SECTION II. STATEMENT OF NEED

The National Marine Fisheries Service’s Office for Law Enforcement (OLE) enforces laws that protect and conserve our nation's living marine resources and their natural habitat. OLE Special Agents and

Enforcement Officers are sworn law enforcement officers with specified authority to make arrests and enforce over 37 statutes, as well as numerous treaties related to the conservation and protection of marine resources. To effectively enforce these statutes, OLE operates five divisional offices and 59 field offices across the U.S. and overseas.

The National Marine Fisheries Service’s Office for Law Enforcement (OLE) is looking to procure bullet proof vest packages for law enforcement activities. OLE currently has 130 Special Agents (SAs) and

Enforcement Officers (EOs). Each is required to carry a firearm while on duty and is required to be issued a protective ballistic vest. EOs are required to wear their vests at all times while in the field. SAs are allowed to use their discretion regarding when to wear their vests. All Enforcement Officers and

Agents are required to qualify quarterly with their agency-issued firearms.

OLE’s current vests are multi-threat vests providing protection against both handgun rounds and spiked weapons. This enhanced level of protection (bullets and spikes) in a single vest makes the multi-threat vests we currently issue much heavier and less flexible than today’s newer technologies.

Because our SAs and EOs conduct a variety strenuous activities every day as a function of their duties i.e. running, jumping, climbing on and off fishing vessels at the dock and at sea, climbing into fish holds and into small compartments, the vests OLE issues must be of the lightest, most flexible material made which is still capable of providing the same level of ballistic protection (level IIIA) and still provide some form of stab/spike/edged weapon protection. OLE has chosen to follow the new industry standard mailto:kristy.dixon@noaa.gov mailto:kristy.dixon@noaa.gov http://www.sam.gov/ in providing this multi-threat protection. This can be accomplished by seeking light-weight ballistic panels placed in a carrier with front and back pockets for the insertion of protective plates designed to provide defense against edged (knives) and spiked weapons.

OLE is looking to procure up to 120 bullet proof vests for its SAs and EOs. Names, duty station addresses for shipping and sizes (each person must be professionally measured using the attached form) are included in the attached documents.

(e) Definitions. The clause at FAR 52.202-1, Definitions, is incorporated herein by reference.

(i) Any such clause is unenforceable against the Government.

(ii) Neither the Government nor any Government authorized end user shall be deemed to have agreed to such clause by virtue of it appearing in the EULA, TOS, or similar legal instrument or agreement. If the EULA, TOS, or similar legal instrument or agreement is invoked through an “I agree” click box or other comparable mechanism (e.g., “click-wrap” or “browse-wrap” agreements), execution does not bind the Government or any

Government authorized end user to such clause.

(iii) Any such clause is deemed to be stricken from the EULA, TOS, or similar legal instrument or agreement.

(2) Paragraph (u)(1) of this clause does not apply to indemnification by the Government that is expressly authorized by statute and specifically authorized under applicable agency regulations and procedures.
