JUSTIFICATION AND APPROVAL

JUSTIFICATION

1. Contracting Activity

The Naval Sea Systems Command, Naval Surface Warfare Center, Dahlgren Division (NSWCDD), Contracts Department

2. Description of the Action Being Approved

Award of a firm fixed priced contract on a sole source basis for critical service to be used by the Naval Surface Warfare Center, Dahlgren Division (NSWCDD), Weapons Control and Integration Department (Code H), Asymmetric Systems Division (Code H10), manufactured by EOS of North America.

3. Description of Supplies/Services

The proposed requirement is for annual maintenance for the EOSINT M280 and M290 Direct Metal Laser Sintering (DMLS) Machines manufactured by EOS of North America. H10 produces components with extremely complex geometries and precise dimensions for classified programs using these printers, and no other equipment onsite provides the capability of these machines. H10 uses the M280 and M290 DMLS Machines to satisfy these requirements and to support additive manufacturing capabilities. The constant use of this equipment will wear down and burnout the parts and mechanical components. The systems may not reach its estimated life expectancy if it is not maintained on a regular basis. The current maintenance ends on January 25, 2022; therefore, the service must begin on January 26, 2022 to avoid a gap.

The Government's minimum needs have been verified by the certifying technical and requirements personnel.

4. Statutory Authority Permitting Other Than Full and Open Competition

41 U.S.C. 1901 as implemented in FAR Subpart 13.5.

5. Rationale Justifying Use of Cited Statutory Authority

The Government has invested over a $1,522,510.30 in EOS equipment and materials. We have spent over six (6) years developing our capabilities, which would not be recovered if the Government were forced to purchase a different manufacturer’s equipment and materials. Selection of an alternate brand would cause the Government to incur additional time estimated at 360 Direct Productive Person Hours (DPPH) developing or converting the current CAD design data or lost production costs. In addition to the 360 DPPH, personnel would need to learn how to configure, secure, test, and troubleshoot any problems with another brand name product prior to producing parts, which will ultimately lead to major delays in program schedules. This would cost the program an estimated additional 12 months and greatly increase the technical and programmatic risk to the sponsor, and cost in excess of $635,000.

6. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable

Market research and discussions with EOS of North America, the Original Equipment Manufacturer (OEM), confirm that all maintenance support should go through their authorized reseller, Phillips Corporation to perform the annual maintenance and repair (sole source letter attached). Phillips Corporation is the only vendor that can meet the Government’s minimum requirements. The NSWCDD has no plans at this time to compete future contracts for the types of supplies/services covered by this document due to the proprietary nature of this procurement. If a future requirement should arise, reappraisal will take place to determine whether competition is feasible. If another potential source emerges, NSWCDD will assess whether competition for future requirements is feasible.

The proposed contract will be synopsized on beta.SAM.gov website to give fair opportunity. No additional market research was conducted because it is not practicable, for the reasons discussed in paragraph 5 above, for any company other than Phillips Corporation to provide the required equipment.

7. Determination of Fair and Reasonable Costs

The Contracting Officer has determined that the anticipated cost to the Government for the equipment covered by the J&A will be fair and reasonable.

8. Actions to Remove Barriers to Competition

For the reasons set forth in Paragraph 5, Dahlgren Contract Department has no plans at this time to compete future contracts for the type of equipment covered by this document. If another potential source emerges, Dahlgren Contract Department will assess whether competition for future requirements is feasible.
