STATEMENT OF WORK/ TECHNICAL SPECIFICATIONS
Aircraft Lease: Boeing 737 Classic Aircraft Justice Prisoner and Alien Transportation System (JPATS)
Oklahoma City, Oklahoma I.
GENERAL
The primary mission of U.S. Marshals Service, Justice Prisoner and Alien Transportation System (JPATS) is the safe, secure and efficient transportation of federal and non-federal prisoners and the provision of aircraft and flight crew for the support of other operational missions. Additional mission assignments include, but are not limited to, international flights in support of foreign extraditions, witness security and enforcement operations, strategic deployment of USMS and Special Operations Group personnel and equipment and other special operations assigned by the USMS or U.S. Attorney General.
JPATS has a requirement for an Aircraft Lease of one (1) Boeing 737-300 or 737-400 or 737-500 to be operated from the JPATS Oklahoma City operational site. The aircraft will be operated by JPATS as Public Use aircraft meeting the mandatory requirements of Title 14 CFR Part 91 for operations in National Airspace. The period of performance will be: November 1, 2014 – September 30, 2015 with four (4) Option Years.
II.
AIRCRAFT UTILIZATION
Based on current mission flying schedules, JPATS’ estimated utilization rate for the proposed aircraft will not exceed 1,290 flight hours or 900 takeoffs and landings (cycles) per year. “Flight Hours” by definition is “wheels off” during takeoff to “wheels on” during landing. The actual hours and cycles will vary due to scheduling demands.
III.
AIRCRAFT REQUIREMENTS / CONFIGURATION
A. Aircraft / General : The Contractor shall provide one (1) aircraft that, at time of delivery:
1. Is a Boeing 737-300 or 737-400 or 737-500 (Classic) jet aircraft with a United States of America registration (“N” number) as well as a current and valid FAA issued Standard Certificate of Airworthiness. (NOTE: Brand Name Requirement is based on pilot type certification).
2. Has the manufacturer’s Airplane Flight Manual (AFM) with Performance Specifications and Systems Description and Operation.
3. Has the manufacturer’s Aircraft Operating Manuals (AOM)
4. Has the manufacturer’s Quick Reference Handbook (QRH)
5. Has the manufacturer’s Weight and Balance Manual (if separate from the Airplane Flight Manual)
6. Is accompanied with the latest Weighing Data
7. Is accompanied with the aircraft Layout of Passenger Accommodations (LOPA)
8. Is accompanied with current aircraft Equipment List
9. Is accompanied with documentation and manuals for the operation of the aircraft flight systems (e.g. FMS, TCAS, etc.) Aircraft specific serial number and current FCOM Vol. 1 and Vol. 2 will suffice.
10. Meets all specifications of its original Type Certificate in accordance with Title 14 CFR Part 25.
11. Has not accumulated, and will not accumulate, more than 60,000 total cycles since new (TCSN) during the contract period of performance (base year and option years).
12. Is certified for day, night, Visual Flight Rules (VFR), Instrument Flight Rules (IFR) operations and flight into known icing conditions.
13. Is accompanied with appropriate documentation testifying that the aircraft has not sustained any substantial damage as defined by National Transportation Safety Board 49 CFR Subpart A,General 830.2.
14. Has all cockpit and cabin instrumentation, avionics, placards, gauges readable in the English language and in the United States measuring system.
15. Is “Stage 3” noise level compliant with maximum takeoff noise levels not exceeding those levels as prescribed in Title 14 CFR Part 36, Section B36.5 (d) of appendix B and International Civil Aviation Organization (ICAO) Annex 16, Environmental Protection, Volume 1, Aircraft Noise, Third Edition, July 1993, Amendment 7, effective March 21, 2002, or later edition
16. Is equipped with an APU suitable for providing ground electrical power and self-contained engine starts. The APU must be capable of running two environmental systems, simultaneously, for ground heating or cooling the aircraft while maintaining 20 to 25 PSI duct pressure. The unit must be capable of supplying electrical power to the aircraft’s electrical system while airborne.
17. Has a minimum of 147 passenger seats installed with a minimum pitch, between any two rows of seats, of 31 inches. Seats shall be “Tourist Class” configuration and meet Title 14 CFR Part 121 standards for the carriage of passengers. Seat cushions, seat covers and seat backs will conform to Title 14 CFR Part 121 burn criteria.
18. Is equipped with a preferred number of three (3) flushable lavatories, one located in the forward cabin and two located in the aft cabin, configured for external servicing.
19. Preferably equipped with self-contained, powered, forward air stairs at the L-1 door.
20. Has no life limited parts (LLP) requiring replacement in the base year of the contract. LLPs that are associated with the installed engines, APU and nose and main landing gear must not come due in the base year or option years of the contract based on the projected aircraft utilization identified in paragraph II. LLP replacement thresholds will be determined by the original equipment manufacturers (OEM) recommended overhaul interval.
21. Is in compliance with all applicable published FAA Airworthiness Directives and manufacturer Mandatory Service Bulletins.
22. Is in compliance with all calendar, flight hour, flight cycle maintenance inspections and events from either a manufacturer or FAA approved maintenance program.
23. Has no “Scheduled” Heavy Maintenance or Major Inspection (C Check or higher) due in the base year of the contract.
24. Is equipped with emergency equipment and over water passenger operations equipment in accordance with Title 14 CFR Parts: 121.309, 121.310, 121.337, and 121.339.
25. Is powered by the highest available thrust rating engine delivered by the Original Equipment Manufacturer on the type and model offered.
26. Shall have the highest Original Equipment Manufacturer Gross Take Off weight, highest Gross Landing Weight, and highest Max Zero Fuel Weight available for the type of model being presented.
27. Is accompanied by an on-wing Max Power Assurance Run sheet showing clear documentation of 3B2 (22,000 LBS of thrust) and 3C1 (23,500 LBS of thrust) EGT Margins for each installed engine.
28. Is accompanied by a video boroscope record of each installed engine with a written boroscope report detailing the internal health of the engines to include the fan, compressor, combustion and turbine sections of the engine. This requirement must be current and valid and have been performed after the last flight of the previous operator and prior to the first flight by JPATS.
29. Has an operational Class C fire detection and suppression system conforming to Title 14 CFR Parts 25 and 121.
30. Has the minimum number of flight attendant seats required by Title 14 CFR Part 121.
31. Has standard “airline” type and style galleys with service carts, coffee makers, and ovens installed.
32. Has a reinforced Flight Deck Door meeting the standards for a Title 14 CFR Part 121.313 commercial air carrier.
33. Has non-descript paint scheme with no logos from any previous operator visible.
34. Has it’s appropriately assigned U.S. registration (“N”) number applied to the aircraft in accordance with Title 14 CFR Part 45.25 requirements.
B. Avionic/Navigation/Auto Flight System: In addition to the requirements of Paragraph A the aircraft shall have, as a minimum, the following at the time of delivery to JPATS:
1. Flight Management Systems (FMS) with software version U10.8a and navigation database subscription for the duration of the lease from the date of delivery for worldwide database navigation data conforming to WGS-84 coordinate system or equal. Additionally, the airport database will incorporate all airports with an instrument approach procedure (IAP) and a runway greater than 5,000 feet in length within the geographical area as defined by the Continental United States (CONUS), Alaska, Hawaii, Canada, Caribbean, Latin America and South America regions.
2. Global Navigation Satellite System (GNSS) capable of gaining operational approval to conduct Title 14 CFR part 97 instrument procedures within the U.S. National Airspace System (NAS) where domestic air traffic control (ATC) procedures are applied and Enroute Remote/Oceanic certification specifications listed below:
3. RNAV 1 & 2 Airway Routes, Standard Instrument Departure (SID), and Standard Terminal Arrival Routes (STAR).
4. RNAV 1 & 2 Airway Routes, Standard Instrument Departure (SID), and Standard Terminal Arrival Routes (STAR).
5. At a minimum be certified to execute RNAV/GPS IAPs to LNAV minimums.
6. The FMS must be fully interfaced with and receive navigational data/inputs from a minimum of two Inertial Reference Systems (IRS), or a minimum of two Global Navigation Satellite Systems (GNSS), and or a minimum of two radio navigation systems.
7. A Flight Guidance/Autopilot System capable of meeting the required RNAV capabilities while coupled to the LNAV system.
8. An Electronic Flight Instrument System (EFIS) consisting of both pilot and copilot:
(a) Electronic Attitude Director Indicator (EADI) with integrated airspeed format display with single and or dual cue capability flight directors.
(b) Electronic Horizontal Situation Indicator (EHSI) utilizing a heading up and not track up display format.
NOTE: Engine instrument/hydraulic displays may be either EFIS or analog displays.
9. Two (2) digital VHF transceivers communication systems with a minimum of 760 channels with 8.33 KHZ spacing are required, but three (3) would be desired.
10. One (1) HF transceiver communication system with SELCAL.
11. One (1) UHF transceiver radio system is desired, but not required.
12. One (1) Radar system meeting the requirement of Title 14 CFR Part 121.357
13. One (1) Enhanced Ground Proximity Warning System (EGPWS) with low level wind shear detection meeting the requirement of Title 14 CFR Part 121.358.
14. All aircraft equipment and components necessary for certification for flight operations in RVSM airspace.
15. Two (2) Air Data Computers.
16. Class A TAWS conforming to TSO-C151b dated Dec. 17, 2002.
17. Two (2) digital VHF, VOR/LOC navigation receivers.
18. Two (2) glide slope receivers with a minimum of 40 receive channels.
19. One (1) marker beacon receiver systems.
20. Two (2) digital ADF navigation systems.
21. Two (2) Mode S Transponder systems.
22. Traffic Collision Avoidance System (TCAS) II system that meets TSO C–119b (version 7.0), or a later version.
23. Two (2) Radio Altimeter systems.
24. One (1) Digital Flight Data Recorder which complies with Title 14 CFR Part121.343 and 121.344 including Part 121 Appendix B and M as applicable.
25. Quick-Access Recorder (QAR) conforming to the USMS Flight operations Quality Assurance (FOQA) program.
26. One (1) Digital Cockpit Voice Recorder.
27. Two (2) Distance Measuring Equipment (DME) Systems, with Nav-1 and Nav-2 channeling.
28. One (1) Altitude Pre-select/Alerter system.
29. Wiring for one (1) Air Cell ST 3100 Iridium Telecommunication Systems (satellite communication system). Supplied system to include coax and antenna capable of supporting a cockpit mounted handset and a cabin mounted handset provided by the U.S. Marshals Service.
30. Digital auto throttle system.
IV
Maintenance / Logistics Support JPATS Responsibilities:
1. JPATS will be responsible to perform all Line Maintenance and Line Servicing maintenance inspection and repairs to include the associated logistics requirements. This will be performed by a Title 14 CFR Part 145 Certificated Repair Station (CRS) under a separate contract. All maintenance will be performed on this lease aircraft without discrimination when compared to the 737-400 aircraft owned and operated by JPATS. Maintenance, inspection and repairs will be to a Title 14 CFR Part 91 standard.
2. JPATS will be responsible to utilize the JPATS Daily Flight Log Books, FAA Form 337, and United States Marshal Service (USMS) Routine and Non-Routine Work Order Forms for documenting maintenance, inspections and repairs of this aircraft made during the period of this lease.
3. JPATS will be responsible to make all appropriate entries into the Aircraft, Engine, and APU Historical Log Books for all applicable maintenance, inspections and repairs of this aircraft made during the period of this lease.
4. JPATS will be responsible to develop and utilize an automated maintenance tracking program for this aircraft in accordance with the manufacturer’s Maintenance Planning Document (MPD) and will be used to identify, track and document all maintenance events performed or coming due during the duration of this lease. This program will be a program common to the aviation industry and will meet a Title 14 CFR Part 91 standard such as CAMPS / Daniels.
5. JPATS will be responsible for attaining, maintaining and utilizing “approved data” to include all required Aircraft Maintenance Manuals (AMM), Illustrated Parts Catalogs (IPC), Structural Repair Manual (SRM) and Wiring Diagram Manual (WDM).
6. JPATS will be responsible for the acquisition of all parts, materials, consumables, free stock, and lubricants required to maintain the aircraft in a safe airworthy condition as detailed in the maintenance and inspection program as well as to correct pilot reported discrepancies (PIREPS). All parts purchased will be done so utilizing acquisition policies and procedures of the aforementioned Title 14 CFR Part 145 CRS using their Approved Vendor List of certified FAA vendors. All parts installed will have FAA Forms 8130-3 attached and will have a since “birth” traceability.
7. JPATS will be responsible for the accomplishment of FAA issued Airworthiness Directives (AD) with a compliance date falling within the period of this lease, base year and option years, that can be performed at a Line Maintenance level and does not exceed $25,000 in total cost.
8. JPATS will be responsible for the accomplishment of manufacturer issued Mandatory Service Bulletins (SB) with a compliance date falling within the period of this lease, base year and option years, that can be performed at a Line Maintenance level and does not exceed $25,000 in total cost.
Contractor Responsibilities:
1. The Contractor will be responsible to perform all “Scheduled” Heavy Maintenance to include scheduled Major Inspections; C Checks or higher, to include “Non-Routine” Discrepancies identified during the heavy maintenance or major inspections. These Heavy Maintenance events and Major Inspections will be performed by a Title 14 CFR Part 145 Certificated Repair Station (CRS) to a Title 14 CFR Part 91 standard, as a minimum.
2. The Contractor will be responsible for the accomplishment of “Unscheduled” Heavy Maintenance on the aircraft or engines. When such heavy maintenance was a direct result of the actions, or inactions, on the part of JPATS employees, or the employees of JPATS Line Maintenance contractor. Reimbursement for this maintenance will be made to the Contractor as an Over and Above effort under a separate Contract Line Item Number (CLIN).
3. The Contractor will be responsible for “off-wing” engine maintenance such as an engine shop visit. When the “off-wing” maintenance or engine shop visit was the direct result of actions, or inactions, on the part of JPATS employees, or the employees of JPATS Line Maintenance contractor, reimbursement will be made to the Contractor as an Over and Above effort under a separate Contract Line Item Number (CLIN).
4. The Contractor will be responsible to have exclusive control of a “spare” CFM56-3B2 or CFM56-3C1 engine, as applicable, to be utilized by JPATS in keeping the aircraft in revenue service in the event an installed engine must be removed for performance deterioration restoration or an unscheduled failure such as FOD damage.

VI.
DELIVERY, INSPECTION AND ACCEPTANCE OF THE AIRCRAFT
A. Aircraft -- The Government will inspect the Contractor’s proposed aircraft utilizing a Delivery Inspection Checklist to verify that the aircraft complies with all of the requirements of the Contract.
B. Deliverables --In addition to the aircraft, during the final delivery, inspection, and acceptance process, the Contractor must provide all contract deliverables as identified in this Statement of Work, Table 1, Deliverables (Items 2-9). All documentation, manuals, placards, etc., must be readable in the English language and in the U.S. standard measurement system.
C. Configuration Schedule -- The Contractor shall configure the aircraft for final delivery, inspection and acceptance to Oklahoma City, Oklahoma, not later than six (6) weeks from Date of Award.
D. Final Delivery/Inspection and Acceptance Flight -- The Government will inspect the delivered aircraft to verify that it complies with the contract's requirements. The Government will have three (3) calendar days to conduct its inspection of the configured aircraft and associated deliverables. During the inspection, the Government will document any findings where the aircraft /deliverables do not meet the contract's requirements. The final delivery and inspection process will also include an Acceptance Flight that is to be provided by the Contractor. This acceptance flight is meant to demonstrate the takeoff and landing capabilities and the en route characteristics of the proposed aircraft. It shall be performed by pilots provided by the Contractor; however, a JPATS pilot shall sit in the center cockpit "jump" seat on the flight deck during this acceptance flight as the official Government observer. An acceptance flight will be deemed successful if all aircraft systems are fully operational and function properly during the reposition flight, and the aircraft exhibits an acceptable level of trim, stability, manoeuvrability, and controllability as determined by the JPATS pilot. A JPATS Flight Acceptance Profile will be provided prior to flight. Any inoperative or improperly functioning component or system discovered during the acceptance flight shall be documented by the JPATS pilot in the applicable flight log book. After the Final Delivery/Inspection and the Acceptance Flight, the Contractor shall correct all deficiencies within five (5) calendar days from the date it receives the Government's notice to correct deficiencies, or in a time frame agreed to by the Contracting Officer, prior to a final determination of acceptance by the Government. JPATS reserves the right to hire an outside expert/consultant to assist with the pre-award and final delivery inspection and acceptance flight process.
E. Termination for Cause -- If, after this inspection process, it is determined by the Government that any proposed aircraft is not acceptable or is unavailable for delivery on the required delivery date, the Government may terminate for cause this contract in whole or in part at no cost to the Government.
