Justification and Approval (J&A) for Other Than Full and Open Competition

IV. Statutory authority permitting Other than Full and Open Competition.

41 U.S.C. 1901 as implemented by FAR Subpart 13.5 - Simplified Procedures for Certain Commercial Items.

V. Demonstration that the contractor's unique qualifications or nature of the acquisition requires the use of the authority cited above (applicability of authority).

Currently Laerdal SimMan 3G manikins utilizing SimView Software are used in the Transport Medical Training Lab (TMTL).

This purchase allows consistency and compatibility with existing Simulation Training platforms currently in the TMTL.

The requirement is a Laerdal brand name item that is proprietary in nature and the use of such descriptions in the acquisition is essential to the Government's requirements, thereby precluding consideration of a product manufactured by another company.

Awarding to other source(s) would result in the substantial duplication of cost to the Government that would not be recovered through competition and unacceptable delays in fulfilling the Army's requirements. The cost of Hardware, Software, re-training of staff to utilize and maintain the non-compliant systems within the TMTL would be in excess of approximately It should also be noted that the current hardware infrastructure, in the current TMTL, represents an investment by the Army of an estimated as necessitated by previous Laerdal SimMan 3G manikins purchase.

The conversion cost of approximately will never be recouped in subsequent purchase of other manikin, is therefore, not cost effective. Because other manikin simulators would not be compatible with the current system, AMEDC&S would invest at least an additional year as well as another adjusted for inflation and time to recreate a duplicate system.

In addition, technology will not be available from other source due to its proprietary nature and would require research and development funding as well. Further, failure to continue with standardization of TMTL systems will have significant long term impacts to strategic goals for reductions of operational costs by increasing training costs, spare provisioning costs, and increased integration costs for non-standardized management systems.

AMEDDC&S must continue to maintain one infrastructure standard. With the reduced man power resulting from decreased post war Government spending, it is imperative that the Army is able to do more with less. Maintaining a standard within the TMTL helps reduce the overall manpower, man hours, and overall operating costs expended to maintain the TMTL system.

Purchasing a brand name high fidelity manikin is critical to the success in management of Advanced Critical Care Training by the Critical Care Flight Paramedic Course (CCFPC) at Fort Sam Houston, TX. These manikins are critical to the following courses and departments:

* Critical Care Flight Paramedic Course (CCFPC) which includes the National Registered Paramedic Course (NRP) and the Critical Care Course (CCC) *Brigade Combat Team Trauma Training (BCT3) pre-combat training for combat medics *Tactical Combat Medical Care Course (TCMC) pre-combat training for Physician Assistants, Nurses, and Physicians

* Joint Forces Combat Trauma Management Course (JFCTMC) - pre-combat training for Surgeons and Nurses

* Army Trauma Training Department (ATTD/ATTC) which includes the Combat Extremities Surgical Course (CESC) pre-combat training for forward surgical teams

* Advanced Training Branch which includes NCO Courses Advanced Leader Course (ALC) and Introduction to Basic Army Medicine (IBAM)

* Department of Combat Medic Education (DCME) subject matter experts for combat medics; assist w/ POI submissions for all medic courses.

VI. Description of efforts made to ensure that offers are solicited from as many potential sources as practicable.

VII. Determination by the Contracting Officer that the anticipated cost to the Government will be fair and reasonable.

The techniques identified at FAR 15.404-1(b) will be used to ensure the award will be fair and reasonable. The Contracting Officer will use price comparison based on adequate price competition to establish a fair and reasonable price. The requirement listed in Section III are commercial supplies/services; therefore, certified cost and pricing data will not be obtained.

VIII. Description of the market research conducted and the results, or a statement of the reasons market research was not conducted.

b. Significant search was performed by the Center for Pre-Hospital Medicine (CPHM) via the INTERNET to ensure competition was sufficient in the purchase of this manikin with accessories. No other vendors were found sold Laerdal SimMan mannequins.

However, according to contracting office, the manufacturer stated other distributors were selling these mannequins, they would not provide a list of these companies.

d. NAICS Code Selection:

IAW FAR 19.102(a), the small business size standard is applied by classifying the product or service being acquired in the industry whose definition, as found in the North American Industry Classification System, best describes the principal nature of the product or service being acquired. The NAICS Code 33999 - All Other Miscellaneous Manufacturing, with a small business size standard in number of employees' is 500 and Federal Supply Code 6910 - Training Aids is determined to be the most appropriate for this acquisition. (NOTE: The NAICS Code is not listed on the Non-Manufacturer Waiver List).

IX. Any other facts supporting the use of Other Than Full and Open Competition.

The purchase of other manikins other than Laerdal SimMan 3G and Accessories listed in Section III would not be cost effective or compatible with existing simulation stations utilized for training. Purchasing Hardware and software other than the Laerdal product requested would result in retrofitting several existing Simulation stations. The cost of Hardware, Software, re-training of staff to utilize and maintain the systems within the TMTL would be in excess of approximately The Laerdal products currently utilized in the TMTL provide the level of high fidelity simulation for which the TMTL was designed. This is imperative for meeting the mission requirements to train Flight Medics to the level of Critical Care Flight Paramedics. The Laerdal SimMan 3G Manikin and Laerdal 3G Trauma Manikins are currently used throughout the Military Community as a standardized platform for Simulation Training. Training Simulation Scenarios currently being developed by the Critical Care Flight Paramedic Program to train Soldiers in the TMTL will be distributed throughout the Flight Medic community to allow local training at various commands. Maintaining consistency with Hardware and Software training platforms is imperative for consistency of training as well as cost efficiency. Although other manufacture Simulation manikins "may" function similarly, purchasing manikins other than the Laerdal products requested would render those currently utilized in the TMTL, as well those purchased by commands outside of AMEDDC&S useless due to Software incompatibilities across the industry.

X. List of sources, if any, that expressed interest in the acquisition.

XI. A statement of the actions, if any, the agency may take to remove or overcome any barriers to competition before making subsequent acquisitions for the supplies or services required.

There will be continuing contact with deployed medical commands/units; and with training courses to establish whether any other manikins can be used within the structure utilized at CCFPC. Subsequent requests will be accompanied by research throughout the Internet to ensure the most competitive prices can be obtained.
