25 May 2018 Page 2 of 4

I. Contracting Activity.

Air Force Material Command (AFMC) AFTC/PZIE, Air Force Test Center, 205 West D Avenue, Bldg. 350, Ste 414, Eglin AFB, FL 32542 is the contracting activity responsible for this justification for other than full and open competition.

II. Nature and/or description of the action being processed.

AFTC/PZIE intends to solicit on a brand name basis for Silvus Technologies, Inc. (Silvus) in accordance with FAR 13.5, Simplified Procedures for Certain Commercial Items. This requirement is commercial and will be a Firm Fixed Price contract estimated at . Delivery is required by no later than 30 October 2019 to ensure production schedule is met. Contract is funded with Spectrum Relocation Fund Program using Research Development Test & Evaluation (RDT&E) (3600) funding.

III. Description of supplies/services required to meet agency needs.

Radios are required for the transmission of video and C2 functions on remote targets. Existing radios at the ranges utilize frequencies that the Air Force is in the process of vacating as part of the Spectrum Relocation initiative, the existing radios will not be compliant in the very near future. New radios within the correct frequency ranges must be provided to replace the existing non-compliant radios. In addition to the non-compliance issue, the existing radios provide no encryption capabilities, thus presenting a major security concern, and are extremely costly to maintain and operate. This replacement effort will mitigate all of these issues - lack of security, obsolete technology, O&M ineffectiveness.

This requirement is for the purchase of:

36 Units of Silvus 4240 MIMO Radios 24 Units of Silvus 4480 MIMO Radios Associated hardware accessories:

6.8Ah Battery, Dual Charger, Silvus PTT headset with in-ear bud, Peltor over-ear headset, HD IP Camera ODU cable for 4200 series, ODU cable for 4400 series, AC Power supply, Ethernet Jumper, 36-V battery eliminator, Antenna, OMNI, 6 dBi, 2.2-2.5 GHz, spring base, TNC (m), GPS Module, Modula ODU cable for SC4200-BB, 6"trunk, 6"Ethernet branch, 6" Serial branch, Female Switchcraft connector with pigtails, IP68 cover, ODU Cover for IO multi-pin connectors

IV. Statutory authority permitting other than full and open competition.

Pursuant to 41 U.S.C. 1901, FAR 13.501(a)(1)(ii) procedures are being used for this acquisition. Based on Market Research conducted, there is reasonable basis to conclude that the Government's minimum needs can only be satisfied by unique supplies or services available from only one supplier with unique capabilities. In accordance with Title 10 U.S.C. 2302b, the supplies or services required by the agency are available from one responsible source and no other type of supplies or services will satisfy agency requirements.

V. Demonstration that the contractor's unique qualifications or nature of the acquisition requires the use of the authority cited above (applicability of authority).

Comprehensive equipment testings were conducted for system performance and interoperability with the existing infrastructure. Various radios meeting the threshold/preliminary "performance parameters" were tested to ensure they meet the intended system requirements, as well as their "compatibility" with the existing network communication systems.

Among the different brands tested, Silvus 4240 and 4480 radios outperformed all other brands and models, in terms of "coverage", and "compatibility" with the existing network system. The additional network coverage offered by Silvus equipment will upgrade the existing system into a more superior C2 system, which in turn provides a greater Return on Investment (ROI) ratio for the overall project.

Additionally, due to the compatibility issue, if other brands were to be utilized, modification of existing systems is required, cost associated with the modification efforts is significant and it is unknown at this time.

VI. Description of efforts made to ensure that offers are solicited from as many potential sources as practicable.

These radios manufactured by Silvus are distributed and sold by multiple vendors. This requirement will be provided to the public on FedBizOpps.gov for competitive responses.

VII. Determination by the Contracting Officer that the anticipated cost to the Government will be fair and reasonable.

Pricing will be determined fair and reasonable IAW FAR 13.106-3(a). The Contracting Officer expects adequate competition. The vendor has sold the requested items to multiple non-Government customers providing the Government abundant information for comparison. 96 RANSS/RNR will perform a technical evaluation of the contractor's proposed product for acceptability.

VIII. Description of the market research conducted and the results, or a statement of the reasons market research was not conducted.

Technical Data Sheet (TDS) of the different radios were obtain for performance screening, only those radios meeting the performance parameters were selected for actual equipment testings. Samples of the selected radios were purchased and various follow on equipment testings were conducted at different sites following the preliminary selection. At the end of the initial testing, two brands of radios were selected for product analysis - Persistent and Silvus. After the analysis, only Silvus was determined to be capable to meet the need for this project.

IX. Any other facts supporting the use of Other Than Full and Open Competition.

None.

X. List of any sources that expressed, in writing, an interest in the acquisition.

XI. A statement of the actions, if any, the agency may take to remove or overcome any barriers to competition before making subsequent acquisitions for the supplies or services required.
