Alert status, real or exercise.
4.2.2.4 During all on-site work, the Contractor personnel
will be accompanied and continuously monitored by one (1) Government inspector/escort. Failure to remain within the area being monitored is a serious breach of security and safety regulations. The Contractor will take all necessary action to ensure compliance. The Contracting Officer reserves the right to deny entry to/or take action with any Contractor personnel who refuses to conform to security and/or safety regulations. Delays resulting from such entry denial shall not result in any cost to the Government or schedule delay.

SECTION 01300
SUBMITTALS
1.1 PROCEDURES:
1.1.1 The Contractor shall be required to submit items listed in the Submittal Schedule at the end of this section to the Contracting Officer for approval.
1.1.2 Transmit each item under AF 3000, Material Approval Submittal form. Identify contract number, project number, and Contractor. Identify section and paragraph reference for each item submitted with the AF 3000.
Submit five copies unless otherwise required elsewhere in the specification.
1.1.3 Unless specifically stated otherwise elsewhere in this
specification, each submittal shall be approved by the Contracting Officer prior to incorporation of materials into the work.
1.1.4 Approvals of submittals which do not conform to the contract shall not be construed as a change to the contract.
1.2 MANUFACTURER'S DATA AND SAMPLES: Where manufacturer's data and samples are required, submit in accordance with procedures identified in 1.1 above.
1.2.1 Manufacturer's Certification: Submit a statement from the product manufacturer that proposed products meet the specified standards and other salient characteristics identified as requirements in the specification.
1.3 TEST DATA: Test results shall be dated and signed by the agency performing the test.
1.4 MISCELLANEOUS SUBMITTALS: Submittals which are none of the above types shall meet the specific requirements identified in the referenced paragraph of the Specification Section identified in the schedule.
1.5 SUBMITTAL SCHEDULE: The following is a list of required submittals for this Contract and deadlines for their submittal.

ENVIRONMENT PROTECTION
1.1 The Contractor shall perform all work in such manner as to minimize the polluting of air, water, or land, and shall, within reasonable limits, control noise and the disposal of solid waste materials, as well as other pollutants.
1.2 IMPLEMENTATION: Within 20 calendar days after Notice to Proceed and prior to commencement of the work at the site, the Contractor shall:
1.2.1 Detail his proposal for implementing the requirements for environmental pollution control specified herein and submit to the Contracting Officer for approval.
2. PRODUCTS: Not used.
3. EXECUTION:
3.1 PRECONSTRUCTION SURVEY: Prior to start of any on-site construction activities, the Contractor shall make and submit to the Contracting Officer a condition survey after which the Contractor shall record on a layout plan the condition of trees, shrubs, and grassed areas immediately adjacent to the site of the work and adjacent to his assigned storage area and access route as applicable.
3.2 PROTECTION OF LAND AREAS: Except for work areas, equipment storage areas, or access routes specifically assigned for the use of the Contractor under this contract, the land areas outside the limits of permanent work performed under this contract shall be preserved in their present condition.
The Contractor shall confine his construction activities to areas defined for work on the plans or specifically assigned for his use. Storage and related areas and access routes required temporarily by the Contractor in the performance of the work will be assigned by the Contracting Officer.
3.3 PROTECTION OF TREES AND SHRUBS: Except for trees or shrubs marked on the plans to be removed, the Contractor shall not deface, injure or destroy trees or shrubs, nor remove or cut them without special authority. No ropes, cables, or guys shall be fastened to or attached to any existing nearby trees for anchorage.

3.3.1 Tree Protective Structures: Where, in the opinion of the Contracting Officer, trees may possibly be defaced, bruised, injured, or otherwise damaged by the Contractor's equipment or by his other operations, he may direct the Contractor to provide temporary protection of such trees by placing boards, planks, or poles around them.
3.3.2 Restoration of Damaged Trees: Any tree scarred or damaged by the Contractor's equipment or operations shall be restored as nearly as possible to its original condition at the Contractor's expense. All scars made on trees not designated on the plans to be removed by construction operations shall be coated as soon as possible with an approved tree wound dressing. Trees that are to remain, either within or outside established clearing limits, that are damaged by the Contractor so as to be beyond saving in the opinion of the Contracting Officer shall be immediately removed, if so directed, and replaced with a nursery-grown tree of the same species and size.
3.4. PROTECTION OF WATER RESOURCES: The Contractor shall control the disposal of fuels, oils, bitumens, calcium chloride, acids or harmful materials, both on and off the Government premises and shall comply with applicable federal, state, county and municipal laws concerning pollution of rivers, streams, and wetlands while performing work under this contract.
Special measures shall be taken to prevent chemicals, fuels, oils, greases, bituminous materials, herbicides, and insecticides from entering public waters. Water used in on-site material processing, concrete curing, foundation and concrete cleanup, and other waste waters shall not be allowed to reenter a stream if an increase in the turbidity of the stream could result therefrom.
3.4.1 Disposal of water generated during construction dewatering.
3.4.1.1 Dewatering of Groundwater: For temporary dewatering
of groundwater encountered during construction, the Contractor shall land apply all water generated in accordance with Paragraph: LAND APPLICATION.
3.4.1.1.1 Land Application: Land application shall
follow state requirements; however, no permit will be necessary. "Land application" implies that the Contractor shall discharge water at a rate which allows the water to percolate into the soil. No sheeting action, soil erosion, discharge into storm sewers, defined drainage areas, or discharge into the "waters of the State" shall occur. The Contractor shall contact the State of North Dakota, Division of Water Quality and Permit Program, to discuss the water quality parameters for chemical contaminants (such as chlorine), oil, grease, and total suspended solids and shall ensure that all water intended for land application will meet the state requirements.

3.5 WASTE DISPOSAL: As part of his proposed implementation under paragraph 1.2, and prior to on-site construction, the Contractor shall submit a description of his scheme for handling and disposing of all waste resulting from the work under this contract. If any waste is dumped in unauthorized areas, the Contractor shall remove the waste and restore the area to the condition of the adjacent undisturbed areas. Where directed, soil which is contaminated by the Contractor shall be excavated, disposed of as approved by the Contracting Officer, and replaced with suitable fill material, all at the expense of the Contractor.
3.6 BURNING: Burning shall be prohibited on the Government premises.
3.7 DUST CONTROL: The Contractor shall maintain all excavations, embankments, stockpiles, access roads, plant sites, waste areas, borrow areas, and all other work areas free from excess dust to such reasonable degree as to avoid causing a hazard or nuisance. Temporary methods consisting of sprinkling, chemical treatment, light bituminous treatment or similar methods will be permitted to control dust. Dust control shall be performed as the work proceeds and whenever a dust nuisance or hazard occurs.
3.8 EROSION AND SEDIMENT CONTROL: The Contractor shall be responsible for providing erosion and sediment control measures in accordance with local, state, and federal regulations. The erosion and sediment controls selected and maintained by the Contractor shall be such that local, state, and federal water quality standards are not violated as a result of the Contractor's construction activities. The area of bare soil exposed at any one time by construction operations should be held to a minimum. For areas subject to erosion including, but not limited to, steep slopes, soils spreading areas, and stockpile areas, the Contractor shall disturb as little vegetation as possible, minimize the period of time that the soil is exposed, prevent surface water runoff from flowing across disturbed areas, stabilize disturbed soils as soon as possible, and provide adequate drainage for the increased runoff. Sedimentation/erosion control features may include, but not be limited to, vegetation cover, stream bank stabilization, slope stabilization construction of terraces, interceptor channels, sediment traps, inlet and outfall protection, diversion channels, and sedimentation basins. Runoff management practices should be employed in areas where the potential for storm water contamination exists that can not be addressed by a prevention or source reduction measure. Runoff management procedures may include vegetative swales, reuse of collected storm water, infiltration devices, and detention/sedimentation basins. Any erosion and sediment control measures which are damaged or found to be ineffective shall be remedied by the Contractor at no additional cost to the Government. Any areas damaged by erosion shall be repaired by the Contractor at no additional cost to the Government.

3.9 CORRECTIVE ACTION: The Contractor shall, upon receipt of a notice in writing of any noncompliance with the foregoing provisions, take immediate corrective action. If the Contractor fails or refuses to comply promptly, the Contracting Officer may issue an order stopping all or part of the work until satisfactory corrective action has been taken. No part of the time lost due to any such stop orders shall be made the subject of a claim for extension of time or for excess costs of damages by the Contractor unless it is later determined that the Contractor was in compliance.
3.10 POST-CONSTRUCTION CLEANUP OR OBLITERATION: The Contractor shall, unless otherwise instructed in writing by the Contracting Officer, obliterate all signs of temporary construction facilities such as haul roads, work areas, structures, foundations of temporary structures, stockpiles of excess or waste materials, and other vestiges of construction prior to final acceptance of the work.
