Single Source Justification (Simplified Acquisition)

Section A: General Contract Information

Contracting Activity: 60th Contracting Squadron Travis AFB

Purchase Request/ Identification Number:

Project/Program Name: AMO STAR Excimer Laser, Intralase FS Laser, VISX Laser Maintenance

Estimated Contract Cost (including Options):

Section B: Description of the Supplies/Services Required

Services consist of the following: scheduled visits for planned maintenance and intervening service calls as required for repairs on the STAR Excimer Laser System (annual service), INTRALASE FS Laser (annual service), VISX Wavescan Wavefront System (annual service), and provision of CUSTOMVUE Cards (144 Cards Total).

Section C: Justification for Soliciting from a Single Source

Section 4202 of the Clinger-Cohen Act of 1996, as implemented by: FAR 13.106-1(b)(1). Only one source and no other supplies or services will satisfy the agency requirements. These lasers are highly sensitive medical devices that must be maintained to exact manufacturer's specifications to ensure safe and effective ophthalmic applications. The field engineers who will perform the requested services required by the medical center have been trained and certified and are the original equipment manufacturers (OEMs) of these products and are the only ones capable to perform the services on the laser systems.

Furthermore, is the only authorized company to perform scheduled and unscheduled maintenance on the laser systems.

Section D: Efforts to Obtain Competition only source capable of fulfilling the government need. Efforts to obtain competition have included market research with unsuccessful responses. This solicitation and justification will be posted to the primary point of Government entry (Federal Business Opportunities) for 7 days.

Section E: Steps to Preclude Future Single Source Awards

The Air Force centrally procured the subject lasers for all the AF Laser Refractive Centers located at Travis AFB, Keesler AFB, Lackland AFB, Wright-Patterson AFB, Andrews AFB and the USAF Academy. Prior to awarding the contract(s), the AF knew that the OEM only approved AMO to provide maintenance and the CUSTOMVUE cards. These cards are essentially short term licenses. Each card allows five patients to be treated. The equipment cannot be utilized without the cards and only AMO can provide them. There are currently no distributors and failure to maintain this equipment properly could result in damage and excessive repair and/or replacement costs. In the future, if market research reveals that other companies are capable, we will inquire and verify.

Section F: Contracting Officer's Determination

I have determined, in accordance with FAR 13.106-1(b)(1), that the circumstances of this contract action deem only a single source is reasonably available.
