52.212-2 EVALUATION--COMMERCIAL ITEMS (Oct 2014)

(a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factor(s) shall be used to evaluate offers:

(i) Price

(ii) Past Performance

Price is equal to Past Performance when being evaluated.

(b) Basis for Contract Award

This solicitation is conducted in accordance with Federal Acquisition Regulation (FAR) Part 12, Acquisition of Commercial Items, as supplemented by the Defense Federal Acquisition

Regulation Supplement (DFARS), and the Air Force Federal Acquisition Regulation Supplement

(AFFARS). These regulations are available electronically at the Air Force (AF) FAR Site, http://farsite.hill.af.mil.

A contract will be awarded to the lowest priced offeror whose offer conforms to the solicitation requirements (to include all stated terms, conditions, representations, certifications, and all other information required by Addendum to 52.212-1), and receives an “Acceptable” Past

Performance rating. Failure to provide a complete quote conforming to the entire solicitation

(i.e. 52.212-1, 52.212-2, applicable amendments, PWS & contract provisions/clauses) will result in that offeror not being eligible for award.

(c) Number of Contracts to be Awarded

The Government intends to award one (1) contract as a result of this solicitation.

(d) Evaluation Process

First, the Government will rank all quotes conforming to the solicitation by Total Evaluated

Price (TEP) from lowest to highest.

Secondly, the Government will evaluate past performance. If the lowest priced offeror is evaluated to have a “Acceptable”, performance confidence assessment, award shall be made to that offeror without further consideration of any other offers. If the lowest priced offeror is determined to have an “Unacceptable”, performance confidence assessment, the Government evaluation team will evaluate the next lowest priced offeror until a “Acceptable” performance confidence assessment is achieved or all offerors are evaluated. If all offerors are evaluated and no “Acceptable” is achieved, the Government reserves the right to conduct discussions if it’s deemed to be in the best interest of the Government.

i. Factor One: Price

(1) For the purpose of evaluation the Government will evaluate an offerors proposed price utilizing one or more of the techniques identified in FAR 15.404-

1(b).

(2) Proposed prices shall be fully burdened inclusive of all direct and indirect costs (e.g., profit, fringe benefits, salary, indirect rates and overtime hours). An offeror’s final price will be determined by adding all CLINs the price per pound proposed. Round all prices up to the nearest penny.

ii. Factor Two: Past Performance

(1) The Government shall evaluate an offerors Past Performance using the ratings identified in Table 2.

(2) Offerors must provide (as part of Attachment II) a list of no less than two/no more than three of the most recent and relevant contracts performed for Federal agencies and commercial customers. Point of contract information must be provided for each contract to include name, phone number and email address.

Only the first 3 identified contracts will be evaluated. As part of an offerors past performance, a Staffing Plan must be provided. The Staffing Plan should describe the methods an offeror will employ to hire and retain qualified personnel. The

TABLE 2 – PAST PERFORMANCE RATINGS

Rating Description

ACCEPTABLE

Based on the offeror’s recent/relevant performance record and use of other evaluation methods specified in Section ii(4), the

Government has a high expectation that the offeror will successfully perform the required effort.

UNACCEPTABLE

Based on the offeror’s recent/relevant performance record and use of other evaluation methods specified in Section ii(4), the

Government has a low expectation that the offeror will be able to successfully perform the required effort.

Staffing Plan must also describe the time required to commence performance (i.e how long to start performance). Failure to provide the Staffing Plan will result in that offer being considered nonresponsive and remove them from consideration of award.

The government will evaluate the quality and extent of offeror’s performance deemed relevant to the requirements of the PWS. The evaluation of past performance information will take into account past performance information regarding predecessor companies, key personnel (if applicable) who have relevant experience, or subcontractors that will perform major or critical aspects of the requirement when such information is relevant to this acquisition. The

Government will use the following recency and relevancy definitions when assessing recent and relevant contracts:

(i) Recency Assessment: An assessment of the past performance information will be made to determine if it is recent. To be recent, the effort must be ongoing or must have been performed during the past five

(5) years from the date of issuance of this solicitation. Past performance information that fails this condition will result in a past performance confidence rating of “Unacceptable”.

(ii) Relevancy Assessment: As described in Table 3 below, the

Government will conduct an in- depth evaluation of all recent performance information obtained to determine how closely the provided products/services performed under those contracts relate to the Performance Work Statement (to include magnitude of effort) provided and assign a rating of “Relevant or “Not

Relevant. Magnitude of effort is defined by dollar value. Failure to provide references valued at at least $30,000 per year, will not be considered within the magnitude of effort and will receive a rating of “Not Relevant”. A relevancy determination of the offeror’s past performance will be made based upon the aforementioned considerations, including joint venture partner(s) and major and critical subcontractor(s). In determining relevancy for individual contracts, consideration will be given to the effort, or portion of the effort, being proposed by the offeror, teaming partner, or subcontractor whose contract is being reviewed and evaluated. Past performance information deemed “Not Relevant” will result in an

“unacceptable” past performance rating.

TABLE 3 - RELEVANCY ASSESSMENTS

Rating Definition

RELEVANT Present/past performance effort involved essentially the same scope and magnitude of effort and complexities described in the PWS.

NOT RELEVANT Present/past performance effort involved little or none of the scope and magnitude of effort and complexities described in the PWS.

(4) In conducting the Past Performance evaluation, the Government reserves the right to use both the information provided in the offeror’s Past Performance proposal attachment, and information obtained from other sources available to the

Government, to include, but not limited to, the Past Performance Information

Retrieval System (PPIRS), Federal Awardee Performance and Integrity

Information System (FAPIIS), Electronic Subcontract Reporting System (eSRS), or other databases; interviews with Program Managers, Contracting Officers and

Fee Determining Officials; the Defense Contract Management Agency (DCMA), and commercial sources. Negative past performance found using these sources within the last five (5) years may result in a past performance confidence rating of

“Unacceptable”.

(5) Assigning Ratings. Past performance submissions determined to be neither recent and/or relevant, will result in an offeror receiving a performance confidence assessment of “Unacceptable”. Any negative past performance found may result in an offeror receiving a performance confidence assessment of

“Unacceptable”. Negative past performance found using sources described in paragraph 4 above, may result in a past performance confidence rating of

“Unacceptable”.

NOTE: In the case of an offeror without a record of relevant past performance or for whom information on past performance is not available or so sparse that no meaningful past performance rating can be reasonably assigned, the offeror may not be evaluated favorably or unfavorably on past performance (see FAR 15.305 (a)(2)(iv)). Therefore, the offeror shall be determined to have unknown (or “neutral”) past performance. In the context of acceptability/unacceptability, a neutral rating shall be considered “acceptable.”

(e) A written notice of award or acceptance of an offer mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer’s specified expiration time, the

Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.
