52.212-1 ADDENDUM
ADDENDUM TO 52.212-1—(Instructions to Offerors-Commercial Items) Addenda to 52.212-1(b), Submission of Offers. The paragraph is tailored as follows:
1.Paragraph (b) (10) is deleted in its entirety and replaced with paragraph B below under “Addenda to 52.212-1.
Addendum to 52.212-1(c), Period for Acceptance of Offers. The paragraph is tailored as follows: “The offeror agrees to hold the prices in its offer firm for 120 calendar days from the date specified for receipt of offers.”
Addenda to 52.212-1(e), Multiple Offers. This paragraph is deleted in its entirety.
Addenda to 52.212-1(h), Multiple Awards. This paragraph is deleted in its entirety.
ADDENDA TO 52.212-1 (continued)
Proposal Preparation Instructions:
A. To assure timely and equitable evaluations of offers, offerors must follow the instructions contained herein. Offerors are required to meet all certifications and technical requirements. Failure to meet a requirement may result in an offer being ineligible for award. Taking exceptions to any provision in the solicitation will render the proposal ineligible for award. The proposal in response to this solicitation will consist of (2) two separate parts; Vol. I, “Technical Proposal” and Vol II, “Price Proposal”. Page size shall be 8.5” x 11” and the font size shall be no less than 10 point. Technical Proposal is limited to 1 page in length. The offeror must submit an explicit statement that they take no exceptions to the solicitation statement. Failure to submit that statement will render the offer technically unacceptable and ineligible for award in the absence of discussions.
To be considered, the complete proposal must received by 802d CONS – Front Desk not later than 12:30 PM Central Standard Time on 28 June 13 at 802 CONS/LGCB-F, Attn: Ms. Susan Edwards, 1655 Selfridge Avenue, Joint Base San Antonio - Lackland TX 78236-5253. Offers received after 12:30 PM Central Standard Time on 28 June 13 will be late and will handled in accordance with 52.212-1 paragraph (f). All offers must be in English. Fax or email offers will also be considered. The fax number is 210-671-1433. If faxed, the agency must receive the entire fax by the deadline for submission of offer. If emailed, the offer must arrive in the email box of susan.edwards@us.af.mil by the deadline for submission of offers.
B. Representations and Certifications
The offeror’s proposal shall include a signed copy of the Representation and Certifications. The Offeror may complete its Representations & Certifications in the new website “System for Award Management Registration” SAM https://www.sam.gov (previously referred to ORCA) in lieu of completing the representations and certifications included in the solicitation (http://www.acquisition.gov)
C. Price
a. Complete blocks 12, 17a, and 30a, b, and c of the SF1449. In doing so, the offeror accedes to the contract terms and conditions as written in the SOLICITATION, with attachments.
b. Insert proposed unit and extended prices in the Pricing Schedule. The extended amount must equal the whole dollar unit price multiplied by the number of units. Failure to fill in all space for unit and total CLIN prices in the Pricing Schedule will render the Offer unacceptable and the Agency will not consider the Offer for award in absence of discussions.
c. Complete the necessary fill-ins and certifications in provisions. The provisions FAR 52.212-3 shall be returned along with the proposal.
52.212-2 EVALUATION--COMMERCIAL ITEMS (JAN 1999)
(a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The government intends to award without discussions but reserves the right to conduct discussions if deemed necessary. The following factors shall be used to evaluate offers:
1. Price: this requirement is being solicited on a lowest priced, technically acceptable basis. An offeror’s proposed estimated prices will be determined by multiplying the estimated quantities identified in the bid schedule by the proposed unit price for each CLIN to determine the extended amount for each CLIN. Estimated totals for each CLIN wil then be totaled to determine the estimated price for each offeror. The price evaluation will document reasonableness of the proposed total evaluated price. The Government may determine that an offer is unacceptable if unit prices or option prices are significatnlty unbalanced. An offeror’s proposal may be rejected if the Contracting Officer determines that the lack of balance poses an unacceptable risk to the Government.
2. TechnicallyAcceptable: the Government will evaluate all timely proposals for technical acceptability starting with the lowest priced proposal submitted. To be eligible for award an offer must be technically acceptable. Any proposals found to be technically unacceptable are ineleigible for award. The Government will determine a proposal to be technically acceptable if the offeror takes no exception to the PWS or terms and conditions of the solicitation. If the lowest priced proposal is found to be technically unacceptable, the Government will then evaluate the next lowest proposal; the Government will proceed in this fashion until a proposal is evaluated and found to be technically acceptable, the evaluation will stop at that point and the government will award to that offeror as it represents the best value under the basis of award.
(b) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.
