Section C: Justification for Soliciting from a Single Source or Brand Name
Only one responsible source is available to meet this requirement and no other supplies or services will satisfy the agencies requirement. The uniqueness of this requirement is that RELX, Inc. (incumbent contractor) currently provides CALR access to the Air Force, Army and Marine Corps. Therefore, award to any other source would result in unacceptable delays in fulfilling Department of Defense requirements, due to the short duration (30 September 2019 - 30 November 2019) of the bridge contract. Any contract gap would revoke access to legal databases for all DoD military branches. This would severely degrade the effectiveness of DoD military legal capabilities necessary to perform per-trial preparations, agency compliance reviews, evaluation of precedence in legal proceedings, and application of the most current legal interpretations/decisions.
The current contract (FA3300-15-C-0002) is scheduled to expire on 30 Sep 2019. It has been determined to be in the best interest of the Government to reduce the performance of the current contract by one day (30 Sep 2019), to allow the Air Force to use FY19 funds for the new sole source "bridge contract." Based on historical funding for option years of the current contract, fully coordinated Military Interdepartmental Purchase Requests (MIPRs) from all agencies are not expected until mid to late November 2019.
The bridge contract will allow the start date for the new competitive contract to start 1 December 2019. This will allow adequate time for the Air Force to coordinate MIPRs between the other agencies and ensure compliance with regulations, to include the Antideficiency Act (31 U.S.C. section 1341).
The Air Force is unable to provide full funding to award the new contract while the other agencies coordinate MIPRs. In the absence of full funding for the base year, the Contracting Officer would have to issue a stop order on the contract, resulting in mission stoppage. Without a short duration contract in place to bridge the time between the 30 September 2019 expiration of the current contract and the anticipated 1 December 2019 start of the new contract, no military branch will have access to the legal databases.
RELX, Inc. confirmed on 12 April 2019 that they are in concurrence with the intended plan of action to reduce the current contract by one day to allow a 30 September 2019 start date for the bridge action at no cost to the Gov't.
This bridge contract will negate mission stoppage for the legal agencies of the Air Force, Army, Marine Corps, and Navy.
Section D: Efforts to Obtain Competition
On 3 June 2019, an Intent to Sole Source was posted on the GPE (www.fbo.gov) with a close date of 17 June 2019. There were no responses from businesses interested in competing for the proposed "bridge" action.
Section E: Steps to Preclude Future Single Source or Brand Name Awards
Pre-solicitation activities are currently under way for an anticipated competitive award for CALR, utilizing FY20 O&M funding.
That contract is planned to start on 1 December 2019. This start date will preclude the need to perform additional single source actions as it accounts for the lead time of multiple agency funding coordination.

Section F: Contracting Officer's Determination
I have determined, in accordance with FAR 13.106-1(b)(1), that the circumstances of this contract action deem only a single source is reasonably available.
