PERFORMANCE WORK STATEMENT

FOR

TRANSPORTATION SERVICES

BROOKE ARMY MEDICAL CENTER

1. DESCRIPTION OF SERVICES/ GENERAL INFORMATION. The contractor shall provide qualified vehicle operators to support the transportation services for the wounded warrior-in-transition program at Brooke Army Medical Center (BAMC), Warrior Transition Battalion (WTB), Joint Base San Antonio Fort Sam Houston (JBSA-FSH), TX 78234. The contractor shall provide vehicle operators in accordance with (IAW) this Performance Work Statement (PWS) and the Wounded Warrior Act. Given the nature of these Soldiers’ injuries and/or illnesses they require assistance to maintain normal life support functions. In accordance with (IAW) the Wounded Warrior Act and memo from the Secretary of the Army, transportation services to and from the Wounded Service Member’s (WSM) residence, medical treatment centers, and centers of subsistence shall be provided for all WSMs in accordance with this PWS.

1.1. DESCRIPTION OF SERVICES. The contractor shall provide a project manager, bus drivers, and shuttle van drivers IAW local and federal laws, regulations, and commercial practices. The contractor shall provide vehicle operators with more than 3 years of experience. The contractor shall show proof of qualified commercial drivers’ licenses with a Passenger (P) endorsement prior to contract award, see para. 1.2.9.1. The contractor shall provide transportation services for WSM that are participating or enrolled in the medical recovery program at BAMC, JBSA-FSH.

1.1.1. ROUTES. The contactor shall provide transportation services for the primary and secondary routes of this PWS, see Appendix D and E. Any transportation requests extraneous to the primary and secondary routes noted in paragraphs 1.1.1.1 and 1.1.1.2 shall be considered tertiary and submitted to the contractor’s Project Manager (PM) 24 hours in advance by the Contracting Officer’s Representative (COR).

1.1.1.1. PRIMARY ROUTE/LOOP.

1.1.1.1.1. The contractor shall provide vehicle operators to safely transport WSM, designated Non-medical attendants, and family members for scheduled medical appointments, rehabilitation programs, and in/out processing to and from the following locations (at BAMC and JBSA-FSH, Texas): Moreno Clinic, Budge Clinic, TMC Clinic, BAMC, Medical Mall, CFI, HHC, SFAC, WFCS, GH, Bldg. 2263/367, Bldg. 3526, Adaptive Sports, PX run, Fisher House residences, Holiday Inn Powless House, and Liberty dormitories. The primary route/loop is estimated 10 mile radius, see map in Appendix A and Appendix D.

1.1.1.1.2. The contractor shall provide vehicle operators to safely transport BAMC staff, Military Active duty, Retirees, and patients and beneficiaries to and from pickup and drop off designated stops on BAMC campus. The contractor shall provide primary route/loop ADA Shuttle at the following locations: BAMC Parking Garage at Naval Reserve Lot Stop, BAMC Main Entrance, ISR, CFI, BAMC Parking Garage at George Beach Overpass, BAMC Medical Mall Entrance, and Peds Clinic Parking Lot. This primary route/loop is estimated 2 mile radius, see map in Appendix G.

1.1.1.1.3. The contractor shall provide vehicle operators to safely transport BAMC staff, Military Active duty, Retirees, and patients and beneficiaries to and from the BAMC and WHASC JBSA Lackland. The contractor shall provide primary route/loop ADA Shuttle from BAMC Parking Garage at Naval Reserve Lot Stop to WHASC Main Entrance. This primary route/loop is estimated 50 mile radius, see map in Appendix H.

1.1.1.2. SECONDARY ROUTE. The contractor shall provide vehicle operators to safely transport WSM, designated Non-medical attendants, and family members to and from residential home to scheduled medical appointments and rehabilitation programs within 50 mile radius of BAMC and JBSA-FSH, Texas. See Appendix E.

1.1.1.2.1. The contractor shall provide vehicle operator to safely transport WSM from residence, medical treatment facilities, or other locations necessary for subsistence to and from the following locations: JBSA-FSH Post Exchange and Commissary, 3 runs a day Monday through Friday; BAMC (Dining Facility), 3 runs a day Saturday, Sunday, and federal holidays; and Walmart (1430 Austin Hwy, San Antonio, TX 78209), Mental Health Clinic, and other Quality of Life Support Facilities, 2 runs a day Monday and Wednesday. A run is defined as a round trip event.

1.1.1.3. TERTIARY ROUTE. The contractor shall provide vehicle operators to safely transport WSM, designated Non-medical attendants, and family members to and from special Warrior Family Support Center events as designated by the COR no later than 24 hours prior to the event. See Appendix A (Workload Estimate). Most of these events occur within the contractor’s established hours of operation and 50 mile radius. Events may occur outside of the 50 mile radius (roughly once per quarter). The contractor will not support special events outside of a 100 mile radius.

1.1.1.3.1. Special Circumstance: The contractor shall be responsible for daily route for transporting WSM with conditions that medically prohibit them from driving. The contractor shall be responsible for transporting WSM from their homes, transporting the WSM to any necessary destination, and returning the WSM to their residence.

The route is not fixed and could change multiple times throughout the performance period. In this instance only the WSM’s Chain of Command will request the service and provide all coordinating details to the COR, who will distribute to the contractor no later than 24 hours prior to execution. The 50 mile radius requirement still stands, transportation contractors will not make trips over 50 miles, unless the event is specified as a special circumstance and coordinated more than 24 hours in advance (roughly 1x quarter). See para 1.2.4 and para 1.2.4.2 of this contract.

1.1.2. SCHEDULES.

1.1.2.1. The contactor shall provide one (1) copy of shuttle bus services route schedule to the COR no later than 10 business days after award. The shuttle bus services route schedule shall include arrival time at each approved pick-up and drop-off points per Appendix D. The shuttle bus service shall begin at the beginning of the hours of operation for the day, to include scheduled stop at each designated primary route pickup and drop off locations.

The contractor shall notify dispatch at each designated stops. The contractor may dictate how many shuttle buses to employ in lieu of reacting to specific requests for transportation.

1.1.2.2. The COR will provide shuttle bus services schedule for all other routes not specified in Appendix D to the contractor 24 hours prior to scheduled appointment of WSM. The schedule will include names of WSM and designated escorts.

1.1.3. The contractor shall provide vehicle operator to provide bus transportation services for all WSM per approved scheduled bus routes. The contractor shall pickup and/or drop-off WSM from their residence to medical treatment facilities and other locations necessary for life support functions. The approved scheduled bus routes provide WSM the necessary transportation in support of the recovery in accordance with The Wounded Warrior Act and Memorandum from Secretary of the Army, Subject: Use of Non-Tactical Vehicles in support of injured or ill Soldiers Assigned to Warrior Transition Units.

1.2. GENERAL INFORMATION.

1.2.1. QUALITY CONTROL. The contractor shall be responsible for quality control for all work accomplished during the performance of the task. The contractor shall provide and maintain a Quality Control Plan (QCP) which ensures the requirements in this PWS are met. The QCP will be considered acceptable and approved unless the contractor is notified by the Contracting Officer (CO) prior to award. The QCP shall be included in the technical proposal for evaluation and acceptance. As a minimum, the contractor shall develop quality control procedures that address the areas identified in section 2, Service Delivery Summary.

1.2.2. QUALITY ASSURANCE. The Government will periodically evaluate the contractor’s performance by appointing a COR to monitor performance to ensure services are received IAW this PWS. The COR will evaluate the contractor’s performance in accordance with the Quality Assurance Surveillance Plan (QASP).

1.2.3. PROJECT MANAGER (PM). The contractor shall provide, in writing, within five (5) business days after contract award; an appointed PM who shall be responsible for the overall performance of services. The contractor shall provide the name, email address, and office cell phone number of the appointed PM. The PM shall be able to speak, read, write, and understand English.

1.2.3.1. The PM shall have full authority to act on behalf of the contractor on all contractual matters.

1.2.3.2. The PM shall be available during hours of operation.

1.2.3.3. The PM shall provide a list of personnel authorized/licensed to operate the Government vehicles listed in Appendix B to the COR within 10 business days after award. After award, the contractor shall provide any changes within 3 business days throughout the duration of the contract.

1.2.3.4. The PM shall ensure vehicle operators follow posted work schedules. The PM shall coordinate any changes made to the posted schedule with the COR within 24 hour prior to posting the revised schedule.

1.2.3.5. The PM shall work primarily from the dispatch office located at Bldg. 3822, Rm. 105, JBSA-FSH, TX 78234.

1.2.3.6. The PM shall return all calls from the COR within one (1) hour during normal hours of operation.

1.2.3.7. The P M shall be available to meet with Government personnel within two (2) hours on JBSA-FSH as designated by the COR to discuss any problem areas.

1.2.3.8. After normal duty hours, the PM shall be available within the first hour of the next duty day.

1.2.3.9. The PM shall make themselves available 24/7 for unexpected issues involving their contract employees.

1.2.3.10. The PM shall be responsible for all administrative actions, such as payroll, counseling, resolution of issues, and training for contractor employees.

1.2.3.11. The PM shall issue daily vehicle and driving assignments.

1.2.4. HOURS OF OPERATION.

1.2.4.1. NORMAL HOURS OPERATION. Weekdays hours are Monday through Friday. Weekend hours consist of Saturday, Sunday, and federal holidays (as coordinated in advance with the Government).

WEEKDAYS WEEKENDS

NORMAL HOURS 6 A.M – 8 P.M 9 A.M – 6 P.M

1.2.4.2. AFTER HOURS OPERATION. The contractor may be required to work after normal hours due to increase in workload, estimated 30 hours per month. The contractor will receive notice from the COR at least 24 hours prior to after-hours services are required. Additionally, the COR will provide the after-hours schedule at that same time.

1.2.4.3. HOLIDAYS OBSERVED. When a holiday falls on a Saturday, the preceding Friday shall be considered the holiday. When a holiday fall on a Sunday, the succeeding Monday shall be considered the holiday. Routine work shall not be performed on federal holidays. The following shall be observed as federal holidays:

1.2.5. GOVERNMENT INCLEMENT WEATHER/OTHER CLOSURES. Occasionally the installation may be closed unexpectedly due to inclement weather or other reasons. The COR will notify the contractor when government facilities are closing early, due to the weather. The contractor is not required to report to work when the installation is closed. The contractor is advised to monitor local public media for the latest information on weather events. Under “delayed reporting” conditions, due to inclement weather, the COR will contact the PM and advise as to when facilities will be open and routes should be operational.

1.2.6. IDENTIFICATION BADGES. The contractor personnel shall wear a contractor provided identification badge at all times displaying the employee’s name and the name of the contractor while performing work on this contract. Identification badges shall be worn on the upper chest so as to be readily visible and identifiable.

1.2.7. DRUG FREE CERTIFICATION REQUIREMENT. The contractor shall provide a drug-free workforce.

The contractor shall conduct quarterly drug testing and provide a copy of drug free certifications to the COR within the first five (5) business days of the month. These services shall be at the expense of the contractor.

1.2.8. INSURANCE REQUIREMENT. The contractor shall be responsible for providing liability insurance for their Vehicle Operators. In the event of an accident, the contractor is solely responsible for all damages to the vehicle and property and/or any damage to a third party if vehicle operator found at fault. The Government assumes no liability for damages or injuries. The contractor shall be liable for loss, damage, destruction, or theft of Government property if found at fault.

1.2.9. VEHICLE OPERATORS.

1.2.9.1. The contractor shall provide vehicle operators with fully licensed with a Texas Commercial Vehicle Operators License (CDL), Class B, with Passenger (P) endorsement or higher. The contractor shall notify the COR within 24 hours of any vehicle operator driver license status changes.

1.2.9.2. Vehicle operators shall not consume alcohol at least eight (8) hours prior to starting performance of vehicle services.

1.2.9.3. Vehicle operators shall not consume illegal drugs that may hinder their abilities to operate a motor vehicle prior to starting performance of vehicle services.

1.2.9.4. Vehicle operators shall not consume prescribed medications that may hinder abilities to operate a motor vehicle prior to starting performance of vehicle services.

1.2.9.5. Vehicle operators shall be professional and provide highest level of customer service possible within the scope of the contract.

1.2.9.6. Vehicle operators shall be capable of operating a Government owned vehicle listed in Appendix B, such as 15 passenger vans, 44 passenger buses, and Americans with Disability Act (ADA) compliant vans, equipped with Wheel Chair Ramp Lifts.

1.2.10. SAFE PASSENGER TRANSPORT OPERATION. The contractor shall provide vehicle operators to support a safe passenger transportation operation IAW local, state, federal laws and regulations, commercial practices, and the ADA. Vehicle operators are responsible for exercising safety controls when loading and unloading passengers. Vehicle operators are not responsible to manually lift passengers when loading or unloading.

Vehicle operators shall assist passengers and secure wheelchairs. Vehicle operators shall ensure all passengers are properly secured and using seatbelts. Vehicle operators shall ensure all passengers in the ADA vehicle transported in a wheel chair are secured at all times. Vehicle operators shall observe and adhere to the maximum passenger capabilities as stated for all types of vehicles listed in Appendix B during the performance of transportation operation.

1.2.11. COMPUTER/ADMINISTRATIVE SKILLS. The contractor shall have adequate computer skills to complete government required training. The PM shall be proficient in Microsoft Office.

1.2.12. ROAD NETWORK KNOWLEDGE. Vehicle operators shall have knowledge of local road networks and specific routes to be used as designated by the COR.

1.2.13. TRAINING. Contractor employees shall attend a government orientation to familiarize them with the policies and procedures of BAMC, as well as complete mandatory annual training as directed by the Government.

1.2.14. VEHICLE MAINTENANCE. Vehicle operators shall conduct a daily inspection and annotate any deficiencies on Daily Inspection Log that shall be issued to them at the beginning of their shift. This form shall ensure the vehicle was inspected and any deficiencies were corrected. Vehicle operators shall notify the dispatch office of all noted deficiencies before, during, and after operations. Vehicle operators shall ensure vehicles are filled with gas at any gas station that accepts GSA Fleet/Wright Express credit cards. The PM shall issue gas cards daily to vehicle operators with a vehicle. Vehicles shall be cleaned and properly secured at the end of their shift. Vehicle operators shall be required to take vehicles in for maintenance services and car washes as directed by the PM.

Vehicle operators shall report/annotate any minor or major mechanical vehicle issues to their PM.

1.2.15. DRIVING LOGS/REPORTS. The PM shall provide a copy of daily driving logs to the COR within the first five (5) business days of the month, see Appendix F. Reports shall be accurate and detailed, time and mileage are completely and appropriately accounted for on driving logs.

1.2.16. REPORTING PROCEDURES. Vehicle operators shall call dispatch when they arrive and depart from a pick up or drop off location. Vehicle operators shall call and report to the PM all accidents, traffic stop/violations or any situation that causes an unsafe operation of the vehicle. Vehicle operators shall immediately call dispatch and report any discrepancies or problems with passenger pickups, or drop off as they occur. Vehicle operators shall not schedule pickups or drop off directly. The Vehicle operators shall arrive 10 minutes before all scheduled requests and notify dispatch. Dispatch shall make the call how long drivers can wait. Vehicle operators shall complete Government provided driving logs and turn in completed logs to the PM upon return of vehicles.

1.2.17. BACKGROUND CHECKS. All Department of Defense Contract employees shall submit a Position of Trust background investigation (SF 85) to the Security Office. A favorable SF 85 is required before gaining access to a government base. The contractor, when notified of an unfavorable determination by the Government, shall withdraw the employee from consideration from working under the contract, and turn-in Government issued CAC card to the Government. In addition, the contractor shall conduct background checks every 12 months on all employees. The contrctor shall be responsible for initial background checks for all employees.

1.2.18. COMMON ACCESS CARDS. Contractor personnel shall obtain a Common Access Card (CAC) for computer access. CACs shall be used for all mandatory online training and to access Military Installations. All CACs for contractors shall be issued via the Contractor Verification System (CVS). CAC cards shall be surrendered to the COR upon termination of employment for contractor employee or upon completion of the contract. CAC cards shall be surrendered immediately after termination of employment.

1.2.19. PHASE IN. To minimize any decreases in productivity and to prevent possible negative impacts on additional services, the contractor shall have a 14-day phase in period. During the phase in period, the contractor shall become familiar with performance requirements in order to commence full performance of services on the contract start date. The contractor shall complete all required contract employees’ Government orientation within 10 days of contract performance start date, scheduled by the COR.

1.2.20. CHANGES TO CONTRACT. The CO is the only person authorized to make changes to the contract. COs are responsible for ensuring that all contract actions comply with appropriate laws, executive orders, regulations and other applicable procedures, and approvals. Appointed/designated through a written warrant with dollar limitations, COs may bind the Government only to the extent of the authority delegated to them.

1.2.21. REMOVAL OF CONTRACT PERSONNEL. The contractor shall ensure that all employees conduct themselves in a professional manner while on the installation or performing on this contract. The CO reserves the right to direct the contractor to remove from performance on this contract any employee whom the CO determines to be a danger to persons, property, or military security. Additionally, they may be removed for being disruptive, offensive, or otherwise exhibiting improper behavior that undermines good order and discipline. The contractor is responsible for ensuring removed employee’s duties are covered.

1.2.22. HEALTH AND IMMUNIZATIONS REQUIREMENTS. Vehicle operators shall receive a general physical examination prior to commencement of services. The contractor shall provide to the COR, within 10 calendar days prior to start of performing services under this contract, a physical examination certificate for each employee. The certification shall state the date on which the physical examination was completed and the name of the physician who performed the examination. The physician performing the examination shall sign the certification. A physical examination shall be administered no more than 45 days prior to performance of the contract. The physical examination shall include the following:

1.2.22.1. Test for the antibody of HIV (Human Immunodeficiency Virus) with documented results of the test.

1.2.22.2. Current influenza vaccination given on an annual basis or proof from a registered physician that the contractor cannot receive the influenza vaccination due to a contraindication or complication.

1.2.22.3. If all of the immunizations and tests set forth in the preceding paragraphs have not been completed, the contractor shall issue a certificate providing evidence of immunization and tests that have been completed or started and shall provide a schedule for the completion of unfinished immunizations and lab tests. Failure to complete the immunizations as scheduled may be grounds for the CO to issue a “stop order” to the contractor until the contractor is in compliance and/or determine that such individual is not acceptable to perform services under this contract.

1.2.23. SECURITY/SAFETY/SAFEGUARDING MATERIAL. The contractor shall be responsible for safeguarding all Government Property provided for contractor use. If any Government Property is damaged or lost during contractor use and the contractor is found to be at fault, the cost will be incurred by the contractor. The contractor shall safeguard information of a confidential or sensitive nature. Neither the contractor nor any of its contract employees shall disclose or cause to be disseminated any information concerning the operation of the Medical Treatment Facility (MTF) that could result in or increase the likelihood of the possibility of breach of security or interrupt the continuity of operations or which breach the requirements of the Privacy Act of 1974.

However, the contractor shall be required to provided testimony or disposition in cases of due process.

1.2.24. NO SMOKING POLICY. The contractor shall comply with Army Regulation 600-63, Army Health Promotion, for controlling smoking in Government buildings, facilities, and vehicles.

1.3. GOVERNMENT FURNISHED PROPERTY AND SERVICES.

1.3.1. Government shall provide all administrative supplies and equipment required for dispatching operations and vehicle operations. See dispatch inventory list in Appendix C

1.3.2. Government shall provide 2 workstations for administrative requirements.

1.3.3. Government shall provide communication equipment such as 12 handheld radios.

1.3.4. Government shall provide all 24 required vehicles to support the Warrior Transition Battalion Transportation Section’s mission. See vehicle list in Appendix B.

1.4. CONTRACTOR FULL-TIME EQUIVALENT REPORTING. The contractor shall report ALL contractor labor hours (including subcontractor labor hours) required for performance of services provided under this contract via a secure data collection site. The contractor is required to completely fill in all required data fields at http://www.ecmra.mil.

1.4.1. Reporting inputs will be for the labor executed during the period of performance for each Government fiscal year (FY), which runs 1 October through 30 September. While inputs may be reported any time during the FY, all data shall be reported no later than 31 October of each calendar year. Contractors may direct questions to the Contractor Manpower Reporting Application (CMRA) help desk, the COR or to the CO.

1.4.2. Reporting Period: Contractors are required to input data by 31 October of each year.

1.4.3. Uses and Safeguarding of Information: Information from the secure web site is considered to be proprietary in nature when the contract number and contractor identity are associated with the direct labor hours and direct labor dollars. At no time will any data be released to the public with the contractor name and contract number associated with the data.

1.4.4. User Manuals: Data for Air Force service requirements must be input at the Air Force CMRA link. However, user manuals for government personnel and contractors are available at the Army CMRA link at http://www.ecmra.mil.

1.5. SECURITY, SAFETY AND ANTI-TERRORISM (AT) REQUIREMENTS:

1.5.1. Security Requirements: Work under this contract is UNCLASSIFIED. The Contractor shall comply with all applicable DoD security regulation and procedures during the performance of this contract. The Contractor shall not disclose and must safeguard procurement sensitive information, computer systems and data, Privacy Act data, and Government personnel work products obtained or generated in the performance of this contract. Contractor employees will be issued by the Government a Common Access Card (CAC) which is required for access to Government computer databases and entrance to the installation. Additionally, all Contractor employees must be issued a special identification card issued by SAMMC PMO Badge and ID Office prior to reporting for duty. The Contractor shall be responsible for the control and safe keeping of all Government issued IDs and ensure all badges are returned to the COR upon termination of an employee or the contract end date. The Contractor shall ensure all contractor employees are aware that in the event either of the Government IDs are lost or stolen that they are to advise the PM or alternate immediately upon discovery. The Contractor shall ensure that the COR is notified the same day the employee reports an ID lost or stolen. The Government shall conduct criminal background checks on all Contractor employees in accordance with the procedures set forth in Public Law 100-235, DoD Directive 5200.28, DoD Directive 5200.2-R, DoDI 1402.5. The Contractor is responsible for ensuring all Contractor employees must complete the SF86, Authorization for Release of Information form and ensure all background check submittals are initiated in accordance with this PWS prior to employees providing services at SAMMC facilities.

Background checks shall be based on fingerprints of individuals obtained by qualified Government law enforcement or security personnel, inquiry’s conducted through the Federal Bureau of Investigation (FBI) and the State Criminal History Repository check, and a local Installation Record Check., if required. The procedures for completing the required background check are outlined in the Department of Defense Instruction (DoDI) 1402.5. Government will not allow any employees to start work until clearance of criminal background check has been completed.

1.5.2. Physical Security: The contractor shall be responsible for safeguarding all government equipment, information and property provided for contractor use at the end of each business day. The Contractor shall ensure all government facilities, equipment, and materials shall be secured at the close of each duty day.

1.5.3. Antiterrorism (AT) / Operations Security (OPSEC) Requirements: For OPSEC to be effective, all Contractors must be aware of OPSEC and understand how OPSEC complements traditional security programs. All personnel must know how to apply and practice OPSEC in the performance of their daily tasks. OPSEC must become a mindset of all Contractor employees and be performed as second nature. To accomplish this level of OPSEC vigilance, OPSEC training programs must be action and job-oriented, enabling the workforce to put into practice the knowledge and tactics, techniques, and procedures (TTPs) they learned in training. Training should maximize the use of lessons learned to illustrate OPSEC objectives and requirements. In order to ensure accomplishment of training, the Government will include OPSEC training as a part of their organization’s annual training guidance. Contractor employees must complete Level I OPSEC and AT Awareness training within 30 calendar days of reporting to duty in according to Army Regulation 530-1 and 525.13. AT Level I awareness training is also available at https://atlevel1.dtic.mil/at.

1.5.4. iWATCH Training: The Government will brief all Contractor personnel on the local iWATCH program.

This local developed training will be used to inform employees of the types of behavior to watch for and instruct employees to report suspicious activity to their COR. Contractor employees must complete iWATCH training within 30 calendar days of reporting to duty.

1.6. OPERATIONAL SECURITY (OPSEC) REQUIREMENT:

1.6.1. Investigation Requirements. The contractor providing service under this contract is required to initiate and document the new employee’s Electronic-Questionnaires for Investigations Processing (e-QIP) and coordinate, or validate through the SAMMC Security Manager’s Office all background investigation requirements needed for employment at SAMMC, or in SAMMC organizations. Clearances will be validated using the Joint Personnel Adjudication System (JPAS) when a new employee begins in-processing after contract is awarded. The SF 85P Questionnaire for Public Trust Positions is to be completed and printed and electronic copies (downloaded from internet program) are to be hand carried to the SAMMC Security Manager prior to performance. The Contractor shall have proof of U.S. citizenship (certified copy of birth certificate or naturalization papers) or a valid U.S.

Immigration Form 1-151 and Alien Registration Card ("Green Card"). As a minimum, the contractor providing service requiring operating government-furnished workstations that have access to Department of Defense e-mail and requiring unescorted entry to a restricted area/Controlled Areas, must successfully complete a National Agency Check (NAC). The contractor shall coordinate and schedule appointments with the SAMMC Security Manager prior to performance. The SAMMC security manager will initiate the Request for Personnel Security Action, review the security questionnaire and request a Local File Check from the Provost Marshall prior to scheduling an appointment with the Security Specialists to submit the e-QIP for processing. This security questionnaire must be completed and processed by the SAMMC Personnel Security Office prior to contract performance. The contractor is responsible for monitoring the coordination and completion of the scheduled appointment date and time with the Security Manager.

1.6.2. Freedom of Information Act Program (FOIA and Privacy Act). The contractor shall comply with DOD Regulation 5400.7-R, DOD Freedom of Information Act Program requirements. The Freedom of Information Act sets policy and procedures for the disclosure of records to the public and for marking handling transmitting and safeguarding For Official Use Only materials.

1.6.3. Reporting Requirements. The contractor shall comply with DoD 5200.2-R, January 1987, Personnel Security Program and AR 380-67, 9 September 1988, Department of the Army Personnel Security Program Regulation. Contractor shall report to the SAMMC Security Manager any information or circumstances which may pose a threat to DOD or contractor personnel, resources, or DOD information.

1.6.4. Physical Security. The contractor shall comply with all Force Protection Condition (FPCON) procedures, Random Antiterrorism Measures (RAMS) and local search/identification requirements.

1.6.6. Government Computer Access Requirements. If this contract requires contractor personnel to have access to government computers, contractor personnel requiring access to government computers shall successfully complete, a National Agency Check (NAC), before obtaining access to the computer. These investigations shall be submitted by the government at no additional cost to the contractor. Common Access Cards (CACs) for Contractor Personnel are required which is hereby incorporated by reference if not otherwise included. The contractor shall comply with Homeland Security Policy Directive (HSPD)-12, Policy for Common Identification Standard for Federal Employees and Contractors and Federal Information Processing Standard 201.

1.6.7. Keys and Lock Combinations. The contractor shall abide by all current SAMMC key control and lock combination procedures. The Contractor shall be responsible for any keys issued to the employee. The keys shall not be duplicated. The Contractor shall ensure that its employee’s not allow government-issued keys be used by personnel other than those currently authorized. No unauthorized personnel shall be allowed entry into the locked area. Keys shall not be used to open work areas for personnel other than personnel engaged in performance of their duties, unless authorized by the Government functional area chief. The employee shall use keys issued to them to secure/open areas only as directed by the COR and/or functional area chief. Lost keys and/or locks shall be reported to the issuing party and COR immediately upon recognition of the loss. The COR shall notify the PMO of the lost key. The employee shall be responsible for the replacement costs of any lost keys and any associated locks.

Reimbursement shall be provided before the Government replaces lost keys or performs re-keying.

1.6.7.1. Key Control. The contractor shall safeguard all keys issued by the government and insure they are used only by authorized contractor personnel. The contractor shall not duplicate issued keys and shall report lost keys to the COR immediately; the contractor shall be responsible for the replacement of lost keys.

1.6.8. Identification of Privacy Act. This contract required the development of a system of records in accordance with the Privacy Act of 1974.

1.6.9. Neither the Contractor nor any of its contract service providers shall disclose or cause to disseminate any information concerning operations of military services. Such actions could result in violation of the contract and possible legal actions.

1.6.10. All inquires, comments or complaints arising from any matter observed, experienced, or learned of as a result of or in connection with the performance of this contract, the resolution of which may require the dissemination of official information, shall be directed to the COR.

1.6.11. The contractor shall only conduct business with designated government personnel listed as points of contact (POCs). Names of authorized personnel shall be provided to the Contractor by the government, in writing, and updated as necessary throughout the contract period.

1.6.12. U.S. Government records, copies of original results and reports, verified original data, corrected data, and corrected supporting final reports are maintained by the Contractor, but remain the property of the U.S. Government.

These files/results must be surrendered to the COR upon request.

1.6.13. Installation passes. Contract personnel shall wear a badge that clearly identifies them as a contract employee.

The badge will contain a personal picture, name of the employee, and Contractor’s name. Badges will be worn on the outer garment in full view at all times, attached to the outer shirt or jacket pocket by a button or clip or worn around the neck secured by an appropriate identification card lanyard.

1.6.14. The contractor shall comply with all applicable federal, state and local laws and ensure performance is secure while protecting material, equipment, and supplies from damage and loss. Government security personnel shall have the express right to inspect for security violations at any time during the term of the contract.

1.7. PHYSICAL REQUIREMENTS AND WORK ENVIRONMENT.

The work is primarily performed in an office setting involving normal day-to-day risks and discomforts. The Contractor shall be responsible for ensuring that their employees are familiar with and follow normal safety precautions typical in an office environment.
