1. DESCRIPTION OF SERVICES.

Basic Services: The mission of the 308th Rescue Squadron (RQS), Patrick AFB, FL, to organize train, equip, and sustain Pararescuemen (PJs) for rapid worldwide deployment in support of the full range of Special Operations missions. The U.S. Navy is the Department of Defense single point manager and proponent for all military diving matters. The Navy Safety Center annually inspects each of the RQS dive locker operations. To ensure mission success and personnel safety, it is imperative that diving and associated mission support equipment is maintained at peak operational readiness levels IN ACCORDANCE WITH Navy guidelines. If Navy guidelines are not available for certain types of equipment, adherence to manufacturer’s specifications is required. Navy guidelines are very stringent and RQS dive lockers must be in compliance. To maintain compliance and insure operational readiness, the RQS must have highly qualified and experienced dive locker personnel, who have extensive and practical knowledge of: U.S. Navy Maintenance and Material Management (3M) system; maintenance and repair of SCUBA and oxygen diving systems; and the ability to conduct informal classroom as well as supervise dive training operations IN ACCORDANCE WITH the U.S. Navy, MAJCOM, and general diving/maritime operations training procedures.

1.2. SPECIAL REQUIREMENTS

1.2.1. Contractor Full-Time Equivalent Reporting. “The contractor shall report ALL contractor labor hours (including subcontractor labor hours)” required for performance of services provided under this contract for the Dive System and Maritime Equipment Maintenance contract/Ambulance Contract via a secure data collection site. The contractor is required to completely fill in all required data fields using the following web address http://www.ecmra.mil.

Reporting inputs will be for the labor executed during the period of performance during each Government fiscal year (FY), which runs October 1 through September 30. While inputs may be reported any time during the FY, all data shall be reported no later than October 31 of each calendar year. Contractors may direct questions to the ECMRA help desk.”

Uses and Safeguarding of Information: Information from the secure web site is considered to be proprietary in nature when the contract number and contractor identity are associated with the direct labor hours and direct labor dollars. At no time will any data be released to the public with the contractor name and contract number associated with the data.

1.2.2. Technical: The contractor shall work with the 308 Rescue Squadron (RQS) and Major Command (MAJCOM) diving program manager to identify area where technology advances in diving and maritime operations that can benefit the commence. Specifically, the contractor should look for solutions to technology gaps, resource protection, and enhanced equipment training methodology that will save training time, funding, or enhance combat survivability of battlefield airman during water operations.

1.2.3. The contractor shall assist the 308 RQS by providing technical experience in the operation and maintenance of assigned diving equipment, boats, and outboard motor, and operate boats during unit dive operations at the discretion of the unit commander. In addition, contractor dive locker technician shall support waterborne operations designed to enhance the combat readiness and collective skills of Pararescuemen. Military diving experience and credibility in the Navy dive community are essential to successful delivery of the required service.

1.2.4. RQS Master Diver:

1.2.4.1. The contractor shall be a military trained and certified Master Diver in accordance with AFI 10-3501, Chap. 1, Para. 1.3.3. and NAVSEA SS521-AG-PRO-010 U.S. Navy Diving Manual.

1.2.4.2. The contractor will demonstrate knowledge of U.S. Navy recompression chamber operation and have a thorough familiarity with recognition and treatment of diving emergencies as outlined in the NAVSEA SS521-AG-PRO-010 U.S. Navy Diving Manual.

1.2.4.3. The contractor will have to perform pre-operation maintenance and have experience in operation of high pressure air systems.

1.2.4.4. The contractor will implement and employ the U.S. Navy 3M system IN ACCORDANCE WITH NAVSEA SS521-AG-PRO-010 U.S. Navy Diving Manual and AFI 10-3501 as it applies to diving for near, mid, and long-term equipment requirements.

1.2.4.5. The contractor shall have the technical background and communication skills to conduct and analyze a variety of dive and related equipment tests and inspections as well as advise and assist 308 RQS subject matter experts. This includes diver breathing air sample testing, high pressure air flask/tank hydrostatic testing, high pressure air hose proof testing, dive system gauge testing, and SCUBA regulator air flow/purge flow and opening effort testing.

1.2.4.6. The contractor will possess ability to read blueprints and schematic drawings, understand specifications, and interpret illustrated parts breakdowns and other publications used in the field of specialization.

1.2.4.7. In addition to U.S. Navy dive regulations, the contractor shall be knowledgeable of USAF regulatory guidelines and instructions related to dive operations as outlined in AFI 10-3501.

1.2.4.8. Shall have a Florida Certificate of Boating Education to perform Boat Master Duties.

1.2.4.9. Shall be certified in accordance with COMNAVSEASYSCOM Diving Advisory 13-06 to conduct maintenance on US Divers Conshelf 14 Regulators.

1.2.4.10. Shall be a certified Level B Divator Service and Maintenance Technician to conduct maintenance on Interspiro MK-IIG/MK-20 Full Face Mask Breathing Valves/Regulators.

1.2.4.11. The contractor shall have USAF Test Measure and Diagnostic Equipment (TMDE) Coordinator Certification.

1.2.5. The contractor shall execute the following activities:

1.2.5.1. Schedule, direct, and monitor 3M system while keeping apprised of changes/directives issued by U.S. Navy. The contractor shall be proficient in most current version of Navy SKED Program. The contractor shall be granted Common Access Card credentials to obtain data and information through computer-based information system via the Internet.

1.2.5.2. Administer all daily, weekly, monthly, quarterly, and annual or greater 3M maintenance requirements for assigned diving related equipment.

1.2.5.3. Conduct inventories of 308 RQS diving equipment, watercraft, and engines.

1.2.5.4. Schedule calibration of all diving related gauges and special instruments.

1.2.5.5. Contact hydrostatic testing of SCUBA bottles in accordance with Department of Transportation regulations.

1.2.5.6. Schedule and complete routine preventative maintenance and minor repairs as required by the original equipment manufacturer (OEM). Major repairs and overhauls are to be accomplished by a manufacturer’s authorized service facility or equivalent.

1.2.5.7. Maintain update regulations, publications, and directives required by Naval Sea Systems Command (NAVSEA) and Naval Safety Center pertaining to waterborne operations. The contractor shall be granted Common Access Card credentials to obtain data and information through computer-based information system via the Internet.

1.2.5.8. Advise users concerning equipment capabilities and maintenance requirements. Work to resolve maintenance problems and advise users of problems outside the contractor’s ability.

1.2.5.9. When requested, advise/assist in Air Force and Navy investigations and analysis of accidents, incidents, and failures. Provide technical expertise and assistance in report writing.

1.2.6. The contractor will provide operational support to RQS as follows:

1.2.6.1. Conduct formal classroom or informal training in the maintenance of assigned equipment/systems ancillary equipment. The contractor shall hold a Master Training Specialist Qualification AFI 10-3501, Chap. 1, Para. 1.3.6.

1.2.6.2. When requested, assist the squadron training and scheduling section with planning, coordinating, and conducting training in open-water diving, maritime operations, rough water operations, and low visibility diving/underwater mechanical dexterity training. Required training may include, but is not limited to tactical diving and waterborne operations Rigging Alternative Method Zodiac (RAMZ) airdrop, low-attitude low-speed helicopter deployed inflatable, and high-altitude inflatable airdrop and deployable.

1.2.6.3. When requested, at the discretion of unit commanders, provide boat driver support for unit training when qualified military boat drivers are unavailable.

1.2.7. The contractor will demonstrate the following experience and qualifications:

1.2.7.1. The contractor will have experience and qualifications in the operation of U.S. Navy approved underwater breathing equipment, support systems, and recompression chambers NAVSEA SS521-AG-PRO-010 and AFI 10-3501.

1.2.7.2. The contractor will demonstrate experience and qualifications as a Diving Salvage Warfare Specialist in accordance with NAVEDTRA 43910-A Personnel Qualification Standard. The contractor shall have experience and qualifications in the use of U.S. Navy Planned Maintenance System as outlined in OPNAVINST 4790.4D/NAVSEA INST 4790.8B as well as demonstrate experience in the use of Navy Safety Center, Dive Jump Reporting System NAVSEA SS521-AG-PRO-010 U.S Navy Dive Manual.

1.2.7.3. The contractor shall obtain certification by 308 RQS Boat Master to operate the following water craft: 35 ft Safe Boat, 28 ft Whaler, 24 ft RHIB, MK 5 Zodiac, and Zodiac EVOL in accordance with to paragraph 1.2.5.2 . Certification shall include the performance of basic preventative maintenance of this equipment and related trailer components. This includes Flush Engine Cooling System and conducting pre-operation and in-transit trailer inspections and removal of contaminates from water craft via rinsing with water.

1.2.7.4. The contractor will ensure maritime equipment such as Zodiacs, Outboard Motors, Whalers, Rib Craft, and Alternate Rescue Craft is serviceable prior to use. Unserviceable equipment will be reported to vehicle maintenance section at soonest possible convenience.

1.2.7.5. The contractor shall be experienced in preventative maintenance, maintenance, and repair of dive breathing air compressor systems demonstrated NAVSEA SS521-AG-PRO-010.

1.2.8. Maritime operations shall be a primary responsibility. The contractor will demonstrate experience and qualifications in the following as outlined in AFI 10-3501, Chap. 5, Para 7 and 8.

1.2.8.1. Zodiac RAMZ, Soft Duck, T-Duck and Hard Duck package recovery procedures, parachute and swimmer recovery.

1.2.8.2. Waterborne, Zodiac Hard Duck package pallet recovery and towing.

1.2.8.3. Experience in the maintenance and use of HP air compressors and use of Authorized for Navy Use (ANU) approved underwater tools as outlined for U.S. Navy 3M systems.

1.2.8.4. Small Craft operation, Navigation and Rule of the Road, Seamanship and Maritime Communication course.

1.2.8.5. Shall be experience to provide classroom and operational training in the use and maintenance of Side Scan and Diver Hand Held Sonar Systems.

1.2.9. Additional duty requirements shall include:

1.2.9.1. Maintaining the Material Safety Data Sheet (MSDS) and hazardous material program for dive operations.

1.2.9.2. Provide boat party support during RAMZ maritime training operations as boat operator as boat operator and provide boat operator training as noted in paragraph 1.2.5.2.

1.2.10. The contractor shall keep the Functional Area Chief (FAC) and Contracting Officer’s Representatives (COR), and others as designated by the FAC, informed of task status and progress by, as a minimum, monthly reports, written correspondence, and meeting.

1.2.11. The contractor shall be able to obtain and maintain a secret clearance.

1.3. Deliverables and Delivery Schedule: Contractor shall provide the following Contract Date Requirement List (CDRL) as stated below:

CDRL A0001: Monthly Status Report: Submit one (1) copy to the 308 RQS/LG by the 10th of the following month (reference SOW Para 1.3.1.).

CDRL A0002: Dive Report: Submit one (1) copy to the Naval Safety Center as required (reference SOW 1.3.2.).

CDRL A0003: Maintenance Report: Submit one (1) copy to the 308 RQS/LG as required (reference SOW 1.3.3. and OPNAV 4790).

CDRL A0004: Trip Reports: Submit one (1) copy to the 308 RQS/DO as required (reference Para 1.3.4.)

CDRL A0005: Mishap Report: Submit one (1) copy to 308RQS/DOV and 308RQS/OGV 72 hrs after event occurs (reference SOW Para 1.3.5 and OPNAV 5102.1C).

CDRL A0006: AFTO Form 17, Marine Masters Operation & Maintenance Log: Submit one (1) copy to 308RQS/LG as required (reference SOW 1.3.6. and AFSOC 36-2204).

CDRL A0007: Training Policy: Submit one (1) copy to 308RQS/DOV as required (reference SOW 1.3.7. and AFSOC 36-2204).

CDRL A0008: Distribution: Distribution shall be made to the respective organization listed below. 308RQS/DOPJ, 734 Spacelift Ave, MS9213, Patrick AFB FL 32925, or 920RQG/OGV, 734 Spacelift Ave, MS9213, Patrick AFB FL 32925.

1.3.1. Monthly Status Report: Contractor shall provide the Government a written monthly progress report containing Contractor progress, status, and management updates by the tenth of the following month. The report shall address at a minimum, training conducted and work progression during the past month, training and diving operation compliance issues, actions to be taken to resolve discrepancies, and future planning initiatives. The report may be submitted electronically if readable by MS Word 6.0. Reference CDRL A0001.

1.3.2. Dive Report: Submit dive reports using the computerized Dive Reporting System to the Naval Safety Center IN ACCORDANCE WITH OPNAV 31 50.28A. Reference CDRL A0002.

1.3.3. Maintenance Report: As required, prepare oral/written reports/recommendations to correct deficiencies in all aspects of waterborne equipment maintenance. Reference CDRL A0003.

1.3.4. Trip Report: The Contractor shall provide a trip report in each instance. The report may be submitted electronically if readable by MS Word 6.0. Reference CDRL A0004.

1.3.5 Mishap Report: When requested, advise/assist in Air Force and Navy investigations and analysis of accidents, incidents, and failures. As required, provide inputs in written form. As required, develop briefings and information papers related to maintenance and operational problems for dissemination to Special Tactics personnel. Reference CDRL A0005.

1.3.6. AFTO Form 17, Marine Masters Operation and Maintenance Log: The Contractor shall maintain AFTO Form 17 for all watercraft. When requested or required, provide copies of the log to appropriate agencies as required by local, national, or international law. Reference CDRL A0006.

1.3.7. Training Policy: When requested, assist the RQS Training and Standards/Evaluations Sections in the development and drafting of diver training policies, directives, and regulations for review and approval by the 308RQS/DOV/920RQG/OGV. Reference CDRL A0007.

1.3.8. Distribution: Distribution shall be made to the respective organization listed below.

3. GOVERNMENT FURNISHED PROPERTY AND SERVICES.

3.1. The Government will furnish or make available to the contractor any services deemed necessary to fulfill performance objectives outline in Statement of Work (SOW). The government shall provide desks, workspace, utilities, electrical power hookups, personal computers, telephone access, LAN access, and all related equipment, tools, and supplies to conduct dive operations and maintenance functions. The contractor shall keep workspace neat and orderly and will dispose of trash at the end of each duty day.

3.1.1. The Government will provide all required equipment for maritime operations. This includes dive apparatus and boats.

4. GENERAL INFORMATION.

4.1. POINT OF CONTACT. The Contractor shall provide a point of contact that shall be responsible for the performance of the work. The point of contact shall have full authority to act for the Contractor on all matters relating to the daily operation of this contract. The point of contact may be the contract employee providing services in accordance with this PWS. The Contractor shall designate this individual, in writing, to the CO before the contract start date. An alternate may be designated, but the Contractor shall identify those times when the alternate shall be the primary point of contact.

4.2. Continuity of Services: If routine services are disrupted for more than fourteen (14) consecutive scheduled shifts, the Government reserves the right to procure such services from another source, until routine services are restored by the Contractor. When the Government exercises its right to procure these services from another source, the Government will reduce the Contractor's invoice at an equivalent amount to that incurred. A copy of the other source’s service ticket will be used as the basis for this reduction. The Government will furnish the Contractor a copy of this ticket upon the Contractor's request.

4.3. Conflict of Interest: The contract employee shall not be a person who is an employee of the United States Government if the employment of that person would create a conflict of interest. The contract employee shall not be a person who is an employee of the Department of the Air Force, either military or civilian, unless such person seeks and receives approval in accordance with DoD Directive 5500.7, Standard of Conduct and Air Force policy.

4 4. EMERGENCY HEALTH CARE: The 45 Medical Group will provide emergency health care for the contract employee for injuries occurring while on duty. These services will be billed to the Contractor at the current full reimbursement rate.

5. Security Requirements

5.1. Employee Criminal Background Check: In accordance with DOD Regulation 5200.2-R, Department of Defense Personnel Security Program, paragraphs 3-614 and Appendix K, all contractor personnel having access to Government computer systems shall be subject to a favorable background investigation, to include fingerprinting, to be conducted by the Government. The contractor shall complete the necessary background check prior to the employee staring work on site.

5.2. Contractor personnel shall have a minimum of a secret clearance at the start of performance. Refer to the DD Form 254 prepared for this requirement for additional security requirements.

5.3. Security Clearances: Certain task orders will require the contractor to work with documents with security classifications up to, and including, SECRET. All contractor personnel assigned to work on the contract shall hold a SECRET or higher clearance prior to being assigned work compatible with the level of clearance. The contractor shall provide a copy of the applicable security clearances, if not already provided, to both the Contracting Officer and the QA personnel before performance is scheduled to begin.

5.4. Document Accountability: The contractor shall maintain accountability records for contractor generated and received classified material in accordance with DoD 5220.22M (Document can be viewed at: http://www.dss.mil/isecfnispom 01 95.htm).

5.6. Contractor classified accountability record/receipts, or AF Form 310, Document Record and Receipts, shall be used for accountability of classified material, to include transfer and destruction. Contractor facilities for the storage of classified material shall meet the requirements of DoD and Air Force industrial security policies and procedures.

5.7. Notifications to Security Forces: The contractor shall notify the security forces at Patrick AFB, FL or any installation on which work is being performed under this contract, as to the details listed in AFFARs Clause 5352.242-9000. The contractor is required to notify the security forces at least 30 days before operations are to begin on base.

6 QUALITY CONTROL

6.1. Quality Control Program: The contractor shall establish a complete quality control program to assure the requirements of the contract are provided as specified. One copy of the contractor's quality control plan will be provided to the contracting officer as part of the proposal submission.

6.2. QUALITY ASSURANCE. The government will periodically evaluate the contractor’s performance by appointing a representative(s) to monitor performance to ensure services are received. The government representative will evaluate the contractor’s performance through intermittent on-site inspections of the contractor's quality control program and receipt of complaints from base personnel. The government may inspect each task as completed or increase the number of quality control inspections if deemed appropriate because of repeated failures discovered during quality control inspections or because of repeated customer complaints. Likewise, the government may decrease the number of quality control inspections if merited by performance. The government will also investigate complaints received from various customers located on the installation. The contractor shall be responsible for initially validating customer complaints. However, the government representative shall make final determination of the validity of customer complaint(s) in cases of disagreement with customer(s).

6.3. If any of the services do not conform to contract requirements, the Government may require the Contractor to perform the services again in conformity with contract requirements, at no increase in contract amount. When the defects in services cannot be corrected by re-performance, the Government may:

6.4. Require the Contractor to take necessary action to ensure that future performance conforms to contract requirements.

6.5. Reduce the contract price to reflect the reduced value of the service.

6.6. Contracting Officer Representative (COR)

6.6.1. The Contracting Officer Representative (COR) is the authorized government representative(s) who will perform assessments of the contractor’s performance. Subsequent to contract award, the identity of the COR(s), with a letter defining their duties and authority will be provided.

6.6.2. The COR (s) or alternate(s) will inform the contract manager in person when discrepancies occur and will request corrective action. The COR(s) or alternate(s) will make a notation of the discrepancy on their assessment checklist with the date and time the discrepancy was noted and will request the contract manager (or authorized representative) to initial the entry on the checklist.

6.6.3. Any matter concerning a change to the scope, prices, terms or conditions of this contract shall be referred to the Contracting Officer and not to the COR(s).

6.6.4. The services to be performed by the contractor during the period of this contract shall at all times and places be subject to review by the Contracting Officer or authorized representative(s).

7. PHYSICAL SECURITY: The contractor shall be responsible for safeguarding all government property provided for contractor use. At the close of each work period, government facilities, property, and materials shall be secured.

7.1. Key Control: The contractor shall establish and implement methods of ensuring that all keys/key cards issued to the contractor by the government are not lost or misplaced and are not used by unauthorized persons. (Note: all references to keys also included key cards. No keys issued to the contractor by the government shall be duplicated. The contractor shall develop procedures covering key control that shall be included in the quality control plan. Such procedures shall include turn-in of any issued keys by personnel who no longer require access to locked areas).

7.1.1. The contractor shall immediately report the occurrences of a lost of duplicate key to the contracting officer.

7.1.2. In the event keys, other than master keys, are lost or duplicated, the contractor shall, upon written direction of the contracting officer, rekey or replace the affected lock or locks; however, the government, at its option, may replace the affected lock or locks or perform rekeying. When the replacement of locks or rekeying is performed by the government, the total cost of rekeying or the replacement of the lock or locks shall be deducted from the monthly payment due the contractor. In the event a master key is lost or duplicated, all locks and keys for that system shall be replaced by the government and the total cost deducted from the monthly payment due the contractor.

7.1.3. The contractor shall prohibit the use of keys issued by the government by any persons other than the contractor’s employees. The contractor shall prohibit the opening of locked areas by contractor employees to permit entrance of persons other than contractor’s employees engaged in the performance of assigned work in those areas, or personnel authorized entrance by the Contracting Officer.

7.1.4. Lock Combinations: The contractor shall establish and implement methods of ensuring that all lock combinations are not revealed to unauthorized persons. The contractor shall ensure that lock combinations are changed when personnel having access to the combinations no longer have a need to know such combinations. These procedures shall be included in the contractor’s Quality Control Plan.

7.2. TRAVEL: Travel outside the local area may be required to support the requirements of this task order. All travel must be directed and approved in advance by the COR. Travel shall be reimbursed in accordance with the, Joint Travel Regulation (JTR), Allowable Travel Cost. Contractor personnel are not authorized to travel on Government invitational travel orders. Trip reports will be provided as stated in 1.3, CDRL Deliverables.

7.2.1. The Contractor shall fund all travel and expenses for technical training of on-site Contractors related to the operation, repair, and servicing of existing diving equipment in inventory to include operation of watercraft at time of contract acceptance or options exercised. The Contractor shall also fund all expenses for routine/recurring technical training/certifications required by dive master for any diving equipment and water craft currently in or inventory replacements as a function of meeting specific requirements listed in section 1.2 during the period of the contract.

7.2.2. The 308 RQS shall fund all travel and expenses for technical training of on-site Contractors for new and/or unusual diving equipment and watercraft added to inventory Special Tactics-wide, if required. To qualify for 308th funding, the technical training must be for a new technology/ability that is not currently expected to be held by dive master personnel as outlined in section 1.2.

7.2.3. The 308 RQS shall will fund all travel and expenses for technical training courses related to the operation, maintenance, repair, and servicing of locally purchased unit specific and diving equipment.

7.2.4. The 308 RQS units will fund all travel and expenses for maintenance or servicing of dive equipment. The on-site Contractor is required to perform at an off-site or commercial facility when on-site Government-provided facilities are inadequate to accomplish the work. Determination of adequate facilities for servicing and maintenance tasks rests with the Contracting Officer Representative (COR)

8. HOURS OF OPERATION.

8.1. Normal Hours of Operation: The contractor shall perform the services required under this contract during the following hours: 0730-1630, Monday through Friday and normally scheduled Unit Training Assemblies. As required by 308 RQS, night operations between the hours of 1600-0600 are required and will be scheduled on an as needed basis, not to exceed 80 hours per pay period. The contractor may work, with prior approval of the Contracting Officer, extended hours to ensure timely completion of work at no additional cost to the government.

8.2. Planned overtime must be approved by the unit commander providing the fund source and the contract program manager will be notified in writing prior to overtime usage. Overtime that is not pre-approved may only occur in support of critical mission training or emergency situations. The contractor will provide a written accounting and explanation, within 72 hours of the event, to the same parties required notification for planned overtime.

8.3. Federal Holidays: There are ten (10) federal holidays each year. They are New Year’s Day (observed 1 January), Martin Luther King, Jr’s Birthday (observed the third Monday in January), President’s Day (observed the third Monday in February), Memorial Day (observed the fourth Monday in May), Independence Day (observed 4 July), Labor Day (observed the first Monday in September), Columbus Day (observed the second Monday in October), Veterans Day (observed 11 November), Thanksgiving Day (observed the fourth Thursday in November), and Christmas Day (observed 25 December). If New Year’s Day, Independence Day, Veterans Day or Christmas Day falls on a Saturday, it is observed on Friday; if it falls on Sunday, it is observed on Monday.

8.4. Essential Services: The services under this contract are essential for performance during crisis according to DODI 1100.22. Specified hours of operation shall be provided for continuation of services for each instance as required. The Contractor shall be notified verbally and/or in writing by the on-site commander or the designated representative of the assigned unit when services are essential for performance during a crisis situation.

9. CONSERVATION OF UTILITIES: The contractor shall instruct employees in utilities conservation practices. The contractor shall be responsible for operating under conditions which prevent the waste of utilities which include the following:

9.1. Lights shall be used only in areas where and when work is actually being performed.

9.2. Mechanical equipment controls for heating, ventilation, and air conditioning systems shall not be adjusted by the contractor or by contractor employees unless authorized.

9.3. Water faucets or valves shall be turned off after the required use has been accomplished.

9.4. Government telephones shall be used only for official government business.

10. RECORDS: The contractor shall be responsible for creating, maintaining, and disposing of only those government required records that are specifically cited in this PWS or required by the provisions of a mandatory directive listed in Appendix B, Applicable Publications and Forms. If requested by the Government, the contractor shall provide the original record, or a reproducible copy of any such record within five working days of receipt of the request.

11. ENVIRONMENTAL CONTROLS:

11.1. Compliance with Laws and Regulations: The contractor shall be knowledgeable of and comply with all applicable Interstate, Federal, State, and Local laws, regulations, and requirements regarding environmental protection. In the event environmental laws/regulations change during the term of this contract, the contractor is required to comply as such laws come into effect. If there is an increase or decrease in cost as a result of the change, the contractor shall inform the Contracting Officer pursuant to notice requirements and negotiate a modification to the contract.

11.2. Notification of Environmental Spills: If the contractor spills or releases any substance contained in 40 CFR 302 into the environment, the contractor or its agent shall immediately report the incident to Patrick AFB Fire Dept at 911 . The liability for the spill or release of such substances rests solely with the contractor and its agent.

11.3. Material Storage and Use: The contractor shall follow manufacturer’s guidelines and professional recommendations for control of humidity, temperature, cleanliness, and materials handling. This includes hazardous materials.

11.4. GOVERNMENT OBSERVATIONS: Government personnel, other than contracting officers (COs) and contracting officer representative (COR), may from time‑to‑time, with CO coordination, observe contractor operations. However, these personnel may not interfere with contractor performance or make any changes to the contract.

12. SAFETY REQUIREMENTS: In performing work under this contract, the contractor shall:

12.1. Conform to the safety requirements contained in the contract for all activities related to the accomplishment of the work.

12.2. Take such additional immediate precautions as the contracting officer may reasonably require for safety and mishap prevention purposes.

12.3. Develop and provide at the start of the orientation period or the start of the first operational performance period (if there is no orientation period) a safety plan for the protection of government facilities and property and to provide a safe work environment for contractor personnel.

12.4. Provide protection to government property to prevent damage during the period of time the property is under the control or in possession of the contractor.

12.5. Include a clause in all subcontracts to require subcontractors to comply with the safety provisions of this contract as applicable.

12.6. Record and report promptly (within one hour) to the contracting officer or designated government representative (GR), all available facts relating to each instance of damage to government property or injury to either contractor or government personnel.

12.7. In the event of an accident/mishap, take reasonable and prudent action to establish control of the accident/mishap scene, prevent further damage to persons or property, and preserve evidence until released by the accident/mishap investigative authority through the contracting officer.

12.8. If the government elects to conduct an investigation of the accident/mishap, the contractor shall cooperate fully and assist government personnel in the conduct of investigation until the investigation is completed.

13. PHASE IN/OUT:

13.1. If there is a change in contractor or if the operation reverts to in-house, the incumbent contractor will provide familiarization, to the government or the follow-on contractor, whichever the case may be. During the phase-out familiarization period, the incumbent will be fully responsible for the preventive maintenance inspections.

13.2. The government reserves the right to conduct site visits in all contractor operated facilities in conjunction with the solicitation of offers for the follow-on contract. In the event the follow-on contract is awarded to other than the incumbent, the incumbent contractor will cooperate to the extent required to permit an orderly change over to the successful contractor. With regard to the successor contractor’s access to incumbent employees, a recruitment notice may be placed in each facility.

14. PUBLICATIONS:

14.1 Compliance with all publications, regulations and operating instructions provided by the

Government is required when:

14.2. They pertain to the procedures for materials expediting herein and where the contractor is authorized by the statement of work to accomplish the work specified in the publication, regulation or operating instructions.

14.3. The publications prescribe USAF policies, use of materials, procedures and processes applicable to the work requirements.

14.4. The contractor is required to acquire and work on the latest version of the publication
