(ix) FAR 52.212-2 EVALUATION--COMMERCIAL ITEMS (OCT 2014)
(a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be best value to the Government in accordance with FAR 13.106-2, price and other factors considered. Proposals are evaluated for acceptability, but not ranked using the non-price factors/subfactors. In order to be considered awardable, there must be an “acceptable” rating in every non-price factor/subfactor. The technical proposal factors and subfactors will be evaluated on a technically acceptable basis providing there’s enough detail to determine the contractor will successfully perform the requirement as outlined in the PWS and its appendixes and attachments. The following factors shall be used to evaluate offers:
Factor 1: Technical Capability
Recruitment Plan - Describe the requirement and placement plan, the methods to recruit qualified and competent personnel to ensure medical services commence when required. Understanding of market in which performance is required to include the requirement strategy. Describe processes for initial verification of licensure, certification, education and completion of the health requirements. Describe processes for ensuring licensure, certification, experience and health requirements are kept current. Describe company policy and plan to retain employees and/or subcontractors with minimum turnover. Explain any retention, relocation or bonus incentives used. Provide a list of proposed subcontractor to be utilized under the resulting contract or if none are listed, the Government will assume that the awarded company will provide the service.
Executive Summary - The Offeror’s narrative summary of the entire proposal shall be included in technical and should be concise, to include addressing the significant risks, and highlighting any key or unique features, excluding price.
The Government shall evaluate the offeror’s proposal against these requirements to determine whether the proposal is acceptable or unacceptable, using the ratings and descriptions outlined in Table 1.
Table 1. Technical Acceptable/Unacceptable Ratings
Rating
Description
Acceptable
Proposal clearly meets the minimum requirements of the solicitation.
Unacceptable
Proposal does not clearly meet the minimum
requirements of the solicitation.
Factor 2 Past Performance
A) Past performance evaluations will be conducted using information provided with the offer, information obtained from references, information obtained from the Past Performance Information Retrieval System (PPIRS), and information from any other sources deemed appropriate. When evaluating past performance the government may consider the currency and relevancy of the information, the source of the information, the context of the data provided, and the general trends in the contractor's performance. The government may take into account past performance information regarding predecessor companies, key personnel who have relevant experience and/or subcontractors that will perform major or critical aspects of the requirement. An offeror that has no available relevant past performance history will not be evaluated favorably or unfavorably.
B) Offerors are cautioned that the Government may review available past performance data available in the PPIRS. The Government reserves the right to obtain past performance information from any available source and may contact customers other than those identified by the Offeror when evaluating past performance. Since the Government may not necessarily interview all of the sources provided by the Offerors, it is incumbent upon the Offerors to explain the relevance of the data provided. Offerors are reminded that the burden of proving low performance risk rests with the Offerors. Past performance shall be rated on an acceptable/unacceptable basis. Acceptable is based on the offeror’s performance record, the Government has a reasonable expectation that the offeror will successfully perform the required effort. Unacceptable is based on the offeror’s performance record, the Government has no reasonable expectation that the offeror will be able to successfully perform the required effort.
Factor 3. Price
Price Reasonableness: This section is to assist the Offeror in providing the pricing information required to evaluate the reasonableness and balance of the proposed price. Compliance with these requirements is mandatory and failure to comply may result in rejection of the proposal. Note that unreasonably high proposed prices, initially or subsequently, may be grounds for the Government not to proceed with award. Additionally, unbalanced pricing poses an unacceptable risk to the Government and may render a proposal un-awardable. The burden of proof for credibility of proposed prices rests with the Offeror.
(b) Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s). The Government shall rank quotes lowest to highest price which are technically acceptable.
(c) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), unless a written notice of withdrawal is received before award.
(End of provision)
(x) The provision at FAR 52.212-3, Offeror Representations and Certification—Commercial Items, with Alternate I, is applicable to this acquisition. Ensure all Representations and Certifications are updated in SAM.
(xi) The clause at FAR 52.212-4, Contract Terms and Conditions-Commercial Items, applies to the acquisition.
(xii) The clause at FAR 52.212-5 -- Contract Terms and Conditions Required to Implement Statutes or Executive Orders -- Commercial Items (DEVIATION), applies to this acquisition. See Attachment 1 for full text.
