Justification for Other Than Full and Open Competition

Department of Labor

Bureau of Labor Statistics Shopping Cart#:

(1) Nature and/or description of the action being approved.

The Bureau of Labor Statistics, Division of Human Resources and Organizational Management (DHROM) has a requirement for Eleanor Smith, Woman Owned Small Business, to provide Human Resources (HR) services. .

(2) A description of the supplies or services required to meet the agency's needs (including the estimated value including all options).

a. Description – It is crucial that Ms. Eleanor Smith continues to provide support to the Human Resources Governing Board and the BLS University and assist the Office of Administration on strategic and metric development, customer service, program evaluation, and continuous improvement or reengineering of HR business processes.

b. Estimated Value – $88,000

(3) An identification of the statutory authority permitting other than full and open competition.

The Bureau of Labor Statistics intends to award a sole source contract to Eleanor Smith as a follow on in accordance with DOLAR 2903 602 (B). The Federal Acquisition authority for this action is FAR Part 13.106-1(b), Soliciting from a single source.

(4) A demonstration that the proposed contractor's unique qualifications or the nature of the acquisition requires use of the authority cited.

Ms. Eleanor Smith’s experience in the HR arena and as a former senior manager with longstanding management involvement is vital to the goals of the BLS HR program and initiatives. She is widely known and respected by Bureau senior management for her sound judgment, her discernment, and for her management advice on a wide range of HR issues. She has been and will continue to be an invaluable resource to the HRGB and senior Bureau management. No one else has the in-depth knowledge of the history of HR programs and initiatives in BLS to be able to appraise their status accurately within the very short timeframes required to meet agency HR goals, priorities, and commitments.

(5) A description of efforts made to ensure that offers are solicited from as many potential sources as is practicable, including whether a notice was or will be publicized as required by Subpart 5.2 and, if not, which exception under 5.202 applies.

Although presented as a sole source contract, this action will be synopsized in the government Federal Business Opportunities (FBO). If any offers are received this justification will be amended to address those responses.

(6) A determination by the contracting officer that the anticipated cost to the Government will be fair and reasonable.

The contracting officer will determine that this price is fair and reasonable prior to award.

(7) A description of the market research conducted (see FAR Part 10) and the results or a statement of the reason market research was not conducted.

Market research was not conducted due to Ms. Smith’s extensive knowledge of the Human Resources Governing Board and the BLS University. Also, she has much involvement in and comprehension of the BLS HR program and initiatives.

(8) Any other facts supporting the use of other than full and open competition, such as:

(9) A listing of the sources, if any, that expressed in writing, an interest in the acquisition.

(10) A statement of the actions, if any, the agency may take to remove or overcome any barriers to competition before any subsequent acquisition for the supplies or services required.

The pending contract will be synopsized in the government FBO.

Supporting data that is the responsibility of technical or requirements personnel (e.g., verifying the Government's minimum needs or schedule requirements or other rationale for other than full and open competition) and which form a basis for this justification is certified as complete and accurate by the technical or requirements personnel.
