ALL OCCUPATIONS LISTED ABOVE RECEIVE THE FOLLOWING BENEFITS:
HEALTH & WELFARE: $4.27 per hour or $170.80 per week or $740.13 per month
VACATION: 2 weeks paid vacation after 1 year of service with a contractor or successor, 3 weeks after 5 years, and 4 weeks after 15 years. Length of service includes the whole span of continuous service with the present contractor or successor, wherever employed, and with the predecessor contractors in the performance of similar work at the same Federal facility. (Reg. 29 CFR 4.173)
HOLIDAYS: A minimum of ten paid holidays per year: New Year's Day, Martin Luther
King Jr.'s Birthday, Washington's Birthday, Memorial Day, Independence Day, Labor Day, Columbus Day, Veterans' Day, Thanksgiving Day, and Christmas Day. (A contractor may substitute for any of the named holidays another day off with pay in accordance with a plan communicated to the employees involved.) (See 29 CFR 4.174)
THE OCCUPATIONS WHICH HAVE NUMBERED FOOTNOTES IN PARENTHESES RECEIVE THE FOLLOWING:
1) COMPUTER EMPLOYEES: Under the SCA at section 8(b), this wage determination does not apply to any employee who individually qualifies as a bona fide executive, administrative, or professional employee as defined in 29 C.F.R. Part 541. Because most Computer System Analysts and Computer Programmers who are compensated at a rate not less than $27.63 (or on a salary or fee basis at a rate not less than $455 per week) an hour would likely qualify as exempt computer professionals, (29 C.F.R. 541.
400) wage rates may not be listed on this wage determination for all occupations within those job families. In addition, because this wage determination may not list a wage rate for some or all occupations within those job families if the survey data indicates that the prevailing wage rate for the occupation equals or exceeds
$27.63 per hour conformances may be necessary for certain nonexempt employees. For example, if an individual employee is nonexempt but nevertheless performs duties within the scope of one of the Computer Systems Analyst or Computer Programmer occupations for which this wage determination does not specify an SCA wage rate, then the wage rate for that employee must be conformed in accordance with the conformance procedures described in the conformance note included on this wage determination.
Additionally, because job titles vary widely and change quickly in the computer industry, job titles are not determinative of the application of the computer professional exemption. Therefore, the exemption applies only to computer employees who satisfy the compensation requirements and whose primary duty consists of:
(1) The application of systems analysis techniques and procedures, including consulting with users, to determine hardware, software or system functional specifications;
(2) The design, development, documentation, analysis, creation, testing or modification of computer systems or programs, including prototypes, based on and related to user or system design specifications;
(3) The design, documentation, testing, creation or modification of computer programs related to machine operating systems; or
(4) A combination of the aforementioned duties, the performance of which requires the same level of skills. (29 C.F.R. 541.400).
2) AIR TRAFFIC CONTROLLERS AND WEATHER OBSERVERS - NIGHT PAY & SUNDAY PAY: If you work at night as part of a regular tour of duty, you will earn a night differential and receive an additional 10% of basic pay for any hours worked between 6pm and 6am.
If you are a full-time employed (40 hours a week) and Sunday is part of your regularly scheduled workweek, you are paid at your rate of basic pay plus a Sunday premium of 25% of your basic rate for each hour of Sunday work which is not overtime
(i.e. occasional work on Sunday outside the normal tour of duty is considered overtime work).
** HAZARDOUS PAY DIFFERENTIAL **
An 8 percent differential is applicable to employees employed in a position that represents a high degree of hazard when working with or in close proximity to ordnance, explosives, and incendiary materials. This includes work such as screening, blending, dying, mixing, and pressing of sensitive ordnance, explosives, and pyrotechnic compositions such as lead azide, black powder and photoflash powder.
All dry-house activities involving propellants or explosives. Demilitarization, modification, renovation, demolition, and maintenance operations on sensitive ordnance, explosives and incendiary materials. All operations involving re-grading and cleaning of artillery ranges.
A 4 percent differential is applicable to employees employed in a position that represents a low degree of hazard when working with, or in close proximity to ordnance, (or employees possibly adjacent to) explosives and incendiary materials which involves potential injury such as laceration of hands, face, or arms of the employee engaged in the operation, irritation of the skin, minor burns and the like;
minimal damage to immediate or adjacent work area or equipment being used. All operations involving, unloading, storage, and hauling of ordnance, explosive, and incendiary ordnance material other than small arms ammunition. These differentials are only applicable to work that has been specifically designated by the agency for ordnance, explosives, and incendiary material differential pay.
** UNIFORM ALLOWANCE **
If employees are required to wear uniforms in the performance of this contract
(either by the terms of the Government contract, by the employer, by the state or local law, etc.), the cost of furnishing such uniforms and maintaining (by laundering or dry cleaning) such uniforms is an expense that may not be borne by an employee where such cost reduces the hourly rate below that required by the wage determination. The Department of Labor will accept payment in accordance with the following standards as compliance:
The contractor or subcontractor is required to furnish all employees with an adequate number of uniforms without cost or to reimburse employees for the actual cost of the uniforms. In addition, where uniform cleaning and maintenance is made the responsibility of the employee, all contractors and subcontractors subject to this wage determination shall (in the absence of a bona fide collective bargaining agreement providing for a different amount, or the furnishing of contrary affirmative proof as to the actual cost), reimburse all employees for such cleaning and maintenance at a rate of $3.35 per week (or $.67 cents per day). However, in those instances where the uniforms furnished are made of "wash and wear" materials, may be routinely washed and dried with other personal garments, and do not require any special treatment such as dry cleaning, daily washing, or commercial laundering in order to meet the cleanliness or appearance standards set by the terms of the Government contract, by the contractor, by law, or by the nature of the work, there is no requirement that employees be reimbursed for uniform maintenance costs.
** SERVICE CONTRACT ACT DIRECTORY OF OCCUPATIONS **
The duties of employees under job titles listed are those described in the
"Service Contract Act Directory of Occupations", Fifth Edition (Revision 1), dated September 2015, unless otherwise indicated.
** REQUEST FOR AUTHORIZATION OF ADDITIONAL CLASSIFICATION AND WAGE RATE, Standard
Form 1444 (SF-1444) **
Conformance Process:
The contracting officer shall require that any class of service employee which is not listed herein and which is to be employed under the contract (i.e., the work to be performed is not performed by any classification listed in the wage determination), be classified by the contractor so as to provide a reasonable relationship (i.e., appropriate level of skill comparison) between such unlisted classifications and the classifications listed in the wage determination (See 29 CFR
4.6(b)(2)(i)). Such conforming procedures shall be initiated by the contractor prior to the performance of contract work by such unlisted class(es) of employees
(See 29 CFR 4.6(b)(2)(ii)). The Wage and Hour Division shall make a final determination of conformed classification, wage rate, and/or fringe benefits which shall be paid to all employees performing in the classification from the first day of work on which contract work is performed by them in the classification. Failure to pay such unlisted employees the compensation agreed upon by the interested parties and/or fully determined by the Wage and Hour Division retroactive to the date such class of employees commenced contract work shall be a violation of the Act and this contract. (See 29 CFR 4.6(b)(2)(v)). When multiple wage determinations are included in a contract, a separate SF-1444 should be prepared for each wage determination to which a class(es) is to be conformed.
The process for preparing a conformance request is as follows:
1) When preparing the bid, the contractor identifies the need for a conformed occupation(s) and computes a proposed rate(s).
2) After contract award, the contractor prepares a written report listing in order the proposed classification title(s), a Federal grade equivalency (FGE) for each proposed classification(s), job description(s), and rationale for proposed wage rate(s), including information regarding the agreement or disagreement of the authorized representative of the employees involved, or where there is no authorized representative, the employees themselves. This report should be submitted to the contracting officer no later than 30 days after such unlisted class(es) of employees performs any contract work.
3) The contracting officer reviews the proposed action and promptly submits a report of the action, together with the agency's recommendations and pertinent information including the position of the contractor and the employees, to the U.S.
Department of Labor, Wage and Hour Division, for review (See 29 CFR 4.6(b)(2)(ii)).
4) Within 30 days of receipt, the Wage and Hour Division approves, modifies, or disapproves the action via transmittal to the agency contracting officer, or notifies the contracting officer that additional time will be required to process the request.
5) The contracting officer transmits the Wage and Hour Division's decision to the contractor.
6) Each affected employee shall be furnished by the contractor with a written copy of such determination or it shall be posted as a part of the wage determination (See
29 CFR 4.6(b)(2)(iii)).
Information required by the Regulations must be submitted on SF-1444 or bond paper.
When preparing a conformance request, the "Service Contract Act Directory of
Occupations" should be used to compare job definitions to ensure that duties requested are not performed by a classification already listed in the wage determination. Remember, it is not the job title, but the required tasks that determine whether a class is included in an established wage determination.
Conformances may not be used to artificially split, combine, or subdivide classifications listed in the wage determination (See 29 CFR 4.152(c)(1)).

1.0. DESCRIPTION OF SERVICES. The contractor shall provide all management, tools, supplies, equipment, and labor necessary to conduct and administer all aspects of the aerobics program held at the West Fitness Center and Fitness and Sports Complex, Andrews AFB, MD.
1.1. Conduct Aerobic Workout Program. All programs shall consist of an aerobic type workout and include but are not limited to: step aerobics, high/low impact, modified; slide aerobics, yoga, and cycling. The contractor will schedule 14 aerobic classes total each week with the approval of the Complex Director Each exercise session will be 55 to 60 minutes in duration.
1.2. Warm-Up and Heart-Rate Checks. Each instructor shall incorporate standardized and safe warm-up, stretching and exercise techniques. A minimum of two (2) target heart rate checks will be performed during each class, as well as a safe cool down period to conclude the cardio segment of each class.
1.3. Ensure Classes Start on Schedule and Instructor is Ready to Teach Class. The
Aerobics Contract Manager (ACM) will ensure an instructor is present for scheduled classes. If for some reason, a scheduled instructor cannot make a scheduled class, the ACM must provide a qualified substitute to teach the same type class as scheduled. Instructors should arrive for class at least 15 minutes prior to the start of each class. It is essential that the instructor arrive at least
15 minutes prior to the scheduled class start time in order to sign out keys, headset, and retrieve stereo equipment for each class. In addition, instructors will provide their own music, either by I
POD or compact disc for each class. Instructor will have all equipment in place and be ready to start class at scheduled start time.
1.4. Class Head Count. Instructor will record an accurate head count for each class performed using forms provided by the Fitness Center. Failure to ensure all class participants sign-in may have an impact on that particular class when evaluations are conducted to determine if the class should be continued, modified, or eliminated.
1.5. Set Up and Take Down of Equipment. Instructor will set up and take down all stereo equipment and ensure all equipment is returned to its proper place and secured and that the exercise area is clean after the class and keys returned to the front desk.
1.6. Safety and Instructions to Students. Instructors will be safety conscious and will begin each class with a short safety briefing, followed by an effective class that is positive and motivating to the students. Instructors will provide instruction for students demonstrating high and low impact options as well as beginning, intermediate, and advanced techniques in a progressive building format.

3.0. GOVERNMENT FURNISHED PROPERTY AND SERVICES
3.1. The Government shall provide, without cost to the contractor, the utilities necessary to accomplish the tasks specified in this Performance Work Statement, including electric, fire protection, and 911 services.
3.2. Medical. Malcolm Grow Medical Center will respond to medical emergencies involving contractor personnel performing services on Andrews AFB. The contractor will reimburse the government for these services.
3.3. The government shall provide a designated area suitable for aerobics instruction. In addition, the government shall provide steps, mats, weights, bands, balls, spinning cycles, microphone, and a sound system.
3.4. The Fitness Center staff will train the contractor and/or ACM on proper usage of stereo equipment prior to being used. Contractor will notify fitness center staff if a problem occurs with the stereo equipment.
4.0. GENERAL INFORMATION
4.1. Quality Control. Contractor shall develop and maintain a quality program to ensure services are performed in accordance with standards and specifications identified in this PWS.
The contractor shall develop and implement procedures to identify and prevent defective services from occurring/reoccurring. As a minimum, the contractor shall develop quality control procedures that address the areas identified in paragraph 2, Service Delivery Summary. The government evaluator must have a specific quality control inspector to notify in case of customer complaints.
4.2. Quality Assurance. The government will periodically evaluate the contractor’s performance by appointing a representative(s) to monitor performance to ensure services are received. The government representative will evaluate the contractor’s performance through intermittent on-site inspections of the contractor's quality control program, on-site inspections of performance objectives as they are being accomplished, and/or receipt of complaints/feedback from the customer. The government may increase or decrease the number of inspections based on the overall performance of the contractor, as discovered through surveillance methods.
4.3. Addition/Cancellation of Classes. The Fitness Center Director may cancel or add aerobic classes (upon the availability of funds) due to mission requirements, insufficient class attendance or substandard contractor performance. The Director will provide the contractor with twenty-four (24) hour notice prior to cancellation, at a minimum when possible. The lead instructor must be notified at least 24 hours before a cancellation to make sure that the fitness staff is aware of cancellation, and if cancellation is within the 24 hours then the instructor needs to call the front desk to notify fitness staff.
4.4. Master Program Schedule. The ACM shall provide a master program schedule in a monthly calendar format, depicting aerobics instructor names for the designated type of class.
This schedule must be submitted to the Fitness Center Director ten (10) days prior to the effected month.
4.5. Days of Operation/Holidays. There will be no classes on Federal Holidays, Military
Down/Family Days, or during the Joint Services Open House (JSOH) in May.
4.5.1. No classes will be conducted during the two week break for the Christmas and New Year holiday period.
4.5.2. The contractor does not have to provide instructors on other days as identified by the
Fitness Center due to closure or special circumstances when notification is given 24 hours prior.
The contractor will be notified as quickly as possible if/when the facilities close due to inclement weather.
4.6. Aerobics Contract Manager (ACM). The contractor shall designate/appoint in writing to the Fitness Center Director, the names and telephone numbers of the Aerobics Contract Manager and an alternate (when ACM is not available). These designated individuals shall meet with government personnel to discuss immediate problems should they arise. The ACM or representative will attend monthly meetings with the Fitness Center staff to receive any changes and class scheduling.
4.7. Base Passes. ACM will contact the Contracting Officer to obtain the necessary information required to request issuance of a base pass to gain entry onto the base during contract period of performance.
4.8. Certifications.
4.8.1. ACMs shall be certified in Aerobics and Fitness Association of American (AFAA) or
National Aerobics & Fitness Trainers Association (NAFTA) Primary Group Exercise
Certification and has at least three years teaching experience.
4.8.2. The contractor’s instructors will possess, as a minimum, certification by one of the following national fitness organizations: Aerobics & Fitness Association of America (AFAA), National Aerobic and Fitness Trainers Association (NAFTA), American Council of Exercise
(ACE). Other certifications such as Johnny G/Mad Dogg Spinning, or Yoga Fit, are required, if they are to teach those types of classes. In addition, all instructors (including substitutes) must possess a current Cardiopulmonary Resuscitation (CPR) certification. All certifications must be valid prior to employment.
4.8.3. The ACM is responsible to interview prospective instructors and verify certifications are valid and current.
4.8.4. The contractor as part of the evaluation process must submit copies of instructor’s certifications and signed letters of commitment from the each instructor submitted.
4.9. The Contractor and/or ACM must be able to personally mentor new instructors in safety guidelines and methods of instruction. In addition, the ACM will train instructors on proper usage of stereo equipment prior to equipment being used.
4.10. List of Instructors. The ACM will provide the Fitness Center with a complete list of instructors, to include telephone numbers, as well as their qualifications, within thirty (30) days after award of contract. The ACM shall keep this list, to include telephone numbers and qualifications, current.
4.11. Injuries Involving Aerobic Patrons. ACM shall ensure instructors notify on-duty Fitness
Center staff of any injuries or accidents associated with aerobic patrons. Should ambulatory services be needed, the Fitness Center shall notify the proper agency for assistance. The instructor is required to assist the Fitness Center staff in the completion of an accident report after the conclusion of the incident.
4.12. Responsibility for Damage to Equipment. The contractor and/or ACM shall be financially responsible for any damage caused to Fitness Center equipment while it is under their control (i.e. broken keys/locks, stereo equipment, microphone/headset, etc.) to include the repair/replacement, maintenance, shipping and handling of damaged equipment.
4.13. The contractor is reminded that off-duty, active military personnel hired may be subject to permanent change of station (PCS), change in duty hours, recall, and deployments. Their absence does not constitute a valid excuse for non-performance under this agreement.
4.14. Contractor Personnel Appearance. Contractor personnel shall present a neat appearance and be easily recognizable while in the Fitness Center, which should be accomplished by wearing distinctive athletic attire. Recommend a distinctive t-shirt displaying the contractor’s logo and identifying the instructor be worn by all instructors during conduct of aerobic classes and while the instructor(s) is in the facilities.
4.15. Equipment malfunction or problems with the class shall be reported to the Fitness Center
Director or representative by the end of the class.

FORMAL COMMUNICATIONS
L-1.1. The following Points of Contact (POC) is provided for this acquisition. Address any questions or concerns you may have to the POCs via email listed below NLT 1 December 2016, 12:00PM EST. Clarifications and answers will be provided only in response to written requests for clarification and will be made available to all offerors simultaneously by attachment to this solicitation. Written requests for clarification should be emailed to the addresses indicated below. 11 CONS assumes no responsibility for non-delivery due to problems with email servers, and no extensions will be granted for these issues.

FORMAL COMMUNICATIONS
L-2.1. Offerors are cautioned to strictly comply with all instructions within this solicitation to ensure submission of a complete proposal. Failure to furnish a complete proposal at the time of proposal submission may result in an unacceptable proposal that the Government eliminates from consideration for award. The Government will not accept any changes to offerors’ proposals after the closing date of this solicitation (see FAR 15.208 for further information regarding late proposals).

DISPOSITION OF UNSECCESSFUL PROPOSALS
L-3.1. In compliance with FAR Subpart 4.8, the Government will retain one copy of all unsuccessful proposals.
Extra copies of unsuccessful proposals will be destroyed. No destruction certificate will be provided.

PROPOSAL PREPARATION INSTRUCTIONS
L-4.1. The instructions below prescribe the format of proposals. Proposals shall include all of the information requested in the specific instructions. Failure to include all information requested may adversely affect the evaluation.
L-4.2. A proposal that is orderly and sufficiently documented will enable the Government to easily understand and perform a thorough and fair evaluation. The Government may incorporate into this contract, by reference or full text, portions of the successful offeror’s proposal submitted in response to this solicitation as revised and supplemented through the final proposal revision.
L-4.3. Proposal Format. A complete proposal consists of two (2) separate volumes: Past Performance and
Cost/Price.
L-4.3.1. Page Format. The proposal text shall be printed single-sided versus duplex. Type size for text shall not be smaller than Microsoft Word Times New Roman, 10 point, single column, nor proportional spacing and one inch
(1”) margins (top, bottom, left and right). Text for charts, tables, graphs, and figures shall be no smaller than
Microsoft Word Times New Roman, 8 point, and used only when absolutely necessary.
L-4.3. 2. Electronic Copies. Electronic copies of all proposal information for each volume shall be e-mailed to Tad

EXECEPTIONS
The Government reserves the right to award without discussions; therefore, offerors are advised that taking exception to any requirements specified in this solicitation may result in the Government finding the proposal unacceptable. Clarification of Government requirements shall be handled by submitting questions/recommendations.
