Section B: Description of the Supplies/Services Required

The 721st Security Forces Squadron ( 721 SFS) at Cheyenne Mountain Air Force Station (CMAFS) has a requirement for the purchase, delivery, and training usage of two (2) Heuresis HBI-120 Hand-held X-Ray Scanners or equal. The X-ray scanners need to have two (2) Li-ION rechargeable battery packs providing up to four (4) hours use per battery on typical duty cycle. A 110/220 VAC battery charger; also supports operation on AC/Mains power. Must have a lockable, waterproof case with wheels. A PC interface cable that connects to the attached transreflective 720 x 1,280 pixel color touchscreen LCD display. A built-in macro camera and flashlight. Training material must have a Quick Start Guide and Electronic User Guide. The two x-ray scanners must also be able to operate in temperatures ranging from -20 degrees F to 100 degrees F.

Section C: Justification for Soliciting from a Single Source or Brand Name

The 721st SFS requires that the x-ray scanner be hand-held, have an attached touchscreen, and an operating temperature range of at least -20 degrees F to 100 degrees F. The touchscreen needs to be attached to the scanner for real time analysis of the property and vehicles being scanned. Other x-rays without a screen attached do not provide the real time analysis of property and vehicles and therefore would result in a lag of scanning abilities. The temperature range is needed because these x-rays will be located at CMAFS security checkpoints. CMAFS is located within a mountain and the scanning will be done on the outside at the security checkpoints before entering the mountain base. Temperatures can vary from -20 degrees F to 100 degrees F at any one time for this austere location.

The above requirements for the two hand-held x-rays lead the market research to the Heuresis HB-120. As the manufacturer of this hand-held x-ray, Heuresis is the only source capable of offering the HBI-120 Hand-held X-Ray Scanner. This requirement became a Brand Name specific purchase but also a sole source as Heuresis is the only company that produces this hand-held x-ray and sells it. The HBI-120 Hand-held X-Ray Scanner will be utilized to scan personal belongings and vehicles entering CMAFS Protection Level 1 (PL-1) Restricted Area (RA). If this equipment is not procured, the 721 SFS will not be adequately equipped to secure personnel and vehicles entering the PL-1 RA. The particular Heuresis brand product is essential to the Government's requirements and per the market research conducted, other companies do not provide the Heuresis product or an acceptable "or equal" product.

Section D: Efforts to Obtain Competition

A Sources Sought was conducted via FedBizOpps (FBO) on 28 August 2018 with a closing date of 5 September 2018.

The Sources Sought results identified that there is (1) one large business and (3) three small businesses that can provide hand-held x-ray scanners. Another vendor, Heuresis, was identified during the customers market research efforts. Only one (1) vendor (Heuresis) provided the Heuresis HBI-120 which met the 721 SFS's requirements. One (1) of the four (4) remaining vendors provided a hand-held x-ray scanner but not to the specifications required.

Section E: Steps to Preclude Future Single Source or Brand Name Awards

The Government will continue to make a conscious effort to avoid sole source and limited source vendors that could provide the product for this requirement in the event another Hand-held X-Ray Scanner has to be replaced again in its entirety. With technology advances, the Government is expecting that other companies will provide similar products in the future that would satisfy the requirement. A consideration in the market research phase for new scanner purchases will be presented to the requirements function. This will allow the requiring activity access to whether or not other companies have proprietary software or restrictions that limit other companies from providing their equipment.

Section F: Contracting Officer's Determination

I have determined, in accordance with FAR 13.106-1(b)(1), that the circumstances of this contract action deem only a single source is reasonably available.
