SECTION 01 14 00

WORK RESTRICTIONS

PART 1 GENERAL

1.1 REFERENCES – Not Used

1.2 DEFINITIONS – Not Used

1.3 SUBMITTALS

Government approval is required for submittals with a "G" designation; submittals not having a "G" designation are for Contractor Quality Control approval. The following shall be submitted in accordance with Section 01 33 00 SUBMITTAL PROCEDURES:

1.4 SPECIAL SCHEDULING REQUIREMENTS

a. All medical and mission critical areas will remain in operation during the entire construction period. The Contractor must conduct his operations so as to cause the least possible interference with normal operations of the activity.

b. Permission to interrupt any Activity roads, railroads, and/or utility service must be requested in writing a minimum of 30 calendar days prior to the desired date of interruption.

1.5 CONTRACTOR ACCESS AND USE OF PREMISES

1.5.1 Activity Regulations

Ensure that Contractor personnel employed on the Activity become familiar with and obey Activity regulations including safety, fire, traffic and security regulations. Keep within the limits of the work and avenues of ingress and egress. Wear hard hats in designated areas. Do not enter any restricted areas unless required to do so and cleared for such entry. Mark all Contractor equipment for identification

1.5.1.1 Subcontractors and Personnel Contacts

Provide a list of contact personnel of the Contractor and subcontractors including addresses and telephone numbers for use in the event of an emergency. As changes occur and additional information becomes available, correct and change the information contained in previous lists.

1.5.1.2 Installation Access

Non DOD persons (Contractors, vendors, etc) requiring entry to JBSA must be sponsored by an authorized DBIDS registered DOD ID card holder. Sponsors must notify the applicable 502nd Security Forces Visitor Control Center NLT 10 days prior to the requested entry date.

Sponsors or Authorizing Official shall request the permit in writing or via email from a .mil address to the Visitor Control Center. An Application for an Installation Access Credential form will be submitted by the Sponsor or Official to the Pass and Registration Office.

Contractor and vendor companies requiring access to any Joint Base San Antonio location shall provide the credential information for their employees to the sponsor in order to process the base access.

Per AFI 10-245, sec. 1.4.4.5.2, coordinate with the installation Anti-terrorism Officer (ATO) to ensure Level I – AT Awareness Training is offered to all contractors (T-O). Coordination for training should be done by the requiring unit after contract award.

Note: All construction contractor employees must have:

a. One form of picture identification

b. Provide personal (full name, date of birth, home address, and driver license number) and vehicle information.

c. A memo from the construction company on company letterhead stating the reason for entry, contract number, project start and end date, and the location at JBSA base where the jobsite is located

Failure to obtain entry approval will not affect the contract price or time of completion

1.5.1.7 No Smoking Policy

Smoking is prohibited within and outside of all buildings on installation, except in designated smoking areas. This applies to existing buildings, buildings under construction and buildings under renovation. Discarding tobacco materials other than into designated tobacco receptacles is considered littering and is subject to fines. .

1.5.1.8 Government Housing Areas

b. When working inside a housing area, working hours are limited to 0800 (8 am) to

1600 (4 pm) unless otherwise approved by the Contracting Officer.

1.5.4.1 Airfield and Flight Line Requirements – Not Used

1.5.4.2 Radioactive Materials and Equipment (Use and Storage)

a. Contractors who intend to use or store radiation sources on Joint Base San Antonio must obtain proper authorization in accordance with AFI 40-201 and AFI 48-148.

Contractors will not use radiation sources on referenced locations without an approved JBSA authorization issued by the JBSA Radiation Safety Officer (RSO) as described in paragraph (f) below. Such equipment typically includes equipment for Soil Density Testing, Lead-Based Paint Analysis (X-Ray fluorescent analyzer), etc.

b. Contractors require that JBSA authorization to use or possess ionizing radiation sources on an Air Force installation. For the purpose of this paragraph, ionizing radiation source means any source that, if held or owned by an Air Force organization, would require a specific permit.

c. The JBSA authorization will specify start and stop dates for the work and describe for what purposes the applicant needs the authorization. The following information shall be submitted to the RSO for this request.

1) Brief Description of Proposed Activities

2) The Contractor possesses a valid U.S. Nuclear Regulatory Commission (NRC)

Form 347 material license that allows the applicant to use the source as specified in the request.

3) The Contractor possesses a valid Agreement State or Radioactive Material

License (Texas Department of Health, Bureau of Radiation Control) license that allows the applicant to use radioactive material (RAM) as specified in the request and the applicant has filed NRC Form 241, Report of Proposed Activities in Non- Agreement States, with the NRC in accordance with 10 CFR 150.20. A copy of the NRC Rom 241, must accompany the TRC Form 12-1. An authorization issued under this circumstance will be valid for no more than 180 days in any calendar year.

5) Contractor Radiation Safety Officer: Name, Address, and Phone.

6) Copy of Contractual Clause of the Air Force/Army Contract describing work to be performed and inclusive dates (from the contract)

7) Provide log of actual equipment usage to the JBSA RSO office.

8) Leak test documentation for the equipment with the radioactive source(s).

9) Site map defining area where radioactive materials/equipment is to be used.

10) Radiation Safety Program to include standard operating procedures (SOP), training program and designation of Radiation Protection/Safety Officer.

11) Written confirmation that the JBSA-FSH RSO can conduct periodic assessments and has authority to suspend contractor operations believed to be unsafe.

12) For naturally occurring or accelerator produce radioactive material

(NORM/NARM) and machine-produced ionizing radiation sources, the applicant has an appropriate State authorization that allows the applicant to use the source as specified in the request or has in place a radiation safety program that complies with Air Force requirements.

d. All authorizations will require applicants to remove all permitted sources from Air

Force property by the end of the work day. No contractor owned radioactive materials shall remain on a JBSA installation overnight).

e. Disposal of radioactive material (RAM) by non-Air Force agencies on Air Force property is strictly prohibited.

f. Contractor will apply by letter with supporting documentation at least thirty (30) days before the requested start date of the permit. Review of the authorization request and subsequent approval/disapproval requires approximately 30 days.

g. Submit three (3) copies through the Contracting Officer and addressed to the JBSA

RSO at the 502nd Air Base Wing Safety Office:

1.5.7 Permits and Requests

All permit requests must include at minimum the following:

i. Contractor’s Representative Contact Information

1.5.7.1 Digging Permits / Utility Locate

a. Digging permits must be obtained prior to any digging, drilling or any excavation work.

b. Contact the 502 CES Construction Manager for dig permit coordination.

c. Contractor to allow (14) calendar days for Government review of digging permit requests. A digging permit for a specified area of excavation expires 30 days after the issue date; the Contractor must re-apply for a new permit to perform excavation in the area if the excavation was not started within the 30-day period.

d. Permits will identify all underground utilities within 5 feet of the designated area.

Contractor shall be responsible for all repairs, costs, and damages due to excavating without permit or damaging an identified utility.

1.5.7.2 Utility Outage Permit

a. Contractor shall complete and submit a written request 14 days in advance of the requested utility outage to CES Utility Manager through the 502 CES Construction Manager. The request shall include the utility service to be affected, proposed date, proposed time, and outage duration.

b. Contractor shall be responsible to coordinate with CPS Energy about any energy or gas outage request. This coordination is separate than the government coordination.

c. Provide CES Construction Manager a copy of the written Utility Outage request.

d. After submitting the request to the government, the Contractor must receive approval from the government prior to schedule a utility outage.

1.5.7.3 Hot Work Permits

a. Contractor shall obtain a Hot Work Permit for any welding, burning, abrasive blasting, hot-riveting, or other fire-producing or spark-producing operations every 30 days.

b. Contractor shall contact JBSA FSH Fire and Emergency Services to request the permit. No form required for the request. The JBSA FSH Fire and Emergency Services is located in Building 4196. The phone numbers are 210-221-5452, 210-221- 4798, and 210-221-2727.

c. The Hot Work Permit will be issued by the JBSA-FSH Fire and Emergency Services.

d. Permits expires in 30 days, so if work will extend beyond 30 day period the

Contractor must contact JBSA- FSH Fire and Emergency Services to re-issue a new permit.

1.5.7.4 Road Closure Approval Requests

a. Road closings will not be permitted without approval. To get approval for a proposed road closure Contractor must submit a traffic control plan to the 502 CES Project Manager (PM) 30 days prior to anticipated need for closure.

b. The Contractor traffic control plan will include each section of road that will be worked on or impacted as a result of this contract. The traffic control plan shall be in accordance with "Traffic Controls for Street and Highway Construction and Maintenance Operations" of the latest edition of the "Texas Manual on Uniform Traffic Control Devices."

c. Contractor will provide traffic control signs and barricades for all street widening and extensions. At least one lane of traffic must be maintained at all times.

1.5.8 Laydown Area

The contractor shall prepare a site plan indicating the proposed location and dimensions of any area to be isolated/fenced for use by the contractor, the number of trailers to be used, avenues of ingress/egress to the project area, and laydown/storage area. Any areas, which may have to be graveled to prevent the tracking of mud, shall also be identified. A SWPPP shall be submitted and conform to the requirements in specification section 01 35 35. The contractor shall also indicate if the use of a supplemental or other staging area is desired.

Contractor site plan shall be submitted for approval by the government 14 working days in advance prior to mobilization for construction.

1.5.8.1 Temporary facilities

1.5.8.1.1 Administrative Field Offices: The contractor shall provide and maintain any necessary administrative field office facilities within the construction area per approved Site Plan. Government office and warehouse facilities will not be available to the contractor's personnel.

1.5.8.1.2 Storage Area: The contractor shall construct and maintain temporary 6-foot high chain link fence around the exterior of the project site perimeter, trailers and stored materials. The fence shall include woven privacy fabric, 90%-density, bound edging with brass 1”-grommets fastening locations; factory cut wind-holes;

color: dark brown, so that visibility through the fence is obstructed. Fence fabric shall be installed on the “public” side of the site’s construction fence and maintained in a neat and tight fashion onto the fence. Fence fabric damaged during the construction phase shall be replaced at the direction of the Contracting Officer.

Fence fabric material color shall be dark brown and submitted to the Contracting Officer for approval. Fence posts may be driven, in lieu of concrete bases, where soil conditions permit. Trailers, materials, or equipment shall not be placed or stored outside the fenced area unless such trailers, materials, or equipment are

SECTION 01 14 00 WORK RESTRICTIONS Page 7 of 12 assigned a separate and distinct storage area by the Contracting Officer away from the vicinity of the construction site but within the military boundaries. Trailers, equipment, or materials shall not be open to public view with the exception of those items which are in support of ongoing work on any given day. Materials shall not be stockpiled outside the fence in preparation for the next day's work. Mobile equipment, such as tractors, wheeled lifting equipment, cranes, trucks, and like equipment, shall be parked within the fenced area at the end of each workday.

1.5.8.1.3 Appearance of Trailers: Trailers utilized by the Contractor for administrative or material storage purposes shall present a clean and neat exterior appearance and shall be in a state of good repair. Trailers which, in the opinion of the Contracting Officer, require exterior painting or maintenance will not be allowed on the military property and can be sent back at the discretion of the Contracting Officer.

1.5.8.1.4 Maintenance of Storage Area: Contractor shall keep fencing shall in a state of good repair and proper alignment. Should the contractor elect to traverse with construction equipment or other vehicles, grassed or unpaved areas which are not established roadways, such areas shall be covered with a layer of gravel as necessary to prevent rutting and the tracking of mud onto paved or established roadways; gravel gradation shall be at the contractor's discretion. Grass located within the boundaries of the construction site and 5’ outside the boundaries of the construction site shall be mowed by the contractor for the duration of the project.

Grass and vegetation along fences, buildings, under trailers, and in areas not accessible to mowers shall be edged or trimmed neatly.

1.5.8.1.5 Security Provisions: Contractor shall provide adequate outside security lighting at the contractor's temporary facilities. The contractor shall be responsible for the security of its own equipment; in addition, the contractor shall notify appropriate law enforcement agency requesting periodic security checks of the temporary project field office. It will not be the responsibility of the Government to pay for or replace items that may be taken or lost due to lack of properly securing the temporary site.

1.5.8.1.6 Removal of Temporary Fence: The contractor shall remove the temporary fence upon completion and acceptance of the project. In case the fence needs to be removed for the completion of obstructed areas, such as landscaping, the site shall remain in neat appearance with all proper barricades, as specified.

1.5.8.1.7 Use of Temporary Project Safety Fencing: As soon as practicable, but prior to the commencement of work, the contractor shall furnish and install temporary project safety fencing at the work site. The contractor shall also furnish

SECTION 01 14 00 WORK RESTRICTIONS Page 8 of 12 and install hazard safety fencing at temporary hazards and work site areas considered to be hazardous to the public. Caution tape shall not be used as a means of fencing. In lieu of caution tape sawhorse traffic barricades (Type I or II) with tightly strung yellow rope may be used on a limited basis. The safety fencing shall be a high visibility OSHA orange colored, high density polyethylene 1.5” x 3” oval grid or approved equal, a minimum of 48 inches high, supported and tightly secured to steel posts located on maximum 6-foot centers, constructed at the approved location. The temporary safety fencing shall be maintained by the contractor during the periods listed below. Upon completion and acceptance of the work, the fencing shall remain the property of the contractor and shall be removed from the work site.

1.5.8.1.7.1 Duration of Temporary Safety Fencing: The following durations for the use of specific safety barriers shall be used as a guideline. The Contracting Officer may dictate longer or shorter periods as required for project specific work.

• Sawhorse traffic barricades with tightly strung yellow rope not to exceed a 24-hour period.

• Traffic cones not to exceed 3-days (excluding road construction).

• Traffic barricades and safety fencing not to exceed 14-days.

1.5.8.2 Signage: A project sign is required for this project. The project sign must be located in a cleared area. It can be attached securely to the site fencing or freestanding and it must comply with UFC 3-120-01.

1.5.8.3 Restoration of Government Area: Areas used by the contractor for the storage of equipment or material, or other use, shall be restored to the original or better condition prior to returning to the government. It is the responsibility of the contractor to document the condition prior to mobilization to ensure that the area is returned in the same or better condition.

JBSA SECURITY REQUIREMENTS

1. Obtaining and Retrieving Identification Media. As prescribed by the AFFARS 5352.242- 9000, Contractor access to Air Force installations, the contractor shall comply with the following requirements:

a. The contractor shall obtain base identification and vehicle passes for all contractor personnel who make frequent visits to or perform work on the Air Force installation(s) cited in the contract.

b. No later than three days prior to start of contract work, the contractor shall submit a written request on company letterhead (or e-mail correspondence) to the project manager (with copy to contract administrator) listing the following: project title, project number, contract number, location of work site, contract start and stop dates, work schedule, and names of contractor employees needing access to the base, including full legal name, date of birth, sex, race, SSAN, state issued I.D. Card/Drivers License #. This will include names of sub-contractors, if not employed directly by the prime contractor (See the template to be used in submitting visitor pass requests in Appendix “D”). The authorized program manager will endorse the request and forward it to the issuing base pass and registration office or security forces for processing. Contractors will present government (state or federal) issued ID, and INS Form 9 (I9), before being issued a pass to enter the installation. A Wants and Warrants check is conducted for every person before a pass is issued. Personnel employed by the contractor must get a pass for their privately owned vehicles at the respective JBSA Visitor Reception Center, with proof of following:

(1) Liability Insurance

(2) Current License Plates

(3) Current State Inspection Sticker (If Required)

(4) Valid State Driver License

(5) A phone number for sponsor on base

c. Vehicles owned by the contractor with the company name permanently printed on them are not required to obtain a pass as long as a current work order is presented at the time of entry. However, current liability insurance, state inspection sticker, and registration is required.

The person driving the vehicle must have a valid operator license for the type of vehicle.

d. The contractor is responsible for ensuring employees report to the respective JBSA Visitor Reception Center, to present their Form I-9 (Employment Eligibility Verification).

e. Upon completion or termination of the contract or expiration of the identification passes, the contractor shall ensure that all base identification passes issued to contractor employees are returned to the issuing office. If a contractor employee has been terminated, the pass will need to be retrieved and returned to Security Forces so that employee does not have base access. If the pass is not retrieved then SF will need to be notified so base access is not allowed. Upon completion of the contract return all issued installation access passes to the issuing authority.

.f. Failure to comply with these requirements may result in withholding of final payment.

2. Pass and Identification Items. The Host Unit shall ensure the following pass and identification items required for contract performance are obtained for employees and non-government owned vehicles:

a. Installation Access Pass (IAP) (DBIDS), Visitor/Vehicle Pass (AFMAN 31-116), used for contracts for less than one year to include one-day visits (i.e. warranty work)..

b. Installation Access Card (IAC) (DBIDS), Civilian Identification Card (AFI 31-113), used for contracts for more than one year or more which do not require access to controlled areas or government computer systems.

c. DoD Common Access Card (CAC), (AFI 36-3026), used for contracts for more than one year and requirement exists for access to the government computer systems and software.

CAC applications are accomplished by Trusted Agents via the Contractor Verification System

(CVS).

3. Suitability Investigations.

a. For contracts requiring IT-Level III computer access, contractor personnel shall successfully complete, as a minimum, a National Agency Check with Inquiries (NACI), before operating government furnished workstations. The contractor shall comply with the DoD 5200.2-R, Personnel Security Program, AFMAN 33-152, User Responsibilities and Guidance for Information Systems, and AFI 33-200, Information Assurance (IA) Management, requirements. NACI investigations requests are initiated using the Standard Form (SF) 85 and are submitted to the installation Information Protection Office through the Unit Security Manager within five days of contract start. NACI investigations are different from the Wants and Warrants checks, and are provided by the government at no additional cost to the contractor.

b. For contracts requiring IT-Level I and II access with no access to classified material, the contractor shall complete an SSBI or NACLC investigations, respectively. These investigations are submitted using the SF 86, and are submitted to the Information Protection Office through the Unit Security Manager within five days of contract start. These investigations are provided by the government at no additional cost to the contractor.

c. For contracts requiring routine access to the installation in excess of 180 days, the contractor shall complete a NACI investigation. These investigations are submitted using the SF 85, and are submitted to the Information Protection Office through the Unit Security Manager within five days of contract start.

4. Listing of Employees. The contractor shall maintain a current listing of employees. The list shall include employee's name, social security number, and date of investigation if service work involves unescorted entry to Air Force restricted or other sensitive areas designated by the installation commander. The list shall be validated and signed by the company supervisor, and provided to the contracting officer prior to the contract start date. Updated listings shall be provided when an employee's status or information changes.

5. Freedom Of Information Act Program (FOIA). The contractor shall comply with DoD Regulation 5400.7-R/Air Force Supplement, DoD Freedom of Information Act Program, requirements. The regulation sets policy and procedures for the disclosure of records to the public and for marking, handling, transmitting, and safeguarding For Official Use Only (FOUO) material. The contractor shall comply with AFI 33-332, Privacy Act Program, when collecting and maintaining information protected by the Privacy Act of 1974 authorized by Title 10, United States Code, Section 8013. The contractor shall remove or destroy official records only in accordance with AFMAN 33-363, Management of Records, or other directives authorized in AFI 33-322, Records Management Program.

6. Reporting Requirements. The contractor shall comply with AFI 71-101, Volume- 1, Criminal Investigations, and Volume-2, Protective Service Matters, requirements. Contractor personnel shall report to an appropriate authority, any information or circumstances of which they are aware may pose a threat to the security of DoD personnel, contractor personnel, resources, and classified or unclassified defense information. Contractor employees shall be briefed by their immediate supervisor upon initial on-base assignment and as required thereafter.

7. Entry Procedures to Controlled/Restricted Areas. Contractor personnel requiring unescorted entry to areas designated as controlled or restricted areas by the installation commander shall comply with installation’s access requirements and will possess, as a minimum, a favorable suitability determination. These requirements are contained in AFI 31-101, Integrated Defense, for installation’s access procedures and AFI 31-501, for suitability determinations. The contractor shall comply and implement local base procedures for entry to Air Force controlled areas.

8. Additional Security Requirements. In accordance with DoDM 5200.01 and AFI 31-401, Information Security, the contractor shall comply with AFMAN 33-152, User Responsibilities and Guidance for Information Systems ; AFI 33-200, Information Assurance (IA) Management;

applicable AFKAGs, AFIs, and AFSSIs for Communication Security (COMSEC); and AFI 10- 701, Operations Security (OPSEC). The contractor will comply with DoD Standard 22/Force Protection Condition Measures, DoD Standard 25/Level I-AT Awareness Training, and associated tasking contained in AFI 10-245, Antiterrorism (AT) standards. Level I AT Awareness training is available for contractor personnel and needs to be requested through the Government representative or the PMs on the project.

9. Physical Security. Areas controlled by contractor employees shall comply with base Operations Plans/instructions for FPCON procedures, Random Antiterrorism Measures (RAMS) and local search/identification requirements. The contractor shall safeguard all government property, including controlled forms, provided for contractor use. At the close of each work period, government training equipment, ground aerospace vehicles, facilities, support equipment, and other valuable materials shall be secured. During increased FPCONs, contractors may have limited access to the installation and should expect entrance delays.

10. Key Control. The contractor shall establish and implement key control procedures in the Quality Control Plan to ensure keys issued to the contractor by the government are properly safeguarded and not used by unauthorized personnel. The contractor shall not duplicate keys

SECTION 01 14 00 WORK RESTRICTIONS Page 12 of 12 issued by the government. Lost keys shall be reported immediately to the contracting officer.

The government replaces lost keys or performs re-keying. The total cost of lost keys, re-keying or lock replacement shall be deducted from the monthly payment due the contractor. The contractor shall ensure its employees do not allow government issued keys to be used by personnel other than current authorized contractor employees. Contractor employees shall not use keys to open work areas for personnel other than contractor employees engaged in performance of their duties, unless authorized by the government functional area chief.

11. Lock Combinations. The contractor shall establish procedures in local OIs ensuring lock combinations are not revealed to unauthorized persons and ensure the procedures are implemented.

ADMINISTRATIVE REQUIREMENTS

1.2 SUBMITTALS

Government approval is required for submittals with a "G" designation; submittals not having a "G" designation are for Contractor Quality Control approval.

1.4 VIEW LOCATION MAP

Submit to the Contracting Officer, with the each digital photograph submittals, a sketch or drawing indicating the required photographic locations of the project.

1.5 PROGRESS AND COMPLETION PICTURES

Photographically document site conditions prior to start and at completion of the project.

Digital photographs, .jpeg, shall be provided to the Contracting Officer for unrestricted use by the Government.

1.6 MINIMUM INSURANCE REQUIREMENTS

Procure and maintain during the entire period of performance under this contract the following minimum insurance coverage:

a. Comprehensive general liability: $500,000 per occurrence

b. Automobile liability: $200,000 per person, $500,000 per occurrence for bodily injury, $20,000 per occurrence for property damage

c. Workmen's compensation as required by Federal and State workers' compensation and occupational disease laws.

d. Employer's liability coverage of $100,000, except in States where workers compensation may not be written by private carriers,

e. Others as required by Texas law.

1.7 CONTRACTOR SPECIAL REQUIREMENTS

1.7.1 Asbestos Containing Material

All contract requirements of Section 02 82 16.00 20, "Engineering Control of Asbestos Containing Materials" assigned to the Private Qualified Person (PQP) shall be accomplished directly by a first tier subcontractor.

1.7.2 Space Temperature Control, HVAC TAB, and Apparatus Inspection

All contract requirements of Section 23 05 93 TESTING, ADJUSTING AND BALANCING FOR HVAC shall be accomplished directly by a first tier subcontractor, including the Commissioning Agent.

No work required by Section 23 05 93 shall be accomplished by a second tier subcontractor.

1.8 SUPERVISION

Have at least one qualified supervisor capable of reading, writing, and conversing fluently in the English language on the job site during working hours. In addition, if a Quality Control (QC) representative is required on the contract, then that individual shall also have fluent English communication skills.

The Project Manager in this context shall mean the individual with the responsibility for the overall management of the project and the Project Superintendent shall mean the individual with the responsibility for quality and production.

Both the Project Manager and Project Superintendent are subject to removal by the Contracting Officer for non-compliance with requirements specified in the contract and for failure to manage the project to insure timely completion.

Furthermore, the Contracting Officer may issue an order stopping all or part of the work until satisfactory corrective action has been taken.

No part of the time lost due to such stop orders shall be made the subject of claim for extension of time for excess costs or damages by the Contractor.

Approval of Project Manager and on-site Project Superintendent is required prior to start of construction.

The Contracting Officer reserves the right to interview the proposed Project Manager and on-site Project Superintendent at any time.

1.10 PRECONSTRUCTION CONFERENCE

After award of the contract but prior to commencement of any work at the site, meet with the Contracting Officer to discuss and develop a mutual understanding relative to the administration of the value engineering and safety program, preparation of the schedule of prices or earned value report, shop drawings, and other submittals, scheduling programming, prosecution of the work, and clear expectations of the "Interim DD Form 1354" Submittal.

Major subcontractors who will engage in the work shall also attend.

1.14 PARTNERING

To most effectively accomplish this contract, the Government requires the formation of a cohesive partnership within the Project Team whose members are from the Government, the Contractor and their Subcontractors. Key personnel from the Supported Command, the End User (who will occupy the facility), JBSA Civil Engineer Team, the Contractor and Subcontractors, and the Designer of Record will be invited to participate in the Partnering process.

The Partnership will draw on the strength of each organization in an effort to achieve a project that is without any safety mishaps, conforms to the Contract, and stays within budget and on schedule.

The Contracting Officer will provide Information on the Partnering Process and a list of key and optional personnel who should attend the Partnering meeting.

1.15 AVAILABILITY OF CADD DRAWING FILES

After award and upon request, the electronic "Computer-Aided Drafting and Design (CADD)" drawing files will only be made available to the Contractor for use in preparation of construction data related to the referenced contract subject to the following terms and conditions.

Data contained on these electronic files shall not be used for any purpose other than as a convenience in the preparation of construction data for the referenced project.

Any other use or reuse shall be at the sole risk of the Contractor and without liability or legal exposure to the Government.

The Contractor shall make no claim and waives to the fullest extent permitted by law, any claim or cause of action of any nature against the Government, its agents or sub consultants that may arise out of or in connection with the use of these electronic files.

The Contractor shall, to the fullest extent permitted by law, indemnify and hold the Government harmless against all damages, liabilities or costs, including reasonable attorney's fees and defense costs, arising out of or resulting from the use of these electronic

These electronic CADD drawing files are not construction documents. Differences may exist between the CADD files and the corresponding construction documents. The Government makes no representation regarding the accuracy or completeness of the electronic CADD files, nor does it make representation to the compatibility of these files with the Contractors hardware or software.

In the event that a conflict arises between the signed and sealed construction documents prepared by the Government and the furnished CADD files, the signed and sealed construction documents shall govern.

The Contractor is responsible for determining if any conflict exists.

Use of these CADD files does not relieve the Contractor of duty to fully comply with the contract documents, including and without limitation, the need to check, confirm and coordinate the work of all contractors for the project.

If the Contractor uses, duplicates and/or modifies these electronic CADD files for use in producing construction drawings and data related to this contract, all previous indicia of ownership (seals, logos, signatures, initials and dates) shall be removed.

1.16 ELECTRONIC MAIL (E-MAIL) ADDRESS

The Contractor shall establish and maintain electronic mail (e-mail) capability along with the capability to open various electronic attachments in Microsoft, Adobe Acrobat, and other similar formats.

Within 10 days after contract award, the Contractor shall provide the Contracting Officer a single (only one) e-mail address for electronic communications from the Contracting Officer related to this contract including, but not limited to contract documents, invoice information, request for proposals, and other correspondence.

The Contracting Officer may also use email to notify the Contractor of base access conditions when emergency conditions warrant, such as hurricanes, terrorist threats, etc.

Multiple email address will not be allowed.

It is the Contractor's responsibility to make timely distribution of all Contracting Officer initiated e-mail with its own organization including field office(s).

The Contractor shall promptly notify the Contracting Officer, in writing, of any changes to this email address.

PROJECT MEETINGS

1.1 Preconstruction Conference

Prior to start of construction, a pre-construction conference will be scheduled by the authorized representative of the Contracting Officer. The Contractor's Project Manager, Superintendent, and Quality Control Manager will attend this meeting. The Contractor is encouraged to have an officer of his company and representation from his sub-contractors at this conference. This conference will be held at the location specified by the Contracting Officer's authorized representative. Minutes of the meeting will be prepared by the Government and signed by both the Contractor and the Contracting Officer. The minutes shall become a part of the contract file.

1.1.1 Start of Task Order Work

If the Contractor has submitted the Accident Prevention (Safety) Plan, Quality Control Plan, Environmental Protection Plan, and the Storm Water Pollution Prevention Plan for review prior to this meeting, these may be accepted in total or accepted with comments at the conference. Task order work will not proceed until after this meeting has been held, these plans noted above have been accepted and the Notice to Proceed has been received and acknowledged by the Contractor.

1.2 Other Meetings

Construction Quality Control meetings and conferences are specified in Section 01 45 00.10 20 CONTRACTOR QUALITY CONTROL. Other meetings are specified in various Division 1 and technical sections.

1.2 Qualifications

The Contractor shall designate an authorized representative who shall be responsible for the preparation of all required project schedule reports.

1.3 Submittals

Government approval is required for submittals with a "GA" designation; submittals having a "FIO" designation are for information only. When used, a designation following the "GA" designation identifies the office that will review the submittal for the Government. The following shall be submitted in accordance with Section 01 30 00 SUBMITTAL

PART 3 EXECUTION

3.1 GENERAL REQUIREMENTS

A Project Schedule as described below shall be prepared. The scheduling of construction shall be the responsibility of the Contractor. Contractor management personnel shall actively participate in its development. Subcontractors and suppliers, subcontractors and suppliers working on the project shall also contribute in developing and maintaining an accurate Project Schedule. The approved Project Schedule shall be used to measure the progress of the work, to aid in evaluating time extensions, and to provide the basis of all progress payments.

3.2 BASIS FOR PAYMENT

The schedule shall be the basis for measuring Contractor progress. Lack of an approved schedule or scheduling personnel will result in an inability of the Contracting Officer to evaluate Contractor's progress for the purposes of payment. Failure of the Contractor to

SECTION 01 32 01.00 10 PROJECT SCHEDULE Page 2 of 6 provide all information, as specified below, shall result in the disapproval of the entire Project Schedule submission and the inability of the Contracting Officer to evaluate Contractor progress for payment purposes. In the case where Project Schedule revisions have been directed by the Contracting Officer and those revisions have not been included in the Project Schedule, the Contracting Officer may hold retainage up to the maximum allowed by Contract, each payment period, until revisions to the Project Schedule have been made.

3.3 Project Schedule

The computer software system utilized by the Contractor to produce the Project Schedule shall be capable of providing all requirements of this specification. Failure of the Contractor to meet the requirements of this specification shall result in the disapproval of the schedule.

Manual methods used to produce any required information shall require approval by the Contracting Officer.

3.3.1 Use of the AF IMT 3064 will be the normal requirement for contractor construction schedules for most of the task orders issued under this contract and shall include the required items, submittals, level of detail and contract requirements listed below for critical path method activities (Work Elements), in this paragraph C. through F and as detailed in the Instructions to Contractors on the reverse side of the AF IMT 3064, Form..

3.3.2 Use of the Critical Path Method: The Critical Path Method (CPM) of network calculation shall be used to generate the Project Schedule. The Contractor shall provide the Project Schedule in the Precedence Diagram Method (PDM).

3.3.3 Level of Detail Required: The Project Schedule shall include an appropriate level of detail. Failure to develop or update the Project Schedule or provide data to the Contracting Officer at the appropriate level of detail, as specified by the Contracting Officer, shall result in the disapproval of the schedule. The Contracting Officer will use, but is not limited to the following conditions to determine the appropriate level of detail to be used in the Project Schedule:

a. Activity Durations: Contractor submissions shall follow the direction of the Contracting

Officer regarding reasonable activity durations. Reasonable durations are those that allow the progress of activities to be accurately determined between payment periods (usually less than 2 percent of all non-procurement activities' Original Durations are greater than 20 days).

b. Procurement Activities: Tasks related to the procurement of long lead materials or equipment shall be included as separate activities in the project schedule. Long lead materials and equipment are those materials that have a procurement cycle of over 90 days.

Examples of procurement process activities include, but are not limited to: submittals, approvals, procurement, fabrication, and delivery.

c. Critical Activities: The following activities shall be listed as separate line activities on the

Contractor's project schedule:

i. Pre-final inspection.

ii. Correction of punch list from pre-final inspection.

iii. Final inspection.

iv. Construction phasing.

d. Government Activities: Government and other agency activities that could impact progress shall be shown. These activities include, but are not limited to: approvals, approvals, design reviews, environmental permit approvals by State regulators, inspections, and Notice to Proceed (NTP) for phasing requirements.

e. Responsibility: All activities shall be identified in the project schedule by the party responsible to perform the work. Responsibility includes, but is not limited to, the subcontracting firm, contractor work force, or government agency performing a given task.

Activities shall not belong to more than one responsible party. The responsible party for each activity shall be identified by the Responsibility Code.

a. Work Areas: All activities shall be identified in the project schedule by the work area in which the activity occurs. Activities shall not be allowed to cover more than one work area. The work area of each activity shall be identified by the Work Area Code.

b. Modification or Claim Number: Any activity that is added or changed by contract modification or used to justify claimed time shall be identified by a mod or claim code that changed the activity. Activities shall not belong to more than one modification or claim item. The modification or claim number of each activity shall be identified by the Mod or Claim Number. Whenever possible, changes shall be added to the schedule by adding new activities. Existing activities shall not normally be changed to reflect modifications.

c. Feature of Work: All activities shall be identified in the project schedule according to the feature of work to which the activity belongs. Feature of work refers, but is not limited to, a work breakdown structure for the project. The feature of work for each activity shall be identified by the Feature of Work Code.

f. Scheduled Project Completion: The schedule interval shall extend from NTP to the Contract completion date.

a. Project Start Date: The schedule shall start no earlier than the date on which the NTP was acknowledged. The Contractor shall include as the first activity in the project schedule an activity called "Start Project". The "Start Project" activity shall have an "ES" constraint date equal to the date that the NTP was acknowledged, and a zero day duration.

b. Constraint of Last Activity: Completion of the last activity in the schedule shall be constrained by the contract completion date. Calculation on project updates shall be such that if the early finish of the last activity falls after the contract completion date, then the float calculation shall reflect a negative float on the critical path. The Contractor shall include as the last activity in the project schedule an activity called "End Project". The "End Project" activity shall have an "LF" constraint date equal to the completion date for the project, and a zero day duration.

c. Early Project Completion: In the event the project schedule shows completion of the project prior to the contract completion date, the Contractor shall identify those

SECTION 01 32 01.00 10 PROJECT SCHEDULE Page 4 of 6 activities that have been accelerated and/or those activities that are scheduled in parallel to support the Contractor's "early" completion. Contractor shall specifically address each of the activities noted in the narrative report at every project schedule update period to assist the Contracting Officer in evaluating the Contractor's ability to actually complete prior to the Contract period.

g. Interim Completion Dates: Contractually specified interim completion dates shall also be constrained to show negative float if the early finish date of the last activity in that phase falls after the interim completion date.

d. Start Phase: The Contractor shall include as the first activity for a project phase an activity called "Start Phase X" where "X" refers to the phase of work. The "Start Phase X" activity shall have an "ES" constraint date equal to the date on which the NTP was acknowledged, and a zero day duration.

e. End Phase: The Contractor shall include as the last activity in a project phase an activity called "End Phase X" where "X" refers to the phase of work. The "End Phase X" activity shall have an "LF" constraint date equal to the completion date for the project, and a zero day duration.

f. Phase X: The Contractor shall include a hammock type activity for each project phase called "Phase X" where "X" refers to the phase of work. The "Phase X" activity shall be logically tied to the earliest and latest activities in the phase.

h. Default Progress Data Disallowed: Actual Start and Finish dates shall not be automatically updated by default mechanisms that may be included in CPM scheduling software systems.

Actual Start and Finish dates on the CPM schedule shall match those dates provided from Contractor Quality Control Reports. Failure of the Contractor to document the Actual Start and Finish dates on the Daily Quality Control report for every in-progress or completed activity, and failure to ensure that the data contained on the Daily Quality Control reports is the sole basis for schedule updating shall result in the disapproval of the Contractor's schedule and the inability of the Contracting Officer to evaluate Contractor progress for payment purposes.
