NAVAIR FIRE EXTINGUISHER SERVICE

1. Location of Work: All Work described in this Performance Work Statement (PWS) shall be performed at the Lakehurst Site of Joint Base McGuire Dix Lakehurst (JB-MDL) in all NAVAIR owned facilities. Work is to be accomplished on location at each facility.
1.1 See Attachment 1 FIRE EXTINGUISHER LIST FOR NAVAIR:
2. Description of Work: The work consists of furnishing all labor, equipment, materials, and related items necessary to purchase and install new fire extinguishers and perform annual maintenance and four year maintenance on 10lb. and 20lb. stored pressure chemical fire extinguishers. All work shall be IAW (in accordance with) National Fire Protection Association (NFPA) Standard 10, Standard for Portable Fire Extinguishers, current Edition.
2.1. Emergency or After-Hour Call-Outs: There will be no after-hour call-outs. If an extinguisher is discharged the occupant will be advised to contact the contractor during the next business or duty day.
3. Inspections and Servicing Tasks:
3.1. General: Visual inspections and servicing tasks shall be performed, on base, at location requested by facility occupant IAW the requirements of the NFPA 10, Standard for Portable Fire Extinguishers. If work cannot be accomplished on site, the contractor shall furnish replacement extinguishers that remain current with NFPA 10 standards until occupant units are returned to service.
3.2. Annual Maintenance: Visual inspections, tests, and maintenance to be performed on each system shall include, but is not limited to Table I.1(a), Mechanical Parts Maintenance Checklist, and applicable sections of Chapter 7 found in NFPA 10, Standard for Portable Fire Extinguishers, current Edition.
3.3. Four-Year Maintenance Procedures: Visual inspections, tests, and maintenance to be performed on each system shall include, but is not limited to Table I.1(a), Mechanical Parts Maintenance Checklist, Table I.1(b), Agent and Expelling Means Maintenance Checklist, and applicable sections of Chapter 7 found in NFPA 10, Standard for Portable Fire Extinguishers, current Edition.
3.4. Hydrostatic Testing/Maintenance Procedures: Hydrostatic Tests/Maintenance will be accomplished on cost comparison basis. If it’s less expensive to purchase a new extinguisher, rather than having a hydrostatic test/maintenance, the facility occupant will be so advised by the contractor to purchase a new unit of equal size/type.
4. Inspection Report: The contractor shall maintain records of all maintenance procedures on all fire extinguishers, and shall provide documentation upon request from the Base Fire FOR OFFICIAL USE
Department. The contractor shall use, at a minimum, the extinguishers full serial number and building number where located for identification purposes.
5. Replacement of Extinguishers: Contractor shall supply, as needed, new 10lb and 20lb extinguishers in place of extinguishers that have exceeded their service life.
6. Schedule: The contractor shall service fire extinguishers as scheduled in coordination with the facility occupant. This service shall be made available all week days, excluding nationally/Federal recognized holidays. The contractor shall provide an inspection/maintenance schedule.

6.1.1. On work days that have been declared “family days,” or “down days” the Base may be minimally manned with many offices and facilities closed. On these days, the POC shall ensure that the contractor has access to the work site. However, if the POC or another government representative will not be on duty, arrangements shall be made with contractor personnel to make up any hours not worked or missed due to the “family or down day.” The contractor does not get “family days or down days” off; they are not holidays.
NOTE: Any of the above holidays falling on a Saturday will be observed on the preceding Friday.
Holidays falling on a Sunday will be observed on the following Monday.
6.2. SPECIAL QUALIFICATIONS. Contractor personnel shall be certified by the appropriate federal and state regulatory agencies to meet federal and local certification requirements in the inspection, maintenance/repair and servicing of fire extinguishers.
6.3. CONTINUATION OF ESSENTIAL DOD CONTRACTOR SERVICES DURING
CRISIS, IAW DOD INSTRUCTION 3020.37—
6.3.1. All services or any specifically designated portions of the functions accomplished under this contract shall be performed during any wartime operations. Wartime operations are those actions, including contingency planning, which would be required to support current or future
United States Air Force wartime requirements. Functions that will be continued during wartime-related contingencies include all work required under this PWS.
6.3.2. The CO or the POC shall notify the contractor of a crisis by any means of communication.
There shall be no costs paid by the Government to the contractor during a crisis except those incurred for work performed under this PWS. Notwithstanding any other provision of this contract, the contractor agrees that, in the event of the occurrence of any wartime-related contingency, the government shall have the unilateral right to extend performance of this contract as long as the wartime contingency(ies) exist. Contract payment will be in accordance with the existing contract rate.
6.3.3. The government representative shall inform the contractor within 24 hours when a contingency or crisis exist by email, in person or by telephone.
6.3.4. The contractor shall provide the names of employees to the Joint Base McGuire-Dix- Lakehurst AFB Force Protection Personnel to allow for access to the base during times of contingencies or crises; a copy of this documentation must be provided to the CO.

8. RECORDS MANAGEMENT REQUIREMENTS.
8.1. The service provider shall ensure all records (according to Title 44, United States Code, Public Printing and Documents, Section 3301, include all books, papers, maps, photographs, machine readable materials, or other documentary materials, regardless of physical form or characteristics), files, documents and working papers provided by the Government, and/or generated for the Government in the performance of this contract, remain Government property and are maintained in accordance with established Federal Records Act (Public Law 81-754), Freedom of Information Act (Public Law 90-23), Privacy Act of 1974 (Public Law 93-529), (DoD), and Air Force directives listed in this PWS.

52.212-3 OFFEROR REPRESENTATIONS AND CERTIFICATIONS--COMMERCIAL ITEMS (MAY 2014)
An offeror shall complete only paragraph (b) of this provision if the offeror has completed the annual representations and certifications electronically via http://www.acquisition.gov. If an offeror has not completed the annual representations and certifications electronically at the System for Award Management (SAM) website, the offeror shall complete only paragraphs (c) through (o) of this provision.
(a) Definitions. As used in this provision --
“Economically disadvantaged women-owned small business (EDWOSB) Concern” means a small business concern that is at least 51 percent directly and unconditionally owned by, and the management and daily business operations of which are controlled by, one or more women who are citizens of the United States and who are economically disadvantaged in accordance with 13 CFR part 127. It automatically qualifies as a women-owned small business eligible under the WOSB Program.
"Forced or indentured child labor" means all work or service-
(1) Exacted from any person under the age of 18 under the menace of any penalty for its nonperformance and for which the worker does not offer himself voluntarily; or
(2) Performed by any person under the age of 18 pursuant to a contract the enforcement of which can be accomplished by process or penalties.
Inverted domestic corporation, as used in this section, means a foreign incorporated entity which is treated as an inverted domestic corporation under 6 U.S.C. 395(b), i.e., a corporation that used to be incorporated in the United States, or used to be a partnership in the United States, but now is incorporated in a foreign country, or is a subsidiary whose parent corporation is incorporated in a foreign country, that meets the criteria specified in 6 U.S.C.
395(b), applied in accordance with the rules and definitions of 6 U.S.C. 395(c). An inverted domestic corporation as herein defined does not meet the definition of an inverted domestic corporation as defined by the Internal Revenue Code at 26 U.S.C. 7874.
Manufactured end product means any end product in Federal Supply Classes (FSC) 1000-9999, except--
(1) FSC 5510, Lumber and Related Basic Wood Materials;
(2) Federal Supply Group (FSG) 87, Agricultural Supplies;
(3) FSG 88, Live Animals;
(4) FSG 89, Food and Related Consumables;
(5) FSC 9410, Crude Grades of Plant Materials;
(6) FSC 9430, Miscellaneous Crude Animal Products, Inedible;
(7) FSC 9440, Miscellaneous Crude Agricultural and Forestry Products;
(8) FSC 9610, Ores;
(9) FSC 9620, Minerals, Natural and Synthetic; and
(10) FSC 9630, Additive Metal Materials.
Place of manufacture means the place where an end product is assembled out of components, or otherwise made or processed from raw materials into the finished product that is to be provided to the Government. If a product is disassembled and reassembled, the place of reassembly is not the place of manufacture. FOR OFFICIAL USE http://www.acquisition.gov/
Restricted business operations means business operations in Sudan that include power production activities, mineral extraction activities, oil-related activities, or the production of military equipment, as those terms are defined in the Sudan Accountability and Divestment Act of 2007 (Pub. L. 110-174). Restricted business operations do not include business operations that the person (as that term is defined in Section 2 of the Sudan Accountability and Divestment Act of 2007) conducting the business can demonstrate--
(1) Are conducted under contract directly and exclusively with the regional government of southern Sudan;
(2) Are conducted pursuant to specific authorization from the Office of Foreign Assets Control in the Department of the Treasury, or are expressly exempted under Federal law from the requirement to be conducted under such authorization;
(3) Consist of providing goods or services to marginalized populations of Sudan;
(4) Consist of providing goods or services to an internationally recognized peacekeeping force or humanitarian organization;
(5) Consist of providing goods or services that are used only to promote health or education; or
(6) Have been voluntarily suspended.
Sensitive technology--
(1) Means hardware, software, telecommunications equipment, or any other technology that is to be used specifically--
(i) To restrict the free flow of unbiased information in Iran; or
(ii) To disrupt, monitor, or otherwise restrict speech of the people of Iran; and
(2) Does not include information or informational materials the export of which the President does not have the authority to regulate or prohibit pursuant to section 203(b)(3) of the International Emergency Economic Powers Act (50 U.S.C. 1702(b)(3)).
Service-disabled veteran-owned small business concern--
(1) Means a small business concern--
(i) Not less than 51 percent of which is owned by one or more service-disabled veterans or, in the case of any publicly owned business, not less than 51 percent of the stock of which is owned by one or more service-disabled veterans; and
(ii) The management and daily business operations of which are controlled by one or more service-disabled veterans or, in the case of a service-disabled veteran with permanent and severe disability, the spouse or permanent caregiver of such veteran.
(2) Service-disabled veteran means a veteran, as defined in 38 U.S.C. 101(2), with a disability that is service-connected, as defined in 38 U.S.C. 101(16).
"Small business concern" means a concern, including its affiliates, that is independently owned and operated, not dominant in the field of operation in which it is bidding on Government contracts, and qualified as a small business under the criteria in 13 CFR Part 121 and size standards in this solicitation.
Subsidiary means an entity in which more than 50 percent of the entity is owned-- FOR OFFICIAL USE
(1) Directly by a parent corporation; or
(2) Through another subsidiary of a parent corporation.
Veteran-owned small business concern means a small business concern--
(1) Not less than 51 percent of which is owned by one or more veterans (as defined at 38 U.S.C. 101(2)) or, in the case of any publicly owned business, not less than 51 percent of the stock of which is owned by one or more veterans; and
