1. Introduction. The USDA Forest Service, Prescott National Forest, has a requirement to install electrical connections to power them alleviating the need for generators on trailers at the Prescott National Forest.

2. Type of Award. As a result of this solicitation, Government anticipates The Government Anticipates awarding a Firm Fixed-Price Construction Contract using RFQ Lowest Price Technically Acceptable

(LPTA).

This is a 100% Small Business Set Aside to NAICS code 238210. PSC code J061.

In order to be eligible for award of a Federal contract, potential vendors need to already be registered in the System for Award Management (SAM) at https://www.sam.gov . DUNS and business email are required to enroll in SAM.

3. Basis for Award. Technical Capability shall be submitted in the form of a statement or document that demonstrates the contractor’s capability to perform the work to meet or exceed the requirements of this solicitation. In order to meet the Technical Capability Requirements, offers shall address the following factors:

Factor a - Provide written documentation that specifically addresses your firm’s expertise and ability to conduct electrical repairs on trailers in accordance with the scope of work below.

Factor b – Prices – Contracting Officer intends to award without discussions, provide your best price in your offer.

Failure to provide adequate information for Technically Capability may result in the offer being removed from the competitive range.

4. How to submit your offer. Submit RFQ pages 1 through 3 as your business proposal. In a separate document, also submit a technical proposal as outlined in the Basis for Award (above). SECTION C – STATEMENT OF WORK/DESCRIPTIONS

C.1 – GENERAL DESCRIPTION OF WORK

Due to mitigations related to COVID19 the Prescott National Forest is obtaining mobile office trailers to alleviate congregations of people in the existing building. Mobile office trailers were used in 2020 at the Fire Center and were powered by generators. An electrical connection is a cost-effective solution for powering the mobile office trailers.

All work shall be in accordance with the plans and specifications contained herein. No changes to the specifications, terms, or conditions of this Request for Quotations (RFQ) shall be made without the prior approval of the Contracting Officer in writing.

The Prescott National Forest plans to rent (5) mobile office trailers to be located at the Prescott Fire Center, Henry Y.H. Kim Aviation Facility. The trailers require an electrical connection to power them alleviating the need for generators. The electrical connection must provide uninterrupted power to the mobile office trailers.

All work conducted must be in accordance with the 2021 National Electric Code.

The Government intends to award a contract based on Lowest Price Technically Acceptable (LPTA). The offeror that demonstrates that they have technical skill required and lowest price. In order to remain in the competitive range, Offerors (Contractors) shall submit the Return Package with the requirements in Section M, Evaluation Factors.

Magnitude of project - Between $25,000 and $100,000.

All work must be performed by a licensed electrician. The vendor awarded the contract must provide an electric connection to power (5) mobile office trailers. The trailers will all be located in the same general vicinity at the Prescott Fire Center. Each trailer will be a minimum of 28 feet in length and 8 feet in width.

C.3 – SPECIFIC SCOPE OF WORK

• Ensure that only qualified electrical designers accomplish or direct all planning, design, construction, alteration, or repair of Forest Service electrical systems

• Ensure that the design and construction of electrical systems comply with applicable requirements of the latest industry, State and local codes, and agency standards.

• Prepare plans, specifications, and cost estimates prior to beginning construction or renovation of electrical systems.

• Ensure that electrical systems meet the requirements of the needs and functions they are to serve.

• Ensure that the design, construction, operation, and maintenance of electrical systems authorized under special-use permits support activities authorized by the permit, meet quality standards for physical improvements, and protect the public welfare and safety.

• All design for systems of 600 volts or less must be prepared by qualified personnel meeting at least one of the following requirements:

o (1) Current registration as a Professional Engineer with appropriate education and experience in the work being performed.

o (2) Successfully completed a minimum of 15 quarter hours of electrical theory and design from a nationally-accredited electrical engineering program. This course work should cover the fundamentals of electric and magnetic circuits, power conversion (motors, generators, and transformers), electronics, control systems, lightning protection, and building electrical systems.

At least 5-quarter hours should be in design.

o (3) Successfully completed 15 additional quarter hours of course work in related areas such as mechanical design, building construction, instrumentation, communications, and alternative energy systems.

o (4) Successfully completed a minimum of 1 year working in the area of electrical design under the direction of an individual with the qualifications listed in paragraph (1).

• The contractor must ensure the supplied power is adequate for each trailer to be running simultaneously (using either heat or air conditioning, lights, and outlet power).

• The source of the power will be derived from the Prescott Fire Center in the electrical room in the NE corner of the building.

• The Prescott Fire Center sits on 16 acres of land leased from the City of Prescott. The building is owned by the USDA Forest Service.

• The vendor that is awarded the contract will be required to obtain any necessary permits and ensure inspections occur if required.

• The vendor that is awarded the contract will be required to follow the appropriate electrical codes (federal/ state/ local).

• The vendor that is awarded the contract will be required to obtain underground utility locating prior to starting the project.

• The conduit must be routed through the existing masonry wall rather than the roof. It must be run underground from the existing facility to the location of the trailers.

• A concrete pad must be poured where the electrical connection surfaces. The pad must be protected with bollards. The bollards must be strong enough to withstand a vehicle impact, be a minimum of 4’ tall and painted in high-visibility paint.

• A connection from where the electrical connection surfaces to each mobile office trailer will be provided by the vendor.

• There will be an assigned Contracting Officer’s Representative (COR) who will perform contract administration, including site inspections for quality assurance.

• A site can be made available to the Contractor for staging and storage during the duration of the project and will be located by the COR.

• Before final acceptance of the project by the Government, the Contractor shall remove from the Government land all waste material and rubbish resulting from this work.

• The Government is not responsible for any damage or theft to equipment and/or supplies left on site.

• Portable restrooms and hand washing stations will be available for use.

• Transportation to and from the work site for the Contractor’s personnel and materials will be provided at the Contractor’s expense.

• The work zones shall be delineated and marked adequately to warn of equipment operations and other hazardous conditions. Any damage to existing improvements shall be repaired at the Contractor’s expense according to the direction of the COR.

• No Government furnished supplies will be provided.

• The normal working hours will be from 0800 to 1600 Monday – Thursday unless coordinated in advance with the COR. Work shall be completed within thirty (90) days of the Notice to Proceed issued by the Contracting Officer.

• System shall be in accordance with the latest edition of the International Building Codes and National Electrical codes.

• Complete Operations and Maintenance manuals of the system shall be provided upon completion.

• All work shall be performed in a workman like manner, to the quality and standard of the industry.

• The Contractor shall comply with Federal Regulatory Agencies.

• The Contractor shall comply with all State, County and City laws, regulations and regulatory agencies.

• The Contractor shall always ensure the safety of everyone and shall provide adequate warnings of environmental and safety hazards.

Safety Requirements:

• The Contractor shall insure that all contract and subcontract employees shall adhere to the safety standard contained within the Federal Register and the Occupational Safety and Health Act (OSHA).

• The Contractor, contractor’s employees, sub-contractors, third party inspectors, suppliers or visitors SHALL adhere to the CDC COVID – 19 guidelines.

• Face Masks and other PPE – To support a safe workplace and consistent with CDC guidelines, EO 13991 and the OMB approved USDA COVID-19 Workplace Safety Plan, masks must be worn on National Forest System lands when physical distancing cannot be maintained by the following; USDA employees, on-site contractors, cooperators, volunteers, and employees of special use authorization holders. It is recommended that a mask that aligns with CDC guidance be carried at all times by everyone over the age of 2 who visits/works on NFS lands, regardless of the purpose.

• Symptom Monitoring – If on-site contractors, partners, cooperators, volunteers, employees of special use authorization holders, or visitors, are not feeling well, they should not enter the USDA workplace. Federal employees, contractors working on site, partners, cooperators, volunteers and employees of special use authorization holders, will be asked to complete symptom screening (such as a symptom questionnaire, an exposure history questionnaire, or a temperature check), on a daily basis or upon entry to the workplace. This information will be used to assess the individual’s risk level and to determine whether they should be allowed entry to the workplace. Visitors will also be asked to complete symptom screening before entering a USDA facility. • Protection of Work: The Contractor shall take precautions to protect all work during the construction period. The Contractor shall provide and maintain adequate protection during severe weather conditions to prevent damage to the work, materials, and equipment. The existing elements of the buildings shall remain undamaged and structurally sound during all phases of this contract. Any damage to the buildings or their functional elements resulting from the Contractor’s work at the sites shall be immediately repaired at no additional cost to the Government.

• Safety: The Contractor is responsible for safeguarding employees, public, existing facilities, and forest resources from his/her operations. All operations shall comply with the requirements and restrictions of OSHA, the Arizona Occupational Safety and Health Code, and the Workman’s Compensation Board. The Contractor shall erect signs and barricades to make unguarded operations safe as required. Signs and barricades shall be maintained at night and on weekends. Precautions such as safely storing materials shall be practiced preventing injury to others in the area.

• Security: Security is not provided by the Government. The Contractor shall take all precautions deemed necessary to secure the worksites, improvements, and equipment.

This may include security fencing at the Contractor’s discretion. It is therefore recommended the Contractor make every attempt to bar public access to storage during periods of construction inactivity such as nights and weekends.

Period of Performance All work and final cleanup should be completed within 90 calendar days from issuance of Notice-To-Proceed.

SECTION E - Inspection and Acceptance

52.246-12 Inspection of Construction (Aug 1996)

(a) Definition. Work includes, but is not limited to, materials, workmanship, and manufacture and fabrication of components.

(b) The Contractor shall maintain an adequate inspection system and perform such inspections as will ensure that the work performed under the contract conforms to contract requirements. The Contractor shall maintain complete inspection records and make them available to the Government. All work shall be conducted under the general direction of the Contracting Officer and is subject to Government inspection and test at all places and at all reasonable times before acceptance to ensure strict compliance with the terms of the contract.

(c) Government inspections and tests are for the sole benefit of the Government and do not—

(1) Relieve the Contractor of responsibility for providing adequate quality control measures;

(2) Relieve the Contractor of responsibility for damage to or loss of the material before acceptance;

(3) Constitute or imply acceptance; or

(4) Affect the continuing rights of the Government after acceptance of the completed work under paragraph (i) of this section.

(d) The presence or absence of a Government inspector does not relieve the Contractor from any contract requirement, nor is the inspector authorized to change any term or condition of the specification without the Contracting Officer’s written authorization.

(e) The Contractor shall promptly furnish, at no increase in contract price, all facilities, labor, and material reasonably needed for performing such safe and convenient inspections and tests as may be required by the Contracting Officer. The Government may charge to the Contractor any additional cost of inspection or test when work is not ready at the time specified by the Contractor for inspection or test, or when prior rejection makes re-inspection or retest necessary. The Government shall perform all inspections and tests in a manner that will not unnecessarily delay the work. Special, full size, and performance tests shall be performed as described in the contract.

(f) The Contractor shall, without charge, replace or correct work found by the Government not to conform to contract requirements, unless in the public interest the Government consents to accept the work with an appropriate adjustment in contract price. The Contractor shall promptly segregate and remove rejected material from the premises.

(g) If the Contractor does not promptly replace or correct rejected work, the Government may—

(1) By contract or otherwise, replace or correct the work and charge the cost to the Contractor; or

(2) Terminate for default the Contractor’s right to proceed.

(h) If, before acceptance of the entire work, the Government decides to examine already completed work by removing it or tearing it out, the Contractor, on request, shall promptly furnish all necessary facilities, labor, and material. If the work is found to be defective or nonconforming in any material respect due to the fault of the Contractor or its subcontractors, the Contractor shall defray the expenses of the examination and of satisfactory reconstruction. However, if the work is found to meet contract requirements, the Contracting Officer shall make an equitable adjustment for the additional services involved in the examination and reconstruction, including, if completion of the work was thereby delayed, an extension of time.

(i) Unless otherwise specified in the contract, the Government shall accept, as promptly as practicable after completion and inspection, all work required by the contract or that portion of the work the Contracting Officer determines can be accepted separately. Acceptance shall be final and conclusive except for latent defects, fraud, gross mistakes amounting to fraud, or the Government’s rights under any warranty or guarantee.

52.246-13 Inspection—Dismantling, Demolition, or Removal of Improvements (Aug 1996)

(a) Unless otherwise designated by the specifications, all workmanship performed under the contract is subject to Government inspection at all times and places where dismantling or demolition work is being performed. The Contractor shall furnish promptly, and at no increase in contract price, all reasonable facilities, labor, and materials necessary for safe and convenient inspection by the Government. The Government shall perform inspections in a manner that will not unduly delay the work.

(b) The Contractor is responsible for damage to property caused by defective workmanship. The Contractor shall promptly segregate and remove from the premises any unsatisfactory facilities, materials, and equipment used in contract performance, and promptly replaces them with satisfactory items. If the Contractor fails to proceed at once in a workmanlike manner with performance of the work or with the correction of defective workmanship, the Government may—

(1) By contract or otherwise, replace the facilities, materials, and equipment or correct the workmanship and charge the cost to the Contractor; and

(2) Terminate for default the Contractor’s right to proceed. The Contractor and any surety shall be liable, to the extent specified in the contract for any damage or cost of repair or replacement. (End of clause) 52.246-21 Warranty of Construction (MAR 1994)

(a) In addition to any other warranties in this contract, the Contractor warrants, except as provided in paragraph (i) of this clause, that work performed under this contract conforms to the contract requirements and is free of any defect in equipment, material, or design furnished, or workmanship performed by the Contractor or any subcontractor or supplier at any tier.

(b) This warranty shall continue for a period of 1 year from the date of final acceptance of the work. If the Government takes possession of any part of the work before final acceptance, this warranty shall continue for a period of 1 year from the date the Government takes possession.

(c) The Contractor shall remedy at the Contractor’s expense any failure to conform, or any defect. In addition, the Contractor shall remedy at the Contractor’s expense any damage to Government-owned or controlled real or personal property, when that damage is the result of—

(1) The Contractor’s failure to conform to contract requirements; or

(2) Any defect of equipment, material, workmanship, or design furnished.

(d) The Contractor shall restore any work damaged in fulfilling the terms and conditions of this clause. The Contractor’s warranty with respect to work repaired or replaced will run for 1 year from the date of repair or replacement.

(e) The Contracting Officer shall notify the Contractor, in writing, within a reasonable time after the discovery of any failure, defect, or damage.

(f) If the Contractor fails to remedy any failure, defect, or damage within a reasonable time after receipt of notice, the Government shall have the right to replace, repair, or otherwise remedy the failure, defect, or damage at the Contractor’s expense.

(g) With respect to all warranties, express or implied, from subcontractors, manufacturers, or suppliers for work performed and materials furnished under this contract, the Contractor shall—

(1) Obtain all warranties that would be given in normal commercial practice;

(2) Require all warranties to be executed, in writing, for the benefit of the Government, if directed by the Contracting Officer;

and

(3) Enforce all warranties for the benefit of the Government, if directed by the Contracting Officer.

(h) In the event the Contractor’s warranty under paragraph (b) of this clause has expired, the Government may bring suit at its expense to enforce a subcontractor’s, manufacturers, or supplier’s warranty.

(i) Unless a defect is caused by the negligence of the Contractor or subcontractor or supplier at any tier, the Contractor shall not be liable for the repair of any defects of material or design furnished by the Government nor for the repair of any damage that results from any defect in Government-furnished material or design.

(j) This warranty shall not limit the Government’s rights under the Inspection and Acceptance clause of this contract with respect to latent defects, gross mistakes, or fraud.

SECTION F – DELIVERIES OR PERFORMANCE

FAR 52.211-10 Commencement, Prosecution, and Completion of Work (APR 1984)

The Contractor shall be required to (a) commence work under this contract within 10 calendar days after the date the Contractor receives notice-to-proceed, (b) prosecute the work diligently, and (c) complete the entire work ready for use not later than 90 calendar days from issuance of notice-to-proceed. The time stated for completion shall include final cleanup of the premises.

Within 5 calendar days after receipt of a written request from the Contracting Officer, the Contractor must submit the following information in writing for approval:

52.204-7 SYSTEM FOR AWARD MANAGEMENT (OCT 2018)

(a) Definitions. As used in this provision— “Electronic Funds Transfer (EFT) indicator means a four-character suffix to the unique entity identifier. The suffix is assigned at the discretion of the commercial, nonprofit, or Government entity to establish additional System for Award Management records for identifying alternative EFT accounts (see subpart 32.11) for the same entity.

Registered in the System for Award Management (SAM) means that–

(1) The Offeror has entered all mandatory information, including the unique entity identifier and the EFT indicator, if applicable, the Commercial and Government Entity (CAGE) code, as well as data required by the Federal Funding Accountability and Transparency Act of 2006 (see subpart 4.14) into SAM

(2) The offeror has completed the Core, Assertions, and Representations and Certifications, and Points of Contact sections of the registration in SAM;

(3) The Government has validated all mandatory data fields, to include validation of the Taxpayer Identification Number (TIN) with the Internal Revenue Service (IRS). The offeror will be required to provide consent for TIN validation to the Government as a part of the SAM registration process; and

(4) The Government has marked the record “Active”.
