JUSTIFICATION AND APPROVAL

FOR USE OF OTHER THAN FULL AND OPEN COMPETITION

JUSTIFICATION

1. Contracting Activity

The Naval Sea Systems Command, Naval Surface Warfare Center, Dahlgren Division (NSWCDD), Contracts Department

2. Description of the Action Being Approved

Award of a firm fixed priced contract on a sole source basis for critical equipment to be used by the Electromagnetic and Sensor Systems Department (B), Sensor Data Exploitation (B60), Sensor Data Fusion Branch (B61), manufactured by The Durbin Group LLC.

3. Description of Supplies/Services

The NSWCDD B61 requires a quantity of four (4) customized Enhanced Collection System (ECS) Permanent-Alteration (Perm-Alt) Cabinet Assemblies, model number DGM24210, manufactured by The Durbin Group LLC. The Durbin Group will provide all cabinets to accept system hardware and enhanced interface design to meet ship integration specifications (MIL-S-910D Shock Grade B).

Internal components will include:

• DGM24228 Internal Cable Assemblies

• QTY 2 DGM24221 SAN/SPAN Server including RAID Controllers, Network Interface Card, Compression Card, and Graphics Card. Not included: Solid State Drives.

• QTY 1 DGM24247 Controller Server including RAID Controllers, Network Interface Card, Compression Card, and Graphics Card. Not included: Solid State Drives.

• QTY 4 DGM24219 ECS 1U Server including RAID Controllers, Network Interface Card, Compression Card, and Graphics Card. Not included: Solid State Drive.

The required delivery date is 30 NOV 2022 to meet FY23 ship installations.

The Government's minimum needs have been verified by the certifying technical and requirements personnel.

The estimated cost of the proposed contract action $1,500,000.00.

Fiscal year 2022 Operations and Maintenance, Navy, funding will be utilized for this procurement.

4. Statutory Authority Permitting Other Than Full and Open Competition

41 U.S.C. 1901 as implemented in FAR subpart 13.5.

5. Rationale Justifying Use of Cited Statutory Authority

The ECS is a real time collection system that will retrieve the Stimulus and Returns (STIMS/RETURNS) and Analog to Digital (A/D) data from the Multi-Mission Signal Processor (MMSP) on the Baseline 9C SPY Radar. The ability to collect this data is critical to the improvement of performance models and event reconstruction in support of the program office’s mission. The ECS Shock and Vibe Test cabinet assembly has been uniquely designed to meet the Enhanced Coherent Data Collection System (ECDCS) requirements. This system meets the requirements of the design that has already been configured and tested to support data collection of the SPY Radar system and is currently the only system that meets the requirements of the program office. The proven ECS design has been used to record radar I&Q data at multiple shore based facilities and at live test fire events onboard DDG-class US Naval ships and this enhanced version will allow for the collection of additional channels of data. The ECS system design is fully compatible with the current tactical radar system. This model of systems has been developed, integrated, tested and includes information assurance scans and validation which have successfully supported fleet events. Simulated traffic through the equipment has assured the government software collected properly in this configuration. The ECS will reside onboard Aegis Baseline 9C DDG ships. The fully populated cabinet that The Durbin Group is building is the only option as The Durbin Group built a prototype cabinet that has been proven to pass all Environmental Quality Testing (EQT) certification.

Running the risk of going with a different company is unacceptable as the exact design that was built from a previous orders under Contract N0017819PP029, N0017820PC608 and

N0017821PC616 must be installed on the ships. Additionally, for logistics and maintenance support, the Ship Change Document (SDC) contains each of the part numbered components submitted for Integrated Logistics Support certification so the Fleet understands what materials are needed to be replaced when equipment potentially fails. If another company were to rebuild the qualified 14U collection cabinet and were to make modifications to this cabinet changing the shock profile, then additional testing would be needed to prove the new design meets 901-D standards which would be at least an additional cost of $650,000.00. Furthermore, there would be at least a one-year delay in schedule for another company to deliver a new design and for our government team to put this design through environmental testing. This delay would result in the ECS missing four (4) ship install windows in Fiscal Year (FY) 23, which would then delay installing on these ships by a minimum three (3) years due to ship availability. This additional cost could not be recovered through full and open competition.

6. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable

Due to the long lead-time for production and the short time frame that ECS has to prepare for permanent installation onboard Aegis ships in FY23, utilizing another brand of hardware would require a complete redesign of current hardware and software, as well as the need to certify and train on the new system resulting in an estimated $1,850,000.00, as well as an additional 24 months to deploy. The NSWCDD has extensively worked with The Durbin Group LLC on the design and alterations needed for the Shock and Vibe testing under Contract N0017819PP029, N0017820PC608 and N0017821PC616. The current configuration is compatible in all aspects of form, fit and function, and thus there can be no substitute. Further testing would be required to have a better understanding of the performance capabilities of any potential alternative options before another source could be explored.

Until these evaluations take place in a laboratory environment, shore base test facility, and onboard US Navy ships, ECS would not be able to receive the necessary approvals in time for the shipboard installations. The proprietary nature of the system and the timeline required for ship installation limits the ability to promote competition.

The solicitation was posted on beta.Sam. Only the Durbin Group expressed interest in this requirement. No additional market only The Durbin Group expressed interest in this requirement. No additional market research was conducted because it is not practicable, for the reasons discussed in paragraph 5 above, for any company other than The Durbin Group LLC to provide the required equipment.

7. Determination of Fair and Reasonable Costs

The Contracting Officer has determined that the anticipated cost to the Government for the equipment covered by the J&A will be fair and reasonable.

8. Actions to Remove Barriers to Competition

For the reasons set forth in Paragraph 5, Dahlgren Contract Department has no plans at this time to compete future contracts for the type of equipment covered by this document. If another potential source emerges, Dahlgren Contract Department will assess whether competition for future requirements is feasible.
