. 1 Statement of Work

STATEMENT OF WORK

LANDSCAPE AND GROUNDS MAINTENANCE SERVICES

NARRAGANSETT, RI

SCOPE OF SERVICE

Landscape and grounds maintenance for the National Marine Fisheries Service/Northeast Fisheries Science Center (NEFSC) located at 28 Tarzwell Drive, Narragansett, RI.

Services shall be performed on the grounds of the NMFS laboratory which includes property around the Main Laboratory Building, Modular office unit, Main Storage Building and all Parking Lots and Access Roads. The area of grounds to be maintained is approximately 3 acres.

1. All work performed under this contract is required to meet the quality and performance standards as identified in this SOW.

2. The Contractor shall provide all personnel, equipment, tools, materials, supervision and other items necessary to perform grounds maintenance. All work shall be performed in a manner that will promote and maintain healthy grass, shrubs and plants and present a neat and professional appearance.

3. Services shall be performed during normal business hours between the hours of 8:00 and 3:30PM, Monday through Friday. In the event services cannot ber performed due to inclement weather, the Contractor shall perform any and all scheduled services the next business day with no degradation to existing scheduled services.

PRE-BID SITE VISIT

It is highly recommended that a site visit be conducted prior to submitting a quote in order to view site conditions and verify measurements. Contact the government COR to schedule a site visit between the hours of 7:30 AM– 3:30 PM, Monday through Friday. Please plan to coordinate site visits at least two working days in advance of intended site visit.

SPECIFIC TASKS

1. Mowing and trimming Operations – The Contractor shall be responsible for monitoring the growth of the grass and schedule cutting / mowing operations as required. The Contractor shall prevent scalping, uneven mowing, rutting etc. by the equipment and damage to trees and shrubs during contractor operations. The contractor shall replace shrubs and trees damaged by mowing operations. Precautions shall include removal or repair of equipment causing unnecessary damage or procedures causing unsatisfactory mowing. The

Government is not responsible for damage to Contractors equipment due to trash, debris or uneven terrain. The Contractor shall maintain all open drainage systems, open culverts under driveways and roads free of debris, trash, limbs, leaves and grass clippings. Grass shall be cut on a weekly basis from April 15th through October 31th and maintained between 2” and 3.5” in height. Grass and weeds shall be trimmed around trees, shrubs, buildings fences, poles, posts, fire hydrants, parking lot curbs and other fixed obstacles. Trimming height shall match surrounding area grass height. Grass clippings shall be removed or mulched to provide a uniform appearance after mowing. Grounds shall look well-manicured at all times. All areas shall be trimmed concurrent with mowing. Damage to trees and shrubs from trimming caused by the Contractor shall be repaired by the Contractor at no additional cost to the Government. If a plant should die or become unhealthy due to damage caused by the contractor, the Contractor will be responsible for replacing the damaged plant or tree of the same species and size. Plant or tree replacement or repair shall occur within 15 days of noticed damage. It is the Contractors responsibility to ensure trees are not damaged by their trimming or mowing services.

2. Edging – Grass shall be cut back from all edges 0.5” to 1.5” and not cut deeper than 1.5” to 2”. Edging shall include removal of vegetation from crack and expansion joints in sidewalks, driveways and curbs. Grass shall not extend over the edge of parking lots, concrete pads, walkways, sidewalks, driveways, paved areas and curbs in all areas.

3. Shrubs and Hedge Maintenance – The Contractor shall accomplish in accordance with established arboricultural and landscape maintenance practices, all work necessary to maintain shrubs and hedges in all grounds areas. Shrubs shall be pruned to maintain their natural growth characteristics except when clearance of a facility is required.

4. Debris Removal and Policing Grounds – All debris and trash such as paper, plastic, bottles, cans and deciduous debris, etc., that accumulates within the confines of all NMFS grounds shall be collected and legally discarded off site by the contractor. All debris such as grass clippings, limbs, branches and other matter resulting from mowing, trimming, edging, pruning, etc. shall be collected and legally discarded off site by the Contractor.

5. Weed Control – The Contractor shall remove or eradicate all weeds that may grow within shrubs, plant beds, grounds and non-landscaping areas such as around buildings, fences, sidewalks, parking area’s and street gutters.

It shall be the responsibility of the contractor to protect the property of others as well as his/her own property, and to repair or replace any property damaged by the contractor in fulfilling this project. The contractor shall keep the area clean and upon completion of the project, the contractor shall clean up the work area and remove all debris from the job site in a timely and legally acceptable manner so as to not detract from the aesthetics or the functions of the building. Government dumpsters will not be available for contractor use.

SUPPLIES, MATERIALS AND EQUIPMENT

Government Furnished Equipment:

The Government will not provide any supplies, equipment, materials or manpower necessary for the performance of this contract.

Contractor Furnished:

1. The Contractor shall furnish all supplies, equipment and materials necessary to achieve the quality performance standards of the work in this contract unless otherwise specified herein.

2. The Contractor shall furnish all equipment necessary to accomplish the work under this contract. All equipment must meet all applicable OSHA standards for safe operation. Contractors shall not use any equipment that may be unsafe or any equipment that is in need of repair.

CONTRACTOR PERSONNEL

1. Within 5 days of the contract start date, the Contractor shall submit, in writing, the name of the site manager and an alternate to the COR. The Contractor shall supply telephone, cell phone and /or pager numbers to the COR for use in contacting the site Manager.

2. The Site Manager shall conduct overall management coordination and shall be the central point of contact with the Government for performance of all work under this contract. The site Manager shall be authorized to receive any notices of deficiency in contract performance. The notices may include but not limited to the following: Non-performance of work, Deficiencies in work performed and Notices of proposed payment deductions due to the above.

The site Manager shall be available weekdays between the hours of 8:00 a.m.

and 3:30 PM. to discuss problem areas.

3. All personnel employed by the Contractor shall be experienced in the type of work involved and familiar with the specifications of this contract.

4. Contractor personnel shall conduct all operations in such a manner as to minimize any inconvenience in the use of the facilities to the occupants.

SCHEDULING WORK AND REPORTING REQUIREMENTS

Within five (5) work days of the contract starting date and annually thereafter for renewal periods, the Contractor shall submit to the COR schedules to accomplish required services throughout the contract year. If changes need to be made to reduce conflicts with Government operations, special events, or other occurrences, the Contractor shall meet with the COR and revise the schedule as necessary. The COR can request changes to the monthly work schedule so spacing of services is distributed to meet the needs of the Government. The Contractor shall not deviate from this schedule without prior approval from the COR.

WORKMANSHIP AND QUALITY CONTROL

All work shall be of highest quality and in strict accordance with commercial grounds maintenance standards and best practices.

• Unless otherwise noted in the contract documents, contractor shall comply with the current specifications and details within the SOW.

• The contractor shall provide adequate number of experienced workmen regularly engaged in this type of work who are skilled in the application techniques of the materials specified. Provide at least one thoroughly trained and experienced superintendent on the job at all times when work is in progress.

PERFORMANCE STANDARDS AND GUIDELINE REQUIREMENTS

The Contractor shall provide all labor, equipment, materials, supplies and supervision necessary to perform grounds maintenance and landscape services as identified in the statement of work (SOW) and what is considered to be the normal industry quality and performance standards for intended services under this type of contract.

(a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers: 1) Past Performance 2) Price.

(iii) past performance (see FAR 15.304);

(b) Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s).

(c) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer`s specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.

. 6 52.217-8 OPTION TO EXTEND SERVICES (NOV 1999)

The Government may require continued performance of any services within the limits and at the rates specified in the contract. These rates may be adjusted only as a result of revisions to prevailing labor rates provided by the Secretary of Labor. The option provision may be exercised more than once, but the total extension of performance hereunder shall not exceed 6 months. The Contracting Officer may exercise the option by written notice to the Contractor within 7 days of the end of the period of performance.

. 7 52.217-9 OPTION TO EXTEND THE TERM OF THE CONTRACT (MAR 2000)

(a) The Government may extend the term of this contract by written notice to the Contractor within 7 days of the last day of the period of performance provided that the Government gives the Contractor a preliminary written notice of its intent to extend at least 14 days before the contract expires. The preliminary notice does not commit the Government to an extension.

. 8 52.232-39 UNENFORCEABILITY OF UNAUTHORIZED OBLIGATIONS (JUNE 2013)

(a) Except as stated in paragraph (b) of this clause, when any supply or service acquired under this contract is subject to any End User License Agreement (EULA), Terms of Service (TOS), or similar legal instrument or agreement, that includes any clause requiring the Government to indemnify the Contractor or any person or entity for damages, costs, fees, or any other loss or liability that would create an Anti-Deficiency Act violation (31 U.S.C. 1341), the following shall govern:

(1) Any such clause is unenforceable against the Government.

(2) Neither the Government nor any Government authorized end user shall be deemed to have agreed to such clause by virtue of it appearing in the EULA, TOS, or similar legal instrument or agreement.

If the EULA, TOS, or similar legal instrument or agreement is invoked through an `I agree` click box or other comparable mechanism (e.g., `click-wrap` or `browse-wrap` agreements), execution does not bind the Government or any Government authorized end user to such clause.

(3) Any such clause is deemed to be stricken from the EULA, TOS, or similar legal instrument or agreement.

(b) Paragraph (a) of this clause does not apply to indemnification by the Government that is expressly authorized by statute and specifically authorized under applicable agency regulations and procedures. (End of clause)

(a) Definitions. As used in this provision-- "Data Universal Numbering System (DUNS) number" means the 9-digit number assigned by Dun and Bradstreet, Inc. (D&B) to identify unique business entities.

"Data Universal Numbering System +4 (DUNS+4) number" means the DUNS number assigned by D&B plus a 4-character suffix that may be assigned by a business concern. (D&B has no affiliation with this 4-character suffix.) This 4-character suffix may be assigned at the discretion of the business concern to establish additional System for Award Management records for identifying alternative Electronic Funds Transfer (EFT) accounts (see the FAR at Subpart 32.11) for the same concern.

"Registered in the System for Award Management (SAM) database" means that--

(1) The offeror has entered all mandatory information, including the DUNS number or the DUNS+4 number, the Contractor and Government Entity (CAGE) code, as well as data required by the Federal Funding Accountability and Transparency Act of 2006 (see Subpart 4.14) into the SAM database;

(2) The offeror has completed the Core, Assertions, and Representations and Certifications, and Points of Contact sections of the registration in the SAM database;

(3) The Government has validated all mandatory data fields, to include validation of the Taxpayer Identification Number (TIN) with the Internal Revenue Service (IRS). The offeror will be required to provide consent for TIN validation to the Government as a part of the SAM registration process; and

(4) The Government has marked the record ``Active''''.

(b)

(1) By submission of an offer, the offeror acknowledges the requirement that a prospective awardee shall be registered in the SAM database prior to award, during performance, and through final payment of any contract, basic agreement, basic ordering agreement, or blanket purchasing agreement resulting from this solicitation.

Simms Division of | Revision No.: 17 Director Wage Determinations| Date Of Revision: 12/29/2015 Note: Under Executive Order (EO) 13658, an hourly minimum wage of $10.15 for calendar year 2016 applies to all contracts subject to the Service Contract Act for which the solicitation was issued on or after January 1, 2015. If this contract is covered by the EO, the contractor must pay all workers in any classification listed on this wage determination at least $10.15 per hour (or the applicable wage rate listed on this wage determination, if it is higher) for all hours spent performing on the contract in calendar year 2016.
