JUSTIFICATION FOR OTHER THAN

FULL AND OPEN COMPETITION

I. CONTRACTING ACTIVITY

The contracting organization responsible for this action is the 49th Contracting Squadron, 1210 Forty Niner Road, Holloman AFB, NM 88330. (Purchase request number F2ET565246AW01 in support of the 54th Operations Support Squadron).

II. NATURE AND/OR DESCRIPTION OF THE ACTION BEING PROCESSED

This individual justification and approval is for the issuance of a Firm Fixed Price (FFP), single source contract for the purchase of Gentex Oxygen Mask Light Kit. Under the proposed contract, the 49th Contracting Squadron will issue a purchase order per the authority at FAR 13.501(a).

III. DESCRIPTION OF THE SUPPLIES/SERVICES REQUIRED TO MEET THE

AGENCY’S NEEDS

Under the contemplated contract, Gentex Corporation will provide 200 oxygen mask light kits Part number G030-1500-01, which will be used by aircrew for night time flight operations.

IV. STATUTORY AUTHORITY PERMITTING OTHER THAN FULL AND OPEN

COMPETITION

I have determined, in accordance with FAR 13.501, the circumstances of this contract action deem only a single source is reasonably available. This J&A is written in the format of 6.303-2 using the procedures of FAR 13.5.

V. DEMONSTRATION THAT THE CONTRACTOR’S UNIQUE

QUALIFICATIONS OR NATURE OF THE ACQUISITION REQUIRES THE USE OF

THE AUTHORITY CITED ABOVE (APPLICABILITY OF AUTHORITY)

The 54th FG utilizes the Gentex HA/LP Aircrew Oxygen Mask for its flight operations. The Gentex Oxygen Mask Light is an integrated light source designed for the HA/LP Aircrew Oxygen mask. This accessory is a fully integrated compatible light source suitable for use during night flight operations, including those that require the use of Night Vision Goggles (NVGs). These mask lights are specifically made for these masks and are manufactured by Gentex Corp, no other manufacturer produces a comparable product.

VI. DESCRIPTION OF EFFORTS MADE TO ENSURE THAT OFFERS ARE

Market research indicates there is one distributor for the Gentex HA/LP Aircrew Oxygen Mask Light, Transaero Inc.. When contacted by the Contracting Officer, Transaero Inc. explained that through an agreement with Gentex Corporation, they can only quote on international purchases and that all U.S. orders for this item must be place directly with the manufacturer.

VII. DETERMINATION BY THE CONTRACTING OFFICER THAT THE

ANTICIPATED COST TO THE GOVERNMENT WILL BE FAIR AND REASONABLE

The Contracting Officer will determine the price to be fair and reasonable prior to award by comparing the proposed pricing to other contracts for similar products, as several agencies have purchased these exact items.

VIII. DESCRIPTION OF THE MARKET RESEARCH CONDUCTED AND THE

RESULTS, OR A STATEMENT OF THE REASONS MARKET RESEARCH WAS NOT

CONDUCTED

49 CONS conducted in-depth research for Oxygen Mask Light Kits. However, the requirement for compatibility between systems and the NVGs demands Gentex Corporation’s Oxygen Mask Light Kits. A SBA Dynamic Business Search was conducted for NAICS code 336413 (Other - Aircraft Parts and Auxiliary Equipment) Several Small Business Companies were listed. Contact was made with several of the companies to ascertain if the required items were available however, the companies contacted were unable to identify or associate with the part number provided.

IX. ANY OTHER FACTS SUPPORTING THE USE OF OTHER THAN FULL AND

OPEN COMPETITION

Failure to obtain the parts requested will result in hampered abilities for the 54 Fighter Group’s aircrew during night missions due to the increased equipment necessary during night flights and the increased potential for foreign object damage (FOD), resulting in aircraft and mission failure.

X. LIST OF SOURCES, IF ANY, THAT EXPRESSED INTEREST IN THE

ACQUISITION

See Section VI above.

XI. A STATEMENT OF THE ACTIONS, IF ANY, THE AGENCY MAY TAKE TO

REMOVE OR OVERCOME ANY BARRIERS TO COMPETITION BEFORE MAKING

SUBSEQUENT ACQUISITIONS FOR THE SUPPLIES OR SERVICES REQUIRED

54 OSS and 49 CONS will continue to monitor the market for changes to determine if other companies have been authorized to provide this product in the future or if an alternative solution becomes available.

XII. CONTRACTING OFFICER’S CERTIFICATION

The contracting officer’s signature on the Coordination and Approval Document evidences that he/she has determined this document to be both accurate and complete to the best of his/her knowledge and belief IAW FAR 13.501(a)(1).
