JUSTIFICATION FOR OTHER THAN FULL & OPEN COMPETITION
1. IDENTIFICATION OF THE AGENCY AND CONTRACTING AGENCY:

2. NATURE AND/OR DESCRIPTION OF THE ACTION BEING APPROVED:
This justification authorizes and approves the issuance of Contract Number 1605DC-18-C-0018 with Catalogic Software, Inc.
The Department of Labor (DOL) Office of the Assistant Secretary for Administration and
Management (OASAM) Office of Chief Information Officer (OCIO) is requesting authorization and approval to purchase the identified Catalogic ECX and DPX components to support a robust enterprise common operating environment.
The Catalogic ECX and DPX components will replace the end of life (EOL); end of services infrastructure components currently supporting the OCIO customer agencies. The stabilization for the Catalogic ECX and DPX infrastructure under the Fiscal Year 2016 (FY16) EOL Tech
Refresh will support the mission to address to the needs of business workers, provide customer service, and develop strong regional economies to influence workforce development and workplace safety.
This effort is to renew the annual maintenance and support agreement for OCIO’s existing software, and to purchase new licenses. Continued support is vital for the software that provides enterprise level data network backup and recovery services.
The purchase of software and maintenance continues to increase the capabilities of the existing systems and improve the overall business operation through standardization of the configuration, and upgrade of end of life systems and components.
3. DESCRIPTION OF SUPPLIES/SERVICES REQUIRED TO MEET THE AGENCY’S
NEEDS (Including the Estimated Value):
The Contractor shall provide Silver Level products and maintenance support services for all Catalogic products that are currently deployed in the DOL OCIO Information
Technology (IT) Network Architecture. The commercial terms and conditions of
Catalogic Silver Level maintenance support are prescribed by Catalogic and services are outlined below.

The period of performance shall provide continuous coverage of Catalogic products for a six
(6) month Base Period.
The Independent Government Cost Estimate (IGCE) for this contract is: $212,319.32.
4. AN IDENTIFICATION OF THE STATUTORY AUTHORITY PERMITTING
OTHER THAN FULL AND OPEN COMPETITION:
Identification of the justification rationale is 6.302-1, “Only one responsible source and no other supplies or services will satisfy agency requirements”.
The Government received a letter to verify that Catalogic Software, Inc. is the sole manufacturer of the DPX Product (formerly Syncsort Backup Express Product (BEX)), and the only company from which the DOL can obtain the required maintenance services.
5. A DEMONSTRATION THAT THE PROPOSED CONTRACTOR’S UNIQUE
QUALIFICATIONS OR THE NATURE OF THE ACQUSITION REQUIRES USE OF
THE AUTHORITY CITED:
Catalogic Software, Inc. provided the Government with a signed letter dated June 01, 2018, to verify that it is the sole manufacturer of the DPX Product (formerly Syncsort Backup Express
Product (BEX)) and the only company from which the U.S. Department of Labor can obtain maintenance services.
6. A DESCRIPTION OF EFFORTS TO OBTAIN COMPETITION TO ENSURE THAT
OFFERS ARE SOLICITED FROM AS MANY POTENTIAL SOURCES AS
PRACTICABLE, INCLUDING WHETHER A NOTICE WAS OR WILL BE
PUBLICIZED AS REQUIRED BY SUBPART 5.2 AND IF NOT, WHICH
EXCEPTION UNDER 5.202 APPLIES:
The Office of Procurement Services (OPS) and OCIO surveyed the market using general internet search engines to identify suitable providers of like software, licenses, and support. The internet search engines utilized for the market survey included: a) www.yahoo.com; and b) www.google.com.
However, the Government found no like software, licenses, or support to meet mission requirements. Additionally, the Government found no other licensed re-sellers of the required software, licenses, and support.
In accordance with Federal Acquisition Regulation (FAR) Part 5.202(a)(13)(i), a notice was not posted because the Government did not anticipate that the contract action would exceed the simplified acquisition threshold.
7. A DETERMINATION BY THE CONTRACTING OFFICER THAT THE
ANTICIPATED COST TO THE GOVERNEMENT WILL BE FAIR AND
REASONABLE:
The original contract pricing was deemed fair and reasonable at the time of award. The
Contracting Officer communicated with the incumbent to obtain pricing. Considering a slight upward price adjustments to account for inflation and other increasing market costs, the
Contracting Officer deems the prices to be fair and reasonable based on analysis of historic pricing.
8. A DESCRIPTION OF MARKET RESEARCH CONDUCTED (PART 10) AND THE
RESULTS OR A STATEMENT OF THE REASON MARKET RESEARCH WAS
NOT CONDUCTED:
The Office of Procurement Services (OPS) and OCIO conducted Market Research from May 07, 2018 through June 04, 2018 using general internet search engines to identify suitable providers of like software, licenses, and support. The internet search engines utilized for the Market
Research included: a) www.yahoo.com; and b) www.google.com.
However, the Government found no like software, licenses, or support to meet mission requirements. Additionally, the Government found no other licensed re-sellers of the required software, licenses, and support.

The Government also contacted Catalogic Software, Inc. (Catalogic Software) directly to request a letter or statement verifying that Catalogic Software is the only licensed seller / re-seller of the
DPX Product (formerly Syncsort Backup Express Product (BEX)).
Catalogic Software provided the Government with a signed letter dated June 01, 2018, to verify that it is the sole manufacturer of the DPX Product (formerly Syncsort Backup Express Product
(BEX)) and the only company from which the U.S. Department of Labor can obtain maintenance services.
9. ANY OTHER SUPPORTING FACTS SUPPORTING THE USE OF OTHER THAN
FULL AND OPEN COMPETITION:
None.
10. A LISTING OF SOURCES, IF ANY, THAT EXPRESSED, IN WRITING, AN
INTEREST IN THE ACQUISITION:
None.
11. A STATEMENT OF THE ACTIONS, IF ANY, THE AGENCY MAY TAKE TO
REMOVE OR OVERCOME ANY BARRIERS TO COMPETITION BEFORE ANY
SUBSEQUENT ACQUISITION FOR THE SUPPLIES OR SERVICES REQUIRED:
There are no known barriers at this time. The Government will continue to research the market for any other alternatives that may be available.
