I. This is a solicitation for commercial items prepared in accordance with the format in Subpart 12.6. This announcement constitutes the only solicitation; proposals/quotes are being requested and a written solicitation will not be issued. This solicitation is issued as a request for proposal (RFP). The solicitation document and incorporated provisions and clauses are those in effect through Federal Acquisition Circular 2005-95, Effective 19 Jan 2017.
II. This requirement is being procured in accordance with FAR Part 12, Acquisition of Commercial Items and an award will be made in accordance with FAR Part 13. It will also incorporate the procedures of FAR Part 37, Service Contracting. This action is being solicited as open market, small business set-aside.
The NAICS Code associated with this requisition is 561730 with a small business size standard of $18.0 million. Buyer intends to issue award using a fixed priced purchase order. Proposals from Sellers unable to accept purchase orders will not be considered for award.
III. This procurement is to provide lawn care services for the Pelican Island National Wildlife Refuge
(NWR).
IV. Location of Performance: Reference corresponding Statement of Work (SOW) for location information. Period of Performance 10/01/2017 through 9/30/2022
V. Material: Reference Statement of Work (SOW);
Site Visit: Date and time: 8/23/2017 9AM – 10 AM local standard time, 4055 Wildlife Way Vero Beach FL 32963.
NOTE: It is the Contractor’s responsibility to visit the site prior to bidding and know existing conditions.
Contractor wanting to visit site prior to submission of quote may submit their request for attendance by email to oliver_vandenende@fws.gov. Once you submit your request, you will receive a confirmation with containing address of the site visit.
VI. Local conditions (bridge restrictions, weather conditions, water levels, road flooding, etc.) that may affect travel to location: Reference Statement of Work.
VII. RFQ Due Date: Telephone quotes will NOT be accepted. All quotes must be received at this office no later than August 29, 2017, 11:00 AM Local Eastern Time. ONLY EMAILED QUOTES WILL BE ACCEPTED.

a. SF 1449 and SF 30: Provide a completed SF 1449 with signature. Provide all signed amendments, if issued for this notice.
b. Company Capability Statement: Provide company capability statement including a summary of products and services. This should also include company's name, point of contact, address, phone number, fax number, email address, solicitation number, a brief executive summary, and Duns number.
(Maximum 2 pages)
c. Resume of Project Manager/Task Manager and Personnel List: Overview of contractor’s resume and respective personnel that will be working on the project. Provide a list containing background/expertise of identified personnel that is anticipated to be involved with the project. (Maximum 3 pages)
d. Equipment List: Provide a list of equipment/supplies in the offeror’s inventory and/or accessible equipment in order to utilize the work requested under this notice. This will show contractor understanding of work requirement and show contractor as sufficient equipment access to successfully perform the work as required. Contractor must show a tractor w/ brush/bush hog and zero point turn mower of sufficient sizes to conduct work in a timely manner.
e. Past Performance: Complete accompanying past performance form with a minimum of three of your most recent, relevant experiences in working on similar type efforts. Contractor must Show at least five
(5) years of experience.
Any offeror who demonstrated unsatisfactory past performance will not be considered eligible for award. If the Government does not obtain past performance information for the projects identified by the offeror and cannot establish a past performance record for the offeror through other sources, or if the offeror has no past performance record and cannot tie significant, relevant experience of key personnel proposed for this project to cited experience, past performance will be evaluated neither favorably nor unfavorably.
Note: Offerors that cannot provide past performance information must provide a statement citing no past performance and provide explanation on their company ability to effectively meet the requirements with no past experience.
Note: The Government may also use past performance information obtained from sources other than those identified by the offeror.
f. Quality Control Plan: Provide a plan, which includes a spill response plan, to ensure environmental compliance. This plan should also include a description of scheduled control measures that will be incorporated to ensure that a high level of quality is maintained during performance period. (Maximum 3 pages)
g. Price Proposal: Provide total price and price broken down by referenced PWS Attachment 2 “Deliverables Schedule”. (Maximum 2 pages)
NOTE: Any quotes not received by the due date and time specified in this synopsis/solicitation will be rejected. Additionally, any incomplete quote not containing the required information as stated in this solicitation may be rejected. Proposal must include a table of contents and blank sheet/page must separate price proposal from rest of proposal. Final proposal cannot exceed 35 pages.
NOTE: The final quoted price(s), both total and individual, MUST include all applicable fees, gratuities, commissions, service charges, etc. THE FEDERAL GOVERNMENT IS TAX EXEMPT.
XI. Best Value Award Determination:
(a) The awarded contract will go to the offeror who best demonstrates the ability to provide high standards and exceptional performance reflected within their proposal under the requirements identified within the PWS and provides pricing that is competitively priced in comparison to budget and market estimates.
(b) Options. If options have been identified, the Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s).
(c) A written notice of award or acceptance of an offer will be emailed or otherwise furnished to the successful offeror with a 5 day response for acceptance/decline. Offerors that do not respond shall result in a binding contract without further action by either party. Before the offeror’s specified expiration time of acceptance, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.
(d) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer is conforming to the solicitation and will be most advantageous to the Government through technical capability, past performance, and/or other factors and price.
At the discretion of the Contracting Officer, the Government intends to evaluate proposals and award a contract without discussions with offerors. Each initial offer should, therefore contain the Offeror's best terms from both a price and technical standpoint.

(Superior): Exceeds specified performance or capability that greatly benefits the agency/has high probability of success in exceeding all requirement/technical proposal has zero weaknesses/detailed-comprehensive work plan. All required Contractor’s information is provided and completed as requested containing all supplemental information, qualifications, and supporting documentation that that provides unquestionable high level of expertise throughout the proposal with descriptions of experience level(s) that will be advantageous to completing the project as described within the SOW.
(Good): Contractor provided information as required. Information contained above average/has good probability of satisfying the requirements and achieving success/few is any minor weaknesses in technical proposal/work plan good.
(Average): Meets the basic minimal requirements for this section with minor discrepancies that will not affect the overall quality of the project. The contractor has probability of satisfying the requirements/any weakness or weaknesses can be readily corrected.
(Marginal): Slightly below average /has low probability of satisfying all requirements/significant deficiencies and weaknesses that may impact successful performance
(Poor): Fails to meet minimum requirements /deficiency requires a major revision to the proposal to make it correct
Price Section
Price based on price reasonableness, competitiveness, budget.
The Government will evaluate the reasonableness of proposed price by assessing the acceptability of the Offeror's methodology used in developing the price estimates. For the price to be reasonable, in its nature and amount, it should not exceed that which would be incurred by a prudent person in the conduct of a competitive business. This represents a compromise between the seller's and the buyer's opinion of what constitutes a fair price. Reasonableness takes into account the context of a given source selection, including current market conditions and other factors that affect the ability of an Offeror to perform the contract requirements. What is reasonable depends upon a variety of considerations and circumstances, including:
•Whether it is the type of cost generally recognized as ordinary and necessary for the conduct of the Offeror's business or of the contract performance;
•Generally accepted sound business practices, Federal and State laws and regulations, etc.; and
•Any significant deviations from the Offeror's established practices.

FAR 52.237-1 Site Visit (Apr 1984)
Offerors or quoters are urged and expected to inspect the site where services are to be performed and to satisfy themselves regarding all general and local conditions that may affect the cost of contract performance, to the extent that the information is reasonably obtainable. In no event shall failure to inspect the site constitute grounds for a claim after contract award.

The terms and conditions to this cause are determined by the contracting officer to be necessary for this acquisition and consistent with customary practices.
FAR 52.212-1 Instructions to Offerors - Commercial Items. (JAN 2017)
a) North American Industry Classification System (NAICS) code and small business size standard. The NAICS code and small business size standard for this acquisition appear in Block 10 of the solicitation cover sheet (SF 1449). However, the small business size standard for a concern which submits an offer in its own name, but which proposes to furnish an item which it did not itself manufacture, is 500 employees.
(b) Submission of offers. Submit signed and dated offers to the office specified in this solicitation at or before the exact time specified in this solicitation. Offers may be submitted on the SF 1449, letterhead stationery, or as otherwise specified in the solicitation. As a minimum, offers must show --
(1) The solicitation number;
(2) The time specified in the solicitation for receipt of offers;
(3) The name, address, and telephone number of the offeror;
(4) A technical description of the items being offered in sufficient detail to evaluate compliance with the requirements in the solicitation. This may include product literature, or other documents, if necessary;
(5) Terms of any express warranty;
(6) Price and any discount terms;
(7) “Remit to” address, if different than mailing address;
(8) A completed copy of the representations and certifications at FAR 52.212-3 (see FAR 52.212-3(b) for those representations and certifications that the offeror shall complete electronically);
(9) Acknowledgment of Solicitation Amendments;
(10) Past performance information, when included as an evaluation factor, to include recent and relevant contracts for the same or similar items and other references (including contract numbers, points of contact with telephone numbers and other relevant information); and
(11) If the offer is not submitted on the SF 1449, include a statement specifying the extent of agreement with all terms, conditions, and provisions included in the solicitation. Offers that fail to furnish required representations or information, or reject the terms and conditions of the solicitation may be excluded from consideration.
(c) Period for acceptance of offers. The offeror agrees to hold the prices in its offer firm for 30 calendar days from the date specified for receipt of offers, unless another time period is specified in an addendum to the solicitation.
(d) Product samples. When required by the solicitation, product samples shall be submitted at or prior to the time specified for receipt of offers. Unless otherwise specified in this solicitation, these samples shall be submitted at no expense to the Government, and returned at the sender’s request and expense, unless they are destroyed during preaward testing.
(e) Multiple offers. Offerors are encouraged to submit multiple offers presenting alternative terms and conditions, including alternative line items (provided that the alternative line items are consistent with subpart 4.10 of the Federal Acquisition Regulation), or alternative commercial items for satisfying the requirements of this solicitation. Each offer submitted will be evaluated separately.
(f) Late submissions, modifications, revisions, and withdrawals of offers.
(1) Offerors are responsible for submitting offers, and any modifications, revisions, or withdrawals, so as to reach the Government office designated in the solicitation by the time specified in the solicitation. If no time is specified in the solicitation, the time for receipt is 4:30 p.m., local time, for the designated Government office on the date that offers or revisions are due.
(2)
(i) Any offer, modification, revision, or withdrawal of an offer received at the Government office designated in the solicitation after the exact time specified for receipt of offers is “late” and will not be considered unless it is received before award is made, the Contracting Officer determines that accepting the late offer would not unduly delay the acquisition; and—
(A) If it was transmitted through an electronic commerce method authorized by the solicitation, it was received at the initial point of entry to the Government infrastructure not later than 5:00 p.m. one working day prior to the date specified for receipt of offers; or
(B) There is acceptable evidence to establish that it was received at the Government installation designated for receipt of offers and was under the Government’s control prior to the time set for receipt of offers; or
(C) If this solicitation is a request for proposals, it was the only proposal received.
(ii) However, a late modification of an otherwise successful offer, that makes its terms more favorable to the Government, will be considered at any time it is received and may be accepted.
(3) Acceptable evidence to establish the time of receipt at the Government installation includes the time/date stamp of that installation on the offer wrapper, other documentary evidence of receipt maintained by the installation, or oral testimony or statements of Government personnel.
(4) If an emergency or unanticipated event interrupts normal Government processes so that offers cannot be received at the Government office designated for receipt of offers by the exact time specified in the solicitation, and urgent Government requirements preclude amendment of the solicitation or other notice of an extension of the closing date, the time specified for receipt of offers will be deemed to be extended to the same time of day specified in the solicitation on the first work day on which normal Government processes resume.
(5) Offers may be withdrawn by written notice received at any time before the exact time set for receipt of offers. Oral offers in response to oral solicitations may be withdrawn orally. If the solicitation authorizes facsimile offers, offers may be withdrawn via facsimile received at any time before the exact time set for receipt of offers, subject to the conditions specified in the solicitation concerning facsimile offers. An offer may be withdrawn in person by an offeror or its authorized representative if, before the exact time set for receipt of offers, the identity of the person requesting withdrawal is established and the person signs a receipt for the offer.
(g) Contract award (not applicable to Invitation for Bids). The Government intends to evaluate offers and award a contract without discussions with offerors. Therefore, the offeror’s initial offer should contain the offeror’s best terms from a price and technical standpoint. However, the Government reserves the right to conduct discussions if later determined by the Contracting Officer to be necessary. The Government may reject any or all offers if such action is in the public interest; accept other than the lowest offer; and waive informalities and minor irregularities in offers received.
(h) Multiple awards. The Government may accept any item or group of items of an offer, unless the offeror qualifies the offer by specific limitations. Unless otherwise provided in the Schedule, offers may not be submitted for quantities less than those specified. The Government reserves the right to make an award on any item for a quantity less than the quantity offered, at the unit prices offered, unless the offeror specifies otherwise in the offer.

(k) System for Award Management. Unless exempted by an addendum to this solicitation, by submission of an offer, the offeror acknowledges the requirement that a prospective awardee shall be registered in the SAM database prior to award, during performance and through final payment of any contract resulting from this solicitation. If the Offeror does not become registered in the SAM database in the time prescribed by the Contracting Officer, the Contracting Officer will proceed to award to the next otherwise successful registered Offeror. Offerors may obtain information on registration and annual confirmation requirements via the SAM database accessed through https://www.acquisition.gov.
(l) Debriefing. If a post-award debriefing is given to requesting offerors, the Government shall disclose the following information, if applicable:
(1) The agency’s evaluation of the significant weak or deficient factors in the debriefed offeror’s offer.
(2) The overall evaluated cost or price and technical rating of the successful and debriefed offeror and past performance information on the debriefed offeror.
(3) The overall ranking of all offerors, when any ranking was developed by the agency during source selection.
(4) A summary of rationale for award;
(5) For acquisitions of commercial items, the make and model of the item to be delivered by the successful offeror.
(6) Reasonable responses to relevant questions posed by the debriefed offeror as to whether source-selection procedures set forth in the solicitation, applicable regulations, and other applicable authorities were followed by the agency.

(d) Comptroller General Examination of Record The Contractor shall comply with the provisions of this paragraph (d) if this contract was awarded using other than sealed bid, is in excess of the simplified acquisition threshold, and does not contain the clause at 52.215-2, Audit and Records -- Negotiation.
(1) The Comptroller General of the United States, or an authorized representative of the Comptroller General, shall have access to and right to examine any of the Contractor’s directly pertinent records involving transactions related to this contract.
(2) The Contractor shall make available at its offices at all reasonable times the records, materials, and other evidence for examination, audit, or reproduction, until 3 years after final payment under this contract or for any shorter period specified in FAR Subpart 4.7, Contractor Records Retention, of the other clauses of this contract. If this contract is completely or partially terminated, the records relating to the work terminated shall be made available for 3 years after any resulting final termination settlement. Records relating to appeals under the disputes clause or to litigation or the settlement of claims arising under or relating to this contract shall be made available until such appeals, litigation, or claims are finally resolved.
(3) As used in this clause, records include books, documents, accounting procedures and practices, and other data, regardless of type and regardless of form. (a) The Contractor shall, at its own expense, provide and maintain during the entire performance of this contract, at least the kinds and minimum amounts of insurance required in the Schedule or elsewhere in the contract.

(2) Until 30 days after the insurer or the Contractor gives written notice to the Contracting Officer, whichever period is longer.
(c) The Contractor shall insert the substance of this clause, including this paragraph (c), in subcontracts under this contract that require work on a Government installation and shall require subcontractors to provide and maintain the insurance required in the Schedule or elsewhere in the contract.
