Defense Counterintelligence and Security Agency
LIMITED SOURCES JUSTIFICATION
1. Identification of the agency and contracting activity.

2. The nature and/or description of the action being approved.
This document supports the modification of Defense Counterintelligence and Security Agency (DCSA) task order HS002118F0007 on indefinite-delivery/indefinite-quantity (IDIQ) contract HS002118D0001 to provide Consultation, Facilitation, Leadership Alignment and Strategic Collaboration (ConFLASC) Support Services to DCSA’s Industrial Security Field Operations (IO) for four months (08/04/2002-12/03/2022) and add two one-month option periods (12/04/2022-01/03/2023 and 01/04/2023-02/03/2023). Extension of this task order will prevent an imminent lapse in performance due to a post-award protest filed with the Government Accountability Office on 07/11/2022, which resulted in a stay of performance under DCSA task order HS002122F0040, awarded on 06/30/2022.
DCSA awarded task order HS002118F0007 with one 12-month base period (06/04/2018-06/03/2019) and three 12-month option periods (06/04/2019-06/03/2020, 06/04/2020-06/03/2021, and 06/04/2021- 06/03/2022). Modification P00009 reduced the scope of work in performance work statement section
5.2.1.1 by eliminating one Front Office support position, thereby reducing the period of performance (PoP) on CLIN 3001 by four months to extend 06/04/2021-02/03/2022. This modification also added CLIN 3006 with a PoP extending 02/04/2022-06/03/2022. Modification P00010 extended and funded performance for two months under CLINs 4001 and 4006, from 06/04/2022-08/03/2022.
DCSA will award this modification on task order HS002118F0007 as a sole source extension with the incumbent contractor, ICF Incorporated, LLC, in accordance with FAR 16.505(b)(2)(i)(C), which allows for a logical follow-on to an order already issued under the contract, provided that all awardees were given a fair opportunity to be considered for the original order. This extension will allow for continued performance until the protest is resolved. In accordance with Federal fiscal law, the total length of this task order for severable services will not exceed five years.
3. A description of the supplies or services required to meet the agency’s needs.
This task order provides ConFLASC Support Services to the DCSA IO, which supports the agency’s mission to protect classified information and materials in the hands of cleared industry by ensuring compliance with the National Industrial Security Program Operating Manual and Executive Order 12829. Additionally, IO works in partnership with facility security officers and industry representatives to ensure the protection of classified information released under contractual obligations or research and development efforts. In order to continue to perform this mission in an evolving and increasingly complex environment, IO must continuously review, analyze, and update processes, procedures, organizational structure, and methods.
The DCSA IO continues to develop and implement initiatives that will drive consistency, improve performance, and provide for a more effective and efficient workforce.
The existing task order has a PoP from 06/04/2018-08/03/2022. DCSA Acquisition and Contracting (AQ) awarded a new competitive task order, HS002122F0040, on GSA OASIS Small Business (SB) on 06/30/2022 to allow for a 30-day transition from the incumbent Contractor to the new Contractor; however, the agency received a post-award protest on 07/11/2022, resulting in an automatic stay of performance under the new award.
A lapse in service would increase risk of IS operational failure thereby compromising a pillar of DCSA’s national security mission. In short, a Contractor staffing shortfall creates a significant performance gap, forcing Government leadership and personnel to divide their attentions between managerial and oversight functions and administrative support tasks typically supported by Contractor personnel.
To prevent a lapse in service during the protest response period, DCSA will issue a bilateral modification in accordance with Federal Acquisition Regulation (FAR) 16.505(b)(2)(i)(C) to extend the current task order for four months (08/04/2022-12/03/2022) and provide two one-month option periods (12/04/2022- 01/03/2023 and 01/04/2023-02/03/2023) in the event performance has not resumed under the new contract. This four-month extension has a total value of $417,642.40. DCSA reallocated unexpended funds in the amount of $263,243.21 from CLIN 4001 and obligated additional funding in the amount of $154,399.19 to fully fund the PoP. The total cost of this contract was increased by $154,399.19, from $5,918,636.26 to $6,073,035.45.
4. The statutory authority and supporting rationale.
The authority to support this action is found at FAR 16.505(b)(2)(i)(C): “The order must be issued on a sole-source basis in the interest of economy and efficiency because it is a logical follow-on to an order already issued under the contract, provided that all awardees were given a fair opportunity to be considered for the original order."
5. A determination by the Contracting Officer that the order represents the best value.
The anticipated total potential dollar value of this task order extension, to include one four-month PoP and two one-month option periods (extending 08/04/2022-02/03/2023), is $626,463.60, which equates to a monthly unit price of $104,410.60 over six months. This is equivalent to current unit pricing, which was previously determined fair and reasonable by the Contracting Officer. As such, the Contracting Officer anticipates that this pricing represents the best value for the Government.
6. A description of the market research conducted and the results.
Recent market research demonstrates that the program management, consultation, facilitation, and strategic communication support that this effort provides is commercially available from several small businesses in the marketplace. The current pricing was determined fair and reasonable at task order award and there have been no changes to the market that would lead the Contracting Officer to determine this is no longer a fair and reasonable price for these services. This extension will allow for continued services through the protest period for a larger IS support services contract that addresses a number of evolving DCSA mission sets through an expanded scope of work vice the predecessor Defense Security Services mission initially supported by this task order.
7. A statement of the actions, if any, the agency may take to remove or overcome any barriers that led to the restricted considerations before any subsequent acquisition for the services is made.
DCSA conducts extensive market research and engages with requiring activities early and often to ensure all stakeholders have an adequate understanding of marketplace capabilities in relation to agency requirements. Identification of available commercial sources promotes competition to the fullest extent, which benefits industry and results in prices that are fair, reasonable, and in the best interest of the Government. In addition, AQ collaborates with DCSA’s Office of Small Business Programs and Industry Engagement to meet agency needs and satisfy small business subcontracting goals by providing opportunities for competition among small businesses and small business subcontracting. In so doing, the agency regularly meets or exceeds its annual small business goals.
