Heating, Ventilation Air Conditioning (HVAC)

Full Maintenance Statement of Work

1. Background OASAM OCIO has HVAC units deployed in their data center at the U.S. Department of Labor 200 Constitution Avenue, NW Washington, DC 20010 room N5703 and Roof. This purchase request is to acquire a renewed annual full maintenance and support agreement for the HVAC units currently deployed in OASAM-OCIO's network architecture. Continuous maintenance and support of OASAM-OCIO's HVAC units are required in support of OASAM/OCIO's business needs.

2. Objectives The objective of this Statement of Work (SOW) is to obtain a renewed annual full maintenance and support agreement with a 12 month period of performance for the HVAC units currently deployed in OASAM-OCIO's network architecture. (-see table below) It is vital to provide a full maintenance agreement for the LAN room HVAC units. A critical portion of the solution is to provide a fixed fee for scheduled service visits, repairs and providing routine system checks and maintenance .

3. Requirements OASAM OCIO requires that the supplier provide a renewed annual full maintenance and support agreement with a 12 month period of performance for the EBSA HVAC units currently deployed in OASAM-OCIO's network architecture.

The supplier should be experienced and qualified to service units by the original equipment manufacturers: Specific quantities and types of hardware that OCIO requires renewed annual full maintenance coverage are indicated in the table below.

• Emergency service should be available 24 hours a day, 7 days a week with a 4 hour response time.

• None business hours 4 hour response time is required

• Cleaning condenser water strainers two times per year - preferably in the Spring and Fall

Provide quarterly HVAC PM Maintenance inspections for all supplemental units' consisting of the following:

• All necessary system adjustments.

• Checking filters and cleaning or replacing them as scheduled and listed above.

• Lubricating all bearings, motors, and fans.

• Checking fan blades for dust buildup, cleaning if necessary.

• Checking for refrigerant leaks, using an industry standard testing device.

• Checking action of controls and setting them for normal operation.

• Checking amperages and voltages.

• Checking all operating pressures and temperatures.

• Yearly Chillguard calibration.

• Checking belt tension and condition, adjusting or replacing if necessary.

• Cleaning coils, using detergent solution and warm water, twice a year, preferably in the spring and fall. Use fin comb, if necessary to straighten fins.

• Thoroughly inspecting and cleaning interior and exterior of unit.

• Checking drain pans for cleanliness; dropping condensate pan tablets when necessary.

• Checking electrical connections for tightness and discoloration.

• Painting for corrosion control.

• Includes all filters, lubricants and minor cleaning materials for maintenance inspections.

• Includes labor on maintenance inspections and service calls.

• Includes parts, materials and refrigerants for service calls. Excludes labor and materials on major work such as unit replacement, evaporator bundle replacement. A written quote will be submitted for this work .

OASAM OCIO requires maintenance be performed by a certified authorized dealer. They must be familiar with the specialized setup of our various data center controls and equipment that were the original design and installers of refrigerant monitor, emergency evacuation refrigerant fan and controls, XDH units, Sitelink configuration and monitoring system. They also offer on-call off hour service in the event of emergencies. Therefore, in the event of an emergency situation the vendor must respond in an efficient manner in an effort to minimize placing the data center and equipment in an at risk situation.

II. ELECTRONIC INVOICING PROCEDURES

An original invoice shall be prepared and submitted to the Department of Labor (DOL) by email to: DOL-NO-DM-OASAM@quickpay.dol.gov and Shahpoori.Karen.P@dol.gov.

(a) Definitions. As used in this clause-

(1) Contract financing payment has the meaning given in FAR 32.001.

(2) Invoice payment has the meaning given in FAR 32.001.

(3) Payment request means any request for contract financing payment or invoice payment submitted by the contractor under this contract.

(b) Electronic Payment Requests. Except as provided in paragraph (e) of this clause, the contractor shall submit payment requests in electronic form. Purchases paid with a Government-wide commercial purchase card are considered to be an electronic transaction for purposes of this clause, and therefore no additional electronic invoice submission is required.

(c) Data Transmission. A contractor must ensure that the data transmission method and format comply with the following provisions:

(1) The contractor shall:

a. Address the invoice to the appropriate e-mail address specified in the contract.

b. Submit the invoice via attachment in PDF or TIFF format.

c. Submit only one invoice per electronic submittal.

d. Enter specific information in the subject line of the e-mail in the following format:

<Contractor Name>, DOL Agency, <Contract Number, BPA Call or Order Number>, Invoice Number, <Invoice Amount> Example: ABC Co, OASAM, DOL00-00-X0000/X0000, Invoice Number AB-1298433, $15,000.00.

e. Submit a copy of the email with the attached invoice to the contracting officer’s representative (COR) at the COR email address specified in the contract.

f. Before sending another e-mail with the same invoice attachment, confirm whether DOL has already responded and/or whether you have received a success or failure response to your submission.

(2) The contractor MUST NOT:

a. Submit an invoice that exceeds the size limit of 16 megabytes (approximately 400-500 pages). However, if the invoice exceed this limit, a summary invoice attachment of less than 16 megabytes should be e-mailed to the payment e-mail address above; while the detailed invoice, including any supplemental information, shall be sent to the COR or other representative at the address.

b. Submit an invoice that is heavy in shading or color.

1. An e-mailed PDF image cannot have any text that has a background with any color other than white. If the image has a shaded background, it will be converted to black, and the text will be illegible.

2. An emailed TIFF image must be black and white.

a. Submit more than one attachment, as subsequent attachments will not be recognized.

b. Submit more than one invoice in a single attachment.

c. Attempt to use the “Recall or Resend” email message feature.

(d) General Information. Payment due dates will be calculated only from the date that invoices are received in the electronic invoicing e-mail box and determined to be proper invoices.

The relevant invoice must be attached to the inquiry e-mail and the subject line of the e-mail must state “INQUIRY,” followed by the information described in paragraph (1) d. above.

Do NOT use the electronic invoicing e-mail address for inquiries about the invoice.

(e) Invoice requirements. Invoices shall comply with FAR 32.905.

(f) Exceptions. Paper invoices should only be faxed or mailed through U.S. mail when electronic mail cannot be accomplished.

(a) General. Payment will be based on receipt of a proper invoice and satisfactory contract performance.

(b) Content of invoices.

(1) A proper invoice must include the following items (except for interim payments on cost reimbursement contracts for services):

(i) Name and address of the contractor.

(ii) Invoice date and invoice number. (Contractors should date invoices as close as possible to the date of mailing or transmission.)

(iii) Contract number or other authorization for supplies delivered or services performed (including order number and contract line item number).

(iv) Description, quantity, unit of measure, unit price, and extended price of supplies delivered or services performed.

(v) Shipping and payment terms (e.g., shipment number and date of shipment, discount for prompt payment terms). Bill of lading number and weight of shipment will be shown for shipments on Government bills of lading.

(vi) Name and address of contractor official to whom payment is to be sent (must be the same as that in the contract or in a proper notice of assignment).

(vii) Name (where practicable), title, phone number, and mailing address of person to notify in the event of a defective invoice.

(viii) Taxpayer Identification Number (TIN). The contractor must include its TIN on the invoice only if required by agency procedures. (See 4.9 TIN requirements.)

(ix) Electronic funds transfer (EFT) banking information.

(A) The contractor must include EFT banking information on the invoice only if required by agency procedures.

(B) If EFT banking information is not required to be on the invoice, in order for the invoice to be a proper invoice, the contractor must have submitted correct EFT banking information in file:///C:/Users/lamb-michael/AppData/Local/Microsoft/Windows/Temporary%20Internet%20Files/Content.Outlook/16OZXYP3/DCASinvoiceinquiry@dol.gov accordance with the applicable solicitation provision (e.g., 52.232-38, Submission of Electronic Funds Transfer Information with Offer), contract clause (e.g., 52.232-33, Payment by Electronic Funds Transfer-System for Award Management, or 52.232-34, Payment by Electronic Funds Transfer-Other Than System for Award Management), or applicable agency procedures.

(C) EFT banking information is not required if the Government waived the requirement to pay by EFT.

(x) Any other information or documentation required by the contract (e.g., evidence of shipment).

(2) An interim payment request under a cost-reimbursement contract for services constitutes a proper invoice for purposes of this subsection if it includes all of the information required by the contract.

(3) If the invoice does not comply with these requirements, the designated billing office must return it within 7 days after receipt (3 days on contracts for meat, meat food products, or fish; 5 days on contracts for perishable agricultural commodities, dairy products, edible fats or oils, and food products prepared from edible fats or oils), with the reasons why it is not a proper invoice.

If such notice is not timely, then the designated billing office must adjust the due date for the purpose of determining an interest penalty, if any.

(c) Authorization to pay. All invoice payments, with the exception of interim payments on cost-reimbursement contracts for services, must be supported by a receiving report or other Government documentation authorizing payment (e.g., Government certified voucher). The agency receiving official should forward the receiving report or other Government documentation to the designated payment office by the 5th working day after Government acceptance or approval, unless other arrangements have been made. This period of time does not extend the due dates prescribed in this section. Acceptance should be completed as expeditiously as possible. The receiving report or other Government documentation authorizing payment must, as a minimum, include the following:

(1) Contract number or other authorization for supplies delivered or services performed.

(2) Description of supplies delivered or services performed.

(3) Quantities of supplies received and accepted or services performed, if applicable.

(4) Date supplies delivered or services performed.

(5) Date that the designated Government official—

(i) Accepted the supplies or services; or

(ii) Approved the progress payment request, if the request is being made under the clause at 52.232-5, Payments Under Fixed-Price Construction Contracts, or the clause at 52.232-10, Payments Under Fixed-Price Architect-Engineer Contracts.

(6) Signature, printed name, title, mailing address, and telephone number of the designated Government official responsible for acceptance or approval functions.

(d) Billing office. The designated billing office must immediately annotate each invoice with the actual date it receives the invoice.

(e) Payment office. The designated payment office will annotate each invoice and receiving report with the actual date it receives the invoice.

(d) Comptroller General Examination of Record. The Contractor shall comply with the provisions of this paragraph (d) if this contract was awarded using other than sealed bid, is in excess of the simplified acquisition threshold, and does not contain the clause at 52.215-2, Audit and Records-Negotiation.

(1) The Comptroller General of the United States, or an authorized representative of the Comptroller General, shall have access to and right to examine any of the Contractor’s directly pertinent records involving transactions related to this contract.

(2) The Contractor shall make available at its offices at all reasonable times the records, materials, and other evidence for examination, audit, or reproduction, until 3 years after final payment under this contract or for any shorter period specified in FAR Subpart 4.7, Contractor Records Retention, of the other clauses of this contract. If this contract is completely or partially terminated, the records relating to the work terminated shall be made available for 3 years after any resulting final termination settlement. Records relating to appeals under the disputes clause or to litigation or the settlement of claims arising under or relating to this contract shall be made available until such appeals, litigation, or claims are finally resolved.

CONTRACTOR’S OBLIGATION TO NOTIFY THE CONTRACTING OFFICER OF A

REQUEST TO CHANGE THE CONTRACT SCOPE

(a) Except for changes identified in writing and signed by the Contracting Officer, the Contractor is required to notify, within five working days of receipt or knowledge, any request for changes to this contract (including actions, inactions, and written or oral communications) that the Contractor regards as exceeding the scope of the contract. On the basis of the most accurate information available to the Contractor, the notice shall state:

(1) The date, nature, and circumstances of the conduct regarded as a change in scope;

(2) The name, function, and activity of each Government individual and Contractor official or employee involved in, or knowledgeable about, such conduct; and

(3) The identification of any documents and substance of any oral communication involved in such conduct.

(b) Following submission of this notice, the Contractor shall continue performance in accordance with the contract terms and conditions, unless notified otherwise by the Contracting

Officer.

(c) The Contracting Officer shall promptly, within 5 business days after receipt of notice from the Contractor, respond to the notice in writing. In responding, the Contracting Officer shall either:

(1) Confirm that the Contractor’s notice identifies a change in the scope of the contract and directs the Contractor to stop work, completely or in part, in accordance with the Stop Work provisions of the contract;

(2) Deny that the Contractor’s notice identifies a change in scope and instruct the Contractor to continue performance under the contract; or

(3) In the event the Contractor’s notice does not provide sufficient information to make a decision, advise the Contractor what additional information is required, and establish the date by which it should be furnished and the date thereafter by which the Government will respond.

(a) The COR is responsible, as applicable, for: receiving all deliverables; inspecting and accepting the supplies or services provided hereunder in accordance with the terms and conditions of this contract; providing direction to the contractor which clarifies the contract effort, fills in details or otherwise serves to accomplish the contractual scope of work;

evaluating performance; and certifying all invoices/vouchers for acceptance of the supplies or services furnished for payment.

(b) The COR does not have the authority to alter the contractor’s obligations under the contract, and/or modify any of the expressed terms, conditions, specifications, or cost of the agreement.

If, as a result of technical discussions, it is desirable to alter/change contractual obligations or the scope of work, the Contracting Officer must issue such changes.

(c) The COR is authorized to review and recommend approval of:

1. technical matters not involving a change in the scope, price, terms or conditions of this contract;

2. progress reports;

3. inspection and acceptance of supplies/services; and

4. invoices.

(d) The COR is not authorized to direct any action that results in a change in the scope, price, terms or conditions of this contract.
