JUSTIFICATION FOR OTHER THAN
FULL AND OPEN COMPETITION
I. CONTRACTING ACTIVITY
Department of Air Force, 1st Special Operations Contracting Squadron, Hurlburt Field, FL. This document serves as a Justification for Other Than Full and Open Competition. The purchase request number is F2F1066055AW01.
II. NATURE AND/OR DESCRIPTION OF THE ACTION BEING PROCESSED
This action will be awarded as a sole source, firm fixed price purchase order. The notice will be posted to the Federal Business Opportunities (FBO) Government point of entry website at http://www.fedbizopps.gov in accordance with Federal Acquisition Regulation (FAR) part 13.501(a)(iii).
III. DESCRIPTION OF THE SUPPLIES/SERVICES REQUIRED TO MEET THE AGENCY’S NEEDS
The resulting contractor will provide simunitions for the Omega 36 and Omega 1 battlefield simulators. The simunitions and quantities needed are provided below:
M34 Hostile Fire Cartridge, quantity of 2500.
M35 White Star Cartridge, quantity of 5,000.
LA47 Stinger Cartridge, quantity of 3,000.
IV. STATUTORY AUTHORITY PERMITTING OTHER THAN FULL AND OPEN COMPETITION.
Procurement under the contract will be conducted on a sole-source basis in accordance with the statutory authority 10 U.S.C. 2304(c)(1) and implemented by FAR 13.501(a); only one source is capable of providing the supplies required at the level of quality required because the supplies are unique or highly specialized.
V. DEMONSTRATION THAT THE CONTRACTOR’S UNIQUE QUALIFICATIONS OR NATURE OF THE ACQUISITION REQUIRES THE USE OF THE AUTHORITY CITED ABOVE (APPLICABILITY OF AUTHORITY)
The cartridges being purchased for the Omega simulators are manufactured and available exclusively from Chemring Corporation. While there are multiple simulations on the market, the cartridges requested above are the only ones compatible with the Omega simulators.
Failing to purchase Chemrig simunitions that fit existing dispensers would render all simunition devices inoperable. In order to purchase different simunitions, the Government would be required to purchase the simunitions, as well as the devices that use them (i.e. simulators). The current costs of Chemring simunition devices are valued at $400,000.
To utilize another product or brand of simunitions would render current systems obsolete and completely stop mission operations.
Accordingly, Chemrig Corporation is the only firm capable of providing the supplies described in Section III above without the U.S. Air Force experiencing substantial duplication of costs that could not be expected to be recovered through competition and unacceptable delays in fulfilling its requirements.
VI. DESCRIPTION OF EFFORTS MADE TO ENSURE THAT OFFERS ARE SOLICITED FROM AS MANY POTENTIAL SOURCES AS DEEMED PRACTICABLE
A sources sought synopsis was issued on 21 Dec 16 under F2F1065341AW01. No responses were received from this posting.
VII. DETERMINATION BY THE CONTRACTING OFFICER THAT THE ANTICIPATED COST TO THE GOVERNMENT WILL BE FAIR AND REASONABLE
The anticipated cost will be considered fair and reasonable based on comparison with similar items in a related industry and market research performed.
VIII. DESCRIPTION OF THE MARKET RESEARCH CONDUCTED AND THE RESULTS, OR A STATEMENT OF THE REASONS MARKET RESEARCH WAS NOT CONDUCTED
Market research was performed to identify other products in the industry. While there are multiple other products, each simunition is designed for a specific simulator. No products were found that are compatible with the devices the government currently owns.
IX. ANY OTHER FACTS SUPPORTING THE USE OF OTHER THAN FULL AND OPEN COMPETITION
The specifications for the simunitions requested are proprietary to Chemrig Corporation.
X. LIST OF SOURCES, IF ANY, THAT EXPRESSED INTEREST IN THE ACQUISITION
See Section VI above.
XI. A STATEMENT OF THE ACTIONS, IF ANY, THE AGENCY MAY TAKE TO REMOVE OR OVERCOME ANY BARRIERS TO COMPETITION BEFORE MAKING SUBSEQUENT ACQUISITIONS FOR THE SUPPLIES OR SERVICES REQUIRED
There are three actions that can be taken to foster competition for future acquisitions.
First, vendors could manufacture items to be compatible with Chemrig simulators and provide testing documentation and evidence that the products work with the simulator currently owned by the Government.
Another other option would be for the Government to procure a simulator system where the cartridges are universal. At this time, based on the costs associated with purchasing a new simulator, it is not anticipated that this option would be available in the foreseeable future.
The final option would be for vendors to work with Chemrig Corporation to obtain the right to sell their products to the Government. This would allow competition in the future, limited by brand name.
XII. CONTRACTING OFFICER’S CERTIFICATION
The contracting officer’s signature on the Coordination and Approval Document evidences that he/she has determined this document to be both accurate and complete to the best of his/her knowledge and belief.
XIII. TECHNICAL/REQUIREMENTS PERSONNEL’S CERTIFICATION
As evidenced by their signatures on the Coordination and Approval Document, the technical and/or requirements personnel have certified that any supporting data contained herein, which is their responsibility, is both accurate and complete.
