Justification and Approval (J&A) for Other Than Full and Open Competition

I. Contracting Activity.

The Contracting Activity is the Operational Contracting Flight, AFTC/PZIOA, Eglin AFB, FL 32542-6862.

II. Nature and/or description of the action being processed.

The 782nd Test Squadron (782 TS) Seekers and Sensors Test Flight (RNWI) has a requirement for 2 Commercial Off the Shelf cold filtered brand name FLIR Midwave Infrared (MWIR) cameras. This action will be solicited on FBO for brand name FLIR equipment and result in a firm fixed price contract.

III. Description of supplies/services required to meet agency needs.

The 782nd Test Squadron (782 TS) Seekers and Sensors Test Flight (RNWI) has a requirement for 2 Commercial Off the Shelf brand name FLIR cold filtered Midwave Infrared (MWIR) cameras.

- Gigabit Ethernet (GigE) output and be GigE Vision/GenICam compliant

IV. Statutory authority permitting Other than Full and Open Competition.

41 U.S.C. 1901 as implemented by FAR Subpart 13.5, Simplified Procedures for Certain Commercial Items.

V. Demonstration that the contractor's unique qualifications or nature of the acquisition requires the use of the authority cited above (applicability of authority).

This item is peculiar to one manufacturer. FLIR is the only vendor that makes the cold filtered version of the X8500sc series IR imager that will integrate into the 782d's existing data acquisition capability. It is the only equipment that meets the unique technical specifications and is 100% compatible with existing computer, software and training infrastructure. Other manufacturers' systems would require additional or specialized modifications to existing computer infrastructure and existing equipment, resulting in schedule delays and integration cost that could not reasonably be expected to be recovered through competition. If FLIR equipment isn't purchased, there would be a schedule delay of approximately 1 year, and duplication costs in excess of . Due to time constraints, requirement, and compatibility with existing computer, peripherals, software and training infrastructure, the FLIR X8500sc camera system is the only system that fulfills mission requirements.

VI. Description of efforts made to ensure that offers are solicited from as many potential sources as practicable.

This particular model is not currently available on GSA Schedule; however, FLIR has multiple resellers for its cameras on the open market, both small and large businesses.

VII. Determination by the Contracting Officer that the anticipated cost to the Government will be fair and reasonable.

The Contracting Officer anticipates adequate price competition. Anticipated costs will be determined fair and reasonable based on price analysis in accordance with FAR 13.106-3(a).

VIII. Description of the market research conducted and the results, or a statement of the reasons market research was not conducted.

Market research was conducted in accordance with FAR part 10 to determine if other sources were available that would fulfill the equipment specifications required to meet the mission needs. Although there are other companies that offer this type of equipment, FLIR Systems, Inc. brand is the only brand name that offers a product that will fulfill the current technical specifications and requirements and is compatible with existing peripherals. Market research was accomplished through internet searches, trade journal reviews, evaluation of vendor system data sheets, system software and hardware demonstrations, and direct correspondence.

IX. Any other facts supporting the use of Other Than Full and Open Competition.

Accordingly, FLIR Sytems, Inc. brand name is currently the only brand capable of providing the supplies described in Section III above without the U.S. Air Force experiencing substantial duplication of cost that could not be expected to be recovered through open competition and unacceptable delays in fulfilling its requirements since they have already provided government estimates that were attained during market research. It is anticipated that the Government would spend a significant amount in additional research, test and evaluation of another manufacturer’s product.

X. List of sources, if any, that expressed interest in the acquisition.

FLIR has a listing of Distributors of their products.

XI. A statement of the actions, if any, the agency may take to remove or overcome any barriers to competition before making subsequent acquisitions for the supplies or services required.

If additional equipment is needed in the future, the requirement’s office will assess the market to determine if any new equipment with the needed capabilities have become available. If any new equipment with the required capabilities are available, competition will be conducted.
