ADVERTISEMENT AND NOTICE TO BIDDERS

NOTICE IS HEREBY GIVEN that sealed bids for Water Maintenance Materials will be received by the

Town Clerk of the Town of New Castle at Town Hall, 200 South Greeley Avenue, Chappaqua, NY 10514 until

11:00 a.m. eastern standard time on Tuesday, July 8, 2025, at which time the bids received will be publicly opened and read aloud at Town Hall, unless such date and/or time for the submission and/or opening of bids is modified by Addendum. The envelope and/or package containing a bid must be sealed, addressed to the Town Clerk at

Town Hall, 200 South Greeley Avenue, Chappaqua, NY 10514, and shall be labeled on the outside as “DPW

2025-03 Water Maintenance Materials.”

The bid documents, including but not limited to the Specifications for this bid, will be on file and may be obtained at the office of the Town Clerk, 200 South Greeley Avenue, Chappaqua, New York, 10514, commencing on Friday, June 13, 2025. Additionally, on the same date, the bid documents will be available on the following website: http://www.bidnetdirect.com/new-york. This materials bid is an annual estimated requirements contract subject to increase and/or decrease of quantities based upon departmental needs. Unless otherwise noted, all materials shall meet the American Water Works Association (AWWA) latest specifications and the Town’s specifications. Awards shall be made for each item independently. The Town Board of the Town of New Castle reserves the right to waive what it deems to be informalities relating to a specific bid, to waive what it deems to be technical defects, irregularities and omissions relating to a specific bid, to reject any or all bids, to request additional information from any bidder, to re-advertise for new bids or to accept the whole or part of any bid which in the opinion of the Town Board is in the best interest of the

Town of New Castle.

Each bidder assumes the risk of any error or delay in the delivery of its bid by whatever delivery means it chooses (e.g., mail, hand delivery, courier, overnight service or any other means), including the handling of mail by employees of the Town of New Castle.

1. Sealed bids for DPW 2025-03 WATER MAINTENANCE MATERIALS will be received by the Town

Clerk of the Town of New Castle, at Town Hall, 200 South Greeley Avenue, Chappaqua, NY 10514, until

11:00 a.m. EST, on Tuesday, July 8, 2025, unless such date and/or time for the submission of bids is modified by Addendum. The bid shall be submitted in accordance with the Specifications on file with the Town Clerk where they may be obtained and examined beginning on Friday, June 13, 2025. Additionally, on the same date, the bid documents will be available on the following website: http://www.bidnetdirect.com/new-york.

This materials bid is an annual estimated requirements contract subject to increase and/or decrease of quantities based upon departmental needs.

2. Unless otherwise noted, all materials shall meet the American Water Works Association (AWWA) latest specifications and the Town’s specifications.

3. All bids must be enclosed in a sealed envelope and/or package marked "DPW 2025-03 Water Maintenance

Materials" on the outside, and submitted before 11:00 am on Tuesday, July 8, 2025 to the Town Clerk, at which time the bids received shall be opened and read aloud, unless such date and/or time for the submission and/or opening of bids is modified by Addendum. SPECIFICATIONS

FOR

GENERAL INFORMATION

INTENT

It is the intent of these specifications to make individual awards for each item specified herein. The Town does not guarantee that it actually shall purchase each of these items or that it will purchase the estimated quantity indicated for each item. The specifications listed are minimum acceptable requirements. Except with regard to

Item 2 Hydrants, where trade, brand and/or manufacturer names are referenced, they are not meant to be restrictive, rather they are intended to establish the required standard of quality and performance for the item sought and equivalent items will be considered by the Town. Any proposed equivalent must be identified in the bid and detailed specifications, circulars, dimension prints, performance data and all other information and data necessary to evaluate the equivalency of the proposed item must be supplied to allow comparison and analysis by the Town. For Item 2 Hydrants, by resolution adopted on April 5, 2022, the Town Board of the Town of New

Castle standardized the fire hydrants to be purchased and installed by the Town to be Mueller® Super Centurion hydrants for mechanical joint hydrants and Kennedy Valve K81 AW for screw-in hydrants and, therefore, no equivalents or substitutions are permitted for the specified fire hydrants. Bidders are advised that these specifications are meant to be applied in addition to the material specifications of the American Water Works

Association (AWWA) and any other standards or specifications referenced herein. It must be noted that any bid submitted wherein the items or materials identified do not comply with the quality and/or performance requirements set forth by AWWA or in these Town specifications may be immediately rejected without further consideration.

BID

Bids submitted shall remain in effect with a fixed price until May 31, 2026 after the Award of Bids. Prices may be extended for one year if mutually agreed to in writing. The fixed price for the second year may be increased by no more than the amount of the Northeast CPI for the preceding year. The Town will endeavor to make an award within forty-five (45) days of the date of the bid opening and all bids shall remain firm during that time frame. The Town further reserves the right to make award following this period to any bidder who has not provided written notice to the Town that its bid as been withdrawn.

PRICE

Price shall be net F.O.B. Town of New Castle DPW Garage, 280 Joan Corwin Way, Chappaqua, New York, unless otherwise specified. The price is a fixed delivered price with NO fuel surcharge.

METHOD OF AWARD

Awards shall be made for each item independently to the lowest responsible Bidder for each item. The Town of

New Castle reserves the right to determine responsibility based on an evaluation of the Bidder's qualifications, experience, organization, finances, past performances, and other applicable factors. The Town Board of the

Town of New Castle reserves the right to waive what it deems to be informalities relating to a specific bid, to waive what it deems to be technical defects, irregularities and omissions relating to a specific bid, to reject any or all bids, to request additional information from any bidder, to re-advertise for new bids or to accept the whole or part of, as the Town Board deems to be in the best interest of the Town.

DELIVERY

All materials, unless otherwise specified, shall be delivered finished and complete to the Town of New Castle

DPW Garage at 270- 280 Joan Corwin Way, Chappaqua, NY; in the location designated by DPW personnel. Any items specified in unit weights shall be provided with a Weight Certificate of certified weights and may be subject to challenge by the Town of New Castle or its representatives with scales of their choice. When material shall be delivered to a site (other than 280 Joan Corwin Way), the Department of Public Works shall maintain traffic control and any relocation responsibility. DPW personnel shall unload containers by means of fork truck.

Deliveries will only be accepted during weekdays (Monday through Friday), with no deliveries on any Town-recognized holidays.

INFORMATION TO BE FURNISHED WITH BID

Bidders must submit with their bids, in duplicate, detailed specifications, circulars, dimension prints and all other necessary data on materials proposed to be furnished. The failure to do so may cause a bid to be rejected as nonresponsive. The Bidder must state any exceptions. The Town, however, reserves the right to request any additional information deemed necessary, including but not limited to SAMPLES, for the proper evaluation of bids and any claimed equivalents identified in the bids.

GUARANTEED WITH BID

The Bidder guarantees that the material offered meets or exceeds all standards specified herein.

ACCEPTANCE

Before acceptance of the materials to be furnished under this bid, the Commissioner of Public Works or his agent shall have the right to inspect and test the materials to ascertain that all requirements of the specifications have been fully complied with and that the items are proper and complete in every respect and in perfect condition. It is understood and agreed that the Commissioner of Public Works or his agent shall have the right to make such

test by actual use of the materials. In the event of disapproval or rejections by the Commissioner of Public Works of any of the materials or items furnished under an awarded contract, the Bidder shall make such substitutions or replacements as are necessary in order to make the material proper and complete in every respect to the satisfaction of the Commissioner of Public Works. All such replacements to be at the expense of the Bidder.

WARRANTIES

Every item delivered must be guaranteed against faulty materials and workmanship for a period of at least one

(1) year from date of delivery and, if during this period such faults develop, the Bidder agrees to replace the item affected without cost to the Town.

QUALIFICATIONS OF BIDDER

No bid will be considered unless the Bidder can meet the following conditions:

1. That it has in operation or is authorized to represent (see Note below) a factory adequate for the manufacture of the items it proposes to furnish.

2. That it has in operation and has had for at least twelve (12) months prior to the time of bid opening, a storage facility equipped with spare parts, not assembled, which can be delivered within twenty-four hours.

NOTE: In the event a bid is submitted by other than the manufacturer, a certificate executed by the manufacturer may be required stating that the Bidder is an authorized agent, dealer, or distributor of the manufacturer and that the items offered are completely in compliance with the specifications and proposal.

REQUIRED CERTIFICATIONS

Every bid must be accompanied by a completed and executed: (a) Non-Collusive Bidding Certification Certificate of Non-Collusion, (b) Certification of Compliance with the Iranian Divestment Act, and (c) Sexual Harassment

Written Policy & Training Certification.

REVIEW OF REQUIREMENTS & INTERPRETATION OF BID DOCUMENTS

All Bidders should carefully review this solicitation. If any person who contemplates submitting a bid for the proposed contract(s) is in doubt as to the meaning of any part of the Bid Documents, a written request for clarification and/or interpretation of the Bid Documents shall be submitted in writing to the Town DPW

Commissioner at least five (5) days prior to the scheduled date for the opening of bids. If any person or entity who contemplates submitting a bid for the proposed contract(s) believes there is an omission, conflict, error or ambiguity in the Bid Documents, such person or entity shall notify in writing the Town DPW Commissioner at least five (5) days prior to the scheduled date for the opening of bids. Interpretation of the Bid Documents and responses to questions submitted will be made only by addenda issued before the scheduled date for the opening

of bids, and a copy of such addenda will be mailed or delivered to each person known to have acquired a set of such Contract Documents. No protests based on any omission, conflict, error or ambiguity in the bid documents will be allowed if the omission, conflict, error or ambiguity was not brought to the attention of the Town DPW

Commissioner prior to the opening of bids. Any addenda details or supplemental materials issued during the preparation of bids shall be binding on all Bidders and become part of the Bid Documents.

VERBAL STATEMENTS NOT BINDING

The written terms and provisions of these documents and any addenda that may be issued by the Town supersede any and all verbal statements of the officials, employees or agents of the Town. No verbal interpretation of the

Bid Documents will be effective against or binding upon the Town.

INDEMNIFICATION

To the fullest extent permitted by law, the Bidders awarded a contract pursuant to this bid solicitation shall indemnify, hold harmless and defend the Town of New Castle, and its officers, officials, employees, volunteers and agents from and against all claims, damages, losses and expenses including but not limited to attorney’s fees, arising out of or resulting from the performance of the awarded contract(s), provided that any such claim, damage, loss or expense (a) is attributable to bodily injury, sickness, disease or death, or to injury to or destruction of tangible property, including loss of use resulting therefrom, and (b) is caused in whole or in part by any negligent act or omission or violation of any statutory duty or regulation by the Bidder awarded a contract, or anyone directly or indirectly employed by such Bidder or anyone for whose acts such Bidder may be liable, regardless of whether or not it is caused in part by a party indemnified hereunder.

INDEPENDENT CONTRACTOR

In supplying goods under any contract awarded pursuant to this bid, the successful Bidder(s)r shall operate as, and have the status of, an independent contractor and shall not act as agent or employee or be an agent or employee of the Town. The successful Bidder, its officers, employees and/or agents shall not be entitled to any rights or benefits afforded to the Town’s employees, including, without limitation, disability or unemployment insurance, workers’ compensation, medical insurance, sick leave, retirement or any other employment benefit. Each Bidder is responsible for providing, at the Bidder’s sole expense, disability, unemployment, workers’ compensation and all other forms of insurance, training, permits and licenses for its officers, employees and/or agents. The Bidder, its officers, employees and/or agents shall not assert any claim for additional benefits of any nature, including, but not limited to, unemployment compensation benefits, by reason of the goods to be supplied performed pursuant to any awarded contract. The Bidders, its officers, employees and/or agents, shall not be entitled to assert any claim to entitlements pursuant to any collective bargaining agreement now or hereafter in effect between the

Town and any of its employees.

TERMINATION OF CONTRACT

In its sole discretion, the Town may terminate the contract(s) awarded as a result of this solicitation in the event of a material breach by the Bidder(s) awarded a contract, upon three (3) business days prior written notice from the Town. In the event of such termination, the Town shall only pay for the product(s) and/or service(s) provided prior to the termination in full compliance with the awarded contract and shall deduct from such sums (and if

such sums are insufficient, the Bidder(s) shall pay to the Town the additional sums required to compensate the

Town for) any costs and damages incurred by the Town as a result of the material breach(es) of the awarded contract(s) by the Bidder(s), including but not limited to the increased costs incurred by the Town to secure replacement product(s) and/or service(s).

ASSIGNMENT

No assignment, transfer, conveyance, or other disposition of all or any part of the bid or awarded contract or of any monies due or to come due thereunder, or of any right, title of interest therein, or of the Bidder’s power to execute such contract to any other person, firm or corporation will be permitted or allowed without the previous consent in writing of the Town of New Castle.

COMPLIANCE WITH LAWS

The Bidder shall supply all goods described herein in compliance with all laws of the State of New York.

NO WAIVER OF LEGAL RIGHTS

No action or failure to act on the part of the Town to enforce its rights or remedies under the awarded Contract(s) shall constitute a waiver of any right or remedy to which the Town is entitled, nor shall such action or failure to act on the part of the Town waive any duty on the part of the Bidder(s) awarded a contract to perform under the awarded contract nor such action or failure to act on the part of the Town constitute approval of or acquiescence in any breach of the awarded contract, except as the Town Board may specifically authorize in writing.

EXCEPTIONS TO THE SPECIFICATIONS

If the equipment offered differs from the provisions contained in the specifications, such difference must be explained in detail on sheets attached to the proposal and if such deviations do not constitute materials deviations from the Town's specifications and meet the intent of these specifications and are in the best interest of the Town, the proposal will receive careful consideration.

GENERAL REQUIREMENTS

The specifications, requirements, terms, conditions and obligations hereunder form a part of and are included under the various items of the Contracts. The Contractors shall provide, in the Contract Prices for the various items, for the cost of all labor, materials, supplies, tools, appliances, equipment, transportation and incidentals necessary to perform the work and comply with all the requirements hereunder. All materials or services specified must conform to the most recent revision of the AWWA Standard Specifications (American Water Works

Association) for each item unless otherwise noted.

SAMPLES

The item listed as #10 and #10A should have samples of a small quantity (sufficient to evaluate specifications) supplied to the Town for inspection at or before the time of the bid opening. Award decisions may be based upon not only the low bid, but also the results of sample evaluation.

PRODUCT SPECIFICATIONS

ITEM 1 RESILIENT-WEDGE MJ DI 6," 8," 10,” 12” & 16” GATE VALVES C515

ALL BIDDERS TO QUALIFY MUST CERTIFY THAT:

They are providing Mueller A- 2361- MJ x MJ, or equal DOMESTIC MADE, manufactured in the U.S.A.

only, iron body, bronze mounted, Ductile Iron Gate, with the resilient wedge applied to the gate and seated against a corrosion resistant surface (rated 350 psi, 250 psi for 16”). A metallic surface shall have the corrosion resistance of bronze or better. Stainless steel bonnet bolts & nuts. A nonmetallic surface shall be in compliance with AWWA

C550. Supplied with two (2) complete “Mega-Lug” accessory packages (glands, gaskets, shear bolts), all domestic, manufactured in the U.S.A. only, stainless steel. The valves shall conform to the current revision of

AWWA Specifications for "Resilient Seated Gate Valves for Water and Sewerage Systems" C515 and shall turn counterclockwise (opens left). Nuts and bolts are to be all stainless steel.

ITEM 2 HYDRANTS Ductile Iron 5-l/4” Size, 5 foot bury C502-94

All mechanical joint hydrants shall be Mueller® Super Centurion hydrants and all screw-in hydrants shall be

Kennedy Valve K81 AW. The Town has standardized its hydrant purchases; so, no equivalents or substitutions will be considered for hydrants. They are providing Mueller Super 350 psi Centurion Model A423 dry - barrel fire hydrants 5 foot bury. The hydrants must have: 5-l/4” main valve opening; 6 inch mechanical joint inlet;

operating nut to turn counterclockwise to open; two 2-1/2” hose nozzles; one 4-1/2" pumper nozzle; NST

(National Standard Thread). Hydrants shall incorporate a breakable flange and a cast iron safety stem coupling at the ground line, designed to shear on severe impact. Supplied with complete “Mega-Lug” accessory package

(glands, gaskets, shear bolts), all domestic, manufactured in the U.S.A. only, stainless steel. The hydrants shall conform to the current revision of AWWA Specifications for "Dry-Barrel Fire Hydrants" C502-94.

ITEM 2A1 SCREW-IN REPLACEMENT HYDRANTS (Ductile Iron 4-1/2” Size, 4.5 foot bury)

4.5” Kennedy hydrant K81AW (No equivalents or substitutions allowed. The Town has standardized Kennedy

Valve K81 AW for screw-in hydrants).

ITEM 2A2 SCREW-IN REPLACEMENT HYDRANTS (Ductile Iron 4-1/2” Size, 5 foot bury)

4.5” Kennedy hydrant K81 AW (No equivalents or substitutions allowed. The Town has standardized Kennedy

Valve K81 AW for screw-in hydrants).

ITEM 3 MALLEABLE IRON COUPLINGS - Nominal 6, 8, 10, 12, 16, 20, 24” Pipe

They are providing DOMESTIC MADE, manufactured in the U.S.A. only. Power Max 3506-316 by Powerseal malleable iron repair couplings (for nominal pipe sizes of 6” bid a 6” long barrel, for 8” bid a 10” long barrel, for 10” bid a 10” long barrel, 12” bid a 10” long barrel, & 16” pipe bid a 12” long barrel, and providing

Powerseal 3501 long barrel transition couplings for 20” & 24” pipe bid a 12” long barrel) to join pipes of up to 3/4" difference in outside diameter. Designed to join AC, Steel Cast Iron or Ductile Pipe with working pressure of 200 psi. Nuts and bolts are to be all stainless steel.

ITEM 4 TPS ALL STAINLESS REPAIR CLAMPS -Nominal 6, 8, 10, 12, 16, 20, 24” Pipe

They are providing, DOMESTIC MADE, manufactured in the U.S.A. only, TPS QuickCam Repair Clamp 360 degree/Full Circle Repair Clamps (with the options of 15” and 20” widths) designed to fix steel, cast iron, ductile iron, asbestos cement and/or plastic pipes. Clamps are completely gasket lined and designed to mend complete breaks, splits, and holes in pipe with working pressures up to 300 psi.

ITEM 4A SMITH BLAIR 226/228 ALL STAINLESS FULL CIRCLE REPAIR CLAMPS - Nominal

6, 8, 10, 12, 16, 20, 24” Pipe

They are providing, DOMESTIC MADE, manufactured in the U.S.A. only, Smith Blair 360 degree/Full Circle

Repair Clamps (with the options of 15” and 20” widths) designed to fix steel, cast iron, ductile iron, asbestos cement and/or plastic pipes. Clamps are completely gasket lined and designed to mend complete breaks, splits, and holes in pipe with working pressures up to 300 psi.

ITEM 5 HYMAX AND HYMAX 2 COUPLINGS – Nominal 6, 8, 10, 12, 16, 20, 24” Pipe

ALL BIDDERS TO QUALIFY MUST CERTIFY:

They are providing, ISRAEL MANUFACTURED, couplings to meet or exceed AWWA C-219, NSF 61, NSF

372 standards, designed to fix steel, cast iron, ductile iron, asbestos cement and/or plastic pipes. Couplings are capable of joining pipes of differing outside diameters, i.e. cast iron to ductile iron pipe, with working pressures up to 260 psi for diameters under 18”; over 18”, working psi of 232.

ITEM 6 CEMENT-LINED DUCTILE PIPE-Nom. 6, 8, 10, 12, 16, 20, 24” Push-on Joint

They are providing, DOMESTIC MADE, manufactured in the U.S.A. only, ductile iron pipe from either

U.S. Pipe, American Cast Iron Pipe, or Atlantic States C.I.P. in nominal 18 - 20 foot laying lengths in thickness

CLASS 54. This pipe must conform to the AWWA Specification C151/A21.51-91 and have a minimum working pressure of 350 psi. Each length must be provided with the appropriate standard push-on rubber-gasket joint that conforms to the current revision of AWWA Specification C111/A21.11-90.

ITEM 7 DUCTILE TEES Nominal 6, 8, 10, 12, 16, 20, 24” C110/A21.10-93 &

C153/A21.53-88

They are providing DOMESTIC MADE Tyler or Star DOMESTIC “Compact” fittings; cement-lined ductile iron pipe tees. They must be the mechanical joint variety with a pressure rating of 350 psi, and supplied with three (3) complete “Mega-Lug” accessory packages (glands, gaskets, shear bolts), all domestic, manufactured in the U.S.A., stainless steel. Acceptable alternates may be the compact or lightweight fittings.

CHEMICAL CHARACTERISTICS

This alkaline granular drain opener must produce a slow acting continuously controlled heat that eliminates dangerous fumes. It shall be non-flammable and non-explosive. The mixture shall be trace colored in order to see its effectiveness. This sewer solvent shall be capable of emulsifying greases and oils, digesting roots, paper other materials with a higher percentage of cellulose.

PERFORMANCE

If within the first 30 days of use of a product, performance does not meet all of the above qualifications, the contract may be terminated.

ITEM 10A PASSAGE PLUS POWDER BY MOMAR GRANULAR BIOENZYMATIC DIGESTER

The product submitted for consideration must be a free flowing granular bioenzymatic digester product, 50 pound pails/buckets. All products must meet the following list of requirements:

A blend of naturally occurring organisms that attack the waste as it enters the municipality system, preventing solids/sludge accumulation at pump stations, in sewer lines and improving the plant efficiency. The product should not contain any reportable hazardous components according to US Federal Regulations.
