I. Contracting Activity.

21st Contracting Squadron Peterson AFB, Colorado, Air Force Space Command. Contracting Officer is TSgt Justin W.

Bowers. This is a Justification and Approval for Other Than Full and Open Competition for the SSDP Analytical Graphics Inc (AGI) Systems Tool Kit (STK) Software Licenses/Enterprise Subscription Agreement (ESA) Phase 1 (FY19)

II. Nature and/or description of the action being processed.

The government intends to procure this new firm-fixed price contract for Analytical Graphics INC's System Tool Kit via sole source on the open market.

III. Description of supplies/services required to meet agency needs.

AGI's software product line are sole source products, manufactured, owned, sold, distributed and supported by Analytical Graphics, Inc. (AGI) at 220 Valley Creek Boulevard, Exton, PA 19341. AGI software support must be purchased directly, by institutions, from AGI at the address provided herein. AGI specializes in developing COTS software used by the national security and space communities for analysis and visualization of land, sea, air and space assets.

The associated STK modules provided to the SSDP by the ESA Agreement are below and can be referred to collectively as “Systems Tool Kit.”

The estimated value of an STK Software License subscription from 20 September 2019 - 31 January 2020 is

IV. Statutory authority permitting other than full and open competition.

AFFARS 5313.501 - 10 U.S.C. 2302b, Implementation of Simplified Acquisition Procedures (41 U.S.C. 1901)

V. Demonstration that the contractor's unique qualifications or nature of the acquisition requires the use of the authority cited above (applicability of authority).

Space Security and Defense Program supported by AFSPC/CC utilizes the AGI STK Software Licenses Systems Tool Kit (STK) which is Analytical Graphics, Inc.'s (AGI) flagship product supporting programs across their complete life-cycles;

performing engineering analysis and visualization in concepts development, design engineering, test & evaluation, operations, and post operations analysis for STK technology can be embedded within software development efforts supplying commercial-off-the-shelf (COTS) computational components and situational awareness displays to operations systems.

When acquiring information equipment hardware and/ or software, SSDP must follow the guidance of appropriate

18 Jun 2019 FOR OFFICIAL USE ONLY Page 3 of 4 authorities including purchasing items off of the NRO Approved Product List (APL), the NRO's Software Security Risk Database (SSRDB) and approval by the system's accrediting authority. Therefore, SSDP can only buy hardware and software for classified networks, such as Outlaw, that us listed on the NRO APL. AGI STK Software Licenses are listed on the NRO APL and vetted by the system's accrediting authority as an approved solution for SSDP.

VI. Description of efforts made to ensure that offers are solicited from as many potential sources as practicable.

The requirement for STK software licenses will be posted to a GPE and public access of the proposed contract action will allow any vendor who can meet the requirements outlined in section III will be afforded an opportunity to respond to the solicitation electronically.

Although the solicitation will be posted to a GPE, it is important to note that Analytical Graphics, Inc. (AGI) was contacted to provide a list of authorized resellers; however, instead of providing a list of resellers, the company provided a sole source letter stating that they do not have any authorized resellers and STK software licenses are sole source products, manufactured, owned, sold and distributed by AGI.

VII. Determination by the Contracting Officer that the anticipated cost to the Government will be fair and reasonable.

Prior to making award, the Contracting Officer will determine that the proposed price is fair and reasonable IAW FAR 13.106-3(a)(2).

VIII. Description of the market research conducted and the results, or a statement of the reasons market research was not conducted.

Analytical Graphics, Inc (AGI) was contacted to get a list of resellers for their products. AGI returned a sole source letter dated 23 January 2019 stating they are the only vendor authorized to sell their licenses.

IX. Any other facts supporting the use of Other Than Full and Open Competition.

Hardware and software items associated with AGI STK software licenses are listed on the NRO APL and vetted by the system's accrediting authority as an approved solution for SSDP. Only AGI STK software licenses off the APL and Trade Agreement Act (TAA) compliant products can be purchased.

X. List of any sources that expressed, in writing, an interest in the acquisition.

Analytical Graphics Inc (AGI) expressed interest in this acquisition when submitting their sole source letter for STK Licenses.

XI. A statement of the actions, if any, the agency may take to remove or overcome any barriers to competition before making subsequent acquisitions for the supplies or services required.

At the time of any future acquisitions of this type the market will be surveyed again, in an attempt to identify potential sources that can satisfy this requirement.
