JUSTIFICATION FOR OTHER THAN

FULL AND OPEN COMPETITION

I. CONTRACTING ACTIVITY

Department of the Air Force, Air Education and Training Command, 82nd Contracting Squadron, Sheppard Air Force Base (SAFB), Texas 76311-2743.

II. NATURE AND/OR DESCRIPTION OF THE ACTION BEING PROCESSED

The purchase was a new, sole source order to Shermco Industries. The contract is a firm fixed price and the period of performance is 91 days following the Notice to Proceed.

III. DESCRIPTION OF SUPPLIES OR SERVICES REQUIRED TO MEET THE

AGENCY’S NEEDS

Sheppard requires the immediate repair or replacement of the base substation.

Qty 3 – ABB Current Transformers Qty 3 – ABB Potential Transformers 1000 VA Qty 3 – ABB Potential Transformers 1500 VA Qty 6 – Bus Standoff Insulators Qty 1 – Tap Changer Breather Qty 3 – SMU-20 Fuse Cutout Holder Qty 3 – SMU-20 Fuse Unit 7E inserts Qty 6 – Fused Cutout Insulators Qty 3 – Lightning Arrestors Qty 4 – 15 kV Transformer Bushings

The contractor must supply, install, and test all components listed above. Additionally, the contractor must also supply and install material that will deter future bird/wildlife nesting/habitation.

IV. IDENTIFICATION OF STATUTORY AUTHORITY PERMITTING OTHER THAN

FULL AND OPEN COMPETITION.

This purchase was deemed urgent and compelling purchase for the reasons outlined in section five of this justification. According to FAR 6.302-2(a)-(b), this justification is authorized by 10

U.S.C. 2304(c)(2) or 41 U.S.C. 3304(a)(2), when the agency’s need for the supplies or services is of such an unusual and compelling urgency that the Government would be seriously injured unless the agency is permitted to limit the number of sources from which it solicits bids or proposals, full and open competition need not be provided for.

V. DEMONSTRATE THAT THE NATURE OF THE ACQUISITION REQUIRES USE

OF THE AUTHORITY CITED.

IAW FAR 6.302-2, Contracts awarded using this authority shall be supported by the written justifications and approvals described in 6.303 and 6.304. These justifications may be made and approved after contract award when preparation and approval prior to award would unreasonably delay the acquisition.The urgency of the situation is due to the potential loss of electricity to the base for up to two (2) weeks. The circumstance exists because the back-up transformer and other electrical equipment were destroyed by birds. The entire base is now running on one set of electrical components. If that system goes down, the base would be without electricity. Such an occurrence would have an extreme impact on mission accomplishment and cost to the government. Additionally, the base will begin to enter winter season in 3 weeks; therefore, if the base loses power we will also lose the ability to operate boilers to heat facilities and if we reach freezing temperatures there will be a possibility of water lines freezing and bursting, thus causing catastrophic damage to government facilities. Given these circumstances, the contracting officer has determined the requirement to be urgent and compelling. Therefore, the purchase will be made as a sole source so as to expedite the acquisition process.

VI. DESCRIPTION OF EFFORTS MADE TO ENSURE THAT OFFERS ARE

SOLICITED FROM AS MANY POTENTIAL SOURCES AS DEEMED PRACTICABLE

The urgent and compelling nature of this requirement dictated an expedited acquisition method.

Therefore, this acquisition was set aside as a sole source.

VII. DETERMINATION BY THE CONTRACTING OFFICER THAT THE

ANTICIPATED COST TO THE GOVERNMENT FOR THE PROPOSED

ACQUISITION WILL BE FAIR AND REASONABLE

Shermco has performed work on the base substation in the past, both as a prime and a subcontractor for routine work. Their past performance on these projects was satisfactory and found to be reasonably priced. Additionally, the preliminary proposal Shermco provided in response to the solicitation was 9% below the IGE. The final contract award amount was also below the IGE and is therefore deemed fair and reasonable.

VIII. DESCRIPTION OF MARKET SURVEY CONDUCTED AND THE RESULTS OR

A STATEMENT OF THE REASONS THAT A MARKET SURVEY WAS NOT

CONDUCTED.

The urgent and compelling nature of this requirement limited the contracting office’s ability to conduct detailed market research. However, Shermco’s past performance was taken into consideration. Their previous maintenance on the substation was both reasonably priced and performed satisfactorily.

IX. ANY OTHER FACTS SUPPORTING THE USE OF OTHER THAN FULL AND

OPEN COMPETITION.

AN INTEREST IN THE PROCUREMENT.

This is a sole source acquisition under FAR 6.302-2 Unusual and Compelling Urgency. Only one contractor was contacted and was therefore the only one that expressed interest in the procurement.

XI. A STATEMENT OF THE ACTIONS, IF ANY, THE AGENCY MAY TAKE TO

REMOVE OR OVERCOME ANY BARRIERS TO COMPETITION BEFORE ANY

SUBSEQUENT ACQUISITION FOR THE SUPPLIES OR SERVICES REQUIRED

The equipment to be installed is specifically designed to prevent birds or other wildlife from nesting in or around the equipment.

XII. CONTRACTING OFFICER’S CERTIFICATION

The contracting officer's signature on the Coordination and Approval Document evidences that she has determined this document to be both accurate and complete to the best of her knowledge and belief.
