JUSTIFICATION FOR OTHER THAN
FULL AND OPEN COMPETITION
I. CONTRACTING ACTIVITY
Department of Air Force, 1st Special Operations Contracting Squadron, Hurlburt Field, FL. This document serves as a Justification for Other Than Full and Open Competition. The purchase request number is F2F3256203AW01.
II. NATURE AND/OR DESCRIPTION OF THE ACTION BEING PROCESSED
This action will be awarded as a sole source, firm fixed price purchase order. The notice will be posted to the Federal Business Opportunities (FBO) Government point of entry website at http://www.fedbizopps.gov in accordance with Federal Acquisition Regulation (FAR) part 5.301(d). A purchase order will be executed between Inner-vision Security and the United States Government.
III. DESCRIPTION OF THE SUPPLIES/SERVICES REQUIRED TO MEET THE
AGENCY’S NEEDS
Under the contemplated contract, Inner-vision Security will provide two (2) NOVO 15 Tactical Backpack Systems.
The NOVO 15 is a light weight Tactical Backpack system used to identify hazardous devices during Force Protection Missions. Below are the components this system includes.
NOVO 15WS Flat Panel Detector Panasonic™ Toughpad FZ-G1 Tablet (10") NOVO Touch Standard Software Control Box with Built-in Wireless and LED Light Control Box Charger Wireless Ranger USB 20m Communication Cable Detector to Control Box Cable Detector Stand USB to Comm Adapter Control Box to Golden 5 Pin Cable Pelican S115 Custom Backpack Pelican iM2750 Travel Case
This product is an x-ray system that can withstand use in any operating environment, is easily man portable for dismounted operations, and gives the user the most detailed diagnostic feedback http://www.fedbizopps.gov/
The NOVO incorporates a ruggedized mil spec tablet, is the thinnest lightest detector, provides the highest image quality available, can run parallel multi-location control and display units, has a simple 1 touch software interface, and allows integration with any robotic platform.
IV. STATUTORY AUTHORITY PERMITTING OTHER THAN FULL AND OPEN
COMPETITION.
Procurement under the contract will be conducted on a sole-source basis in accordance with the statutory authority 10 U.S.C. 2304(c)(1) and implemented by FAR 13.501(a); only one source is capable of providing the supplies required at the level of quality required because the supplies are unique or highly specialized.
V. DEMONSTRATION THAT THE CONTRACTOR’S UNIQUE
QUALIFICATIONS OR NATURE OF THE ACQUISITION REQUIRES THE USE OF
THE AUTHORITY CITED ABOVE (APPLICABILITY OF AUTHORITY)
The NOVO 15 is the only product on the market that provides all of the requirements identified in paragraph III, specifically the mobility aspect of the system for dismounted operations, the image quality and diagnosing features decreasing safety risks, and the fact that the system incorporates a drop tested toughbook. There are no other systems or manufacturers products that provide these features and functions. The NOVO 15 provides the newest radiographic technology available to the EOD community.
Additionally, the ability to run parallel multi-location controls and display the information received in multiple areas allows the EOD team leader to make fewer approaches on the device, increasing safety and decreasing critical time or target.
There are no other products on the market that provide the Radiographic capabilities needed by the Government.
VI. DESCRIPTION OF EFFORTS MADE TO ENSURE THAT OFFERS ARE
SOLICITED FROM AS MANY POTENTIAL SOURCES AS DEEMED PRACTICABLE
A sources sought synopsis was issued on 21 July 2016 via Federal Business Opportunities seeking potential/interested vendors for the products listed in paragraph III of this justification.
No responses were received.
VII. DETERMINATION BY THE CONTRACTING OFFICER THAT THE
ANTICIPATED COST TO THE GOVERNMENT WILL BE FAIR AND REASONABLE
The anticipated cost will be considered fair and reasonable based on a comparison with similar items in a related industry, market research, and comparison of proposed price with prices found reasonable on previous purchases.
VIII. DESCRIPTION OF THE MARKET RESEARCH CONDUCTED AND THE
RESULTS, OR A STATEMENT OF THE REASONS MARKET RESEARCH WAS NOT
CONDUCTED
1 SOCONS recently awarded a contract for a slightly larger NOVO system with the same radiographic capabilities associated with this purchase. Significant market research was conducted for this purchase utilizing Easy Search website, EZQuery, Electronic Document Access search, Google search, and the Procurement Desktop Defense search. A sources sought was issued for this previous purchase in which one vendor other than Innervision Security responded. Upon reviewing their product information it did not provide the capabilities needed.
Specifically the system did not provide a ruggedized table, multi-location control and display units, long lasting battery life, integration with any robotic platform (specifically the three utilized at Hurlburt Field: Irobot, Remotec and Talon), or the 400M wireless range capabilities.
In addition to the sources sought issued on the previous purchase, vendors found providing x-ray/radiographic products were contacted by the Contracting Office; however, those reached indicated they were not able to meet the Governments requirements.
As a final attempt to promote competition, salient characteristics were obtained by the EOD team so that a Solicitation could be issued on a brand name or equal basis. A combined synopsis/solicitation was published on Federal Business Opportunities and only one quote was received from Test Equipment Distributors, LLC DBA Innervision Security.
IX. ANY OTHER FACTS SUPPORTING THE USE OF OTHER THAN FULL AND
OPEN COMPETITION
Utilizing the NOVO for base support operations allows the user to use the same operating software in both CONUS and OCONUS operations which provides the easiest transition for the operator.
X. LIST OF SOURCES, IF ANY, THAT EXPRESSED INTEREST IN THE
ACQUISITION
See Paragraph VI above.
XI. A STATEMENT OF THE ACTIONS, IF ANY, THE AGENCY MAY TAKE TO
REMOVE OR OVERCOME ANY BARRIERS TO COMPETITION BEFORE MAKING
SUBSEQUENT ACQUISITIONS FOR THE SUPPLIES OR SERVICES REQUIRED
Through every available means, 1 SOCES/EOD will continue to monitor market information and technical publications to determine whether any other source can meet our needs. In addition, minimum requirements for any future requirements as described herein will be shared with industry to encourage other manufacturers to begin producing similar compatible products.
Additionally, as with this purchase and the previous purchase completed less than 30 days ago;
1 SOCONS will continue to issue sources sought notices for future requirements to determine if new products or technology are available that meet the Governments requirements.
XII. CONTRACTING OFFICER’S CERTIFICATION
The contracting officer’s signature on the Coordination and Approval Document evidences that he/she has determined this document to be both accurate and complete to the best of his/her knowledge and belief.
XIII. TECHNICAL/REQUIREMENTS PERSONNEL’S CERTIFICATION
As evidenced by their signatures on the Coordination and Approval Document, the technical and/or requirements personnel have certified that any supporting data contained herein, which is their responsibility, is both accurate and complete.
