STATEMENT OF WORK

FOR EQUIPMENT FOR THE AGENCY TECHNICAL EQUIPMENT PROCURMENT

PROGRAM

1.0 Scope. OSHA CTC needs equipment in various field offices. CTC purchases all the equipment for the Agency Technical Equipment Procurement Program (ATEPP).

2.0 Overview. The equipment and accessories being purchased with this order is of makes and models which are currently owned by the Agency and/or can be serviced (repaired and calibrated) by CTC. The Center has the institutional knowledge and experience to service the equipment in the Agency’s best behalf including, where appropriate, having the necessary repair parts, technical drawings and schematics, calibration systems and procedures to service the technical equipment.

The CTC engineers evaluate new equipment being considered for OSHA’s use and develop protocols to test this new equipment to verify it works properly and meets OSHA’s inspection needs. This can include testing instruments in varying environmental conditions, such as extreme temperature, humidity, and checking compliance for Nationally Recognized Testing Laboratories (NRTL’s) standards for use in hazardous locations. Instrument evaluation includes checking for accuracy, safety approvals, functionality, desirable operational features, environmental effects on the instrument, cost, standardization, and serviceability. The independent instrument evaluations allows CTC to advise OSHA’s other directorates on equipment purchases and provides vital equipment operating information to federal field offices, national offices, and OSHA state consultation program offices. In addition, the engineers are continually reviewing the current inventory of equipment to ensure that the manufacturers still support the equipment and that repair parts are still available.

The Center then initiates the Agency Technical Equipment Procurement Program (ATEPP). This program provides a one-stop shopping capability which allows the field offices to use the Center to coordinate for the actual purchasing of technical equipment for their office. ATEPP allows OSHA to standardize the equipment being purchased which provides for easier training and use of the equipment OSHA-wide as well as more efficient servicing of the equipment. ATEPP also allows the Center to work with the various manufacturers to obtain the best discounts due to the buying of the equipment in larger numbers for all the offices at once as well as save the field offices time in having to research the equipment and purchase information themselves.

The offices select what equipment they want from the annual ATEPP catalog. The catalog is provided by the Center each year after the CTC engineers have evaluated the equipment. This is the time when new equipment is being offered or obsolete equipment is being removed and the field offices are notified. The offices only need to notify the Center as to what new equipment items they wish the Center to purchase for them and CTC does all the rest. The Center takes care of coordinating the transfer of funds to pay for the purchases as well as making sure the equipment is entered into the property inventory database. The Center also checks the equipment for proper operation and calibrates it, if necessary, before sending the equipment to the appropriate field offices.

The DustTrak™ II Aerosol Monitor 8532 is a handheld battery-operated, data-logging, light-scattering laser photometer that gives you real-time aerosol mass readings. It uses a sheath air system that isolates the aerosol in the optics chamber to keep the optics clean for improved reliability and low maintenance.

It is suitable for clean office settings as well as harsh industrial workplaces, construction and environmental sites, and other outdoor applications. The DustTrak II Aerosol Monitor measures aerosol contaminants such as dust, smoke, fumes, and mists.

TSI's IAQ-Calc Indoor Air Quality Meter 7545 is an outstanding instrument for investigating and monitoring indoor air quality (IAQ). The 7545 model simultaneously measures and data logs multiple parameters. Measurements are CO, CO2, temperature, humidity; and calculations are dew point, wet bulb temperature, and % outside air. The proprietary TSI LogDat2™ Downloading Software permits easy transfer of data to a computer. Data can be reviewed on-screen, or downloaded to a computer for easy report generation. Statistics function displays average, maximum and minimum values, and the number of recorded samples.

The VelociCalc Air Velocity Meter 9515 is the economical choice for a digital air velocity meter, without compromising accuracy or precision. It is an ideal tool for face velocity measurements in fume hoods, spray booths, or for ventilation system checks. The Model 9515 features a 40-inch (101.6 cm) telescoping probe for difficult to reach measurements. It also measures temperature.

The PORTACOUNT PRO PLUS can quantitatively fit test all types of respirators, including N95. The unit has a color touch screen and measures fit factors greater than 10,000. The 8038 has a stand-alone operation if report or fit test card printing is not required and can switch between different respirator types in under a minute. FitPro software automates the fit testing process.

3.0 Requirements. The following items are to be purchased:

1. 30 each, 9515 – TSI, Air Velocity Meter, Model Velocicalc 9515

2. 4 each, 7545 – TSI, Indoor Air Quality Meter, Model 75445

3. 8 each 8532 – TSI Handheld Aerosol Monitor, Model DustTrak II 8532 (4 previous models will be turned in for discount towards purchase of these)

4. 2 each 8038 - TSI Portacount Pro+ Respirator Fit Tester, Model 8038 (2 previous models will be turned in for discount towards purchase of these)

3.1 The purchase will include training on the servicing of equipment as well as providing operational training to the OSHA field offices. The operational training of the equipment can be performed by a representative named by the vendor.

3.2 Once the equipment is received at CTC and verified, if a problem exists with the equipment the vendor will issue a return authorization and pay to have the equipment shipped back to the vendor. The equipment will be repaired or replaced (at the discretion of the vendor) free of charge under warranty.

4.0 Delivery. 30 Days after Award, but must provide an estimated time of delivery upon acceptance of contract. CTC will accept partial shipments. Payments will be made for all shipments including partials.

(a) Definitions. As used in this clause-

(1) Contract financing payment has the meaning given in FAR 32.001.

(2) Invoice payment has the meaning given in FAR 32.001.

(3) Payment request means any request for contract financing payment or invoice payment submitted by the contractor under this contract.

(b) Electronic Payment Requests. Except as provided in paragraph (e) of this clause, the contractor shall submit payment requests in electronic form. Purchases paid with a Government-wide commercial purchase card are considered to be an electronic transaction for purposes of this clause, and therefore no additional electronic invoice submission is required.

(c) Data Transmission. A contractor must ensure that the data transmission method and format comply with the following provisions:

An original invoice shall be prepared and submitted to the Department of Labor (DOL) by email to: DOL-CHICAGO@quickpay.dol.gov and lake.donna@dol.gov.

f. Before sending another e-mail with the same invoice attachment, confirm whether DOL has already responded and/or whether you have received a success or failure response to your submission.

(2) The contractor MUST NOT:

a. Submit an invoice that exceeds the size limit of 16 megabytes (approximately 400-500 pages). However, if the invoice exceed this limit, a summary invoice attachment of less than 16 megabytes should be e-mailed to the payment e-mail address above; while the detailed invoice, including any supplemental information, shall be sent to the COR or other representative at the address.

b. Submit an invoice that is heavy in shading or color.

1. An e-mailed PDF image cannot have any text that has a background with any color other than white. If the image has a shaded background, it will be converted to black, and the text will be illegible.

2. An emailed TIFF image must be black and white.

c. Submit more than one attachment, as subsequent attachments will not be recognized.

d. Submit more than one invoice in a single attachment.

e. Attempt to use the “Recall or Resend” email message feature.

(d) General Information. Payment due dates will be calculated only from the date that invoices are received in the electronic invoicing e-mail box and determined to be proper invoices.

Inquiries regarding invoices should be e-mailed to ChicagoInvoiceInquiry@dol.gov. The relevant invoice must be attached to the inquiry e-mail and the subject line of the e-mail must state “INQUIRY,” followed by the information described in paragraph (1) d. above.

(d) Comptroller General Examination of Record. The Contractor shall comply with the provisions of this paragraph (d) if this contract was awarded using other than sealed bid, is in excess of the simplified acquisition threshold, and does not contain the clause at 52.215-2, Audit and Records - Negotiation.

(1) The Comptroller General of the United States, or an authorized representative of the Comptroller General, shall have access to and right to examine any of the Contractor's directly pertinent records involving transactions related to this contract.

(2) The Contractor shall make available at its offices at all reasonable times the records, materials, and other evidence for examination, audit, or reproduction, until 3 years after final payment under this contract or for any shorter period specified in FAR Subpart 4.7, Contractor Records Retention, of the other clauses of this contract. If this contract is completely or partially terminated, the records relating to the work terminated shall be made available for 3 years after any resulting final termination settlement. Records relating to appeals under the disputes clause or to litigation or the settlement of claims arising under or relating to this contract shall be made available until such appeals, litigation, or claims are finally resolved.

(3) As used in this clause, records include books, documents, accounting procedures and practices, and other data, regardless of type and regardless of form. This does not require the Contractor to create or maintain any record that the Contractor does not maintain in the ordinary course of business or pursuant to a provision of law.

DOLAR 2952.201-70 CONTRACTING OFFICER'S REPRESENTATIVE (COR) CLAUSE

"(a) A Contracting Officer's Representative (COR) will be delegated upon award. A copy of the delegation memorandum will be provided to the COR and a delegation letter sent to the vendor.

(b) The COR is responsible, as applicable, for receiving all deliverables; inspecting and accepting the supplies or services provided hereunder in accordance with the terms and conditions of this contract;

providing direction to the contractor which clarifies the contract effort, fills in details or otherwise serves to accomplish the contractual scope of work; evaluating performance; and certifying all invoices/vouchers for acceptance of the supplies or services furnished for payment.

(c) The COR does not have the authority to alter the contractor's obligations under the contract, and/or modify any of the expressed terms, conditions, specifications, or cost of the agreement. If, as a result of technical discussions, it is desirable to alter/change contractual obligations or the scope of work, the contracting officer must issue such changes.

(a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers:

FACTOR I: Understanding the Requirement

The Government will evaluate the offeror’s understanding of the work to be performed in accordance with the SOW. The Government will evaluate information submitted.

FACTOR II: Price

The Government will evaluate offers for award purposes by adding the total of all CLIN prices. No adjectival ratings will be used to evaluate price.

(Contracting Officer shall insert the significant evaluation factors, such as (i) technical capability of the item offered to meet the Government requirement; (ii) price; (iii) past performance (see FAR 15.304); and include them in the relative order of importance of the evaluation factors, such as in descending order of importance.)

Technical and past performance, when combined, are more important (Contracting Officer state, in accordance with FAR 15.304, the relative importance of all other evaluation factors, when combined, when compared to price.)

(b) Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s).

(c) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.
