JUSTIFICATION FOR OTHER THAN

FULL AND OPEN COMPETITION

I. CONTRACTING ACTIVITY

Agency: United States Air Force Activity: 17th Contracting Squadron, Base Operations Flight, Goodfellow AFB, TX

This is a Justification for Other than Full and Open Competition, Brand Name.

Purchase Request Number F1Z5044119A001 has an estimated value of and will be acquired through the use of Investment Equipment (3080) Funds in FY 14.

II. NATURE AND/OR DESCRIPTION OF THE ACTION BEING PROCESSED

This requirement will be procured with a firm fixed priced purchase order to purchase the trainers and related installation under FAR 12 Commercial procedures.

III. DESCRIPTION OF THE SUPPLIES/SERVICES REQUIRED TO MEET THE

AGENCY’S NEEDS

The 312 Training Squadron (TRS) requires the procurement and related installation of Kidde brand burn trainers. This purchase will replace existing liquid propane fed trainers with positive pilot system (vapor propane) trainers. This new technology prevents unburned gas from collecting and will ultimately create a safer environment for training to take place. The contractor will install the following: new car burn trainer, new dumpster burn trainer and new cylinder trainer. Installation will include moving and installing all infrastructures necessary to support the trainers.

IV. STATUTORY AUTHORITY PERMITTING OTHER THAN FULL AND OPEN

COMPETITION

10 USC 2304(c), as implemented by FAR 6.302-1, Only one responsible source and no other supplies or services will satisfy agency requirements.

V. DEMONSTRATION THAT THE CONTRACTOR’S UNIQUE QUALIFICATIONS

OR NATURE OF THE ACQUISITION REQUIRES THE USE OF THE AUTHORITY

CITED ABOVE (APPLICABILITY OF AUTHORITY)

This item is peculiar to one manufacturer. Per AFI 32-2001 para 2.5, All Fire Emergency Services Operations are required to meet National Fire Protection Association (NFPA) standards to include trainers. At this time, Kidde is the only known manufacturer producing burn trainers meeting NFPA Standards that utilizes vapor fed technology. This technology prevents unburned gas from collecting and pooling. The potential pooling of fuels creates a significant explosion hazard with the older trainers. The patented shutoff feature and positive pilot light of Kidde equipment provides significant increases to the safety of instructors and students. For example a large aircraft trainer experienced an explosion when the liquid fuel pooled within the trainer.

The explosion blew two students and the instructor out of the back of the trainer. This type of incident has led to the effort to procure safer technology to replace existing trainers with the current Kidde Fire Trainers.

As of this date, on the converted trainers, the vapor propane technology has saved approximately $201,660 in annual propane costs. The government expects to realize an additional 20 to 25 percent in annual savings, upon completion of the replacement. The trainers in use today were installed using the Kidde Fire Trainers patented parts, burners, igniters, controls, electronics and hardware. The government will not realize the full safety benefits and cost savings maintaining multiple types of trainers. In addition to the annual savings in propane consumption and use, the Kidde Fire Trainers have saved an average of $5,000 annual maintenance costs. This is taking into consideration the average cost of replacing the fire igniters that fail annually. The new technology will replace the igniters. Furthermore the new trainers have shown to have an increased lifecycle for replacement from 5 to 10 years over the previous trainers. Trainer Maintenance estimates show it will cost $7,000 to $10,000 in additional parts annually to maintain two separate trainer systems. The quality of the Kidde equipment has enabled the fire school to request zero training deviations due to equipment failures.

VI. DESCRIPTION OF EFFORTS MADE TO ENSURE THAT OFFERS ARE

SOLICITED FROM AS MANY POTENTIAL SOURCES AS DEEMED PRACTICABLE

In order to ensure offers are solicited from as many potential sources as possible, this requirement will be synopsized on the Federal Business Opportunities (FBO) IAW FAR 5.201.

A sources sought for this requirement was synopsized IAW FAR 5.201 though FBO on 27 Jun 14 with a synopsis number of FA3030-F1Z5044090A001. The synopsis was used to identify additional sources that could provide and install Kidde brand trainers that use propane vapor technology.

A second synopsis was posted on 09 Sep 14 with a synopsis number of FA3030- F1Z5044090A001. The purpose of this notice was to seek vendors that could provide a trainer equal to the Kidde brand trainers that use the propane vapor technology. The government received three responses to this notice; Draeger Safety, Inc., ADS Inc. (Fire Blast Solutions) and Kirila Fire. Technical information was requested from each of the vendors and only two vendors, Draeger and ADS, returned information for evaluation. This information was then forwarded to the using organization for evaluation. The technical information provided by ADS did not provide information on a vapor system and it appears that the vendor specializes in mobile/portable, structural, and simulator trainers that do not meet the scope and magnitude of what is required. All the certificates provided were for structural burn trainers. The technical package received from Draeger shows the company produces mobile trainers which do not meet the scope of the government’s current requirement. The trainers are manufactured from lightweight aluminum construction materials which will not hold up to the volume of training conducted at Goodfellow AFB (GAFB). The vapor technology used by the second vendor is for lighting the pilot light only, the actual fire burners use liquid propane. Neither technical package showed compatibility or interchangeability with our systems in use or show a history of successful burn trainers which meets the magnitude which GAFB requires. The identified inadequacies are not able to be modified to meet the requirement of the Government. Previous history on other procurements shows that there are companies able to provide Kidde brand burn trainers. FA3030-08-C-0095 was awarded competitively to install a large frame trainer; two proposals were received in response to the solicitation. The government expects to receive bids from multiple Kidde distributors.

VII. DETERMINATION BY THE CONTRACTING OFFICER THAT THE

ANTICIPATED COST TO THE GOVERNMENT WILL BE FAIR AND REASONABLE

Adequate price competition is anticipated for this requirement based on the number of responses received during our Market Research. The Government will evaluate all proposals received and will award a contract to the responsible offeror that is most advantageous to the Government with price and other factors considered. Brand name items will be listed separately in the solicitation.

VIII. DESCRIPTION OF THE MARKET RESEARCH CONDUCTED AND THE

RESULTS, OR A STATEMENT OF THE REASONS MARKET RESEARCH WAS NOT

CONDUCTED

Market research was conducted to determine if any other brand of burn trainers is available which uses propane vaporizing technology. New fire trainers must be compatible with the current, updated, vapor trainers to realize the full cost and safety benefits of the trainers. The sources sought synopsis F1Z5044119A001 was posted on 27 Jun 14, to determine if companies exist which would be able to provide Kidde brand burn trainers. The synopsis stated the Government was looking for vendors to provide and install new vapor propane systems along with a car trainer, dumpster trainer, and cylinder trainer.

A second sources sought notice was posted on 09 Sep 14 to determine if there were any other vendors that could provide Kidde brand or equal trainers that use propane vapor technology. As described in Section VI above, market research, in accordance with FAR Part 10, was conducted by synopsis of the proposed acquisition, advising industry of the pending acquisition, and soliciting inquiries from interested parties. The second sources sought notice reference number was FA3030-F1Z5044090A001.

IX. ANY OTHER FACTS SUPPORTING THE USE OF OTHER THAN FULL AND

OPEN COMPETITION

By using products of the same manufacturer, it will allow for the interchangeability of replacement parts for all burn trainers on Goodfellow AFB, thus reducing parts on hand that would be required should a different manufacturer be used. Goodfellow AFB currently has a contract to perform maintenance on the current burn trainer system. The government is responsible for all training cost associated with keeping all contractor personnel current with maintenance procedures for the burn trainers. Currently all of the contractor personnel are fully trained on the existing system, installing a second system would require additional training for all contractor personnel, and further all new personnel would have to attend training for both manufacturers. These additional costs could potentially have adverse effects on the mission of 312 TRS because it would divert funding away from other critical areas of training. GAFB and the 312 TRS is home to the Department of Defense Louis F. Garland Fire Academy. The Louis F. Garland Fire Academy is the only Air Force facility that conducts Air Force Specialty Code (AFSC) awarding firefighter training and provides Fire Protection Apprentice and Advanced courses for the DoD to include the Army, Navy, Marine Corps, and Air Force. Because of its mission the Fire Academy has unique and specific needs that cannot be compared to other installations. Additionally, GAFB must comply with local and Air Force regulations which requires NFPA compliant burn trainers.

XI. A STATEMENT OF THE ACTIONS, IF ANY, THE AGENCY MAY TAKE TO

REMOVE OR OVERCOME ANY BARRIERS TO COMPETITION BEFORE MAKING

SUBSEQUENT ACQUISITIONS FOR THE SUPPLIES OR SERVICES REQUIRED

The local fire school staff will continue to attend demonstrations, trade shows, and research industry literature in order to determine the availability of additional sources for fire trainers.

Further, the government will consult with the NFPA to determine if there are new sources of technology that can satisfy the requirement. In addition, Contracting will continue to monitor our customers’ requirements, available technology within the market place and seek out new potential vendors that can meet these requirements.

XII. CONTRACTING OFFICER’S CERTIFICATION

The contracting officer’s signature on the Coordination and Approval Document evidences that he/she has determined this document to be both accurate and complete to the best of his/her knowledge and belief (FAR 6.303-2(b)(12)).

XIII. Technical/Requirements Personnel’s Certification

As evidenced by their signatures on the Coordination and Approval Document, the technical and/or requirements personnel have certified that any supporting data contained herein, which is their responsibility, is both accurate and complete (FAR 6.303-2(c)).
