Export-Import Bank of the United States Support Contract to Process Foreign Credit Reports

Statement of Work

1.0 Objective

The Export-Import Bank (“EXIM Bank”) has a requirement for Foreign Credit Reports on an as needed basis for a variety of foreign companies to support the underwriting of the short-term exporter held Express multi-buyer export credit insurance policy (“Express”). Effort under this contract will be paid on a per unit basis, not-to-exceed totals for the performance period.

Foreign Credit Reports are required for:

• Small and medium sized foreign companies.

• Emphasis on emerging and developing countries in Asia, Eastern Europe, Middle East, Africa, Central and South America. Additional required markets are Canada, Mexico and Western Europe.

2.0 Scope of Work

The number of required foreign buyer credit reports fluctuates year to year depending on the size of the Express portfolio and the number of requested buyer credits under each Express policy (Express policies are issued for a 12-month period and are automatically renewed if the policy needs the Bank’s credit standards). The number of requested reports averages between 600 – 800 reports annually including comprehensive and condensed reports.

3.0 Foreign Credit Report Requirements

The contractor shall provide credit reports, electronically, on a variety of foreign companies which include: 1) the following detailed credit information and, as required, 2) a shortened overview of a foreign company which includes limited company credit information (such as legal name, address, date of incorporation, line of business):

1. Current Credit Agency reports should state both the date of the report and the date the information was gathered. If the source of the report is not the creator of the report, the origin of the report should be stated.

2. Name, Address and History of the Subject

The business name, address and contact information, such as telephone number, should be verified. Previous names and addresses should also be indicated, particularly in the case of unregistered trade names (“DBA or doing business as”) used by sole proprietors.

The history of a business, the experience and reputation of the owners, and quality of management are important. To include, mention of suits/liens/judgments/bankruptcy (or lack thereof). Any recent demographic, ownership, or management changes should be indicated, together with an appraisal of likely trends in the future.

3. Legal Status and Date of Establishment

The registered form of business should be specified. For partnerships, private and public companies, the names of the major partners or owners (shareholders), and directors should be listed. Affiliations of the partners or owners with other businesses should be indicated along with the nature of their affiliation.

4. Description of Business Activity

Some businesses engage in multiple business activities (manufacturing, wholesale, retail distribution, etc.) When applicable, the whole range should be described. Principal lines of goods and services should be listed with their experience. Past, present and future business trends should be assessed.

Names of foreign and domestic suppliers for whom the subject acts as agent, representative or distributor should be listed.

5. Number of Employees and Subject’s Standing in its Industry

The subject’s number of employees should be specified with notation if that number consolidates several locations (branches or wholly owned subsidiaries). The subject’s competitive standing in its industry and the range and type of clients it serves should be included.

6. Trade References, Commercial Morality, Pay History, Agency Credit Scores

Trade references (if available) should be listed with their experience. An opinion on the subject’s commercial morality and assessment of past repayment history should be given and supported by evidence based on knowledge and collection experience. An agency’s credit score (if applicable) should also include its scoring scale and how scores are derived.

7. Financial Condition A subject’s financial condition (if available) is clearly an essential element for appraising creditworthiness. Past and current records (with dates) of assets, liabilities, equity, turnover, income, expenses and profitability should be provided.

EXIM Bank recognizes that sole proprietorships and other business types may not be required to officially publish financial data. When detailed figures are not released, the reasons should be given. If estimates are provide, the estimates should be clearly described as such.

For companies legally required to publish annual financial statements or those who voluntarily supply agencies with financial information, it is helpful to have balance sheets and income statements for the most recent consecutive two years with dates. There should be an indication whether the financial statements are audited or not and who the auditors are. Effort should be made to include current interim statements to reveal the current financial condition.

The following financial accounts are of particular importance:

- Capital (registered and paid-up figures)

- Reserves

- Current and Long Term Assets

- Current and Long Term Debt

- Net Worth and Liquidity position

- Property and other Fixed Assets (with details of debentures, mortgages, or charges if applicable)

- Turnover (revenues) and Profitability

8. Public Sector Entities (if a report is available)

The credit report should include answers to these questions:

a. Is the subject an agency of the central government?

b. If not, is it a publicly owned entity? The precise status should be described with references to applicable enabling laws or decrees and the degree of autonomy the subject may exercise.

c. What budgetary provisions enable the subject to engage in commercial contracts?

d. Is the subject itself, or some other entity, responsible for payment?

e. What is the source of the subject’s funds?

f. Does the subject have a satisfactory performance record on contracts?

g. Can the subject be made judicially or administratively insolvent?

h. Are legal processes feasible against the subject in the event of default

9. Opinions and Recommendations

Any offered opinion on creditworthiness should be supported by a reasoned argument with specific financial, trading or debt collection items underscoring the opinion. If no opinion is offered the agency should note why and the report should contain facts and figures to enable EXIM Bank to make its own assessment.

4.0 Period of Performance

This contract shall be for a twelve (12) month base period plus four (4) option years from date of award.

5.0 Account Representative

The contractor will maintain a key point of contact to provide problem resolution throughout the contract period. The Point of Contact shall have the experience, knowledge and understanding in providing this service.

6.0 Acceptance/Evaluation Criteria

a. Evaluation Procedures QUOTEs will be evaluated pursuant to FAR part 12 and 15.101, “Best Value Continuum”. Award will be made to the technically acceptable offeror(s) whose proposal, being responsive to all solicitation requirements, offers the best value to the government. Award will further be contingent upon determinations of contractor responsibility and price reasonableness.

b. Evaluation Factors

Technical The following acceptance/evaluation criteria will be applicable for the contractor and the Foreign Credit Reports themselves provided under this Contract:

1. Contractor company background/resume – Contractor shall provide detailed background information about its operating history (establishment date, ownership, etc.), business processes and experience with the creation of foreign credit reports. Additionally, provide samples of foreign buyer credit reports to include a sample of a shortened and extended version.

2. Consistency – Contractor shall guarantee or state that all reports regardless of source will have all required fields completed as requested per Section 2.0 Foreign Credit Report Requirements listed above.

3. Technical Skill – Data provided shall be generated by an in-country investigating source with procedures that enable reporting regardless of company size.

4. Accuracy — Data provided is updated on a semi-annual basis for the most current information and personal contact with company is made annually. If the company’s repayment history with a supplier(s) is provided, a contact name and means of contacting that supplier(s) should be provided for verification purposes, as needed.

5. Format—Credit reports shall be delivered via the internet and/or electronic mail.

Hardcopies shall be provided upon request.

6. Timeliness – Existing company credit reports are accessible immediately via an internet download. Company credit reports requiring updating and/or investigation are provided within five (5) to ten (10) business work days of request.

7. Pricing Schedule – A detailed pricing schedule listing the range of foreign credit reports available (e.g. the price of a condensed credit report vs. the price of a comprehensive credit report).

8. Ease of Use – User-friendly database with robust search capabilities and liberal accessibility for a large number of EXIM Bank credit officer user accounts.

Past Performance

Offerors shall provide three examples of prior projects or use of their product which are similar to the scope and complexity of the requirements of this RFQ. Offerors shall provide accurate contact information on individuals for references for any examples provided. The number of examples, their applicability to EXIM Bank’s stated requirements, and the accuracy of contact information will be assessed. The EXIM Bank reserves the right not to check references.

PP Evaluation Standard In evaluating PP, the Government will review how well the offeror has performed on other relevant comparable projects with respect to scope. In making this determination, the Government will review the following elements:

• Management Controls: Responsiveness, staffing, project management

• Quality of Services: Compliance with contract requirements, technical excellence, accuracy of reports

• Customer Satisfaction: Reasonable and cooperative behavior and commitment to customer service

• Schedule Compliance: Timeliness compared to the schedule of activities, milestones, and/or deliverables

• Cost Control: Management of the contract/task budget and cost control

Price The ExIm Bank intends to award a Firm Fixed Price purchase order, including a base and four consecutive 12 month option periods. The ExIm Bank will evaluate proposed pricing for all periods of performance. Offerors must ensure that pricing is provided for the base year and each option year.
